hi all,

we have checked our status on friday and it said on 1st feb we have mailed a request for evidence. and yesterday my fiance has received an update via email that on 4th feb they are mailing a request for evidence. when we checked the status on the website it said on 4th feb we mailed you. . . etc I am so confused. is this two rfes or one ? isnt this wierd ?

pls help

its just one... that just happened to me a couple of weeks ago one on jan 21 then another email jan 23 saying the same thing... it was just one...RFE

Worst part is that I do not know why yet. It's been almost 5 months and I received an email yesterday just telling it has been denied and I should receive a letter explaining why. So needless to say I'm freaking out. At first I had no clue why, but after looking through this site, I think I might know. I pretty much only filled out the I-129F form and mailed that in with the fee, nothing else. I figued once the backgroud checks were done they would ask for more info for the interviews. I called USCIS 3 different times and talked to 3 different people asking them what I needed to do, and they all said the only thing I need to do is fill out the I-129F form and mail it in. They also mentioned the requiremens to be eligable, but that was it. I talked to a couple lawyers also, but they wanted a few thousand dollars to handle it. I did not get the letter yet, but should in the next couple days. I don't know why I did not find this site before when searching online. It came up now in my google searces on what to do about a visa denial.

So what are my options? Should I get a lawyer?

My background... My Fiance is from the Philippines, and I have known her for 5 years now. I have been supporting her for the past 4, I helped her go back and finish highschool, and she is now in her 3rd year of college. Originally we were going to wait for her to finish college, but I figured it would be better for her to finish here (USA) and get used to the culture, language, and build a network through school. I have a lot of (daily) chat logs from Yahoo, Skype, and emails. I also have a lot of Western Union receipts and Xoom online history of me sending her money. I have visited her and met her family 2 times now and gave her an engagement ring. We are both eligieble to marry and have no criminal background. Also neither one of us have been married before, or have any kids.

I thought I might be asked for clarification or more info, but I did not expect to be denied. Would not providing enough info or documentation result in a denial? I guess worst case is that there is something in her background check that came up, but knowing her as long as I have, I would be very surprised. I feel foolish now if it is just because I did not provide enough info. I waited a few months before mailing the form while trying to make sure it was all I needed.

Please go to the link above to see what should have been included in your application. If you only sent the i-129f form and the fee and none of the other documentation, that seems to me like you got denied for not enough info. I am not sure if that means you can reapply with all the info, and I guess you will have to wait for the letter to get the official reason.

I am sorry. :( I hope it's nothing more serious that that.

I'm sorry to hear that! There is always the fear of the mail getting lost, and unfortunately, VJ can't really help you. It sounds to me like the mail was lost. Was it sent express mail or regular letter mail? And from what USA to what country?
I worked for Canada Post (mail) and if its sent regular mail from one country to another, it can take upto a few weeks, and depending on the country he sent it to, and if your town is remote, it may take longer. If he sent it express, he should have a tracking number that can track it.

Thanks for the info... I was venting and hoping for ideas... it was sent from Tunisia to the United States....They gave him a tracking number but it dosent work... He is gonna go back tomorrow and speak to a friend that works there and see what we can do....

So my fiance and I received and RFE on Jan 30 so he sent me what they were asking for on Feb 1 via mail.... before when he has sent me mail it only took a week it is now 19 days and no paper work as arrived yet. He went to the post office on fri .. we gave it time bc the wekend prior we as a blizzard here in New England so mail was delayed...The post office told him that our packaged arrive in the US on Feb 13... still havent received it and getting very frustrated... I dont know how we can find out where it is? I dont want him to pay to send it again just incase... We have a friend over there now visiting family( my best friends husband) he said just redo paper work and give it to him and he wil bring it back to me... That idea is great but he wont be back in US until March 16 .... SO i dont what else we can do to find my package... :bonk:

Hello, I received my NOA2 letter today in the mail for my K-1 Visa application and it says and I quote, "The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance.

