Got interview date for k3 April 22 but nothing on I-130 yet...

Do you all know if the interview is scheduled first and then the package is sent to the Embassy? or is it Vice Versa? Just trying to figure out if I can make the deadline for March interview.

QUOTE
In other words, can we get the whole AOS package (and the IV package too) ready to go, and just wait for the IIN, pay them both and then send them as soon as status says PAID for each one?

Yep that is correct. When i received my IIN I paid both bills and then sent both packages in. Later I received the AOS package information and it was just a bill if you wanted to mail in your payment and some instructions.

QUOTE
We'll send them separately of course. BTW, is it okay to send DS-230 from petitioner's address instead of beneficiary's? Just wondering.

I am the US Citizen and sent both packages from my address in the USA. Had no problems.

Friends,

I called NVC 02/09/09 to question my wife's case...It has been COMPLETED at NVC and is pending for Interview to be scheduled at Ciudad Juarez...they have given me hopes that POSSIBLY in March...they cant say YES or NO for scheduling, we must wait and pend unitl about Feb 20th to find out if scheduled or not...has anyone that sent I130's in August has been scheduled? anyone processing through Ciudad Juarez in Mexico? Any Ideas will be greatly appreciated...Thanks! and wish me luck!

From my understanding the NVC only schedules interviews the second week of the month. That means you will be given an interview date the week of March 9-13. Usually, they interview is granted for the next month. So you will most like get scheduled in March but have an April interview.

QUOTE (ahadhayat @ Feb 17 2009, 12:06 AM) <{POST_SNAPBACK}>
Hello,

I am sorry if i am asking a question that has been asked again but i am kind of confused. I applied recently for the CR I and am looking for everything to speed up the NVC process. Can some one please answer the following:

My wife is a UK passport holder. She has never lived in the UK. She has lived in the following countries, Bahrain, UAE and Pakistan. Now the question is:
Does she need a police report for all three countries and from England?
What does she ask for? Is there a form that we should give the police that they should fill out?
How long will this report last for?
How does some one usually get these reports if they are for eg living in UAE? Do you have to go to each country, apply there and wait for them to give it?

Thank you for all the help

I believe you need a police report from anywhere you have lived over the age of 16 for more than 6 months. Check this website: http://travel.state....ocity_3272.html

You can find information on the police, prison, and military records you need. Be careful because many times these items are only good for a certain amount of time. I don't know how or where to get the documents but that website will tell you all that information even has phone numbers in the UAE for you to call and ask your questions.

Good luck good.gif

QUOTE (ao_cons @ Feb 24 2009, 08:04 AM) <{POST_SNAPBACK}>
Has anyone noticed the differences in the NVC's ending postal code / PO box code? It's 03801-2909 in the NVC shortcut guide, but if you look at the AOS fee bill and DS-3032 mail packets they send, sometimes it's 2901 or just 03801.

Can someone please tell me where exactly to mail the AOS packet and IV packet respectively??? What did you use and did it come through?

I have seen some post also stating that the zip is different. I used the address on the cover sheets that you print out after paying the AOS and IV packet. Had no problems. My packets were entered into the system the day after they were received.

QUOTE (VivianNYC @ Feb 24 2009, 06:47 PM) <{POST_SNAPBACK}>
Hello all,

I'm jumping the gun a bit here, but now that I'm seeing some fast approvals coming out of Vermont, I'm thinking our I-130 MIGHT get approved sometime in March. I'm going to be outside the US from next week for 3 weeks. Of course I'll be anxiously checking the USCIS site every day to see if we're approved. (Do they always email you as well if you've set up an account?) If we do get approved while I'm away, obviously I don't want to delay things until I return. My understanding from reading the Shortcuts is that once approved I can call the NVC a few days later to see if our case number has been assigned. And once I have that, I can tell my husband to email the 3032 Choice of Agent to the NVC. I also have his signed form so would do the barcode thing and international FedEx it as a back-up. How do you know when the bills are generated so you can pay them - does it say so on the AVR, or do you have to wait for something in the snail mail?

I basically just want to know if I can keep things moving along long-distance. I have or will have by end March all the papers we need to send.

I-130 sent to VSC 1/17/2009
I-130 received 1/25/2009
Check cashed 1/30/2009
NOA1 Receipt date 1/30/2009
NOA1 hard copy received 2/7/2009
NOA1 approved ??

The AVR system will say "...NVC will mail...the beneficiary..." OR "DS3032 and AOS Fee Bill has been generated on________" when your bill is generated. The only problem you will have IF you get an approval is getting your IIN number (invoice number) to pay the fees. You can't get that number by phone they will mail the letter with the IIN number to the address you select on the DS-3032. To solve this you can have someone check your mail or have your wife's address for DS-3032. The rest of the forms I think you can handle from abroad as long as you have everything prepared ahead of time.

