Removing Conditions on Residency General DiscussionCouple of small questions; wording, and tax transcripts.

Just about to file for ROC, and a couple of minor items:

Who is/are the "petitioner/s" here? Are we both petitioners? Is it still only the USC who is petitioning on behalf of the alien, or, as we are "filing this petition together"(as per the wording on I-751) can we say we are both petitioners? Seems like such a silly point, but I don't want any confusion with how we are referring to ourselves on our cover letter.

With regards to tax transcripts - should we send the originals, or copies? We made photocopies of them and were going to send them (and of course they do ask for copies of all your evidence, not originals), but when it comes to transcripts that we could potentially re-order, should we send the originals? What did you do?

In the cover letter, I put both hubby and myself as senders and we both signed the letter. After all, it is a JOINT petition. If you acquired residency through marriage and you ar still together, you and your spouse must file jointly
according to the I-751 instructions.

As for the tax transcripts, I made photocopies of the transcripts only and sent those along with the letter attached by IRS. Did not photocopy the letter itself. I am keeping the original transcripts...am not good at waiting for another transcript :star:

Got a letter from USCIS addressed to my daughter verifying her as being included as a dependent in my ROC. Notice says her green card's validity has been extended. Is this the NOA1? I have not received mine. :unsure:

My name appears as "principal alien" and there is a "Principal receipt number".

You know, you are absolutely right, and I start to doubt everything myself once again lol

Thing is, I read several forum posts (both here and elsewhere) where people actually stated that they didn't list their children because the children were not seeking removal of conditions and everything went fine, and also posts from people who have actually listed their children (both US citizens as children living abroad, both not seeking removal of conditions) and they were asked to pay an additional biometrics fee of $85 for each child separately.

I just did a quick Google search, as I am completely doubting myself again... Here's one of those posts that make me think it isn't necessary to include these children:



But, yeah, the same forum where I found this text, also had someone saying that 'all' actually means 'all'... *bonks with head into wall* what oh what is the right thing to do :S

To make it a bit more confusing, here's a link to a thread on the visajourney forums, where people are debating the same thing: http://www.visajourn...tion-on-part-5/ ...it's kinda sad they didn't continue on with this thread, as to see what the outcome was for the various people who posted in there, as several should have their 10 year GC by now, or have gotten an RFE with whatever choice they made.

You know, I am going to change my petition, the envelop is still open as I didn't make my cover letter yet and didn't make copies of everything just yet (just reading up on stuff to make sure I file the right stuff) and I am going to add both my Dutch daughter who lives with her mother and my US born daughter (born out of this marriage) on the petition. I hope it is the right thing, but from what I read, it should be. I will add a supplemental paper to the whole package, stating that none of these children are seeking to have their conditions removed or something like that as the youngest is a US citizen, and the oldest is living with her mother in the Netherlands and will remain doing so.

I cannot tell you what to do, or what the absolute answer is, but if you are going to follow my example and interpret the question as 'all' children as well, then I urge you to also add the US birth certificate and every possible documentation you have :)


Geez.....USCIS should make their instructions more detailed... :bonk: I was wanting to know so I know how much to put on the check that I will be sending along with the I-751. $85 can buy at least 500 diapers or 5 cans of formula....

yeah, i guess you should send everything rather than get a letter from them asking for more stuff.

From what I understand, you only need to include children who are actually filing removal of conditions together with you. My wife and I had a baby in 2009 but we're not including her either as she is a US Citizen through birth. When you use her for proof for a bona vide relationship, I wouldn't worry about the PH BC either, the US BC should be enough for them :)


She arrived with me on a CR2 visa. Was my husband's stepchild till he adopted her. In her US BC she carries his name, her surname at birth now being her middle name.

Doesn't the form read to list all children?

My daughter was adopted in July 2009 and we now have her new US birth certificate along with the adoption papers. Still need to include her Philippine BC? Also, do we need to include her in the petition and, thus, in the biometrics payment? I have tried calling USCIS about this but nobody can give me an answer. :unsure:

Question: I have ITR's for 2007 and 2009. Hubby did not make a copy of our 2008 one (said he forgot). Is it ok not to have it? What I did was I went thru our bank statements and found the one that shows the tax refund we got for that year. Made a copy of that statement and highlighted it and put a side note. Of course, I will note that on the cover letter as well.

Filing either in the next few days or within the next 2 weeks. My 90 days starts Jan 7th. Hubby is an extension of my credit card, not exactly a joint holder, and I am waiting for a letter from the card company saying so. Is being an extension user just as good as a joint holder?

We went in August 6. Kids are given tuberculin skin test first. If its negative, then they wont do Xray anymore. If positive, they have to do the Xray. My son is 3 years old by the way. If negative, you proceed to immunization. If positive, then Xray... then there will be 3 readers who will read the Xray. If you are lucky, you get the result on that day. If not, they will ask you to come back the next day. In our case, we got the result at 6:30pm already (August 7).

