How about contacting the Montreal consulate directly and ask them - the case officer is the only one in a position to tell you. I have contacted Montreal many times when I was not sure how to proceed, and they always helped.
I don't think it has anything to do with where you were born. Clear your mind from suspicions. I can only imagine that they are conducting the usual investigations in your home country to satisfy any discrepancies.
You have mentioned that "Once the interview was done, he handed me a welcome letter and told me I should get my visa within 4 to 5 days" - did they keep your passport for visa ?
As far as involving congressman, senators etc. are concerned, I wouldn't even bother going that way.....



Dont contact ur congress person//senator----what do you base that on?? Others in a similar position have and have had luck. The Big obstacle for the Op is--where he is born! We have seen this many times here on VJ---A Canadian--yet born in a country that doers not exactly have friendly terms with the USA--gets put into AP!! Always best for the USA citizen to contact their Congress person and then senator--yes mot not do anything, but in the past, it has!

I am a Canadian citizen and my wife is a US citizen. I had my CR-1 Immigrant visa interview at Montreal consulate in September 2012. My interview was 10 minutes long and the interviewing officer asked me basic questions about our relationship etc. Once the interview was done, he handed me a welcome letter and told me I should get my visa within 4 to 5 days.
Instead, I received a letter from the embassy in mail saying that my case has been put into administrative processing. It has been five months but no update. I involved congressman but they couldn't do much. their response is "the case is still undergoing administrative processing".
They told me my case is documentarily complete and didnt ask for any further documentation.
Can someone tell me why the case is in AP and how much longer it can take? Is this normal..This is really frustrating.
Also I was born in Pakistan...not sure if this has anything to do with this. Please help.


You answered your own question....Where you were born!! I'm not saying it is right. If ur congress person is useless..next up the line is your Senator, so the USA spouse could contact them.

Each govt organization has their own rules for granting security Clearances...and one doesn't have to accept the others clearance...and if they want you bad enough, they may grant a waiver.

Well if NVC takes a long time to close the case (cr-1) than it might make sense to go with it since it will be at the consulate soon and since the I-130 still hasn't even been assigned a case number yet, but who knows. Thanks for ur reply though

My memory is pretty much useless, as it was back in 2004 for me. Back then it sort of depended on which got to a certain point first and then you went that route, I don't believe you really got to pick. You submitted for both and just went with the one that got to the finishing point first. In our case, the CR-1. Sorry not much help!

I really hope they go by how many applicants in each visa category they have, I mean it wouldn't really make sense if they schedule K3s far ahead than CR-1 applicants since it's supposed to reunite spouses faster hence it's a non immigrant visa!! Ughhhh every step of this process is stressfulllll and not being able to find an answer to my question frustrates me! :bonk:


That hasn't been the case for years, thus why k3 is pretty much dead. Like I stated before, the only time in Canada where it made any sense to do a k3 was if you lived in Western Canada and able to goto Vancouver...otherwise, best to go cr-1

I really hope they do base it on how many k3 applicants they have when they are scheduling interviews, yes I know K3 visas are rarely given and the only reason ours survived was because NVC received the I-129F a week before the I-130 and had the chance to process it and send it to montreal, I wish somebody could tell me which one would reunite my husband and I sooner since we have the option to choose right now, thanks for your reply anyways :)


Hard to say, since we haven't had any K3 people post here in ages. Everyone's situation is different so its sort of up to you which route to go--there is alot of differences between a k3 and a cr-1--cr-1 is a far superior visa in many ways--greencard quicker, can work right away, travel easier, less Govt paperwork etc etc. Time-wise its probably going to be the same!! NOW if you had been going through VANCOUVER (yes they do k3's) they are a much faster consulate, so maybe it would have made sense to go the k3 route.

they didn't close our K3 route as I mentioned in my original post, the estimate you're giving me is for immigrant visas and as K3 is a NON-immigrant visa I figured they would schedule K3 applicants based on how many K3 visa applicants they currently have which has nothing to do with CR-1/K1


If they based i ton how many K3's they had, you would probbaly have the interview very soon,lol Been awhile since Anyone has even mentioned the K3 in the Canada forum. Back in 2004, we sent both in and the cr-1 beat it out!! Had moved and been residing in the USA for about 4 months when we got info on the k3,lol Best of luck

I may be wrong but from what I understand they basically "kill" the K3 partway through and it becomes either a CR1/IR1 or a K1. CR1/IR1s have interviews assigned to them and K1s schedule their own interviews, either way it takes about 4 months or so from NVC to the day of the interview. Doubt you'll receive your interview sooner because of the visa type. The reason it takes so long is because Montreal is a busy consulate.

Ensure you read e the GUIDES on the CR-1 forum..as there arer plenty of clueless lawyers...To bad you had not found VJ prior to hiring the lawyer as it is an easy process..and a lawyer does not speed it up..just sucks $$ out of ya,lol  I know as we hired one..and then found VJ (back in 2004)  But do yourself a favor and know the process----as no one cares more about your visa journey--than you.

 

I traveled to DC almost monthly from NS, never had a problem, and always told the truth. Ensure you have proof that you are going to return (airfare, letter from employer, etc etc) I always had it with me, never had to show it. My 2 cents is down below in my signature!!