Does this mean that this bypasses the NVC and goes straight to the consulate or does it go to the NVC and then the consulate. Should I contact the consulate in a week or so to get instructions. Any help is appreciated. Thank You

I just posted the same question and called Nvc and they told me yes and then turned around and told me to call them back in 10 business days so im a little confused..

Right there with you!! I've been so stressed and ours was approved May 23th..i'm getting really frustrated! We called multiple times and emailed..no answers..just the old "you'll hear from us soon" None-the-less, good luck at your interview, guys!!

I am surprised you haven't heard anything yet... I emailed them on a fri and mon morning I received packet 3 via email.... they also told me I will hear from them soon.... so I was surprised when it was so quickly.

yes just email the ds 230 but he also needs to bring a copy of it with him to the interview... it doesn't say it in the instructions but that's what happened to us and they rescheduled him bc of that one form....I emailed the ds230 and the next day we had an interview date scheduled for a week later so before you email make sure you have your police certificate and anything else you need... I also emailed them about the fee it is $240 they told me it is an outdated email...

A friend of mine is married to a foreigner and is about to apply for his CR-1 Visa.  She asked me a question about putting the I-130 paperwork together.  The thing is she had a prior "marriage by proxy" (OUTSIDE OF THE UNITED STATES) which was never consummated!!! Now, is she supposed to include the annulment decree or not? Because technically the U.S. does not recognize marriages that were never consummated...if anyone knows the answer to this question we would appreciate the help.  goofy.gif

Hello everyone,

 

I've filed for CR 1 Visa on February(vsc)  .My husband is currently in Bosnia and there are major floods right now.  It is a complete disaster!  I haven' spoken to him since Wednesday and didn't know whether he was ok or not , until he sent me a text today morning saying he is ok and he can't leave his house because of the flood.  I haven't heard from him since.  It is supposed to be raining for a couple of more days.  There is help coming from foreign countries (Russia, France, Germany etc.) I don't know how my husband is doing , he probably has no clean water and food.  Most homes are completely destroyed...now my question is how do I go about filing a service request to expedite our case based on a natural disaster? Any help would be greatly appreciated. Thanks

If I were you, I would STRONGLY urge the boyfriend refrain from trying the third time. First step proving the good "potential" of becoming a good citizen is OBEYING to law of the land.
 
When you chose to break the law, there should be consequences. Now learn to deal with it. Don't try to find a way around it!

You have the terminology wrong.   Package 4 is the interview letter sent to you from the NVC.   You are thinking of the IV package  which is the Immigrant Visa package.  It's not roman numerals but rather an acronym.  :)  It's okay, it's an easy mistake to make.  
 
Check with dwheels and her Case Complete / Interview thread about how long it takes for an interview after a case complete.  I agree with the NVC about sending them a letter and asking for the case complete so they can just go ahead and book the interview, and then your husband will bring the documents needed to the interview.  Your husband will not likely get an interview in Jan but more likely Feb or March if you get a case complete in Dec.  So you likely don't need to worry about your boss not wanting  you to take time off in Jan.  
 
 
It should probably work out IMHO.  You can always contact the embassy after the case arrives and request a date in March if that is later/earlier than your booked date.

So, Im a newbie and Im still learning the terms! It is package IV. I just put a 4 instead of the roman numerals. I have to send in the documents they requested from our second checklist, which are the Guatemalan police certificates (which we were unable to get since the Guatemalan government changed the laws over there. Now you have to physically be present in order to obtain any government issued document. There is a new government ID as well that you have to obtain in person. And my husband is here in the US. The police officers also tried to GET MONEY OFF of us and lied to our lawyer at the police station (so BEWARE those doing this process for Guatemala). We called NVC and explained the situation. They said to NOT accept any document from them since it could be a false document, our lawyer over there said the same thing, and to just write a letter explaining the situation. Once he gets to Guatemala he can get the docs personally and bring them to the interview) and a updated birth certificate, we had sent in his original, the one given to his mother when he was born, birth certificate. We got the new birth certificate tho. So it arrived from Guatemala and my husband is just desperate to get the process done and over with.

