IR-1 / CR-1 Spouse Visa Process & ProceduresNEED HELP WITH MY CHILD'S CR2 APPLICATION
QUOTE (jimandjosil @ Sep 19 2008, 06:41 PM) <{POST_SNAPBACK}>
if u were never married to the biological father then it will not be a problem, they will not ask for the consent from the father. check out the updated rules of dswd in the philippines. just google it.

I read it and thank you. So, it is okay for me to put "N/A" then? I consulted my uncle who is a lawyer and he says that "not registered" is a more proper term than "N/A". The father's name does not appear on any of my daughter's documents, not even on her passport application. I had to execute an affidavit of illegitimacy for her passport.

IR-1 / CR-1 Spouse Visa Process & ProceduresNEED HELP WITH MY CHILD'S CR2 APPLICATION
Hi guys...

We need some advice regarding my child's CR2 visa application. Her biological father's name does not appear in ANY of her documents...her birth cert, baptismal cert, even her passport application. Question #15 asks for her father's name and 16, his birthdate, birthplace and current address. My concern is, what am I supposed to put there? My husband called NVC and they said that I should put his name there and all the other info that i am unsure of as "unknown", but if they see that and they do not see his name on her documents, my fear is that they tell me that I should get a consent to travel from him first. I do not honestly know where he is right now. On the other hand, if I do not put his name, would they question that too and say that it is impossible that i do not know who her father is, and eventually say that I committed some kind of fraud? A friend put her child's father's name on the child's form and they did not allow trhe child to go with her until she got the father's consent...and she did not know where he was. Until now, she still cannot bring him with her.

We really need help on this. I have till next week when my NBI will be released and I send our applications to NVC. Please advise us on this. We would be extremely grateful.

Thank you in advance.

Thank you so much!!

I am also confused about the Police Certificate! What is it? Does my wife in the Philippines just go to the police department and ask for certification that she has been a good girl? I am just trying to know what she needs to do so I can inform her to get this done as soon as possible. thanks in advance.

I understand that if she has lived outside the Philippines for more than 6 months, then she must get a police clearance from whatever country she came from. Otherwise, she just needs the NBI clearnce that says "no derogatory record". I played it safe, though, and got both. My police clearance, I got from Quezon city Hall, since I am from QC. Nothing wrong in playing safe, i would think. It wouldn't be nice to get an RFE just because of that. As for the NBI, she will be given two copies, one will remain with her as her personal copy, so that she would have an original of it too.

IR-1 / CR-1 Spouse Visa Process & ProceduresBest way to mail papers from Philippines to NVC
Hi! What my husband did was that he had them email the receipt of the online IV Bill payment to me. From that email, i was able to download the cover sheet with the barcode and I then printed it. I also downloaded the ds 230 parts 1 and 2, one copy for myself and another for my daugter. Am just waiting for my nbi and I will be sending all the paperwork out to my hubby via courier for his review before passing it on to NVC. Apparently, we have no patience for waiting...just like a lot of us here. All bills were paid online as it is faster. October is too far away, methinks. I would suggest she start geting her papers ready and dowloading the forms herself and send them out to you.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 for a child too?!?
My husband and I wanted initially to file for a K3/K4 for myself and my daughter. He spoke to USCIS and asked if he would need a separateI130 for my child and he was told that yes, eventually, she would. So he decided to go ahead and file one for her. You need only to add the child's birthcertificate and you and your spouse's marriage certificate, which would show the stepdad-stepchild relationship. If you are going for k3, you do not need to file a I129for the child as her name will be reflected anyway in your wife's I129F. File the I130's together.

And you can always call USCIS for further queries.

Yes you can if she is not entering the USA using a K-4 visa, if CR-Immigrant visa then yes.

If SSN card fails to arrive 30 days after entry, then visit SSA office and apply for SSN.

Question: Daughter or Step-daughter? If daughter you could register birth abroad and be issued US Passport, no DS-230 for daughter.

She is my daughter; my husband's stepdaughter. she is entering via a CR visa. smile.gif

Well then she will be eligible for a SSN upon entry

Hi all!!! I'm also gathering all requirements for my DS-230. What i have are these:

1. NSO birth certificate
2. NSO marriage certificate
3. Photocopy of biographic page of passport
4. Police & NBI clearance in married name
5. 2pcs 2x2 visa photos (white background with case #, my name & birthdate at the back)
6. DS-230 form

In #20, the form didnt say we have to send police clearance of all the places we had lived since 16 y/o, right?? I am from Bacolod originally & just transferred to Makati for college & lived here since so this #20 + police clearance is making me nervous, hehe! I really hope i don't have to go to Bacolod!!

Well anyway, i have sealed my envelope & will send the package to my hubby now. Once he receives the IV receipt (& barcode), he can mail the package to NVC asap.

Hi! Seems that both our papers may reach NVC at the same time. I gave the courier my papers Wednesday morning and they are supposed to have flown out today en route to my husband. He is looking to send it out to NVC Saturday morning, after attaching a few more docs to it. He is attaching a copy of my CENOMAR as well to prove that I was not married when I had my daughter. Sent him NBI's in both my maiden and married name but asked him to call NVC and verify which would be needed. Sent photocopies too as per instructions on the site i was directed to when i downloaded the coverpage. Hopefully no RFE's.

Good luck to us and all the others. Do keep in touch smile.gif

CENOMAR is CErtificate of NO MARriage. You are supposed to have obtained this prior to getting a marriage license. I had two copies done, one we submitted to the City Hall in QC and the other I sent to my husband in the US. He has it on file and will attach at least a photocopy of it to the forms.

