Hi! I will tell you about our case that was accepted by the USCIS :) My fiance lives in France temporarily so he will go for the interview in Ukraine, his home country. On the I-129 F Part B question 2 we put his address in France and in the part B question 15 and 16 we put his address in Ukraine.We attach a small paper explaining that he was temporarily in France and that his permanent home was in Ukraine. It work for us as for the approval of the petition :) Hope it helps if you have a similar case.

Question 20 is a request - nothing more. Immediately below the question it says:



They may have asked the embassy in Kiev if they wanted it, and Kiev said no. Maybe they didn't even bother to ask, and sent it to the embassy in the country where he was living. You could ask that it be transferred to Kiev, but there's no guarantee they'll do it. If they do, it will probably delay your case for a month or two - maybe more.

A K1 and a tourist visa are not the same thing. The embassy in Paris told him to apply for his tourist visa in Kiev because they thought he was "consulate shopping" - applying at a consulate in a country other than his home country because he thought he'd have a better chance of approval. If he has a valid reason for living in France, then there's no reason they should be suspicious of him for applying for his K1 visa at the embassy there. The choice of the Paris embassy was made by NVC.

Million thanks, I need to admit that I went a bit crazy. I went blind and did not read the note :bonk: Now I am way calmer. He is living in France until December so it can be even better to have our interview in Paris :)
Now we need to find out if there are big changes between Kiev and Paris what documents they ask for etc. Thank you!!

A similar thing happened to me.I am a Swedish citizen living and working in Dublin.When we filed the petition I put Stockholm, Sweden as the embassy I wanted to do the visa through.They sent it to Dublin anyway. Maybe that's just how they do it?Good luck to you!

HI Thanks!! I have the copy of our petition with me :) and I put Kiev, Ukraine on question 20 :) The thing is my fiance is Ukrainian national, living and working in France for around a year. He applied for tourist visa some months ago and went for interview in Paris. He was denied, and they told that if he want to proceed again and make another visa, he must try in Ukraine. I have many doubts now, I do not know if they mean just for tourist visas or if also applies for fiance Visa. I admit I got the notice one hour ago, and I need to research more about it. I am not against doing it in Paris. The fear I have is that we get there and they told, no you need to go to Ukraine we will send it back to NVC or USCIS. I will contact the consulate in asap. :)))

Hi dear helpers!! We got our NVC notice today! But I notice a big mistake! They sent our petition to the USA embassy but in France! In our petition it says very big that the interview should take place in Kiev!. My fiance is living in France, but when he went for his denied tourist visa, they told him, that he should be making any kind of visa in his home country... I am all confused. I will need to find out if we can really make visa interview there or what. I am clueless,,I have been reading all about embassy in Kiev, I know nothing about France. ok any advice? Thanks all!! I dont get it, why if its very clear in a question number 20 of the i-129f form that is in Kiev , Ukraine they make this error! Thanks all! :help:

What? So they are telling you that they lost your stuff and you should send all again? Koshmar! How can they loose your package, there is all your life, all your info! I hope it all get resolved soon :) In our case, we also have some issues now, because as I told you they send our petition to France, and we really do not know if my fiance will be resident of France for the time of the interview.

My fiance is going ahead and extending his work visa in France before interview. Better safe than sorry. How easy is to get a work visa in the KSA? For example my fiance got contract extension and he will get his visa on passport the same day he request it. Hope all works out for you two :) :thumbs:

Hi, I had same situation plus I lost my job the same week I sent our petition. First thing get a co-sponsor that meet the poverty guide lines and do not worry about it any more. Our interview in Kiev was last week and we were successful.

What they took
1. Me and my co-sponsor I-134
2. My co-sponsor W-2 of 2008 and 2009
nothing else!

We had, bank letters, pay stubs, employment letter, but with the W-2 nothing else was needed.

For our interview we include letters between my fiance's family and me. We have so much evidence as photos, boarding passes, chat logs, that they did not took those letters :rofl: But as for evidence always more than less :thumbs: Good luck.

Hi :). As you said, we do not know which service center our application will go. So, in the letter of intent and cover letter, I wrote the same address where I filed the petition. The address of Texas. I don't think this is relevant if all K-1 applications go first to Texas. I sent my application just a few days ago but I have a friend who did the same way as me and everything was OK without any RFE in that matter. Good luck! :thumbs:

Hi!!! I'm new too in this K-1 process but I have read enough. You will have to present two (2) I-134F. Since you are the petitioner, you must fill out the form I-134F and your mom as the co-sponsor. Only put the truth in yours. You could include a separate sheet explaining the lack of documentation of past years that you weren't earning an income. No problems if your mom meets the income needed. I can't say whether (or not) they'd reissue this receipt notice but if you call, don't refer to is as a NOA1 - they'll have no idea what you're talking about (that'd be VJ-lingo). It'd be your Notice of Action/I-797c (receipt notice).

I'd give it another couple of weeks to see if it shows up - sometimes it takes a while for some odd reason.