Also, a note about the USCIS. I did receive an email and letter when I got the NOA2, however, some people report not receiving these items. So if I were you I would call them periodically just to make sure. Good luck! good.gif

guys!

I am filling out I-864 and i have a problem!

Part 5, Q: 21

If I am the one from line 10, and then my husband is married to me- he has to put 1 in c). I know it says do not count anyone twice but it's just ridiculous ! shall we skip c) and leave it blank? so it will come up to 2 ppl total?

Part 6, Q: 23

My husband is unemployed since May 2008 - he gets unemployment. So i dont think that we can count it as an income right? That money is not based on his work! so I am assuming that this is not an income!
So what should I put in this part? Zero? We have joint sponsor that makes enough money to sponsor both of us smile.gif haha joke smile.gif

If this question is already somewhere on VJ please forgive me if I repeated it - I couldn't find it

thank you for all your help

patita

For part 5 you put 1 in 21a. This is for your husband and 1 for 21 b. That equals 2. Putting 1 in C means there is a third person that is not on this petition that you have sponsored in the past. I got an RFE for this question so I know for certain that you only put 1 in 21a and 21b. (this is assuming you are not bringing children).

For part 6 I only put my income because I did not count my husband's money or income toward the poverty line. Hope that helps. good.gif

New member here -

We married in NYC on Dec 4 2008
She returned to Brazil on Dec 22 2008
I filed I130 on Jan 22 2009
I recieved Notice of Action 1 on Feb 10 2009

questions

1. Does anyone happen to know if it is advisable/possible for my spouse to visit me on her tourist visa while our I130 is in process? Ive heard conflicting opinions about this and I am feeling rather confused.

2. Does anyone have experience with filing I130s from NYC with the spouse in Brazil? If so, how long should we expect this to take?

3. Once her interview is scheduled and visa is approved, will she be able to work upon arrival in the US or do we have to consequently file a work permission?

Any help would be hugely appreciated.

Jake

I don't know if it is advisable but I was told by a lady at USCIS that it was ok and I have gone 3 times to visit my hubby since we put in the application and I got my NOA2 YESTERDA.

I would also like to know the answer to your question 3.

Good luck with it all. kicking.gif

From my understanding it is very difficult for someone to get a tourist visa when filing four an immigrant visa. They think you will not go back to your country and continue with the legal immigration. British Citizens do not need visas to visit the USA but I think people from Brazil do. As for question three, you will get your SSN number roughly one month after arriving in USA and can work.

Yes, it depends on your consulate. Some consulates like the one in Manila have a longer waiting time for visa interviews. Best bet is to ask someone from Canada to get a realistic time frame.

You do not need to wait for the one they send you. You can download the form from the Department of State website and fill it out now. I did not receive the hard copy until after our case was completed at NVC. Good luck.

OBX is right fill it out. Attach all the documents that you need (police reports etc) and print out the cover sheet from where you paid the iv bill. Send it all in.

Marry in the USA and just renew your vows in a ceremony in Peru. Or vice versa. Personally I wouldn't want to chance having problems in the immigration process we all know its long enough already. I was legally married in Peru and we had a great ceremony with his family. We plan on renewing our vows in the USA once my husband gets here for my family.

Don't waste your time calling. They will not give it out and I have not heard of anyone recently getting it over the phone. Instead make sure both of your packets are ready to be mailed. Check everything 4 times!!

IR-1 / CR-1 Spouse Visa Process & ProceduresAfter getting married in foreign country...
QUOTE (yuenashleysl @ Mar 5 2009, 05:26 AM) <{POST_SNAPBACK}>
Sorry if I'm posting it on the wrong forum. I'm not sure where to get some advice on this:

Me and my fiance are getting marry in May in Hong Kong. We are finally decided on CR1 Visa (because it is cheaper in the long term) but may want to wait a little to apply so that by the time he gets his green card, we will be married for 2 years, thus to avoid the cost (paperwork, filing fee, interview time, etc) to remove condition.

Just a few questions though:
1) After getting married, what can I do here in the USA to establish prove of our bonifide marriage? I've checked online and it seems like I can't add him to my credit card or bank account or even company insurance policy without SSN. What do you guys usually do? It's almost impossible for him to get a tourist visa to visit USA, and since I'm also a permanent resident of Hong Kong as well as a naturalized USA citizen, I am the one making all the visits. Is there anything we can do to help "showing co-mingling of financial resources"?

2) I am considering changing my last name in the USA using his last name after the marriage. Will this help in establishing that we are sincere about our marriage and as a secondary prove that this is a bonifide marriage?

3) I've read some posts here saying that you cannont file single in your tax return after the foreign marriage and have to get a TIN to file tax as married. Is this a must and an absolute requirement?

4) Since we are planning to file later on closer to our 2 years anniversary, will this be a red flag to our application?