So, we would love some guidance on this issue. So I work as a nanny, and my boss will be having her third child in Feb. She says that she supposedly needs me for January. I don't know if we should forestall sending in the last documents for packet 4 or to send them now. How long does it take to get an interview in Guatemala embassy? So now I have another question: My husband and I have been married 4 years. We have a lots of documents and a boat full of photos! I've made scrapbooks and photobooks as well as regular albums. It is A LOT. 4 years... a lot happens!! What and how much should we bring?? I have bank statements, leases, credit cards, auto insurance, and pictures of us since 2008! Any ideas?

Wow! Thank you for this wonderful info. I think many do not know this, like myself. Its great to be able to become truly informed about this topic!!

I'm hispanic, so in our culture we see sponsorship as a favor. It would be detramental to other family members and other hispanics to take advantage of a sponsor. I guess I assumed it was a universal thing. I spoke to my cousins about it and they said they simply just become citizens asap and thats the end of the story for them! Some of my father's family have become USC. The ones not USC are the ones who have recently come and were or still are minors when they came, and/or they have been too lazy to learn English and become a USC. One of my cousins become a USC just last year. Also, they have learned to just live with what they can.

So, I understand now why many will not do this. Some even have the petitioner pay them to be a sponsor! They make a lot of money off hispanics because they know that the hispanic culture sees this as a very big taboo. If you come to this country to work, work. Don't come begging for help later. Can't get benefits? Too bad. If you are a woman, find a man who will support you. If you are a man, take any job offered to you. Make sure you stay close to family so they can help you if you have need. No family? Then make friends and become close in case of anything. Sponsor no where in sight... That's just our culture, regardless of how the US government sees it.

Notice that the first 5 years when an LPR is not qualified for means tested benefits has nothing to do with ending the I-864 obligations. So, the I-864 obligation does not end after 5 years. The I-864 obligation can be for life.

The Sponsors Obligations

The Form I-864 Affidavit of Support is a legally enforceable contract, meaning that either the government or the sponsored immigrant can take the sponsor to court if the sponsor fails to provide adequate support to the immigrant. In fact, the law places more obligations on the sponsor than on the immigrant -- the immigrant could decide to quit a job and sue the sponsor for support.

When the government sues the sponsor, it collects enough money to reimburse any public agencies that have given public benefits to the immigrant. The sponsors responsibility lasts until the immigrant becomes a U.S. citizen, has earned 40 work quarters credited toward Social Security (a work quarter is about three months, so this means about ten years of work), dies, or permanently leaves the United States. If the immigrant has already been living in the U.S. and earned work credits before applying for the green card, those count toward the 40.

In fact, in marriage-based cases, work done by the U.S. petitioning spouse during the marriage can be counted toward these 40 quarters.

A sponsor in a marriage-based case remains legally obligated even after a divorce. Yes, a divorced immigrant spouse could decide to sit on a couch all day and sue the former spouse for support. What are the obligations?

Your father has been quite lucky then. Others have had to paid.

The 5 years is for qualifying for public benefits. It does not fulfill the requirement to end the I-864 obligation. These are two different things.

I just saw this and wanted to add something.

My father has sponsored his entire family (8 brothers and sisters and their individual families). All of them were told that my father was their sponsor so he was economically responsible for them for 5 years. After that he was no longer responsible for them. And thats how it has been. What it really means tho, is that the person being sponsored cannot apply for government services for that time. They are supposed to ask the sponsor to help them if they need economic assistance. Mind you, my father is still sponsoring people (in total he has sponsored more than 20 people). He has never had any issues because of it.

That's so sad. Im sorry hun. Have you called immigration tho? Because you say this is what your lawyer believes is the problem. But maybe immigration can give you more info personally.Lawyers can be great but its been our experience that they know very little about individual cases. We have been our best advocates in this process. I call immigration all the time!!

Its worth a shot. They would say one thing to my lawyer and another thing to me. You never know.

I just heard from the lawyer, she said she believes my amount I make per year is too close to the amount needed. I am soo upset, Because I take care of my husband now...adn I have proof of it..this is ridiculus. Now I have to do what they say... I know it makes no sense...I cant believe they have control to do that.