I'm very grateful for the information. I read here in VJ that NOA1 isn't re issued. It's been over 45 days and I have not received the NOA1 hardcopy (notice of action I-797c, :thumbs: ) and I read too, that some never get it. But if you suggest me to wait, I will wait one more week. I know that I can call USCIS, but what exactly I need to request if they don't reissued the hardcopy? Just check with tier 1 the information?

We never got the hard copy of our NOA1. My fiance called USCIS and they said we'll be fine without it. I have not seen anything about needing your NOA1. Do call if you don't receive your NOA2, that's the notice that's important.



Congrats in your NOA2 :yes: Yes, I know the most important is NOA2 but like someone told me Why to take risks and don't use a few minutes of your day and call? What happen if they wrote the wrong country and you never know it until NOA2? Some countries take a long time to get an interview than others. I don't know if that happens, could affect my case in some way delaying the process. So, I never know what to expect dealing with USCIS. :unsure: That convinced me to call and ask for the hardcopy. Also, if I had not called, I wouldn't know they had the wrong address, maybe I wouldn't receive NOA2, neither. So, I think the call was the best thing I did, to avoid possible future problems in that matter. :) NOA1 hardcopy shows more information (as names and country of the beneficiary) than a simple text message. By text message I got the receipt number, call me old fashioned, but a "real" notice in where I can check that information is right, give me a sense of comfort and security. :blush:

I am glad that worked for you. I had two people tell me that they cannot reissue a hardcopy. That makes me want to call back and tell them off... lol...okay maybe not but you get me. This just proves that they don't know what is going on and what they can and cannot do...so disappointing.



I know how you feel but be positive and call. I waited too much to call. Maybe it works this time for you, too. Is important to verify names and beneficiary's country. Yes, girl, just do it! :thumbs:

Just curious.. but on the form, you did specify something like 'Please see supplement sheet' so they would know to look for it, right? You didn't just complete the form and disregard a mention of the sheet? If you did the latter, that might be why they didn't give it attention.

Hi :) Yes, I placed a neon Post it! and a tab in where I specified the supplement sheet with VERY IMPORTANT information about Part A Item #2. The extra sheet was before the second sheet of the I-129 form. Also, I mentioned the supplement sheet in the cover letter. Thanks for your reply :star:

Hi everyone. :)

I decided to call USCIS customer services (1-800-375-5283) because I haven?t received my I-797 notification (NOA1 hardcopy). First, a guy asked me what type of application was and if I had the receipt number, if I was the petitioner or beneficiary, and which is my service office. After answering, he notified me that my status was on "initial review" and I should wait until arrive in the mail any notice. I told him my situation that I had not received I-797 (NOA1 hardcopy) and I wanted to check why. The guy informed me that he going to put me to another officer who could help me. I waited a few seconds and a woman answered, asking my name, receipt number and my alien number. I told her I don?t have any and she said "Fine ". Also, asked for my fianceé's name and date of birth. She told me that my status was in "initial review"... (same as the first guy) and if I have any questions. I told her I had not received my I-797 hardcopy. Immediately, she checked and asked my address. By telling my address, she replied me that it was not. Then, I said my residential address and she said that was correct and that they sent my notification in that address. I told her that I typed on a separate sheet and even use post it! the explanation that my home address is NOT the same as the mailing address. She gave me no excuse, just said the same thing and add to not be worry that they gonna re send it in my "new " direction. :rofl: :wacko:
She asked me if I had another question and I told her that I would like to corroborate that information was correct in the I-797 (names and beneficiary?s country). Kindly she gave me the information and everything was OK thanks to God. She even asked if I had more questions and told me if I do not get the NOA1 harcopy in two weeks to call back. :thumbs:

I wrote this first experience calling USCIS, for two reasons. First, for those who are in a situation like mine, I recommend to CALL. No reason to take so long to receive NOA1 harcopy and Yes they CAN reissued. :dance:
Second, I wonder why the forms are asked to add an explanatory sheet with extra information (if required) if they do not read it? :bonk:
I noted with this that they go directly to the forms and do not verify the extra information added (at least in my case). Thanks to everyone for this wonderful site and my advice is to call for any doubt, even when here is provided valuable information. Not everything here is said and each case is unique. Thanks a lot. Ok, silly question, but I'm not sure what the NOA1 is! :blush: The date the USCIS received our petition and sent us a message on that effect a little later?

We received an e-mail&txt message on June 29th that our petition was received and it contained a receipt number. When I checked on their website using that number it said the following:

"On June 24, 2011, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283."

Is this just a receipt confirmation? Or if it is indeed the NOA1, will June 24 be the date on the hard copy, even though we received the notification on the 29th?

I believe your NOA1 is the date that you receive your receipt number (June, 29) The information of the website with the date June 24, is only telling you the day USCIS received your application and YES is just a receipt confirmation, not the day they take as NOA1. So, your NOA1 hardcopy must stated June 29 as your date. I hope this helps!
