So I called back to verify the information, because you would think that they would follow their own guide which specifically says that they will send a packet with an appointment notice.

Wrong.

He said they sent me and my wife packet 3 and that we have to return it before they can schedule an interview. When I read him what their website says about the packet including an appointment notice he said the following, "Yeah, well that is actually what should happen with a K3 visa, but the consulate sometimes decides just to do what they want and so they aren't held to what their website says."

So I ask which one of us has to fill out the information and he said that either one of us could, and that after it is received by them that they can start assigning an interview. I asked him how long it would take and he said it could take a maximum of 3 MONTHS! This is ridiculous, in three months my wife will be 24 months pregnant! I called last week and they said we should be having our interview within 4 weeks! Do they not realize that they are screwing with people's lives with this kind of BS?

It's no wonder why so many people can't stand our government - they just simply don't care about anyone or anything except for themselves.

This question is for anyone who has done, or who knows about the K3 visa process in Ciudad Juarez. Our case was approved at the California Service Center on January 22, so it wasn't subject to the new administrative closing of K3 visas. It was sent at the Consulate in Juarez on the 29th of January.

I have been calling once every week or two to ask if they had assigned an interview date and they kept saying no, but that they would soon. Anyway, I called today and the guy told me that on the 26th of February they had sent the Packet 3 to my wife, and that she would have to fill it out and send it to them before giving an interview date. This totally just confused me, because on their own website it says that they will send a packet with information and with an appointment notice. It says nothing of K3 visa applicants needing to receive or send in the packet 3. Packet 3 is supposed to be for an immigrant visa according to their website, and K3 visas are under a separate section.

If anyone who has experience with the Juarez Consulate or with the K3 visa processes could help us out it would be great. My wife is hysterical over this right now because we were expecting the next step to be getting the appointment notice, because that is what the website says. Any help would be great. Thank you.

Hey everyone..

My wife has her visa interview for April 28th at 8:15 AM. :D Anyway, I have a few questions for anyone who has been there recently.

We will be arriving around noon on the 26th and are staying at the La Quinta Inn about half a mile from the consulate. They have a free shuttle supposedly to the consulate, DHL, clinics, and possibly even to the border.

Anyway, I was wondering about the payment of $131 that we will be paying for the K3 visa. I know we have to pay it at Banamex, but I just kind of want to have an idea before hand about where the Banamex branch is located. Is it pretty close to the consulate, or would it be better to have my wife pay it in Minatitlan before we get to Ciudad Juarez. I am a little hesitant to do it anywhere besides Ciudad Juarez because I am a little doubtful that they would know exactly what they are doing at some other branch. So any advice about that would be great.


I know the medical clinicas open at 6 in the morning. Is it advisable to go right around 6? Or if we go like at 7 or 8 should we have a problem getting it done?

Also, I am aware that I cannot enter the actual consulate with my wife. Where do most people go during the interview if they can't go in? I would prefer not to go back to the hotel because I won't have any way of knowing when she gets out, but I also am hesitant to be standing around for a few hours because of all the violence that is going on in that city now.

I think those are all of my questions for now. If anyone could answer them that would be great. Thanks!

Well mine was a K3 visa, so it may be different, but they supposedly sent out packet 3 after about 5 weeks. I never got it so I had to fill out the forms online and fax them. They never received them. So finally through our Senator's office we emailed the DS230 that they requested and that day they assigned us an interview appointment for the end of April. Since yours is K1 then your packet 3 should already have an appointment notice I would assume. I would call the call center number that they have on the ciudad juarez consulate website after about 3-4 weeks to see if they have sent it yet, because the mail apparently isn't always that reliable.

We were approved on wednesday and are still here. Our senator's office contacted the consulate and they said that it is still just waiting to be printed off and to check the DHL website. They were closed on friday and closed this wednesday so it could be another few days yet. So far it has cost us an extra 4 nights at a hotel, plus food. We just have been eating at the hotel so that we don't have to leave. So yeah, we planned on it being a 5 day trip and so far we are at 9, so make sure you have some time off. I have already missed a reception with my family and I was supposed to start a new job today and may have just lost it. Unfortunately their days off are more important that printing off visas and costing people time and money :) but good luck!

