Yep...as a k1....you can NOT collect EI until you can legally work.....When you get ur EAD...one sends that in,  and then can collect it.  In your case, it may or may not be worth it!  I would still recommend filing for it when u Quit ur job and move down---as who knows what may happen.....1 other person here on VJ was in a very similar position.....But her supervisor changed his mind and the job she/he thought was all lined up....fell through!   So Apply for it, and if u need it great.....and if not..Great!   But no EI $$$$ until u can legally work.   1 f the benefits of the CR-1/IR-1 visa, as they can work right away once they enter the USA

CanadaBest Way To Move Money To US?

Actually u can carry zillions of cash across the border---u just have to declare it.     If its a small amount of $$$, just leave it in ur Cdn account and then use ones debit card to take it out in the USA.......When its larger amounts of $$$, one should do their homework.  Some banks will cash ur Cdn cheque (if you can find a competent bank teller,lol) some wont charge any fees, but give a sub-par exchange rate.  Others may charge a fee, but give a superior exchange rate, which could actually be better.  This has been discussed many times, so a search should come up with a fair number of hits!   At one time CustomHouse--out of Victoria was awesome!  But then they got bought out by Western Union, and the rates were no longer that great.  Havent checked them in a long time, so not sure if their rates have stayed crappy.  Best of luck

I think they did ask about the rabies!  And I believe, you can't bring any dog food with u!  Do not quote me on that---I had brought dog food from the USA with me to last the whole month and when I came back into the USA--I actually got randomly pulled over to chat with the agricultural person--and she did not care about my dog food, as it had originated from the USA.  

 

I would just have ur list of vaccinations handy and a letter from ur vet stating the dog is healthy!!   I can give you the step by step instructions on how to bring ur animals to Nicaragua though,lol  Best of luck

1 can contact your manufacturer and they should (not all do) issue a compliance letter. As well on some cars they have a compliance sticker that is in the engine bay or inside 1 of the doors and that has sufficed.

Keep in mind---1 VJ memeber that had the sticker on the car--that sticker was NOT good enough for the POE officer, and they wanted the actual compliance letter!! The fun and games

No guarantees......Some get the back within a few days..some longer....if ur orginally from a country thats not on good terms with the USA..may get put into additional processing (AP)....if u have some kind of degree that deals with chemicals may equal AP.....Sometimes people get accepted for AP....Computers can go down, resulting in additional time.   I would mention that you travel a fair deal and require the passport, may/may not help, but does not hurt to mention that.

ur a Canadian Citizen, and ur not going to loose that. Im a USA citizen now, still a Canadian citizen, but I'm a non-resident of Canada as I live in the USA, but I can still work in Canada if I soo desired. I do not belive one can have "dual" residence, one has to have a "home country" but u can still go and work in Canada. As a Permenant resident of the USA, u have to spend the majority of ur time in the USA. But one can live in the USA, and stil work in Canada.

As it appears, you have just filed the k1, so you hae a bit of a ways to go before u gain permanent residency in the USA, so lots of time to reasearch it. Best of luck

Yeppers..still have to notify the IRS..You wil not get taxed on them..ur just notifying the IRS.....and I believe you have to contact the institution in Canada that is looking after them and tell them ur no longer a resident of Canada.   I recall them sending me paperwork to fill out.

I am using RBC as well.  I have several RRSPs and a pension, as well as CPP (eventually) that will need to be deposited into a Canadian account.  Very easy to move money through RBC Can to RBC US.  I have linked our Wells Fargo account with the RBC US one for this purpose. 

 

Make sure u report those RRSPs to the IRS when u move..on form 8891 at tax time

CanadaFlights from Canada to the US, a weird pricing thing...

I have seen layovers in Chicago and Houston as well.  But never want to end up in Chicago in the winter.  The weather there is so unpredictable.  :huh: 
I have found the best bet to be American Airlines so far.  Air Canada is usually more expensive or they trade off airlines at Dallas, and less direct  flights to Dallas as well.

 

The thing I hate about AA, is we joined their little AA points program to try and earn points towards free flights? Well we don't fly enough for them to add up quickly, and they are almost at expiry now.  So I have been seriously considering a travel credit card that you can earn points no matter what you spend your money on, and it doesn't matter which airline.  I saw a commercial on tv for one not too long ago.  Anybody else have one of these?  Any opinions on which is best?

