U can fill it out if u wish too....but u do NOT have to.....it just helps determine ur status.....putting down the date u CEASED to be a Cdn resident on ur tax forum notifies them.

There is that 1 form that one "can" fill out..but it is not a must.....NR73.....When it comes to filing ur Cdn taxes.....on the very first page there is a spot where one enters when they became OR ceased to be a Cdn resident....I just put in the date I left canada.......and for fun I applied for the GST rebate, which I knew I could not get as I made too much $$$, but they sent me a letter more or less saying, sorry you ceased to be a Cdn resident on.....(the date I had put down)  so thats how I knew I was good to go,lol  I called Revenue Canada and asked if I had to fill out NR73 and they said no.  I don't own any property, I have kept 1 bank account open but it has less than $1 in it, so a pretty easy case.

Yep....we Cdns are special!!  We don't need to apply for it ahead of time, and if they deny us, we simply turn around (maybe out airfare $$)  I know in other cases..such as Nicaragua and many others, they fork over the $$$, have to goto the Embassy/consulate and get denied, they are out the $$$ it cost to apply.

The "visa" takes up a whole page...so it is pretty hard to miss......Yes, some Cdn K1'ers have had success....but it is up to the discretion of the Officer!  Once you have had it endorsed..do NOT leave the USA (including Canada) until u get AP or the greencard.

CanadaMy K1 visa has been approved can I still visit the USA before I want to use it?

I called the POE I will be using directly and I was told I can enter the USA with a K1 visa in my passport and I do NOT have to use it.  I just have to be specific that I want to enter as a visitor and I am coming home!

You can enter the USA as with a K1 visa on your Canadian passport without using it, you just have to explain you want to enter as a visitor! :) :)



 

 

Again----it all depends on the POE officer....During the almost 10 yrs I have been on VJ...there have been others that have called ahead to the Port of Entry station....have 1 officer tell them something...and once they arrive..something else totally take place...I'm sure u will have success..but one should always be prepared in case things do not go the way you want them to.

What they tell you at the consulate can differ at the POE...as they are 2 different people, and branches of the gov't!  The POE officer does not have to let u gain entry without endorsing the visa.....What may have worked for Sweetmellissa, does not mean its going to work for you...good chance it will, but it is not a given.

A few yrs back I watching one of those financial programs in the USA....they stated YES one can gain credit rating by being added to your spouses Credit card, but it had to be done a certain way..can't recall the exact wording one had to use.....They did say that that "loophole" may be closing.

The USA Citizen can come into the consulate if they wish.......With regards to fingerprints....unless things have changed...only those with a criminal record require fingerprinting.......No criminal record = no fingerprints required.  At the consulate,they take digital finger prints

Yep, we just started the process to get my fiance from Calgary to join me here in the states. Welcome to what seems to be a pretty large club!!! I am. I just dropped my fiance off today at the border in Windsor. He is going to Montreal today for his interview! I am a nervous wreck, this is the last step we have to take before he gets his visa to come over here for the adjustment of status. I hear it's very simple but still very nerve racking! We have been going into a dark cloud throughout our journey, our lawyer has been no help infact we cant get ahold of him what so ever! So we have no idea what exactly to expect next. There has been some helpful free legal advice we have found online. The embassies or consulates can have some helpful information and same with their websites. It's been a hectic process without the help of a lawyer!

 

 

Too bad you didnt find VJ earlier and save urself $$$$$$$$.  Dont worry as that happens too many--including ourselves!  Best of luck

There are many that Green card holders that work in Canada, But LIVE in the USA!  Canada/USA share a tax treaty, so one should not get double taxed!

Many do cross with no issues....but a few do have issues and some get denied entry.....All depends on the knowledge of the POE officer......Seems to me a year or so back here on VJ had a similar problem going from Victoria to Seattle on the Clipper......she/he was able to still gain access.   The Poe officer does not have to look at ur evidence, always good to have it.   

 

I lived in Victoria for nearly 10 yrs..not while going through the immigration process mind you.  Next time I would go via a land crossing.

Really it does not matter what we think---or what you think....all it takes is for 1 USA Immigration agent to stop you at the border.....And you will loose the Green card on the spot!!  And then you can pay more $$$$$ to hire those immigration lawyers!   If your soo certain..next time U cross into the USA--tell the Immigration official the WHOLE complete story....he may care...he may not....Being cdn they may turn the other cheek!  Make sure u have a good tax accountant as well.

I checked an official Canadian website. In my province you need to be physically present there 153+ days in any 12-month period.

This is what I like about Canada: there is a clear definitive answer.

In the States the criteria are very vague. They can retake your green card even after 2 months of absence. And if you tell them the situation (as you suggested) they can use this info against you.



 

As far as I know....u can't be a resident of 2 countries......you had the interview....you did NOT have to go and get the Visa Endorsed right away....one has up to 6 months to do that....You chose to go and get it endorsed....thus abiding by the laws/regulations that come with the Greencard.....if ur not abiding by them, then you should expect to loose the green card. And right now are u abiding by the rules?  Does not sound like it.  

 

Yes that website says that....but are u a resident of Canada?  if u say yes----then should u be in receipt of the Greencard----that u activated (endorsed)

 

What do you plan on putting down on ur taxes?  U may find yourself in a very interesting situation.  Looks for NEIKS under the members list..she is a Cdn had a green card at 1 time...maybe a citizen now---lives in the USA..but still works in Canada.

If one truly wants to know the answer---next time you head into the USA---tell them ur situation.......The longer u stay living in Canada, the greater chance they will take away ur Greencard......those chances may be slim, who really knows.....but all it takes is one time.....There are many Canucks that work in Canada..but they reside in the USA.....and they checked into it and are not entitled to use the Cdn Healthcare system......I have no time to look for links..not my issue..sure would suck to be sent a huge bill.  Best of luck

Yep...as a k1....you can NOT collect EI until you can legally work.....When you get ur EAD...one sends that in,  and then can collect it.  In your case, it may or may not be worth it!  I would still recommend filing for it when u Quit ur job and move down---as who knows what may happen.....1 other person here on VJ was in a very similar position.....But her supervisor changed his mind and the job she/he thought was all lined up....fell through!   So Apply for it, and if u need it great.....and if not..Great!   But no EI $$$$ until u can legally work.   1 f the benefits of the CR-1/IR-1 visa, as they can work right away once they enter the USA
