Ok, silly question, but I'm not sure what the NOA1 is! :blush: The date the USCIS received our petition and sent us a message on that effect a little later?

We received an e-mail&txt message on June 29th that our petition was received and it contained a receipt number. When I checked on their website using that number it said the following:

"On June 24, 2011, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283."

Is this just a receipt confirmation? Or if it is indeed the NOA1, will June 24 be the date on the hard copy, even though we received the notification on the 29th?

Hi pumpkinseed! I believe your NOA1 is the date that you receive your receipt number (June, 29) The information of the website with the date June 24, is only telling you the day USCIS received your application and YES is just a receipt confirmation, not the day they take as NOA1. So, your NOA1 hardcopy must stated June 29 as your date. I hope this helps!

Hi!!

Yes. All extra papers that you use to complete an answer, must be signed and dated. Also, in the instructions of the I-129F stated: "That you need to write your name on the top of each sheet of paper and alien # (if any) and indicate the part and number of the item to which the answer refers".

I didn't leave any space in blank, write N/A or None wherever is applicable.

We're still waiting for our NOA2 but being the planner I am I'm curious...I know when my fiance arrives on the K-1 we marry but can we go away to an island and marry? I know it's supposed to be the USA but what if it's a place with US jurisdiction like Puerto Rico for example. I always dreamed of an exclusive small beach wedding so I'm wondering about where it can be done. If not we can always go to Florida I suppose but the Carribean sure is nice :)

I'm from Puerto Rico and YES you can enter and get married here. My island is very attractive and beach wedding are splendid and very common here. The weather is perfect for it. Also, Puerto Rico is a bit cheaper than the states. So, if you want to save money, maybe Puerto Rico could be your destiny. Hello VJ! (F)

I have a question about the documents that I need to submit with the I-134 Affidavit of Support. I emailed the Consulate (Bolivia) and they told me that the documents for financial support are:

* Form I-134, Affidavit of Support plus W2 and 1040 of last year
* They don't require pay stubs (and in rare cases they ask for employment letter)

I have read a lot in VJ that we need the last 3 tax transcripts, but they ask only for the last. I'm already have JUST a copy of 1040 and W2 of 2010 and anyways I have an employment letter.

Also, they require to print and complete two copies of DS-156 form. Is not an electronically form? :unsure: They issued only Packet 4 and we need to send all the required documents at least 15 - 10 days before interview date. We don't have our NVC case number yet, but the Consulate told me: "Once we send the Packet 4, the process is approximately 3 to 4 weeks. So, we are gathering the documents to gain time, practically they listed every document that contains Packet 4.

I know that each Consulate works differently but I would like to take in consideration your advices. :star:

A few tips:
First, I'd say do not forget to make copies of everything.
Having a good primary evidence to show that you have seen in the last two years (boarding tickets, passport stamps, hotel receipts, etc).
I put little notes in each section (post it) adding explanations.
And do not forget in the passport photo of each of you write the name on the back.

The answer is yes. You and your fiancee need to sign a new letter of intent to marry with a current date. The signature must be original. In the I-129F instructions you can read: "original statements from you and your fiancee who you plan to marry"
In the interview stage, you use the same statement that you used when you sent the I-129F application. It is was original? Then must be original now, too. You run the risk of using one scanned instead of the original. So, I recommend that your fiancee send it to you as soon as possible. Maybe, other VJers gonna said I'm wrong but is just my humble advice. Good luck!!! Blessings :star:

K-1 Fiance(e) Visa Process & ProceduresCalled the NVC and they received my I129F documentation from the USCIS today!

I received my NOA2 07/26/11 and have been calling and checking with the NVC on and off. I chose to speak directly to an operator today and although the recording said they did not have my info in their system, the operator said that they JUST received it. At that point I proceeded to ask the operator for the case number that they assigned to my info and when the packet of info will be forwarded to the consulate, and she said it should be sent to the consulate soon.

I was surprised. Basically it was not quite a week from the NO2 that the NVC received my info. 9 calendar days to be exact. We will see how quickly the consulate truly receives the info and when my fiance actually receives his packet of info.

Anh Map and pushbrk: I am grateful for your responses. It cleared my doubts that must be a single income even though they have filled taxes jointly.

Then, using my dad as co-sponsor, however he need to put my mother and the child as a dependent on their wages, although my mother has her own salary?
I know my dad's salary meets the requirement, but my biggest concern was headed whether my mom and the child should be a partially or whole dependents in the I-134F.

I had that same question. If my parents fill the taxes together, in the I-134F annual income question #7, I write the salary of one or both as shown in the 1040s? If you say that the I-134F should be a single person, then, what should I do if my father fill out the form with his salary only.