 

There are websites that state which credit cards offer the best value.......Quito often they have specials...get 50,000 free points nby signing up or you have to spend so much $$$$ in a time period to get those free points.  We have a Capital one (can't recall which 1 it is)  but it does very well point wise and no international transaction fees.  http://slickdeals.ne...php?sduid=0&f=9  if u do a search on that website..people often post good deals on CC

LOL 4 hour drive for coffee that's crazy!! There's a Tim's in West Virginia!?!? Is it in Charleston? My future father in law just bought a house there and I was there last July but did not see one. And does it taste the same as back home? I really like their bagels. 

 

I would have to go look on the tim hortons website...Wife was away...so dog and I got in the car and off we went.....It was a long day as hit a lot of traffic on the way back,lol  Coffee was good........I did not like the Timmys in Newport, didnt taste at all like Tim hortons---probably more of a cream issue.

My wife (US Citizen) and myself(CAN citizen) live here in Canada. We are planning a move to the US so I will need a Green card to work. When it comes for the interview to prove domicile, do we have to go to Montreal or can this be done at the US consulate in Toronto.

i'm aware that DCF is not available in Canada. My question is in regards to what would be enough to prove domicile in my situation. I can get a letter for emmployment which is a 3 year contract and i can get an apartment lease as well. From what i have heard the montreal consulate is harsher on the domicile issue so i want to know what else should i have to make my case stronger. i have been living in the US for the past 5 years so i have bank statements and everything else. I will only be moving to canada temporarily so that I live with my wife and commute to US (Windsor/Detroit) while waiting for our paperwork to clear. Therefore i will be applying from Canada. my intent is to move back asap right after clearence of paperwork

Hi,

I will be flying to the U.S. tomorrow. I received my green card last August when I was in the U.S. I returned to Canada in mid August until December 2, when I went back to the U.S. to look for a small business. I arrived back in Canada on December 15 and stayed there till April 8. At this time, I was getting my house in Canada ready for sale. I went back to the U.S on April 8 for a 2 day vacation driving back to Canada on April 10. I have been in Canada since.

My question is, since I have U.S. residence, should I indicate on the U.S. customs form that my Country of residence is the U.S.? Is it true that the important thing to show the customs officials is that one doesn't stay away from the U.S. for more than 6 months at any given time and that he or she has intent to reside in the U.S? When I handed over my U.S immigrant Visa to a U.S. customs official last year at the airport before I got my green card, he indicated that this was a grey area and that the main thing is to show intent to live in the U.S., ie by buying a house, or by getting a job or business. He said if you come back after 2 years and say that you only briefly visited the U.S two times then the customs won't like it.

With a Greencard, you are expected to be LIVING in the USA and if they don't believe you are, they can take back the Greencard. If one is going to be away for longer periods of time, there is a form one should file. And the beauty of it, each POE officer sees the rules a bit differently, so run into the POE officer that believes ur not living in the USA, say good bye to the greencard

Thank you everyone for contributing. I have spoken to an attorney in detail and seems like this domicile and AOS is an everyday thing for US-CDN married couple. There is no need to be over concerned and cover all the basis and tell MTL and CBP the truth. CBP is quiet flexible and they know CDN don't move at once, and they go back and forth to wrap things up (as long as they really are doing it) in the home country and making arrangements for employments and accommodation in US. So they don't bother if a LPR is back in CDN for couple of months to sort things out. I was over concerned about border crossing, during the transition period. Things don't happen over night and they know it. Its stupid to say to close ALL ties from Canada, scratch the maple leaf off your arms etc. You can keep bank accounts property etc etc in Canada. As long as you're moving to US to live their as LPR, it is all good. The list to show domicile is a reality and we need to do it to show intent. It doesn't mean (as many people rightly said in this thread) to move to US to show intent or establish domicile. Just take steps to show that you're going to move to US along with your Canadian spouse once she/he is granted visa.

There ahve been a fgair # of Cr-1//IR-1 that goto the POE and then immediately turn around--just to get the paperwork going (ssn, actual greencard) I got my cr-1 in Dec and shortly after that went back to Canada. Thats 1 of the + of the cr-1//ir-1 visas.

one more thing about your car. You need to do paperwork. You can't just bring in the car and register it. There is stuff you should get before leaving canada. I don't remember all that it was as we decided to sell our cars in Canada and buy new ones when we got here as it was very complicated from what I remember. Had to call car company etc etc.

Please check into that.



With a cr-1 or IR-1 you can enter the USA and then go back to Canada! Month is not a big deal. If it were to be an extended amt of time (not sure if its 6 months or a yr) then their is a form 1 would fill out

I'm not sure what you are saying. Where are you both living.?

