Hmmm, If one requests the RCMP to do a background check, BUT they are residing outside of Canada, doesn't the RCMP then require fingerprinting??? Thought I read that on VJ or on the RCMP.ca website, so that may be the cause if you are residing outside Australia?? Again no hard facts to back this up, just throwing it out there. One could always email Mtl and see what they have to say (not always good info, but at least u have a paper copy on what they replied!!)

Canadian Police check in Calgary should be easy enough to get if ur in Calgary!! Local police or the RCMP should be able to do that, ensure it is a CANADA WIDE background check. Some give the document to u right there, some take take a few days, some charge a fee, some its free. usually a very easy document to get!! No criminal record, no fingerprints required for Canada!!, No clue on Australia. The Canadian police check is good for 1 year for Montreal (where al Cr-1/IR-1) interviews are held

for cr-1, once you enter the USA and activate the visa, thats when the 2 yrs starts ticking. has NOTHING to do with your wedding date. On ur 2 yr green card, there wil be an expirary date, 90 days prior to that date is when you can first submit the I-751. Of course doesnt have to be exactly 90 days, one just CAN'T submit it prior to that.

I think one is gettign confused about the cr-1 and Ir-1, which one of those you get depends on the length of marriage,and yes if you eneter the USA and married 2 yrs or more, one should get the IR-1 (good for 10 yrs). But once you enter the USA on a cr-1 (married less than 2 yrs) u submit the I-751 90 days prior to the expirary date on ur greencard (not ur weddign anniversary) Best of luck

All depends with the DR if you can get the medical completed ahead of time or not! Some Dr's want the letter in the package stating you require the medical, some do not care. Just phone the DR and ask/explain the situation. Best of luck

If you check off the box on the form for the SSN (ds 230 i think) it should arrives 10 to 14 BUSINESS days! if not, head down to your local SSN office and inquire about it. Mine didn't arrive, so i just filled out another form (downloaded it from their website: http://www.ssa.gov/ week later it arrived in the mail

Montreal sets the dates for k1 (and maybe k3) but for cr-1/ir-1 NVC sets the schedule dates for Montreal. With regards to sending info, al the documents have already been sent, and NVC passes them to Montreal. Hopefully someone that has gone through the London consulate can help! or try the VJ search engine, try different words/phrases and eventually you should find some info.

I didn't DCF, just the regular CR-1 route. The last package (can't recall how many there were) had my interview date. I received NO packages from Montreal. NVC sets the schedule (at least for Montreal), thus Montreal didn't even know I existed until NVC sets the schedule!!

That last pkg conatined: the interview date, reminder to bring original documents IF one hadn't already sent in originals, medical information etc etc. As stated,that was in 2004, so things could be different.

I went through the cr0-1 back in 2004--so things may have changed. The LAST pkg I received from NVC was the package that had the interview date on it. As well included was the required documents to bring to the interview. I do belive most of those documents have already been sent in. They did remind one that if you didnt mail in originals, that the originals were to be brought to the interview. As well there may have been info on the medical. That was in 2004, and things may have changed. I'm sure someone with updated knowledge will pop in

I don't know much, but I do know NVC does schedule the CR-1/IR-1 interviews for Montreal. Not sure how it works when they transfer a case from consulate to consulate. Montreal seems to be a very slow consulate when it does come to handing out appts, that goes for the k1 and k3 visas as well. Best of luck

a Cr-1 is a multiple entry visa. Many canucks head to the nearest POE, activate it to get the paper work rolling and turn around and head back to Canada. As long as u have a USA mailing addy, u should be fine. Of course one can't stay in Canada for too long.

I came across a land POE, so I had an inventory of all the stuff in my Uhaul truck!!!

And yes, once ur passport (visa)is stamped, its good to travel with!! Its good for 1 yr, but you should have the actual greencard (looks like ur drivers license) way before then!!

cr-1 dont do the I-94 thing!!! Others will chirp in, but its a very easy process, just can be a bit time consuming, depending how busy they are! I went through a land crossing,so will let others chirp in about the airport! For tha land crossing all they did was take the mysterious brown envelope away, took my pic and fingerprints (again) stamped the page that had the visa on it and the customs dude looked at my inventory list and that was it. Very easy!!

The 3 yrs starts the day you enter the USA and activate the cr-1 visa. In my case it was Dec 17 2004. And the two yrs was up dec 17 2006. 90 days prior to Dec 17 2006, I had to submit the I-751. (doesnt have to be exactly 90 days, you just cant file it any earlier!!) My 3 yrs was up Dec 17 2007. 90 Days prior to that I could have commenced my paperwork for USA citizenship, but havent gotten around to it yet, but will be doing so shortly. In possesion of my 10 yr greencard (from the I-751) so in no hurry at the moment!! Cheers

ya, one has 6 months to use the visa!! If ya needed it extended, I'm sure ya could email Mtl and they could say yes or no! Once u activate it at the POE, it is good for 1 yr, but u should have ur actual card way before the yr is up!! And likek they said, if ya activate it after 2 yrs of marriage, you should get a IR-1 visa. Save ya some filing charges!