For example, if my father has a salary of $ 50,000.00 and my mother $ 32,000 and they filing jointly where the taxes get an annual home salary of $ 82,000.00 with a dependent child. But if my father fill I-134F should be placed on annual income $ 50,000.00 and one dependent? Partially or whole?
Then my mother's income does not count even if present in the 1040 W-2 that is needed to evidence?

I have a question regarding the documents that accompany the I-134. My cosponsor paid their taxes jointly with his wife. I have all documents ready to send, but I wanted to ask this question before because the copy of his 1040 (cosponsor) only has his W2.

Is needed to send the w2's wife, too? Or is sufficient W2's of who will serve as a cosponsor?

An update...

The Consulate notified me that I-864 is required when using a cosponsor. While the k1 visa is non an immigrant visa is treated as such because the beneficiary is not going to visit USA but he will have a possible change of status. So, I have to submit the form I-864.

Also...

I-864 never even named in the Packet 4 and does not appear in the consular information. I think it's a mistake for them. Just a few weeks ago the Embassy assured me that the DS 156 was not an electronically form. So. .. I can expect anything, but I hope this will clear up.

Any of you were asked by USEM for the I-864F? :wacko: It was my understanding that this form is for AOS.

I read in the NVC site, that I-864 is only for immigrants visa and AOS once married, NOT for K-1 interview. Idk, but I reply to USEM the exact paragraph I read. Here--> During the visa interview, applicants will be required to present evidence to the Consular Officer that they will not become a public charge in the U.S. You may present evidence that you are able to financially support yourself or that your U.S. citizen fiancé(e) is able to provide support. The Consular Officer may request that a Form I-134, Affidavit of Support be submitted by the U.S. citizen fiancé(e). The U.S. citizen fiancé(e) will need to submit Form I-864 to USCIS with the application for adjustment of status to that of legal permanent resident following the marriage. <----

Its clear, huh? I don't know why they asking NOW for this after I sent all the documents to USEM and they emailed me confirming all was OK in accordance with the requirements (I sent I-134F with transcript 1040 + W2 + employment letter + recent paystubs) The interview is in 10 days!!! Is insane :help:

Embassies have the right to request any kind of documentation to do the process. Some embassies also require I-864 than I-134 for the K-1 process. It is better to give them what ever they want and push forward the process. I don’t see your reason not to provide it; it will be kind of hard for the co-sponsor to file I-864. I think you got no other choice.

Not that I don't want to provide the form. As soon as they requested it, I filled it with my cosponsor and my fiance already have I-864 in his possession. I just had doubts because I always read in the forum that the I-864 is not required for K-1. Obviously, I send to my fiance all that the Embassy will require.

Yes, it could be. But they told me, that my cosponsor has sufficient income, but I-864 is the form that cosponsor should complete and petitioner the I-134. My fiance going to show both, I-134 and I-864.

Cosponsor already completed I-864 and I mailed it. Although its completed I-864, my doubt remained whether it was really necessary. But indeed as you say, each Consulate has its own requirements and we have to deal with it.

That means when my fiance apply for AOS, he should have to submit I-864 again. If so, at least the positive side is that we already have the form ready :)

I already sent my I-134 and my sister's I-134. But the Consulate requires that cosponsor complete the I-864. According to them, I, the petitioner, complete the I-134 and I-864 is for cosponsor. :blink: In a previous post I talked about the I-864 and finally understood that we must deliver what the Consulate asks and each Consulate has its own requirements. In my case,they use the I-864 to K-1. I can't fight against them, just deliver what they require.

My question remains if in 1-864 part one is placed only one sponsor or first of two sponsor, when the sponsor use a household member. The I-864 allows to use a Household member and combine incomes(USEM told me that my sister's income is sufficient but if she want she can add a household member, they saw the two incomes because they filled taxes jointly).

Yes, you must complete the I-134 and one parent must fill out another I-134. I am not familiar with the requirements of Mexico, but practically the documents accompanying the Affidavit of Support are:
- the most recent IRS 1040 transcripts,plus W2
- employment letter
- bank statements
- recent pay stubs

As a recent graduate student, you could include a letter explaining that you were a student and therefore did not have to fill out IRS transcripts.
Each consulate has different requirements, I hope I've helped. Hopefully someone from Mexico could give you more information. Good luck. :thumbs:

Follow the example letter of intent. It is not a letter of intent to your girlfriend - it is a letter of intent to the USCIS. The form letter is exactly how the letter is meant to be written and is exactly what thousands of petitioners use.

I think Puerto Rico could qualify as a POE because there have been other VJers that had it as their POE. We follow the same procedure for the visas as the US.

But maybe Hawaii is the best option because it's actually a state, Puerto Rico is a Commonwealth of the US. And getting paperwork from any government agency on PR is a royal pain.... :unsure:
