I am restless as I await the packet from the American Embassy. I have called them for an interview appointment but was advised to first wait for the packet. And as I helplessly lounge in the waiting room, now knowing when the packet will knock on the door, I thought of posing an off-topic question to you, my Filipino friends and your loved ones.

It goes like this - if you are a fan of police stories on television or the movies, who is your favorite TV or movie cop? Mine is Steve McGarrett (Jack Lord) of Hawaii Five-O. Also, I admire Inspector Callahan (Clint Eastwood) of the Dirty Harry pictures. (Omigosh, I'm showing my generation here!) How about you?

If so, what was your result...how long did it take to get a response from them....and was it effective?
You can see my timeline below....my application was intially sent to the wrong service center (by USCIS) and then they said they lost it
and then ask us to send another application which was sent to VSC and now they are saying they will process it
by the duplicate application date. BOth times my lawyer sent the application to TEXAS because that is our filing location. They are
the ones that forwarded the applications.

I am sure they don't know what that word (expedite) means.

But anyway. I was just wondering how long you waited to get a reply.

Thanks.

I made the mistake of doing a service inquiry twice.I feel that by doing this,I just gave them permission to take even longer to approve my case. The only thing that got them to move it was when I got my congessman involved.I suggest doing this before doing a service inquiry. It takes them up to 60 days to make a decision when you do it.

She said by March 26th, USCIS should update the website again then still no answer, she will contact USCIS and check. And it is still pretty common for some people to wait this long. Well, I hope so;(

It seems that Congressman Campbell handles immigration a lot and has a lot of power. We got pretty quick answer.
She said we should get noa2 by march 26th.

Unfortunately, they take longer with some cases.Just look at mine.Congressmen can work wonders with immigration.Be persistant and don't bother calling customer service because this will only give you migraines. And what ever you do, do NOT put in a service request, this just gives them an excuse to take their time even more.

Asia: East and PacificVisa Denied Also
QUOTE (pasaitoh @ Jun 25 2008, 04:07 PM) <{POST_SNAPBACK}>
Hello Everyone,

Boy I wish I found this website a week or two ago. We in a similar boat to the thread AmericanGentleman started.

My fiancee, Ngoc had her interview at the HCMC Consulate on Monday the 16th at 8 am.

We thought we were really well prepared. We ran through the instructions multiple times, made sure we had everything in duplicate. Our lawyer (US Lawyer) said our case should be open and shut no problem. We had plenty of evidence and it was well documented. Ngoc listened and practiced sample questions prepared by our lawyer, and I grilled her to make sure we were prepared.

Then disaster struck.

Ngoc was interviewed by a Asian man and a female translator. Had we known about the translators, Ngoc would have done the interview in English. We only opted for the translator, because we didn't want any misunderstandings. Big mistake.

Looking back on what was asked, these seem to be the problem:

How did you meet? = My Uncle JBV and introduced us.
How did you Fiance propose? = He gave me a diamond ring and asked me to marry him. -- this lead to two more questions
You didn't have an engagement party? = No, just proposed with the ring
What is your relationship to your Uncle? What is your Uncle's relationship to your fiance? = My uncle is my Grandmother's Sister's Son (so really 2nd cousin). Uncle JBV and my fiance are friends.

Here is the big problem - Translator still says to the interviewer that Uncle JBV is an Uncle not a Grandmother's Sister's Son.

Then the BLUE slip asking for the following:

Two Electronic DS 156 (We had two typed ones -- ok no big deal, we goofed a little on the convoluted instructions)

List of Names, dates of birth, addresses of Family in the US -- Ok we can get this together fairly easily

Timeline of relationship - Ok no problem, can have it notorized at the embassy. Only problem is I write JBV is her 2nd cousin (which is 100% true).

Petitioner - Proof of purchase of 3 trips worth of airline tickets by credit card statement (weird considering my tickets are included in the packet with our proof, but not a problem)

We rush around all morning thinking we just need to turn this in, and we will be in good shape. Go back to the embassy at 3 pm. Told by security I cannot have my timeline notorized until 8 am. Ok no biggie, what is one more day?

We go back on the afternoon of June 17th at 1pm. We figure it shouldn't take like maybe one and a half hours. Four hours later Ngoc comes out crying saying " They Said We Lied!" #######?

We got the GREEN SLIP:

Beneficiary and Petitionerstatement conflict = She says her Uncle introduced them and her uncle is friends with petitioner. Petitioner says 2nd cousin introduced them, and that Uncle is his best friend

Claim to have started communicating in March 2006, but email starts in August 2007.

Internet phone records only show billing, not phone number of petitioner or beneficiary

Photographs submitted as proof do not show the petitioner and beneficiary have spent more than 2 days together.

CASE BEING SENT BACK TO USCIS

#######?

So I call the Consulate on the cab ride, and am told I cannot speak to a CO. Our case is being returned etc. I said your CO didn't do their job. I can prove he is wrong. They say ok, bring back the GREEN sheet with your proof.

So I write a nice letter explaining everything. The translators miscue, the fact that we are talking about the same exact person, regardless if he is her uncle or second cousin or other semantic BS. I don't know why there was no email from March 2006 to August 2007. I print out our backups of the missing email. I download detailed billing from Skype and Yahoo Voice showing Ngoc's phone number and the time and cost of each call. Finally and this is the one that really annoys me is the pictures. We submitted about two hundred photos. I went and printed 800 more photos from my flickr account. Each with a date stamp showing the date the photo was taken from the EXIF information. Over 15 different days. 2 my butt.

Head back to the embassy at 8 am. Get sassmouthed by the woman at the window. I demand to speak to a CO and an American. Finally she says if I come at 1pm I can talk to one of the COs.

1pm comes around. I am first in line. Get my ticket and wait. Talk to another local at the window. Won't let me do anything without giving him our Green sheet and proof. Gives me another ticket and says wait by window number 9. 3 Hours go by and it seems everyone with Fiancee cases has been called over a hour ago. Now we are into regular immigration and work type visas from what I can tell. Only locals show their faces in the windows. So when a window opens up I jumped in before they could call the next number. THEY FORGOT ABOUT ME. Then I had to give them my Fiancee's name again, case number etc. Wait some more please. She comes back finally about 40 minutes later. Sir this visa is being sent back to the US. AHHHHHHHHH!!!!! I said I want to talk to the supervisor now. Thinking that if I can talk to an American, he will use his brain and see, duh well we had some paperwork to get cleared up, but we would have it settled. No Dice. Middle aged guy wearing glasses.

I asked him what seemed to be the problem. He said they had a "feeling" our relationship was a sham. I was like what? I said we did everything you asked us. I wrote a detailed letter. I proved everything you said was an issue wasn't. Why do you "feel" our relationship is a sham, that is very nebulous. He said yeah it is. I asked him how can I prove to you that our relationship is genuine. He said I really don't see how you can. I said well look at the letter and the evidence. He said how do I know you did this, how do I know the evidence is real. You didn't sign your letter. I didn't because the man up front took it before I could ask questions. Could I sign it now? Do you have proof of who you say you are? Is my US Passport good enough? I'll hold off on sending this back to USCIS for a few weeks and maybe I'll look this stuff you provided over. I told him I am here until the 24th. Lets get this taken care of. I can come back everyday if needed. No DON'T COME BACK (it wasn't a suggestion), I'll call your girlfriend if I change my mind.

So needless to say we are floored. I just got back a few hours ago. I've called my representative and am waiting to be called back. I don't know what else to do, all our plans were tossed away. Our deposit for wedding pictures lost. We can't make invitations, her wedding dress, my suit. My parents are having to change their vacations at work. This is messing up two familys. Nevermind me having to explain to her relatives why we aren't getting a visa.

Anyone have any suggestions?

I know exactly how you feel.I am so sorry.Call your senator also and have him write you a letter also.

QUOTE (Leedah @ Jan 19 2008, 05:06 PM) <{POST_SNAPBACK}>
I am in need of some advice. And it is a doozy.

My hubby is from Gambia and naturally thinks that I am rich. I have been able to travel their several times off of Buddy Passes given to me. Only pay $300-400 (taxes) for a roundtrip trip ticket. Couldn't afford to go otherwise.

