EI sent me a package here in the US that I had to fill out which asked for a copy of my passport and my visa page or my green card.  I copied and sent in the first 2 as I am awaiting my green card still...   I called ELIS/USCIS regarding this at the 60 day post POE mark as recommended on the paperwork I received at the interview, and was told 'things were back-logged'.  

They suggested I give it another month before calling about it again.  I'm approaching that date in a week, so once I have the green card, EI wants me to fax them a copy, otherwise my EI benefits expire Dec 11th (the visa expiration date).

 

you have ur greencard---the stamp..I551 acts as ur greencard...and should have copied it and fexed/emailed it in...... and you should have been collecting EI by now if u entered the USA on July 23....there is a 2 week period where 1 does not get benefits--that's like ur deductible

They didnt write anything on my ROE as I recall-----I just included a short note I was moving to reside with spouse in the USA..and yes as part of the process I recall sending in a scanned picture of the I-551 (the visa in ur cdn pasport) As well included a short note stating that Cr-1 (IR-1) are eligible to work in the USA right away

before you get EI? No.  But after you move you have to report how many hours and how much money you are making so it's possible that you end up working too much to get EI. 

 

Looking at their timeline....I think they are still in Canada....

Funny... I literally posted this and a few minutes later I got a call. But not from the interstate number. They called to tell me my ex-employer hasn't sent in the ROE to them yet. I ended up speaking with HR and she confirmed sending it. A few hours later, I get notice my EAD is approved and in production. I have an accepted job offer with a moving start-date. So I'm thinking there's no point in filing anymore since I can't get any funds for the last few months and when EAD is in my hands, I will begin working. 

 

Depends on how much ur new job makes......the more one makes, the less EI one gets....so may or may not be worth it.......

I haven't had any difficulty with the call-back, as they have returned my call the same day each time.

 

I'm still awaiting my actual green card and EI said I won't receive any funds until such time as I fax a copy of it to them.

 

You should be able to scan the Visa thats in ur passport..it acts as the exact same thing.....

My situation is a tad different. My employer and I came to a mutual agreement that my job sucked and he could get his daughter to do my job for much less money. (Don't ask ... and be careful about working for shady-looking startups.)

 

So I already have an active EI claim. I opened it the same week we sent in my I-129F. I should have enough hours to get me through the CSC process (#fingerscrossed) and then some. I don't want to tell EI what I'm up to with my immigration until it's absolutely necessary (Vancouver interview complete, or at least scheduled).

 

I suppose at that point I will have to suspend my claim and then re-start when I get my EA? 

 

Has anyone been through a similar experience?

 

 

Recall reading a few similar situations....and thats what they had to do...

Oh yeah for sure - but whether someone is applying for EI right or after POE or waiting for the their EAD card, it is kind of the same process with getting all the right paperwork in and phoning in and all those things.  Our cr-1 visa took forever, but yeah, at least when he gets here he can work/apply for EI. My husband had no idea that he would be elgible - I just happened across this forum a couple months ago and was like  What?! Canada is an amazing country - unemployment even if you are moving to the states!  Blew my mind. lol

 

No--as a cr-1--it already has work authorization...u won't be filing for EAD!!  One he crosses the border into the USA and the Immigtarion dude at te POE endorses (activates) the visa..that acts as your temporary greencard until the actual card arrives!  He can start work that day,  thus be elgible for EI right away!  Totally different for k1'ers--they have to wait for that EAD document.....So ensure he Applies right away...there is a 2 week period where he does not get any $$$ as thats sort of like a deductible.....Bt apply right away.....And he will have to send in certain documents.

My canadian is moving here next month and we will navigating through this - thank you everyone for sharing your experiences

 

As a cr-1/ir-1....he can claim EI right away (if he has enough qualifying hrs), as he can work right away....

Will a K1 receive EI after EAD is approved (after 3 months or whatever)?  Or how does this all work for a Canadian moving to the USA on a fiance VISA?  I honestly didn't even know this was an option until browsing these forums.

 

I am planning on moving this summer - I am a teacher here in Canada.

 

 

Go back a few pages and read and u will find more info.  Yes a k1 will get Ei once they get their EAD! One still has to apply ASAP once they are in the USA, but won't receive any $$$ until they get Work authorization

I am confused. Can my husband get EI after we move? We will be moving to the US, I am being laid off from work and seeking new employment in the US he will be quitting his job to follow my new job.

 

Depends:

 

Is he the Cdn citizen?  Will he have enough qualifying work hours to claim EI?  You say husband, so I'm guessing a cr-1/ir-1 and if thats the case he could get Cdn Ei right from the start (k1'ers have to wait until they get work authorization)

as a K1--you can NOT get EI until you can legally work---Just applying does not count, you have to be APPROVED for the EAD.  1 benefit of the CR-1/Ir-1, is that 1 can legally work right away.

if u get denied--1 can appeal.   I first got denied as since I was in the Cdn Military I had to break my contract to get out, and they gave me some reason!  They give u various option to appeal, 1 was via writing and I believe the other was via phone!  I went with the writing route and won

Another option is customhouse.com-----but since it has been taken over by Western Union, the rates tend not to be as great as they once were---but if one is tx'ing over large sums of $$$$ its worth ur time to check them out and compare the exchange rates.  Just because a bank does not charge you NO fees---does not make it a great deal, they may be giving u a sub par exchange rate.

Service Canada deposited my first EI check yesterday.

Does everyone here collected or planning to collect all the weeks of EI entitlement before accepting a job or look for a job.?

I started looking for one ... No luck yet. .. Any suggestion?



 

One has to be actively looking for a job while on EI.....EI Canada can contact you and ask for list of the places you have applied to.    And if you find an acceptable job and it is offered to you, I do believe you have to accept it.  If the EI folks were to find out you turned down an acceptable job offer, I do believe they can terminate your EI.

You can do it via the banks or a service such a customhouse.com--now owened by western union!   Just keep in mind a place may say NO FEES, but that does not mean it is a better deal, as they may be giving you a lower exchange rate, its best to check around and ensure you know the whole picture.  Customhouse used to be great and free and gave a great exchange rate, but since it has been bought out by western Union, I found the exchange rate wasn't as good!!

Nope!  only problem may be that you give up ur greencard, thus why many would say to wait till you get citizenship......Then again later down the road if you were going to move back to the USA---you would have a rough idea on how long it takes and plan accordingly--if that was possible

My understanding is unless you get a visitors visa that allows her to stay for 6 months at a time, you can't be together while you wait. My wife and I can't be together while our forms are processing :S And I can't travel to the US apparently because I'm showing intent to move there? But she can come visit me in Canada.

I'm a little confused about these answers to this post's questions.....if someone can clarify, that would be great. We already sent in our form though, so I guess it's too late and I have to wait here till everything is done.

 



 

Many of us--including myself visited the USA while our cr-1/ir-1 was being processed--I visited monthly from NS to DC never had a problem--my 2 cents i sin my signature block........I believe what they are doing is adjusting of status (AOS) when he/she was in the USA!  Its sort of like a loop hole, it isn't a hard 1 to take advantage of if one keeps their mouth shut if you catch my drift.   While I was on a visit to the USA a friend had a friend who was an immigration lawyer and she said yep, just stay, get married and then AOS.....But I was still in the Cdn Air Force so couldn't do that, nor was I in a hurry!

If the items are traveling with you--u do not need to fil out form 3299--it is for Unaccompanied stuff!!  One should have an inventory list--does not have to be fancy, keep it basic.  Good chance they won't even ask to see it, but best to have it just in case