I only submitted NBI clearance in my married name (no need for the maiden name since we have changed our status) and I also submitted Police Certificate (not Police Clearance) from places I lived since I was 16. For the employment--> just put there "Physician Reliever" for those year/months (I was also a physician reliever in the early part of my employment history after board exam). No need to send photocopies, just send the original copy you got from NSO and NBI. For the NBI, just get a new copy few weeks before your interview and also make sure you have extra copies of your documents (NSO, etc) for your interview as well and for future use. You are well prepared.

For your daughter just write your current address (if she's less than 16). Good Luck and God Bless.

When we get an NBI clearance, we are given two copies automatically, one personal copy and one copy for whatever purpose we need it for, in this case the DS230. So the personal copy is also an original and is valid for the same time period the other copy is which is one year. Also, did "no record on file" appear in your married-name NBI? I was told that this is because this is a new application and obviously they have no record on file.

I included photocopies of the documents as per instructions on the site I was directed to when I downloaded the coverpage for the ds230. As for the CENOMAR, the only surviving copy is with my husband and he will attach it to the form when i send it to him.

Now regarding the "physician reliever" thingy...will they not ask for references for this?

Thank you, thank you , thank you!!!

Here is my DS-230 checklist:

1. NSO birth certificate plus photocopy
2. NSO marriage certificate plus photocopy
3. Photocopy of biographic page of passport
4. NBI clearances in married and maiden name and photocopies
5. Police clearances in married and maiden name (is this really needed) and photocopies
6. 2pcs 2x2 visa photos
7. DS-230 form, Part I signed

My 5-year-old daughter's checklist:

1. NSO birth certificate plus photocopy
2. Our marriage certificate plus photocopy (to show that we were married before her 18th bday)
3. Photocopy of biographic page of passport
4. 2 pcs 2x2 visa photos
5. DS-230 form, Part I signed by me
6. Optional (?) Affidavit of Illegitimacy

Did I miss anything? Also, on my daughter's form #20 states to list all places lived in since age 16. Do I need to fill this up for her?

I also read on a wiki page that I should not leave any gap in my employment history. I was in between work for 8 months from 2003 to 2004 and i filled it with "mainly relieving other doctors at their clinics when they could not come in". Is this ok?

Will be sending all the form out in the next two days. would LOVE to know your responses.

Thanks in advance!

NBI? Married name and maiden name? You should pass the married name.
Police clearance? No need to pass it if you are not stay for more than 6 mos to the other country..
Photocopy? No need to pass it to the NVC..

form#20 just state your address in the Philippines

good luck.. good.gif good.gif

So I can put our current address on my DAUGHTER's #20? As for the NBI, they said in all names used, including maiden and married name. So that was what I did.

Well, we sent ALL we could to establish our relationship...marriage certs, a third-party affidavit attesting to our marriage, tons of pics...my husband had just added me to his bank account and to his insurance so maybe you could do that instead of opening a joint account here. We had tried that too and we could not....not to mention the outrageous amt of USD he would have to bring with him.

Apparently, the truckload of pics from his past 3 visits helped...USCIS must'v had a good laugh.

She suggested usmleworld.com, saying that it helped her much. She did recommend the Kaplan material though, as wel as the First Aid series. I would thinkt hat I would rather study online than at a center, having to tend to both my husband and our 5-year-old daughter.

Was also told that I could finish steps 1 and step 2 CK and finish step 2 CK while doing and before finishing residency. Any info on this?

My husband called October 14th (7:30 ET) and he was told that our case was indeed complete and there may be a possibility of getting an appointment for late November still. He was told to call again this Friday. So, there may still be a few November schedules left for us. Of course, an early December won't hurt too. I also want to be done before mid-December so I can enjoy the holidays more. Don't know how easy it would be for you to get a flight out of Manila on short notice though, but if you are that adamant, you should be able to join your family in time for the holidays.

Our interview schedule as posted on the US Embassy site looks like this:

Case Number: MNL----------
Visa Classification: CR1 (CR2 for my daughter)
St. Luke's Appontment Date: DECEMBER 9, 2008 12:00AM
Embassy Appointment Date: DECEMBER 9, 2008 6:30AM

One would interpret this as having to have our medical exams 12AM of the same day as our interview. What gives??? blink.gif

Some clarification would be much appreciated. I would like to have the medicals much earlier.

A complete I-130 petition application includes pertinent personal documents and 2 G-325a, one each for you and your petitioner, with passport-style photos for both you and your petitioner. Other proofs of your marital relationship are very much welcome. Of course, the more proofs you can offer, the better. After getting a NOtice of Approval, you will be prompted to name an agent, usually your petitioner. This is the DS-3032. The affidavit of support I-864 may be paid for and submitted during this time as well. As far as I know, I-864 is only done when your case reaches NVC and not during the petition-filing process.

congratulations! you should be able to do DS-3032 Choice of Agent now and AOS I-864. I did not wait for my DS 3032 to be mailed to me, and I sent it via email instead (check out the short-cuts for this). Also, you may want to start gathering all the documents you would need for filing the visa and for the interview. Especially that very-much looked for marriage index. If all goes well, you should be out of NVC in less than a month.

Good luck!

about the I-129f i dont know if he put in my baby's name.imma ask him n let you know. but in case he didnt (i hope not)will it be impossible for me to take her?

oh n whats cfo? where can i have that seminar?

You will have to get his consent then. A letter of consent. Notarized? Would be good, i would think, to make things official. As for the I-129F, her name should be included or she cannot get a K4 visa (deriviative child of the K3). He can file the I-129F after the I-130 is received by USCIS (the NOA1) and before the I-130 is approved.

CFO seminar is one given by PRISM to all fiances or spouses of foreign nationals. Is required before leaves. Immigration will not let you leave the country without it. Here in Manila, there are two places to have that seminar...at St. Mary's and at the PRISM office along Taft Ave in front of DLSU.