At the immunization interview, the first assessment was only 4 vaccines will be given to my son then they double checked so it got to six. I brought his immunization record and there were some that were already given that they did not accept. One reason was, the vaccine should be given when he was one year old. My son's bday was april 29 and the vaccine was given april 8. And I was like, "Ok, so it was 20 days earlier before he turned one... was that a lot of difference? And the doctor said yes. In as much as I want to get a second opinion, I felt like ok fine cuz I read in the internet that getting the same vaccine wont hurt you.

Now, about the six shots....hmmm...up to now, Im still bothered with my decision. I think you can have two each day. In my case, the doctor said its fine. There are kids who went thru six injections and they were fine. I was the first to get the vaccine... and I felt nothing! So I was thinking, its not that bad. And there was this kid whom my son befriended there and they were of the same age. He got five shots, screamed and cried, and after that he was ok. My son was next, six shots, screamed and cried and then he was ok. But the thing is, he got traumatized.


Hi. I, too, have a 5-year-old daughter with a low pain threshold who refuses to go back to her original pediatrician simply because each visit to her means another shot. How exactly do they administer the vaccines to children? How do they do the Mantoux (tuberculin) test? I had to struggle to keep my daughter's arm straight for what had been the one time she had to have a blood exam. Come to think of it, there were 3 of us (2 med techs) who had to hold her down, so that I know that there are going to be problems should she need to have either the skin test or the additional vaccines.

Also, is it advisable then to go and have the medical exam done as early as possible prior to the interview date? I am a newbie here and I have paid notice to the timelines on here and it seems that medical exams were done within just a few days till the interview date.

Usual wait is 14 days. I had mine done thru my cousin's travel agency. Apparently, since the new passports are machine-readable, you may need to make a personal appearance, more so if you are renewing your child's visa (if you have a child, of course). Also, passport renewals for fiancees or spouses of foreign nationals now require a CFO certificate before they grant you a new passport. And you will not be allowed to leave the country without that certificate too.

You still have a lot of time but go ahead and get to it. smile.gif

Well, if you are getting married, then why not just renew her passport (even if it has not expired yet) in her married name right after the wedding? You will need an NSO copy of your marriage certificate. But the thing is, you will not be able to get that till, say about 6 months. After your wedding, soon after your marriage is registered, get a CERTIFIED true copy from the local registrat authenticated by the NSO on security paper. You may want to get a few copies as you will need those in filing your petition/s.

Also, she will need to get a certificate from the Commision for Filipinos Overseas prior to renewing her passport or leaving to join you. See www.cfo.gov.ph ( if i am not mistaken). I just did these last friday...was not a pleasant experience as I did not know till then that i could not renew my passport in my married name without it. Thankfully, i had all pertinent documents with me.

Well, i just had the front photocopied. That is the more important...yung makita nila yung face mo and other more pertinent details. Now, if you had travelled outside the Phils, it would not hurt to photocopy those pages too.

There will be a general orientation then you would be broken up into groups, depending on what your destination will be for a short orientation then you will be interviewed one at a time. Php250 for the counseling and Php400 for the certificate at CFO.

A note of importance (believe me!): Before you bring your yellow PRISM certificate back to the CFO office, do photocopy it at PRISM already...well, there is one beside PRISM. Walang malapit na xeroxan sa CFO. I had to take a 10 minute pedicab ride to and from CFO to the nearest copier and it was not a fun ride. wacko.gif

ting, they should've given you the certificate already. I was also asked about my husband's divorce but was not asked to show papers. Depende yata sa mag-iinterview sa yo kasi yung ibang interviewer, hinanapan pa yung applicant ng pictures kahit nga matagal na sila magkasama.

Anyway, bluemist, no consent form needed. Basically, this certificate is needed even if you are just applying to the passport, ke mag-mimigrate ka o hindi, basta's your spouse or fiancee is a foreign national, kelangan mo. Will affix the CFO sticker pag may visa na. And DO NOT lose the certificates from PRISM and CFO kasi pang-habang buhay mo kelangan yan. Kahit may visa ka and a plane ticket, if Philippine immigration does not see those papers, di ka paaalisin. If you have a child traveling with you or later on, basta below 13 years old sticker lang and kailangan with the visa, of course.

She'll probably be asked: what is your name? how old are you? Is she your mother? who is this? (while prescreener or consul points to your husband's picture)....

BUT then again, they wont even bother to ask her anything.. prescreener or consul would probably just look at your daughter and then ask you, is she your daugther? what is her name? how old is she? how does she feel about your husband (if he is not your child's biological father)

My kids are are 10 & 8.. and basically the prescreener only asked them their name and age and the consul didn't bother to ask anything, he directed all his questions to me.