5) I'm just very excited of getting marry. It'll be small and just in the court house with a couple of our friends. I won't even have time to get a wedding gown or reception...is this going to look bad on our application?

Thanks so much. Sorry for the long post. Any advice is appreciated.

Lot of questions there but hope this helps:

1. You can open a bank account with your spouse, but it is more difficult. Ask your bank about putting a non resident alien on your bank account. If they don't do then talk to other banks. In my case, I had to present a notarized copy of his passport, a translated phone bill, and some forms. If you have any property you can add his name to it. Make sure when you are talking to banks, insurance companies or whoever that you explain that your husband is a non resident alien who has never been to the country and is not coming to the country. When most people hear that they tend to understand the situation better and give better answers. Also, if you send money to your spouse that shows co-mingling of finances.

2. I don't think it matters if you change your name. I do not have my husband's last name and many VJers don't or do not change untill the foreign spouse is in the states.

3. Filling married/jointly is an option and is another proof. But I will let others who are more informed explain this process or just read one of the many threads that are about this topic.

4. Not at all plenty of people do the same.

Good luck!! good.gif

5. I don't think they care how much money you spend on your wedding. I think what is important to them is that your marriage is legal.

Good luck!! good.gif

You guys will never believe this....we over nighted our RFE I-864 package to NVC and they just received it. Then I go and check the AVR and it says that they're requesting MORE information!!!!!!!!!!!!!

I had a total meltdown........so much for an April interview at this rate.......

Seriously my husband and my father-in-law have the same names, except different middle names. I really feel like they're screwing up with both of their information. My husband didn't have to file for taxes b/c he was in school, so we proved why, proved he was in school, and proved his dad claimed him for all 3 years. Anyways, my father in law makes way over the poverty line so we're good to go financially with him as our 'support'.

I sent in SO much information. Another RFE? I'm like a case out of history, this never happens with NVC sad.gif

Any light to shine on this guys?!??! ClockWatch2.gif

....by the way, do you think speaking with an operator or a supervisor will help? I have a strong feeling they've mixed up hubby & father in law's info....

Moosker try to breathe it might be nothing. I got an RFE and called NVC found out what was wrong, corrected it and the NVC had the corrected documents in hand the next day by noon. However when I called the next day, the system said I had another RFE for that day. So it sounded like I had 2 RFEs in 2 days! I called NVC and it turned out to be one. I am not sure why the system did that the only thing I can think of is they put in the system that there was an RFE and then mailed it out the next day and made it look like an RFE.

I have another question because I don't want to make a mistake. All the financial paper work such as tax transcripts I-864, letters of employment etc. go in one packet. The DS-230 and criminal records, passport page, police records, marriage certificates all go in a second packet that you send out when you pay the IV bill? Is that correct? Someone mentioned in Cr-1 form that they sent the passport page with the I-864 and I thought it should go with the DS-230.

Also when you guys sent in pay stubs did you send originals or copies? How many did you send?

I called in today to see what step NVC is on in my case. the operator told me that they're preparing things to set up the interview abroad so hopefully that's soooonnnn! (:

i emailed the ds-3032 last night but no automated response. so i'll be mailing out the hard copy tomorrow.

i hope everyone else's ride is going smooth with NVC! (:

I emailed my Ds-3032 on the day I got my case number. It took about 8 days for them to respond via email. When I called they said that form has not yet been processed. Yet the AOS bill was sent. Are they sending the AOS bill to me or my spouse in Peru?

I was calling the nvc all day yesterday but all i got was this number is busy all day. I tred again this morning and got the same thing. I don't know what im doing wrong can someone help??

Are you calling 603-334-0700? If so, then keep on trying.

Yeah i have been trying that and it keeps saying number not in use

I get the same thing during the day from about 10-5 ish. There lines are very very busy. I only call between 730-830 and around 10pm. I keep a list of all the names of people I have spoken to try to get the IIN number. So far no luck, as they say they can't give it out. James short cuts says it is very hard to get the IIN number and said some people had to call 30 times before getting it. Anyone know how long it will take to get the letter in the mail in case we are unable to get it through the phone?

I think NVC operators have been told not to give the IIN....You will get the AOS Bill in 4-5 days......Till then your DS3032 would be accepted ( hopefully:) ) and then you can pay both fees together and send the packages together too....

HTH

yeah they said they're not allowed to give it out.

well that sucks ): how did everyone else get theirs? i'm guessing they got the nice operators. lol

Keep calling until you get an operator that will give it to you tongue.gif

Also just to let you guys know I just got my DS-3032 generated. I had emailed my DS-3032 when they gave me my NVC number and so I also got an email response from NVC to my emailed DS-3032. So I thought I would share that with you all. I will call in an hour or so to see if it has in fact been accepted and to get my IIN.
