My recommendation is take some time and go over the stickies at the top of the K1, K3 and cr-1 forums and the + and -'s of each!!

We used a lawyer, paid $2500 I belive plus filing fee costs. Know what the lawyer does in straight forward cases? Just gathers the papers and double checks everything!! You still have to fill it in,gather the long form birth cert, criminal background check,etc) Simply put, you do all the real work, they just gather the papers!!! Yes, there are cases when a lawyer could assit, but they can't make the process faster.

VJ is a super resource, so take time and look around and ask away. Mostlikely 99.9% of the time the question has been asked before so use the search feature. Just keep in mind there is great advice on here, and not so grat advice, lol but thats expected from a forum. Best of luck

Yes, one can come and marry,then depart. Thats what we did, I came down, we got married and I left and we started the cr-1 process. As a Canadian she can stay up to 6 months.

Yes as a canadian you do not require a waiver or anything, its up to the POE officer to let you in or deny you, and they do deny Canadians entry into the USA. One can not enter the USA and Knowingly stay. If one was to enter the USA and then make the decision to stay, get married and AOS, that would be fine, BUT to knowingly go into the usa, marry, and try to AOS, would be illegal. I guess you might have to proof it was not intentional. I'm sure many do this, but could cause you complications later down the road. And by going this route, ur spouse would most likely not be able to return to Canada until the AOS was over, even to a close relatives funeral etc etc. One would have to get an emergency advance parole for that. I'm sure many people enter the usa with intentions of staying and AOS with no problems, but i'm sure there are ones that get caught and get deported. Its not a short process, K1 takes approx 6 months, and the k3, cr-1 routes are longer, but none of that can start until she gets divorced.

As the above psoter stated, would be hard of you to prove,it was an all of a sudden decsion, as she is selling her house, bringing the child over, she will need proof (from the courts) that the child is allowed to move to the USA. Best of luck

Yep not a fast process, could take a year!!
K1, is a fiance visa, like the above stated it could take 6-8 months. oncer you have the visa, you the ncoem to the USA to get married, which you have upt to 90 days to do so! It is a ONE time entry visa. Until you AOS (adjust of status) or get AP (advance parole) u can't go ut of the USA, which includes Canada!! It is SUPPSOEDLY the fatser of the methods (K3, cr-1) When I say SUPPOSEDLY, nothing with immigrated to the USA is set in stone!! 2 people could fikle at the exactly same time, go through the same processing centres, yet finish the process at different times!! There are a lot of frustratin gthings with the process, so one has to be patient!

I went the cr-1 route so not up to date with K1 or K3, each has their plus's and minuses, you have to take the time and read the guides and decide what is best for you!! in Canada, there are only two consulates that do the k1 and K3 visas, vancouver ot Mtl. Vancouver is much faster than Mtl at dishing out the interviews. Where you get interviewed depends where you live in Canada, but some that should be interviewed in Mtl have managed to get their case transferred to Van, many consider the extra $$$ in airfare to van worth it!!

Can you travel to the USA while this process is ongoing?? yes and NO! lol many have done it (including myself) with no problems! Some do get more heavily questioned, but still gain entry, and some do get denied (if ur honest, thats fine, won't harm ur visa) When travelling to the USa have prrof of tiers to canada (house lease, job from employer, immigration paperwork, etc) Always tell the truth to the POE (port of entry) officer. Answer thier questions, but don't keep blabbing away, if u know what I mean. Dont have tons of luggage or job resumes !!

What I did was on a trip to tthe USa was got married, then RETURNED back to canada, and we went through the cr-1 process. Dont look at my timeline as things were much faster than. probally look at atl east a year for the k3 or cr-1!! But ya never know, things could speed up, as I stated earlier, one must be very patient!!

Take your time filling out the forms, be neat, NEVER USE white out, ensure there are no blank spaces( use n/a, none,etc) Ask question son VJ, I belive i the gallery and "example of forms" on the top of the page wil provide u valuable assistance on filling out the forms, you do not want a RFE (request furthe evuidence) as that slows things down!! You wil lrequire a CANADA wide police background check (from local RCMP or police stn), very weasy document to get ( if NO criminal record, then just the canada wide background check, IF you have eveer had a criminal record, then u require fingerprinting as well, which can take like 4 months, check out rcmp.ca website) As well yuo wil require a LONG form birth cert (its the 1 that has ur parents names on it) There are more documents that u may require as well (divorce cert, phots,etc) but by reading the guides u will find that out. When one is goin gto the USA to see thier spouse or fiance, or even girlfriend, I'm sure it sets off alarms to the POE officer, as there may be a chance you wil stay and reside in the USA. And just having a return plane ticket is NOT sufficient evidence, as most know a return ticket is cheaper than a 1 way ticket.