They don't grill kids so don't worry about it. Just make sure your baby have something to occupy her time while you will be waiting for your number to be called and also bring a little food and drink for her (liquids are ok as long as you keep the seal tightly intact before you pass the guard)... and also don't forget to bring pictures of you and your child when she was a younger like newborn, 1yr old, 2yr old, 3yr old.

Thanks dbears. That helps a lot. I had been conditioning her for both the interview and the medical. Basically told her that we need to do these so we could go to Daddy's house. She is a bit hesitant with the pending injections though and asked if she could just get them from her doctor. I told her that she couldn't, of course. Hopefully, she would not put up much of a fight when it comes to that.

Can't understand the PPD thing. First of all, most Filipinos will have a positive PPD test because, well, they are in a place where TB is prevalent. Secondly, is it NOT the gold standard for diagnosing the presence of TB; an AFB culture would. I should know this as I had screened patients for PTB. I guess their protocol is different....mga praning biggrin.gif

Just how much proof should be presented in providing evidence of our relationship? I've got hundreds of photos, approximately 873 pages of YM chats (legal size paper, back-to-back...and that is just from May 2007 to May 2008), about 300 emails, 4-inch thick stack of letters/cards, the guestbook from our wedding reception as well as the financial details of it, joint bank accounts and credit cards. Oh...and a 128-picture wedding album. biggrin.gif My husband and I had been debating a bit on this issue, especially with the chats. We need some insight.

I know exactly how you feel. Ryan and I had spoken to each other thru emails, chats, phone calls for more than a year before he came to see me...and he says it was the best decision he ever made in his life. I was excited and nervous at the same time and the very moment we came face to face it was magical. I am very sure it will be the same for you.

We did not go around much as he preferred to stay home with me and my daughter. He had only less than 3 weeks of vacation leave. We were engaged within 9 days of his stay here and that weekend, we went up to Sonya's Garden in Tagaytay. Is a bed and breakfast place and it was around July when we went. Is very serene there and set teh perfect scene for our little getaway. Took him for a boat ride to Taal too. But be careful of the boat contractors by the roadside. If they see him, they will give you a steep price. We were given 5T and it was too much so we went to another. When we did, the first one ran after us and brought the price down to half. I asked for 2T and he agreed. blink.gif Bora would be fine or bohol but with the fickle weather, well, I don't know.

Anyway, I am happy for you. Enjoy every second of yoru togetherness. The best of luck and happiness to you. And God's blessings too! smile.gif

I'm sorry to hear this. They're checking for TB I suspect. I don't know if that's true about how long it takes to find out the results, but if they're going to call the Embassy, I'm sure they'll do so if it does take that long.

Someone here said you're not supposed to go to Medical with a cough or cold? Whoever told you that? The testing that the OP is having done has nothing to do with the fact she has a cough or a cold. Now, maybe I'm wrong, and the physician is alerted to possible problems if someone does have a cough or cold, but wouldn't you want to know ahead of time if you had a problem and undergo treatment?

I hope that the sputum tests come back without any problems.

I'm sorry you have to go through that. Yes, they are checking of pulmonary TB. I believe they are doing what we call a sputum AFB smear to check for the TB bacilli and it is normally done for 3 consecutive days. Am not sure why it would take two months though as one only needs a microscope and some special stains and should be ready in a week or so. Unless they are trying to grow whatever it is they find. TB bacilli are hard to grow and if they do grow, they usually take a long time to appear. The Philippines is practically TB country so that they are not taking any chances on the disease finding its way out to the US, hence the strictness when it comes to anyone with a cough or cold.

Meantime, focus on getting yourself well. You will be united with your man sooner or later. biggrin.gif

I guess you could think of it in the context that most commodities in the US cost more than they do here. A doc's monthly income in the US DEFINITELY surpasses a doc's income here more than 10 times over. Then again, HPV vaccines were given out earlier in the US than here.

I am a bit wary of the HPV vaccine though as there was a study done in Texas about the incidence of sterility in some girls who were given the vaccine. The study caused the mandatory vaccination agains HPV to be reviewed. I have a little girl and I definitely want to have grandkids someday.

Anyway, this is my two cents' worth.

I think it depends on how meticulous you are in preparing and providing all the necessary documentation from early on. In general, however, immigrant visas applications take a longer time to leave NVC than K visas. The embassy is only acting on what they get from the NVC in both cases, so that ideally, there should be not much difference as to the final processing. Then again, I would think that since immigrant visas are virtually going to be THE ultimate visa (i.e. green card), they would scrutinize everything as closely as possible.