Normally if you are both living in Canada and your husband is a permanent resident as you say, you would be approved in Canada, once you get your passport with your visa in it back it takes about 3 days, then you are good to move. You have if I remember 6 months do so. Then once in the USA you get the greencard at your place of residence. You do not get the green card while in Canada. The visa is your permission to move and they process you when you cross and then you will get your SS# and official green card and another welcome letter.

So I'm not sure what you are asking and where you are living now and where you applied and got approved??



She is saying that Montreal is a pain in the butt,lol They prefer that the USA citizen is pretty much living/working in the USA, and if thats not the case, one best have strong proof that they will soon be residing in the USA. In some instances, the USA citizen has left Canada, to set up residence in the USA, send in proof that they have, to get the Visa!

Later on, if he wants to obtain USA citizenship, it asks about days outside USA--but they have to be longer than 24hrs! Theres another that lives on the west coast and travels from washington to BC daily! its al based on residence!! You can PM Neiks, she is the Cdn border gaurd!! I believe she stated that she NO longer is able to use the cdn healthcare system, but best to ask her!!

I have a question?? Maybe this is not the right place but I don't know where to post.

I have options as to where I an live in the USA. I am the american my husband is the canadian. I really want to live back in the USA, my reasons are unimportant for the question.

I am hopeing to buy a business and my husband will take early retirement and work with me in the business and move to one city. That's great, my first choice.

My second choice which will give me the ability to live in the USA, my husband will have to keep his job and commute, while he can work from home 2 - 3 days a week, he will have to commute the other 2 - 3 days. It's dooable. Most people commute the amount of time it will take him even if they live in the USA and drive to work. I know people who actually commute longer drives.

The thing is will the border in the US be ok with that?? He will have a US drivers license, US plates, he will file and pay taxes to the US and he will sleep in the USA with the exception of maybe really bad weather and then we would take a hotel room for the night.

His residence will be in the USA, but since he is canadian he can work in Canada no problems and go back and forth. ???


yep!! There is even one Cdn member on here that resides in the USA, and works For the Canadian Borderer Services Agency. Their have been others as well

I just wanted to make a note in this thread for anyone applying for K-1's and worrying about domicile ... don't :P My fiance has been living in Canada for the past year (he is a dual citizen) and it was not an issue at all at our interview -- it was literally not even touched upon once. I'd even go so far as to say that the CO really didn't want to hear about it, haha.



1 should make note that the interview was in VANCOUVER, may be a different story in MOntreal

I'm not sure, my only point is that as a USA citizen, one is suppose to file a tax return every yr! Maybe they only require the latest tax yr. Been soo long since I filed for the cr-1, can't really answer many of those questions with certainty. I'm sure if you read over the guides, you can find the answer.

Well, you can wait and pray that they don't ask for it, but if they do, your in for a delay. OR you can file those taxes, and get a jump start on it, so if they do ask, you already have started the income paperwork, so the delay won't be as long!! But I'm sure others will chine in. VJ tends to be a bit slower on the weekends. I do know USA citizens are suppose to file taxes every year, even if they don't reside in the USA,one of the downfalls of becoming a USA citizen. Canada and the USA do have a tax treaty, so one isn't going to be double taxed! Hope it works out for ya, and hopefully you get a concrete response, one that I would be very proactive in finding the correct response. As we all know the IRS isn't exactly a speedy unit to deal with, and this being prime tax season, not sure how fast they would be at pumping out returns from previous yrs. Best of luck

Ok phew! I was starting to get a little worried about this.

How long is the visa stamp in your passport good for? 5 or 6 months?? 

If we filed EP and stated that my green card was to mailed to my us address, do I still have to chase it once I'm there??

 

I'm really counting on being able to collect EI for a while at least.

Makes sure you keep track of jobs that you have applied to---as just as in Canada, they can request that info...and if your not actively looking for a job, they can terminate the EI.

EI sent me a package here in the US that I had to fill out which asked for a copy of my passport and my visa page or my green card.  I copied and sent in the first 2 as I am awaiting my green card still...   I called ELIS/USCIS regarding this at the 60 day post POE mark as recommended on the paperwork I received at the interview, and was told 'things were back-logged'.  

They suggested I give it another month before calling about it again.  I'm approaching that date in a week, so once I have the green card, EI wants me to fax them a copy, otherwise my EI benefits expire Dec 11th (the visa expiration date).

 

you have ur greencard---the stamp..I551 acts as ur greencard...and should have copied it and fexed/emailed it in...... and you should have been collecting EI by now if u entered the USA on July 23....there is a 2 week period where 1 does not get benefits--that's like ur deductible
