Frm my reading on VJ, a K3 isnt technically allowed to work, as they require the EAD. And many k3'ers stated they were not able to get EI until they got that EAD. When in doubt, give the EI people a call, i found them super friendly back in 2005,lol

I belive--(depends who you talk to at the EI office,lol) a k1 can claim EI right away. And no they can not deposit into a USA bank! They can into a Cdn bank!! Thats where customhouse.com comes in handy. Its a FREE brokerage service. If you do a customhouse search on VJ, u will find a few topics about it. A few of us on VJ use it and love it. Better exchange rates than the bank! and free.

I don't recall ever getting 1 in the mail, but I could be wrong!!! Always head to the library to print one off, or get a family member to log on for ya, scan it and email it to you

I was able to get mine online (end of feb???) a few years back!! Can't recall the exact site, and I'm soon out the door. I'm sure someone will speak up

I wouldn't tell EI UNTIL you actually start working. They could phone u on the 19th and say, sorry, we can no longer hire you!!

The rules are that u have to be looking for work, no different than if your in Canada! and if they phone and you don't have a list available, they can put an immediate stop to your $$$, its called screening ur calls,lol and of course be out looking for work, and have that list available! lol

They tax you 25%

When i did it back in 2005, it was easy! I was a cr-1 so it was very straight forward, because there was never a question if i was work eligible (i am,lol) It is a fairly simple process, bu tlike any other govt office, not always the fastest!

I was all happy at first when my EI cards came in, then only to receive a letter that my claim had been denied! I appealed and won! Hoping for the best.

I resided in NS before coming to the USA, but I didnt got hrough the local EI office, one filed through the interstate branch, which is in Ontario

That seems to be one of the inconsistencies for the k1'ers--the EAD!! Depending who is looking over ur file, the EAD is not required. Read on here of many K1'ers receiving EI with no EAD stamp. And many have applied while still in the Canada.

Did the appeal people have any idea about your situation? I had to explain EVERYTHING during my phone interview with them. Not surprising as they're members of the community rather than EI workers. How the heck would they know about the ins and outs of the K-1 saga on my end. Had a 45 minute conversation on the phone. I thought I had a pretty good case. Was feeling good about it afterwards. Got the letter awhile later. Unanomous denial.



I --well more my wife did,lol-- wrote a letter explaining our situation!! I think it all depends who gets your case. I never expected to get EI, wasnt till I was here in the USA that Cassie stated it was possible.

APPEAL!!!!! One has a few methods 1) one can attend the interview via phone I believe 2) or fil out a form and explain the situation!!

I was originally denied as well. They said since I was in the Cdn Military and was on a contract and broke that contract to be with my spouse, i was not elgible for EI! I appealed it and won. I used my wifes writing skills to my advantage,lol I explained how we tried various methods before we came to the conclusion it was in our best interest if I moved to the USA. There should send you info on how to appeal, or phone and ask or do a search on the EI section on the internet.

I wasnt even going to bother to appeal, but said what the heck, all they can do is say no. If they are denying it entirely based on moving to the USA to be with a spouse is not a valid reason, that is crock!! But maybe his retirement $$$$ plays into the equation, I dont know!! But check into the appeal process, its worth it.

Glad you have done your homework! Another way to look at things is one has various options when one starts the visa process,and the one sure way of being work eligible is the cr-1 or ir-1. best of luck on your case with the usa govt

Not sure why it would cost the US govt $$$$$, they are NOT the ones that are paying the EI, Canada is. Best of luck on your adventure. You would probably pay more for the lawyer,then one would receive from EI.

Keep in mind one still has to have enough qualifying hours from your previous work and dont quit your job to far in advance! One VJ member was denied because according to the EI people she quit too early!!

Not sure if there is a bottom line!! At one time (from readings on VJ) the k1 applicant had to have the EAD to get EI. Then some members were reporting that one no longer had to have the EAD (for K1, K3 still does) to get EI. So for the past while k1'ers were getting EI without the EAD because in Canada's EI eyes they were able to work! I didn't come in on a K1, so im not much help.

I believe you still have to file though ASAP when u enter the USA to start ur claim. I could be wrong. And if ya called back you would probably get a different answer,lol sort of like when you called the USCIS (mis)information line.

hmmm, Im not certain, but it MAY be different between a K1 and K3 when it comes to the EAD thing! I'm probbaly wrong, but thought i read on here something about that.

I received payments every 2 weeks. At that time they couldn't direct deposit, so I received a cheque! But I do believe they wil ldirect deposit into a Canadian acct, which of course you should be able to log on and check.

I believe ur employer by law is suppose to give ur ROE to ya in a certain time frame. Most are good at handing them out asap. Since you now know u need the ROE, give ur pay people a heads up!

One requires a ROE, otherwise Ei has no clue if u even qualify and for how much $$$ ur entitled to! You may be able to start the application process online, but not sure if there is info from the ROE you wil need, im sure others will chirp in. You have to mail in the original ROE as well, so make a photocopy of it for urself. Have u had ur k1 interview yet??