The stamp the POE officer gives ya is just an ink stamp, but it is the one that makes it valid for 1 year

What country is your spouse from?? Us Canadians do it quite often, and yes some do get denied, but most dont. Appears to be up to the POE officer. I travvlled monthly to DC while my cr-1 was ongoing, never had a problem. And if ur spouse is Canadian,do a search as this topic (for Canadians) must come up at least weekly. Best of luck

1 has 2 options:

1) 1 can apply on the DS 230, there is a box that requires to be checked off. BUT it doesn't always work! After 10-14 BUSINESS days after he activates the visa at POE, no SSN, then head on down to ur local SSN office and check up on it! I checked off the box, but never arrived. I simply just had to resubmit the SSN paperwork, the form can be downloaded from http://www.ssa.gov/

2) just simply apply for the SSN when arrive in the USA. One might want to wait a week or two to ensure your in the system. Again download the form at http://www.ssa.gov/

Guess it depends. If she told the truth or if they caught her in a lie, and how they wrote up the incident!

I can only speak of Canadians! But I know some do get denied entry while trying to visit their spouse and it causes no harm to their visa, as long as they told the truth, they simply get turned around and not let to enter. 99.9% of Cdn airports have USA POE there ( Saskatoon doesnt) so when they get denied, they are still on Cdn soil!

Since you live in Vancouver, ur K3 interview will be in Van, but ALL CR-1/IR-1 interviews are in Montreal! Vancouver seems to be a lot faster at handing out interviews, so it may be faster to go the K3 route, but that isn't always the case! NVC assigns the interviews for the CR-1, Mtl doesn't even know u exist until NVC assigns the interview. We (back in 2004) did the K3 and CR-1 ( I resided in NS, so was going to Mtl no matter what!!) and my CR-1 was completed (including interview) much faster than the K3(actually got a NOA stating my K3 had been approved--had already resided in the USA for 4 months,lol)

In reality, the K3 should be faster, it is a multiple entry visa, but one doesnt have work authorization right away, where as the CR-1/IR-1 does. When it comes to process times, its anybodies guess. Like I stated the K3 "should" be faster, but not always the case!! Can be a frustrating experience. 2 people can start the process exact same times, go through same centers, yet finish months apart!! Normally they would ask me if I was coming down for business or pleasure I would state pleasure and would return on so and so a date, and that was it. I never had to state if i was coming down to see my wife, and I didnt give it out, lol. Again it all depends on the POE officer. I presented myself well, didnt travel with lots of luggage, thus never gave them the impression I was intending on staying, which of course I didnt until we got the visa. And they never did ask to see any of the proof of Ties to canada, but I had them ready, if they did ask. Most likely you won't have any problems, but there is no gaurentee. Best of luck

Been covered a zillion times here on VJ, so if you do a search you will find many had no problems like myself, while other have been denied!! It pretty much is up to the POE officer. If he thinks you may stay and not return he may deny you entry. I travelled montly to DC while my cr-1 process wa songoing and never had a problem. Nring Ties from Canada, lease, letter from employer, and have a back up plan in case you do get denied. Be honest when ansering the questions but dont add on to much! best of luck

When my wife and I first started to look into the immigration thing we visited an imigration lawyer here in the DC area for a free consultation. She told us to do pretty much what the OP was told. For me to stay in the USA, get married and adjust of Status. Well that wasnt possible because I was still in the Cdn Air Force. She tyhen replied when your out of the Air Force just move to the USA and adjust of status then!! That sounded wrong, and I inquired that I could bring all my personal belongings with me?? She said to just tell the border crossing your on your way to Western Canada and just cutting through!! hmmm, no!! I hadn't found VJ yet(didnt tell we were almost complete) But the info all sounded wrong. My wife at the time worked for the Dept. of State (not with immigration) did some of her own research and found the lawyers advice to be way offline!!
Each their own, if you want to do it illegally and take the chance of being deported thats your own doing. If it comes back to haunt you, you only have yourself to blame.

For the greater toronta area goto http://www.commissionaires.ca/ belive it takes 3-4 days. They do a CANADA wide check, thus you only require 1!! You stated you have NEVER had a criminal record, thus no finger prints are required,just the canada wide name background check. cheers

My recommendation is take some time and go over the stickies at the top of the K1, K3 and cr-1 forums and the + and -'s of each!!

We used a lawyer, paid $2500 I belive plus filing fee costs. Know what the lawyer does in straight forward cases? Just gathers the papers and double checks everything!! You still have to fill it in,gather the long form birth cert, criminal background check,etc) Simply put, you do all the real work, they just gather the papers!!! Yes, there are cases when a lawyer could assit, but they can't make the process faster.

VJ is a super resource, so take time and look around and ask away. Mostlikely 99.9% of the time the question has been asked before so use the search feature. Just keep in mind there is great advice on here, and not so grat advice, lol but thats expected from a forum. Best of luck