Thanks! That actually does help a lot. I know that what we hear in the news doesn't happen all the time or in every part of the city, but it's still a little scary to think about it, but I imagine it won't be as bad as we are thinking it might be. The main part we are worried about is that our flights will get in around 8 or so at night and also when we travel from the consulate to the border, because it looks like it is a little bit far .. but I am sure it will be fine. We don't have our interview date yet, but I am trying to get everything figured out regarding paperwork and also transportation before the time comes. What we are planning on doing is meeting in Mexico City (both of us will have layovers there if the flight works out right) and then taking the same flight to Ciudad Juarez. Does anyone recommend a specific hotel? And do any of them have shuttles from the airport?

After we get the visa **thinking positively** we are still trying to decide what would be safest. What I would like to do is cross the border into El Paso and fly from there to Salt Lake City, because the flight from El Paso is about a quarter of the price of the flight from Ciudad Juarez. However, safety is a little bit more important for my wife and I right now, so basically what I am asking is if anyone else has done it like that, and is there a recommended way to get to the border? We are a little worried about all the news reports and everything that has been happening down there.

I still can't figure out why they don't allow another couple of consulates process this visa .. it seems a little silly to make us all go to one of the most dangerous cities in the world! Anyway, not that complaining on here will do anything about it :) So if anyone has any advice on any of the things that I mentioned I would appreciate it a lot! Thanks

I just called the NVC today and they said they had forwarded our K3 case to Ciudad Juarez. Does anyone know about how long it takes to get from NVC to the Ciudad Juarez Consulate? And about how long after getting there do they usually assign an interview date? We're getting pretty excited :) Just hoping that everything goes well :unsure:

Removing Conditions on Residency General DiscussionForgot to Report Change of Address
Hello everyone,

I have not posted here for awhile, but I have a question. Here is the situation. My wife received her conditional green card in June of 2011 while we were living in Utah. In July we moved to Arizona for my first year of Law School. However, we did not report our change of address. After a year in Arizona, I transferred to a Law School in Colorado, and we have been at this address since we moved here last year. We also did not report our change of address.

We simply forgot that we had that obligation. I just looked at the change of address form, and it asks me what our last address was. Should I put our address in Arizona? Or should I put our address in Utah, because that is where we were when my wife received her conditional green card?

It doesn't have a space to put more than one former address. My sister and her husband have been living at the house we were at in Utah since then, and they received a letter for my wife there, and that is when I started thinking about reporting the change in address.

Alternatively, should I just report the change of address when we file for removal of conditions, because on that form, it has a space to put any addresses where we have lived since receiving the conditional green card? We are planning on filing that in about two weeks anyway.

I know I shouldn't have forgot to report the changes, but we did, so now if anyone has any advice, I would appreciate it. Thanks!

Removing Conditions on Residency General DiscussionNearly a Month with no Receipt from USCIS
My wife and I sent our I-751 on March 16th, and according to USPS tracking, it arrived on March 18th. We filed a fee waiver request at the same time because of some unforeseen financial problems that forced us to use the money we had saved for the application fee. Anyway, I assumed that the fee waiver would cause a slight delay, but now I am starting to get worried, because we have not received any correspondence from USCIS. I read somewhere that they try to make a decision on Fee Waivers within 5 days. Does anyone have any advice on who I should call, or if I should wait until 30 days have gone by.

Because of some unforeseen circumstances, we had to spend the money we had saved up for it, and because of our current financial situation (Law Student living on Student loans while searching for a job) we had to apply with a fee waiver request. So there was no check to cash, and they have not sent any correspondence or approval letters regarding the fee waiver yet.

This is getting ridiculous.

 

We sent our I-751 packet with a fee waiver request on March 16, 2013. It was received and signed for on March 18th. As of today (April 29, 2013) we have not received any receipt or other correspondence from USCIS. I called the National Service Center on April 17, 2013, and told the representative that we had not received our receipt, and he said he didn't see anything in the system. He said he would make an inquiry with my wife's A Number, and that we would receive something by April 30th. Well today, we received a letter from USCIS (CSC). The helpful answer that we received? "We are unable to determine the status of your I-751 petition unless you provide us with a receipt number." Seriously?! That is the reason that I made the inquiry. We DON'T have a receipt number!

