IR-1 / CR-1 Spouse Visa Process & Proceduresre-filing for spouse visa

My fiancé was recently denied his visa for EWI twice before. He has a 9c ban for 10 years and after his 10 years they said he could file a waiver. He has been back in Mexico since 2010, so he only has 6 years left. I spoke with an attorney today he said if I went to Mexico and got married we could re-file and he could apply for a waiver. I would have to prove extreme hardship for myself and our daughter. This lawyer has given me some hope but I want to be sure this can be done before we do it all over again for nothing. Has anyone EWI from mexico and was approved the spousal visa? If nothing can be done I plan on going there to be with him but I want to make sure I've tried everything before I give up. My last lawyer seemed to just screw me over.

Which do I file the ds 160 or ds 260 for Juarez? My letter says to file ds 260 so do I file both?

I would still consider having a joint sponser. I am somewhat in the same situation as you. My fiancé left to go back to mexico and I ended up living in Mexico with him for 2 years. I returned last year and had only worked in December so I clearly didn't make enough. My fiancés interview is jan. 15th and I have't made enough this year working all year so my parents are so-sponsoring me. anyone who is an immediate family member is able to co-sponser. if you are living with your parents you may want to ask them