I belive it has been highly suggested from a USA POE officer that hangs out in the canada forum here on VJ, that one should have ties to canada if they are visiting the USA while ur visda process is ongoing. Its ur choice to, or not to, just as it is the POE officers choice to let u gain entry or not to. I'm all for visiting the USA (as a canuck) while the visa process is ongoing, I sure did. As wel I belive just in the last while there has been a few Canadians pulled aside for further questioning, and one of the reasons they were allowed entry into the USA was that they had ties to canada with them. Just make sure that you bring proof of ties to Canada, such as a letter from your employer stating that you are on holidays and intend to return to work, bank statements, school schedules, etc. We also received our NOA1 a few days ago and I'll be heading to the States on Friday (YAY!).

I've never had any problems travelling there and back, so I'm sure it'll be alright for you too. Have a good time at the wedding. :)


Out of curiosity, why do you guys think this is necessary? Does an additional level of questions come up if you say you are visiting your fiance compared to just saying you are visiting a friend? My GF has only been over twice, but they never ask her anything. Now I'm worried about trying to bring her down here during the K-1, but I really need to so she can help approve wedding stuff.

Plus we don't wanna get a letter from her employer because we aren't going to tell them she's leaving until we get the visa. Otherwise she might get laid off =/



All depnds on the POE and POE officer, some are stricter than others. When one states to the POE officer, that ur visiting a fiance or a spouse, they may think you may stay and reside in the USA! As well no one for sure (or isnt saying,lol) what the POE officer see's on his computer. Does he know that you have a visa in progress?? Best to bring ties to Canada, and even that doesn't gaurentee u entry!!

Many, including I have travelled to the USA while the visa process was ongoing, and never had a problem!! Others have been denied entry!! So it is not a gimme!!
1) Bring ties to canada with u (letter from employer, lease, immigration paperwork,etc)
2) Be HONEST!!! BUt only answer the question, if you know what I mean!! Dont blab away,lol
3) Don't have tons of luggage, or job resumes with you!!
4)Be confident and polite in ur answers, NEVER get upset, your not going to win!!
5) If you do get denied and u were honest, its ok, shouldn't harm ur visa at all. They will most likley ask at the K1 interview if you have been denied, if u have say yes, not a big deal!!

I travelled monthly to DC and was a breeze, but thats just my experience. Best of luck

1) Always tell the TRUTH. never lie to the POE officer
2) Be confident in ur replies
3)keep ur response short and to the point, dont tell ur life story!!
4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!
5)pack light! No job resumes with you
6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)
7) Always be polite, being rude isnt going to get ya anywhere, and could make things worse!!
8) have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didnt lie! Refer to #1

I'll tell you my experience. While we were on the K1 visa process after NOA1, I went to the states, POE was Miami. The office was very kind and just asked me what was I going to do and where I was heading to. I told him that I was going to visit my fiance, and he just asked if she was an american, and also asked what did I do for a living. Anything else, he didn't even asked me for any proof but I took them anyway like a work certificate, bank statement, last mail received at work, like that

Guayaquil is one of the toughest consulates around the world, and you'll want to make sure you are prepared for what's going to come your way. Start reading reviews and do your homework. It could be a very unpleasant experience if you don't. Posted Image

Coppy attached---the I-551 stamp in ur passport--with the ink stamp by the POE officer acts as your "green card" for lack of more legal terms.  Copy(scan) and include that. And Prob should go from POE date as that was thew date it was endorsed and you moved to the USA and thats the date the "green card" going to expire on a few yrs down the road

Since u are MARRIED--u can NOT do the k1, as it is a fiance visa. You need to post in the CR-1/IR-1 forum. Since ur married for 2 yrs or more--you will be going the IR-1 route--but its the same as the CR-1--just at the end she wil get a 10 yr greencard (vice a 2 yr green card for a cr-1)  At the top of that forum--are GUIDES!!!   It is in your best interest to read them, as they explain the process!!   http://www.visajourn...ess-procedures/

You might temporarily not get benefits as part of the requirements to receiving EI is that you are ready and able to work. Unless you have a work permit right away then you are not able to work and therefore are ineligible for benefits until you receive your EAD.

 

She is a cr-1/ir-1----Which for lack of better terms--already is work eligible right from day one--unlike the k1'ers.