 

So now I sent an email to the CSC followup email address to see if I get any response from them. We only have until June 16th, to file this, so if they lost our packet, we obviously have to know about it very soon. If they lost it, that is ridiculous and stupid, but I need to know at least so we can get this done so that my wife doesn't go out of legal status. This is so frustrating, and I just wanted to vent on here for a minute.

Hey everyone,

 

So after 1.5 months, we finally got our NOA1, however, my wife's last name was spelled wrong. (Baker instead of Barker.) Does anyone think that this will be a problem? Should I call the 1-800 number, or just tell them when we have our biometrics appointment? The name was spelled correctly on all of the paperwork that we sent in.

Still haven't received any correspondence from USCIS. We sent our package with the fee waiver on March 18th. Because of the Fee Waiver request, I was expecting it to take a little bit longer, but we are coming up on a month in about a week. Is there any number we can call to see if it is at least being reviewed? We haven't received any receipt number, so I can't track it online yet. I just don't want to let too much time go by without getting the extension letter for my wife.

I know that it was received because of USPS tracking, but I am getting worried seeing that people who filed after we did have already received their NOA1. Is there any way of making an inquiry without a receipt number?

It should really only take about 2-3 business days if being delivered within Bogotá. However, this is Colombia we're talking about and they had 2 holidays last week so I'm thinking they're trying to catch up. Also, I've heard of people who have had to go to DHL in person and their visa envelope was sitting there all along even though there was no waybill number issued.

So the visa was approved at the interview on 3/26, but still no sign of a waybill number. She has called the embassy to ask without success and nothing is updated online. Any tips or further information we might be missing? She is in Bogota, so everything I've seen posted here is that it would be 4-5 business day.

Finalizing our information for the interview tomorrow morning, and I'm a little skeptical about the Police Certificate. My fiancee went to the site and entered her information, and just got a page with a lot of text including (in bold capital letters), "NO TIENE ASUNTOS PENDIENTES CON LAS AUTORIDADES JUDICIALES". Is printing this page sufficient, or am I missing something? It seems to be far from an official document which has me nervous.

No, the BGT number stays the same all throughout the process. And since you can get a copy of the Instructions Package from the embassy's web site, there's no need to wait around for them to contact you for anything.

Does the BGT number change between NVC and the Embassy? I jumped the gun a little and scheduled the interview as soon as the NVC gave me a BGT#. The package is sent down to the Embassy and should arrive in plenty of time, but is the BGT# going to change or is it possible any other snags may occur because of my over-eagerness?

A minor question that I've been wondering: how far out is the earliest available interviews generally when you get online to schedule? Is it usually booked up for a month? 2 weeks? 2 months? We have a lot of flexibility and should be able to schedule an appointment as soon as possible once we are to that point, I'm just curious how long to expect for there to be open interview slots.

Friends, have faith. I just talked to NVC and they have sent our package down to Bogota and assigned us a BGT#. Using that I've been able to schedule the interview and the end is in sight (*knock on wood*).

Since about a month in to the waiting I had been in contact with my Congressman's office. They reached out to USCIS to verify confirmation, and were told it was taking 5 months to process and couldn't do anything until then. The day it hit the 5 month mark, however, the Congressman's team was able to get the CSC to pull my file and assign it to an adjudicatory. A week and a half later, it was approved. A week after approval, the NVC received it and sent it on to the Embassy yesterday.

I believe my representative helped quite a bit in part because my fiancee's family will be in Utah for a religious gathering at the beginning of April and we wanted to try and get married while they were here since they wouldn't have a chance to attend otherwise. I know we aren't completely there yet, but with a bit more patience and prayer (definitely believe there has been some Divine Intervention helping us out!) I'm hopeful we will be able to get married while her family is here.


Moral of the story: things are moving and eventually you will get to the end.

Our NOA1 came on Sept. 21 for CSC...and NOA2 came last night while I was on a plane! (Had to resist the urge to stand and do a dance in the aisle when I got the email)

I've been working with my Congressman's Immigration staff, and just received this today (some sentences redacted by me):

"I called the California Service Center where your case is pending...The normal processing times have not changed due to DACA and they anticipate it will be sent to the floor for adjudication in the 5 month normal processing time... Each officer receives a large stack of cases to adjudicate and it can easily take 1-2 weeks (sometimes longer) for them to get through the stack."

