I opened my email about an hour ago and to my surprise it was from USCIS with an approval notice of September 13, 2009. We are both very happy. I am in Mexico right now visiting him so we were able to share the news together. I was also surprised to see they sent it on a Sunday. Ok, so with all the excitement I forgot whats next. How long does NVC usually take that is the next step right? I have to reread everything again LOL. Good Luck to everyone else it seems as though the Vermont center is moving things along.

I sent out our K-1 petition on June 2nd through FedEx. Vermont center received our petition on June 3rd and A. Stanley signed for the package. NOA1 dated June 4th and the check was cashed on June 6th. I don’t have the hard copy because I am out of the country, but my sister has it. I had all correspondents sent there since we all know how slow international mail can be.

I have a question regarding the interview are all interviews for Mexico done at the US Embassy in Juarez, Mexico? I am new here and I need some advice. I am an American citizen and my fiancé is a Mexican citizen. We are considering a K-1 visa since from what I hear it is faster than a K-3 visa. I have known my fiancé for many years and we started dating in December 08 and became engaged recently. I am currently living in Mexico with my fiancé. The process of a K-1 visa seems pretty straightforward, but the interview process scares me a bit.
Here are a few questions I have:

How difficult is it to get a K-1 visa when your fiancé is from Mexico?

Have we been together long enough to apply?

The only problem we have is when I was in the USA I was a full time student so I didn’t work. I was told I would need a cosponsor, which my mother has agreed to. Does this complicate the process?

Is it necessary given my situation to hire an attorney?

Please help any advice is welcomed.

I have two questions in regards to filling out the I-129F.

6. Proof of having met in past two years. (click here for examples)
I traveled to Mexico in December where I received a tourist visa (i guess you can call it that), which is good for 180 days. Will this work as proof. I am currently living in Mexico with him how would I show proof of this since nothing is in my name? Also, I have a few pictures of us in December and some recent ones. What else could be used as evidence we have met in the past two years.

The explanation of how we met is a little tricky and I am afraid they may not approve the K-1 because of this. I first met him when I was about 12 years old. My ex-stepdad is his fathers brother. I went to Mexico twice when I was little ages 12 and 13. We were never raised as cousins and I never was raised to call his father uncle. My mother and stepfather divorced early this year. While my stepdad and mother were separated I went to Mexico with my stepfather during my winter vacation. I then met up with my fiancé again during this visit. We started a personal relationship on December 21. Will the fact that he is related to my ex-step-dad will this be a problem? and how do I explain our meeting without raising a Red Flag.

Please help!!! I am putting my I-129F petition together and just need a few more things. I have two documents that are in Spanish can I translate them myself or do I need someone else do to this. I am fluent in Spanish so I was wondering if it was ok for me to do the translating. All that needs to be translated is simple stuff like name, date, car model, vin number, etc.... The back of this same document is in Spanish and English. The other document is basically the same things like name, date, payment etc... need to be translated.


Oh yeah and if I can't translate them myself does the person have to be a certified translator?

I am currently in Mexico with my SO and I don't want to send the petition through regular mail. We all know that it could take weeks for the petition to reach USCIS through "snail mail" and this process is long enough no need to add extra time. Do you think I should use FEDX or DHL? Also would I have to use a different address?

When I first started the process I was considering a lawyer, but then I realized my case was pretty straight forward so I would save the money. The process is scary and quite intimidating, but just READ, READ, READ and you will be fine. Like many others have said if there isn't anything unusual about your case then you can do it yourself. It is completely different for Mexicans. Mexicans MUST get a visitor’s visa in order to travel to the USA. I wish it was as easy as the Canadians, but it isn’t. My soon to be father-in-law has tried six times to get a visitor’s visa and each time has been denied for not having enough ties in Mexico. His proof included 4 properties, a job as a principal, wife and kids in Mexico, bank accounts, and one of the times he applied he held a seat in the local political office and was STILL denied. It can be super tough to get a visitor’s visa. mad.gif

I was in the same situation I couldn’t decide between a K-1 or CR-1. It honestly just depends on your personal situation. I ended up moving to Mexico and filed for a K-1. I really didn’t want to be apart from my SO and I was in a good spot to pick up and move. So far it is working out well. While we wait for K-1 to be approved we are together and I am experiencing a new culture. What part of Mexico does your SO live in?

And peepz are right, in Mexico religious ceremonies are NOT legally binding; but churches are legally obligated to comply with civil law.

You are very wise!!! I completely forgot about that. My friend just had a religious ceremony in Mexico on Sept. 12th and the church would not perform the ceremony without proof they were already legally (civil) married. Sorry it just totally slipped my mind.

I know that a Catholic wedding in Mexico is not considered legal, but I personally would not risk it. There is already enough to deal with especially with your case. I filed a K-1 petition for my SO and we plan on having a religious ceremony on our one year anniversary as previously suggested. I noticed you have Mexico City as the consulate, but all K-1 petitions are done at Ciudad Juarez. My SO lives in Queretaro and Mexico City would be much more convenient, but no such luck. You should really check out the Juarez Consulate thread there is a lot of good information there.

I agree with Chinman I wouldn't trust expired documents. Also the process isn't 400 dollars. The medical is about 181 and the interview is around 171 it just depends on the exchange rate. I wouldn't feel comfortable paying the fee like that, but that is just my opinion.

There was someone in the Juarez thread who paid their fee at a Banamex in Queretaro, but the fee they charged was wrong so once he was in Juarez he had to pay the difference.

You should really look at the Juarez thread there is lots of information there. DHL took 4 days for us. He had his interview on Thursday and we received the visa Monday at 5:30pm. From what I know they do not deliver on Saturday. We did not have a bank account together. They actually only looked at the evidence we sent in with the I-129. He took a accordion style fold filled with evidence and they didn't look at anything. They didn't even ask for the affidavit of support. The only thing they asked for was the 2 copies of the DS-156 and a copy of the DS-156K, CDJ-402 and DS-157. If you have anymore questions you can send me a PM. This is for a K-1 right? You do not need to wait for a packet because Juarez does not send out a packet. All they send out is an open invitation letter directing you to their website. You can print out all the forms from the Juarez Consulate website and have them ready. I highly recommend waiting about 10 days and if you do not receive the letter then just go ahead and go to Juarez. Once you are there you can go to the information window and they will print out your invitation. We went about three weeks ago and my SO is here in the USA and we still have not received the invitation. Again, you do not have to wait for the letter to arrive you can go to Juarez without it. I also recommend looking at the Juarez thread there is quite a bit of information there.

Is it a K-1 visa? My SO interviewed on a Thursday as well and didn't receive the visa until the following Monday. If the CO told you, you were approved then you have nothing to worry about. Also, they would have not sent you to DHL if you were not approved. Just hang in there I know the waiting sucks.

OP I know you are upset, but try to tone down the anger because you won't get answers that way. I don't agree with illegal immigration, but I know it happens and I don't think Chica was trying to belittle you in anyway. She was just warning you of what could happen. I think you do need to be aware of the ramifications of his illegal status. You have to understand how some people may get upset because they did everything legally and it makes them mad when someone doesn't not follow the law. You should just learn to accept that not everyone is going to give you sweet answers to your questions especially if an illegal immigrant is involved.

Chica is trying to help you and others will too, but try not to get so upset. I know her words might have upset you at first, but then she clearly changed her tone so you should try doing the same.

I really hope you do find answers here because there are very knowledgeable people, but you need to be prepared to get comments you might not like just don't let it upset you.