Since Vancouver is normally a much faster Consulate, it could be to ur benefit to go the k3 route, but there may be other obstacles that slow it down.

We had time on our side, even though back in 2004 the CR-1 took around the same time as the k1, maybe just a tad longer.  When you sat down and compared them, just sort of made more sense to go the CR-1 route. Why give the gov't more $$ than you have to,lol  And it for us it didn't really matter being married and separated--going to be separated anyways,lol

When you do your USA taxes---don't forget to report any RRSP's you have still back in Canada--on form 8891 I believe. And I do believ you have to notify whoever holds ur RRSP's (bank etc) that ur moving to the USA

Just because they do--does not mean they are competent!! in Arlington VA--I talked with their USA/Canada EXPERT---he was clueless, so ensure you do some research on your own. Doing Your Canada taxes is very simple, I'm sure most tax programs can handle it. On the hard copy (1st page) is a place where you enter the date you CEASED to be considered a Cdn resident. Calculations are based on that--which the computer program would handle! Lot of info down below.

LOL I love how they have BMO in front of the name and can say "We're not affiliated" Actually dude, you are. Have you checked your name recently? Do you know what BMO stands for?" Morons. Anyhow.... I'll probably just switch to RBC. it seems to be the best option even though I've been with BMO for so long and no matter what, there are NO branches or atms from any Canadian bank anywhere close to where I will be living. I just want to make sure I have a Canadian bank account for visits, to send my kid money, to receive money from important people and to keep a credit line there for if we ever move.



Lot of companies that have the same name are not really affiliated--such as Honda Canada and Honda USA! You buy your new Honda in the USA and take it to Canada--even though it brand new--it no longer has a warranty!! As they say they are two different companies! My 2011 CRV we bough tin the USA and brought to Nicaragua--again has no warranty--even though they have a Honda dealership here!!

I'm with President's Choice and do not pay any extra fees for using my MasterCard here in the US. When I called PC to tell them I was moving, they did tell me that I'd need to close my credit card account with them eventually as permanent residents of the US are not supposed to use their Canadian credit cards. For now, it just has a travel advisory added to the card so that it my purchases are not flagged and card blocked. They did tell me that I'd have issues getting a new card when this one expires but it isn't until 2015 so I hope to have everything figured out by then.

My plan is to keep my Canadian checking account (debit card) but eventually close out my credit card.



For PC--I just use my parents addy in Canada! I closed out my mastercard with them yrs ago, but kept open the chequing acct

No, you are using a canadian credit card in the US therefor you are most likely paying the 3% international fee, at least that's what it is for visa when I use in canada.

One can't make a blanket statement--some banks care, some do not--each have their own policies!! I know my capital one CC charges me no fees while in Canada, Nor here in Nicaragua and a good exchange rate! But if I use my citi bank CC, forget it--they love their fees!!

Keep an eye on the news over the next year. The VISIT-USA Act which has not yet passed, would create a Canadian “retiree visa” that gives Canadians 50 years of age or older the ability to enter the U.S. and reside here for up to 240 days per year and is renewable every 3 years. While it doesn't help your situation now, it could give you more leeway with your time in the future.


Is that just a USA thing?? As once one has stayed over 180 days--one can loose thier Cdn Health care benefits

So here's an interesting question a friend from Brazil just asked me. They knew I voted in the election here, but then asked if I voted in Canada too. I told them I have never voted in Canada and even if I wanted to, I don't think I could because I thought you had to be a Canadian resident to vote in their election.

Is that correct or can any citizen vote in their election regardless of how long you've lived out of the country? It made me wonder, not that I'd ever vote in their election, but now I'm kind of curious how that actually works...


One can still vote---if they have the intention of returning to Canada--I think its within a 5 yr time frame!! I believe its done on the honor system!!

I had my interview in Vancouver and they did ask for evidence, thankfully I went prepared. I had pictures, travel receipts including airline ticket stubs and hotel receipts, half a dozen pics some crudely printed from a ink jet but photos nonetheless, cell phone records, birthday cards and so much more. My interviewer shuffled through them quickly and I got the sense that I could have got away with less. My one piece of advice, however is this:

Don't leave ANYTHING to chance. You're always gonna have room for a few extra sheets of paper and will not regret being over prepared.

A guy ahead of me sadly was declined because of lack of evidence so don't listen to people on here who say they rarely ask for it. Maybe it's true in their cases, but don't cut any corners!


No 1 here has said not to bring evidence. It is true that Montreal (u went to vancouver and ur a k1) rarely asks for evidence, but 1 should always be prepared, and have evidence with you, just don't need tons of it

KISS--Keep it simple Sh..... 99.9%%% of the time they don't ask for any evidence at the interview. The interview itself is super quick,lucky to be 10 minutes and a lot of that time is silence! So bring quality over quantity! Some like myself, bought a plastic accordion binder--the ones that have like 12 or so slots in them. So you can nicely arrange everything (and keep ur immigration stuff you wil need for later down the road) I brought a few pictures of us together, and with her family, she with my family, travel receipts, letter from her mom. That was about it, wasn't a lot, but it was quality. They never asked to see anything...but yes, it is best to be prepared.

No--the cr-1 usually takes longer than the k1, sometimes twice as long. If you click on soem of the recent cr-1'ers that are just getting their interviews in Dec--they started the proces in Jan.