So right now it's looking like we can expect ~5.5 months from NOA1 to get NOA2 for the CSC.

The CSC just doesn't seem to have many processed recently (especially compared to VSC) as far as users on this site go. There's only been 2 in January and a handful in December. I wonder if there is anything unusual going on there or it is just happenstance.

Jacque67 -- I'm off to see him in 2 weeks time - already have so much to save for in the US but i couldnt go the while process without seeing him!

now preparing big time to be questioned at the border and hoping to be let through without a fuss. I shall report back to everyone how it goes! Really nervous that they will give me a grilling or not let me through :/

Vermont filers I think we're looking at approval some time in march...any reason to be more optimistic than that?? :( perhaps with no RFEs??


Don't be too worried. My fiancee just visited a couple weeks ago from Colombia and didn't face anything trouble.

Sent the I-129F in on Sept 5th (after hours, so really 9/6) and after a couple of long weeks I finally received the NOA1 at midnight last night (although it was dated 9/21). It's at the CSC, so hopefully we'll get lucky and have the NOA2 by the end of the year!

First i think you are assuming because she already has a tourist visa she can come and go.


On the contrary, the entire post is because I know she needs to convince the entry officer and I'm trying to get a realistic gauge on the likelyhood of her being allowed in. Like I said, just trying to get a feel for all the options and their chances of success. The K1 and it's associated wait obviously has close to 100% chance of working out as I expect, but I'm not sure on these other possibilities.

Just to clarify, I've no intention of lying. The "phrasing" comment was more in reference to what information to volunteer vs. not volunteer. I'm very firm in making sure we obey all laws and if that means waiting longer that is fine.

I've also found through searching that the 6-month leave is looked on with skepticism, but would the employer being immediate family have any effect on it?

I am a USC and my fiancee is Colombian. We are exploring various options for getting married, and I like to flesh them out as much as possible to make an informed decision. I feel like I've got a very good handle on what to expect going the K1 route (waiting until ~April of next year to get married), but the other option we are considering is to get married in Colombia this fall (October or November), filing for a CR-1 ASAP, and having her come here within a few days of the wedding on her current B2 visit for 6 months before returning to Colombia and waiting until the CR-1 completes to return. A couple things to take into account:

-She originally visited the US in the summer of 2010 and returned without an overstay (B2)
-She was here from December 2010 to April 2012 as a student (F1) without an overstay, although there was some confusion with her I-94 on exit which has since been cleared up.
-She is employed by her sister and brother-in-law, who would be more than happy to give her a 6 month leave while holding her job until her return (even though it would only be a month or 3 before she left permanently).
-That same sister can show the ability to provide plenty of financial support (as well as what I will be providing)
-She has two mortgages/deeds in her name in Colombia.
-We'd buy the return ticket before she comes as evidence of her planned departure
-I plan to have copies of all the documents included in the CR-1 application, but it would likely still be in the mail that quickly after the wedding (assuming we've even got all the documentation of the wedding to submit it at that point)
-Because the wedding will have just taken place, our last names will be different for all intents and purposes

My questions revolve mainly around how we should phrase things with the entry officer if we pursue this route. Does it help/hurt us if her employer is family, or should we leave that bit out? Is it better to explain the entire plan, or treat it as a long visit with friends (not mentioning the wedding) as far as border patrol is concerned? Between JFK and ATL, does one have more sympathetic agents than the other? Is worst-case scenario that she's turned around at the border, or could this result in a ban of any sort? In general (I know every experience is different), how likely is it that things will go through without a problem?

Ultimately the goal is to minimize time apart. The scenarios (and let me know if I'm missing one) are this:

1) Wait until the K1, be apart (other than short visits) until April-ish.
2) Pursue the course of action listed above, things go through without issue, spend from now until the wedding apart and then a short time after 6-months waiting for the interview (May or June-ish?).
3) Pursue the course of action listed above, she's turned around at the border after the wedding, we're apart (other than short visits) until May or June-ish.