They were very nice and accomodatingm unlike the USCIS people, and were surprised as well as to the speed of our approval. We were told to just wait for our respective letters for further instructions. Yes, we have decided to abandon our want for a K3/K4 in favor of the CR1/CR2. star_smile.gif

My hubby has completed his I-864EZ and I just need to get my NBI clearance. Otherwise, we have everything ready when the missives from NVC arrive and will send them all that they ask for, this time via courier. Will never send thru post again mad.gif

if i'm not mistaken, i guess the derivative status of the child from the beneficiary only applies if the child was born to the USC parent or if the visa category is K. i'm kinda confuse on this though. but try to browse on some profiles here. they entered the US on CR1 and their child was CR2, just not sure if the child was the USC son/daughter but they might be helpful.

in my case, our little boy was "our" son so we applied at the USEM for US citizenship, no prob there. so when it comes to derivative issues, i get kinda confuse, but i will try to research further so i could give you some inputs just in case..


I guess it's pretty clear-cut for us what we should do. My concern now is my daughter's. Are her requirements differnt from mine? Am i going to sign the application for her? She is just 5 years old.

My husband called NVC this morning (around 10:30pm Eastern) as he couldn't wait till morning to call them. He was told we had a case number already smile.gif Can I do my NBI now? I understand that NBI is valid for one year. Or shall I wait for the packet that NVC will be sending?

Thank you! We have already started gathering all papers and documents since we started this journey. We are at a loss right now, though, as we were caught by surprise with the speed of the approval which is quite unusual. Maybe it was the 100+ pics he sent...USCIS must've snickered a bit biggrin.gif

CR" stands for "Conditional Residency". IR stands for “Immediate Relative”.
If you are married less than two years, that would be a CR-1. You need to be married two years for an IR-1 status.
You file for a CR-1 by filing an I-130 form..which you already did and was approved. A CR-1 enjoys all the benefits as an LPR does, except, both you and your spouse will have to file a petition together to lift the conditional status 21 months after you became a conditional resident (3 months before the conditional green card expires).

Please note that if your marriage is less than 2 years, you will receive a conditional green card which will be valid for 2 years. You and your spouse MUST file form I-751 (Petition to Remove the Conditions of Residence) jointly 90 days before your green card expires.

My child is from a previous relationship. I was never married to the father nor does his name appear on her birth certificate. Nor, too, has he ever shown interest or given any support to her welfare. My husband loves her as his own and they are best buds. smile.gif

with the current turn out of events, YES, you can't file for I-129f anymore considering that the I-130 has been approved. as i have explained above, the I-129f(K3 route - for spouse) should have been submitted way back when the NOA1 was received. your case will now be moved to NVC, if you insist on submitting the I-129f, the USCIS will simply disregard it since it doesnt have an I-130 to pair it with anymore (since your case - your papers are NOW with the NVC).

not USEM. papers go through a certain chain of offices before you get your interiew:

FIRST : USCIS (Application Phase)
SECOND : NVC (Security and Background Checks, Visa Application Payments, etc)
THIRD : USEM (Final Interview, Medical, Local DV)

USEM doesnt disregard anything, they simply are recieving what the NVC has given them. do their own verifications and decides if the beneficiary gets the Visa or not (Passed or Denied). your papers will not get as far as the USEM if the USCIS and NVC has not PROPERLY SCREENED all your documents. but if youre asking if the K3 application will be waived, YES. it will be, believe me..

we all want everything to be fast..me too, lol. however, the visa category you and your daughter are in now, though a little time consuming (approx 8-11months) is much more hassle-free when you get to the US. if your visas will be granted, you won't have to submit for biometrics and pay 1,010 USD. you will be automatically granted a 5yrs or 10yrs visa (depending on how long you and your husband have been married).

You can track your papers thru DHL so you have an idea when ur papers receive by USEM...reference number should be like this " EXP 19 AUGUST2008" Once USEM receive ur papers from NVC give it 3 to 5days before calling for interview appointment because they need to encode your case first to their system.Then you can go for medical anytime u want except on holidays and atleast 1week prior to ur interview...you can do it a month or weeks earlier.

Ur husband can call NVC for the MNL case instead of waiting for the NVC letter that sometimes takes a long time.Then when NVC give ur case number thru phone..you can now pay document verification.

the application for I-129F (K3 route) should have been submitted right after you received your NOA1 which was last 31st of July. TRUE, you will be notified, but NOT the USEM just yet but by the NVC. they will send you DS-3032 (Choice of Agent) for yo to proceed with the visa process (now, understandably on the CR1/CR2-IR1/IR2 route). it is best that your petitioner (who has an address abroad - USA address) be your Agent, that is if you have NOT hired an attorney to assist you through the whole process. next comes the fee bills for the I-186 and Immigrant visa application...so on and so forth..
