CanadaQuestion about the future...
QUOTE (IR5FORMUMSIE @ Apr 25 2008, 05:56 PM) <{POST_SNAPBACK}>
Just to add, once you are a permanent resident then the citizenship approval is almost a foregone conclusion. Unless SHH lied on his original application (a crime of omission or one of commission) for permanent residence and/or has violated the laws of the United States (state and/or federal) including misdemeanors that are crimes of moral turpitude within, I believe, 5 years of the issuance of the green card. Green card holders who commit acts of moral turpitude (felonies or misdemeanors) are subject to removal from the United States. Some people think becoming a naturalized citizen is tougher while other disagree but if you don't do anything, they can't touch you. good.gif

add that to list of questions asked weekly, lol just kidding!! But I did state the time frame in my first posting about usa citizenship. No he wont loose his Cdn citizenship, he will have dual! But in the eyes of the USA government, he would be a USA citizen. 90 days prior to the 3 yr mark of the date u activated ur cr-1 visa is when u can apply.

CanadaQuestion about the future...
Only time your Wedding anniversary means anything is when it comes to issuing the cr-1--less than 2 yrs of marriage, of the IR-1, 2 yrs or more!!

After that its based on when you activated the visa, which is the date you crossed over at the POE and handed them your paperwork, and you will see the expiry date on the greencard.

And I believe if you spend to much time out of the USA, you would loose ur USA residency, or to do so, one has to fill lout more paperwork. And of course if ur spouse is a USA military member ur not going to loose ur residency because he gets posted out of country!!

Your husband should wait until he has his permanent resident card, which he will apply for two years after he receives his temporary resident card. Then he will be able to come and go without a problem. Any sooner than that and he will abandon his residency.

No, you cannot get your residency in Canada unless you take up residence there.

Is it 2 years after he receives his temporary card, or after we have been married 2 years? The guy told us we will have to file something on our 2 year anniversary (which is this summer). Is that what you are talking about, or am I confused? smile.gif

Ur cr-1 is good for 2 yrs ONCE it is activated (when u cross over at the POE) The expiry date will be on the greencard itself. 90 days before the expiry date ur eligible to apply for your permanent residence card which is good for 10 years. That is the I-751!! Dont send it in 91 days before and dont send it after the greencard has expired! its a VERY easy form to fill out, takes all of 10 minutes!! From the day I sent in my I-751 til I received the 10 yr greencard was approx 6 months!!

NOW for USA citizenship, one can apply 90 days before your 3 yr anniversary of the date u activated ur original cr-1 visa

ie

Cross into the USA to activate CR-1 July 1 2008 (expires July 1 2010)

90 days before July 1 2010 one can mail in I-751 paperwork (shortly after that they will mail you a letter stating you have been granted a year extension, keep that paper!!)

90 days before July 1 2011 you are eligible to start the USA citizenship paperwork if you want to become a USA citizen. of course you dont have to do it within that 90 days, just cant do it earlier than 90, and one has no time limit to apply. i still haven't,lol, but I have filled out most of the form.

EDITING:

As well im assuming ur married for less than 2 years!! if you entering the USA and have been married for 2 yrs or more, you should get the IR-1, which is good for 10 years!!

Thats why some people who have been married for less than 2 years, but are close to their 2 yr wedding anniversary wait and activate thier visa, until they have reached their 2 yr wedding anniversary.

Yes my job did suck!! LOL I worked at a call center and I got fired for hanging up on all the azzholes. . . joke's on them . . . .I made almost $1500 in the few weeks I worked there and barely did any work.
(I'm usually a good worker, but these people treat their employees like #######, I feel bad for all the people stuck working there for years because they have no education and no where else to go. It's very sad. . . worse than McDonalds)

Anyways, I'm sure I'll be fine at the border, I've made it through lots of times before. My only worry is that if they do refuse me, I'll already be in Florida, and that's a heck of a heartbreaker, to be that close and then have to pay for a flight right back. sad.gif

10 more sleeps!!!! smile.gif smile.gif smile.gif

Why would u already be in Florida? Your POE will be in Montreal. if u get refused, it will be in Mtl

1) Always tell the TRUTH. never lie to the POE officer
2) Be confident in ur replies
3)keep ur response short and to the point, dont tell ur life story!!
4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!
5)pack light! No job resumes with you
6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)
7) Always be polite, being rude isnt going to get ya anywhere, and could make things worse!!
8) have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didnt lie! Refer to #1

Best of luck

CanadaUpdate about my license exam
Sorry to hear that. I have no clue how the animal world works, but could a vet still not hire you? i suppose they would just pay you less.

Maybe give Nursing a try!! An Associates degree RN program is 2 yrs ( plus the time it takes to get the prerequisites completed, could be closer to 3yrs!!) and not super expensive if you take it at a college. I pay around $80 a credit and One requires 69 credits for the degree (plus the prerequisites)

Hope it all works out

Canadaengaged to a canadian!!!!
I think most new VJ members do ask, as well they ask:

What type of police record I require, how much, do i need one for each Cdn city I have resided

Where can i get my medical completed

What vaccinations do i require

What can I take to the interview

lol

CanadaIncome taxes
Im no tax expert!!

So ur USA spouse has resided in the USA (never in Canada) right?

If thats the case, filing ur Canadian taxes is just like your SINGLE!! U get no deductions or credits for ur American spouse!!

BUT if ur using tax software, one has to "fool" the program (at least I had to, maybe not in the new programs!) So for his SIN, since he doesnt have one, i just put in all ZEROS, and for his income, I just converted my wifes into Cdn $$, I just did that to fool the program to ensure I didn't get any deductions or credits. If your doing it by hand, leave it blank. As wel ensure you put in the date you ceased to be a Cdn resident as their are some calculations the software makes that are prorated.

Its pretty straight forward, even though ur married, ur in a way filing as ur single!! I included a cover letter stating my USA spouse never resided, nor worked in Canada.

If you have RRSP's,when it comes time to file for the IRS, one has to fill out form 8891. This just notifies the IRS that you have them, and they wont tax you on them now. BUT your State may stil tax you on them, each State has different rules!! As well you have to inform ur Cdn financial institution that holds the RRSPs that ur now a non resident of Canada, and they wil mail u some forms to sign!! blah blah blah!!

Hope that makes sense, My brain is packed with Nursing #######!! Ask me something on osteoarthritis, lol

True, but you've gone on to a very noble career in a field that was unlike the one you had in Canada. I imagine that there might be more than a few folks here who have changed careers once they get below the 49th parallel.

I would take my job back in the Air force in an instant!! Loved it!! Was probably the best job I will ever have! Oh well

Two Words------ TIM HORTONS!! lol Of course ur in Ontario, and that means one has to cheer for the Leafs. In the New jersey Area, one actually has a lot of teams one can root for!!

Seriously, its a hard decision, and one just has to sit down and write out the plus's and negatives for each scenario!