I just applied, I didn't know how to apply really though, as I've never done it before. I put my Canadian address, as you could not put a US address. This is confusing, I don't understand it at all.


Was back in 2005 when I applied, so things prob have changed, and my memory sucks,lol I recall calling the International dept and they emailed me a link.....And In that email it gave me instructions on how to fill out the online form!! But Like I stated, things have prob changed....sorry

There is a formula some where on the site (well used to be) the amt one receives is based on what one was making at their place of employment

My husband has been working at his place of employment for 28 months.
However, if I had to estimate, I'd say on avg he's worked only 5 hours per week.
According to what I'm reading, however, he has to have worked a minimum of 420 hours in the past year (52 weeks)
Am I reading this all correctly so far?
So in short, it looks like he would NOT qualify.
Unless he worked for 420 hours this year, which is highly doubtful.

What do you make when you get the EI anyways?
Is it a percentage of what you were making before?
That's how it works in the US.

I entered on a K-1 and it took me 6 months to start my AOS paperwork, would I still get benefits, or did I take too long to apply for AOS?


Did you ever apply for EI? Even though a k1 can't collect until you get EAD--one still has to apply ASAP. could always cal them and ask.

So I filed back in June for my EI to start up again. And its now Aug. 21st. Nothings happened. I gave them everything they needed and more and still nothing. I keep calling them and leaving them messages and no one cares to call back.

They really don't want to help me out huh? Any one here have this problem too?

This isn't the first time they did this to me. Before I left Canada my hours at work were reduced by A LOT and I had to go on EI which took me two and a half months to get. I had to go into my savings that I was saving up for my move to the US. They're a complete bullsh*t department, I honestly don't care any more. If my husband wasn't supporting me right now I would, honestly, be in major debt and homeless! Just completely fed up and frustrated. I don't want to deal with these people any more.


Start at the basics....are you calling the International EI phone number?? As wel as Email. Look at some of the above posters who have called and been successful---PM them and check to see what # (email)they are using. And if no luck, contact ur former MP back in ur old Canadian riding--and get them on it!!

Do you have a SSN and your green card in hand? I had to send them a copy of these documents before they would start my benefits. You have to prove you are legally allowed to work in the USA.
Also, because we live in the USA we don't get benefits for the full weeks, I think they cut it down by 2 weeks. Maybe someone else can confirm this. Once I did this it didn't take very long.


Person above is on a k1---they have to wait for work authorization (EAD) and she stated above that she faxed it in. But 1 of the slow downs for her/him may be that she started collecting EI in canada then moved to the USA--so now it has to go to the International side of the house. And it being summer--people are probably on holidays

Cards? I'm sorry I don't understand what you mean by "cards"? I never received a card from them. I just want to know when they'll start the direct deposit again. I just wish I could get a job right way, this EI is ridiculous, when I was living in Canada it took them two months to get my EI started and I had already gone deep into my savings. It's seriously such a joke. I hate having to deal with these idiots. They say they're on it and 5 weeks later you still get nothing.


Yes they mail you cards which you have to fill out and return. Can't recall all the info on the cards, but more or less asks if u have been looking for work---and if you have been working, how many hrs did u work, etc etc

Hmm I applied and sent back the form asking for information on why I'm outside of Canada. I sent that back two weeks ago and not a peep from EI. Is this normal or do I need to call around? I figure I would give them a few days because of Christmas but I'm getting antsy now.


Doesnt hurt to contact them just to make sure, but like anything else with the govt, things move slowly around the holidays

I applied for EI about a week ago and got the letter requesting additional information about my situation. I'm a K1 who hasn't married yet. The wedding is set for January 14 and we're filing for AOS a few days after the wedding. I entered the US on November 21. Applied for EI on December 5. Quit my full time job of 3 years on November 15.

I'm just concerned that given the fact that I haven't married and filed for AOS and EAD yet, will I still qualify for EI given that the K1 is not work authorized and I can't apply for EAD until January?


you just will NOT get any $$$$ until u get ur EAD. A few yrs back a few k1'ers were fortunate and got Ei without EAD, but I believe that was because CDN Ei people didnt know what a k1 was,lol

Question- Currently on trying to get EI (just started to apply, i work part time however i qualify for EI) planning on moving to the states with Fiance (k-1 visa) once I have my visa granted, can I still be on EI after I quit my part time job and leave canada?


1 has to LEGALLY be able to work in the USA. As a k1 you can NOT work legally until u get ur EAD! I would imagine you would have to Contact the EI people, and they wil stop paying u the EI $$$$$ until u get ur EAD! Always best to call them and find out the correct answer. Best of luck