Basically, I am not rich and live almost check to check when I don't watch it.

So, my so seems to get upset and thinks I don't love him because I can't send money. He truly believes that I am playing games and hoarding money when he is barely eating. Mind you the U.S. dollar gets about $21 of theirs, so whenever I would come, naturally I have a little extra just because of the exchange rate. Heck even going with $500 will net you a pretty sack of change in the exchange department.

Anyway, his "buddies" are filling his head with insane idea's that I must have married him to get "some". Many women actually come their to get a man to have relations with. I told him that I wasn't rich at all and and doing my level best to even get him here. (barely making ends meet for myself). Then I told him to look at my picture we took together again and think if I REALLY NEEDED to go to another country for a guy. He QUICKLY shut up and said yeah well.... (mumbling incoherent jargon). (hahaha. Need I say more.)

I am at a lost and sad from this whole situation. It doesn't help that I can call him (cheap phone cards) and he associates that (my ability to call regularly) with having loads of money. (even says "if you can call 3 times a day everyday, you must be rich.)

I am almost ready to stop the petition and wait until his head is on straight. lol
Any idea's?

Unfortunately, there is little you can do until he comes to the USA and sees how things are for himself.Mostly everybody in Panama (esp.my SO and his family)think that each of us have a 20 bill tree in our back yards. You should just call him once a day and jsut tell him that you have expenses of your own and that you cannot afford to send him money. He survived just fine before he met you, right ? And that nonsense about "getting some," tell him you could have gotten some here or anywhere, you didin't have to go all the way over there for it.If he really loves you he will understand. His friends are just envious of your relationship. Many compare when somebody is involved with an American citizen to hitting the "powerball jackpot" and that's just not realistic.

Why did you have to get me started, lol? I know many tales of deceit and heartbrake.I only have time to tell you two.

Once upon a time in a small state called RI,there was a gentleman who was a sucessful business owner in the town of Central Falls.People would go to his business to send money back home, use the phone booths to call their countries, buy phone cards, cell phones, you name it,he had it.This man was also happily married to his high school sweetheart who he hed met in his country.Unfortunately, his wife developed a uncurable strain of breast cancer and she succumbed to it in less than a year.Three months later, this man went to his country, supposedly to get over the greif of losing the love of his life.To everyone's surprise,he brought back a supemodel like woman half his age and said it was his wife.He sold his small business in Central Falls, and him and his arm-candy moved to South Carolina. In three months, this girl got her things, and left this man high and dry. devil.gif

I know this lady in my neighborhood who has the reputatation of marrying guys so they can stay in the USA.Her last(and 3rd) husband got deported for statutory rape of her own 16 year old daughter. Now she's on her 4th husband who just happened to be here illegally also.So one day when I saw her at the market,I just asked her why she liked men who didn't have green cards so much. She was quite honest with me and said that she needed someone to pay her bills and mortgage. blink.gif

We know this guy (from South Africa) that was in New York on a work Visa that Expired on 10/12/07....He meet a girl from Long Island 2 months before the expiration of his visa, and got her to marry him on 10/28/07 just before the Work Visa expired....He is now living in the girls parents house and working on Long Island...The parents do not even know they are married...They are planning a big Wedding in September 2008......Now tell me...HOW IS THIS POSSIBLE....why do all of us have to go thur this HELL....and he is sitting pretty in New York Laughing at us,all the time and money we are spending....How can he stay in New York on Expired Visa? How can he Work?.....This is not fair....he only married the girl so he did not have to leave....they only knew each other 8 weeks....I just do not know how this is possible!!!!!

I perfectly understand how you feel. But it seems to me as if this man was just at the right place at the right time and got lucky.

has anyone try to check their status online today,i tried and it shows case status retrieval fail, and login also fail and i checked it last night it went through what could hava caused that. has anyone experieince that.

There are two ways you can access your case status. One is by punching in your receipt number, and another way is that you set up your own account using your passwords.Keep trying. The only time I experienced something similar to what you're describing is when I tried to check my case on a Sunday.

FELICIDADES! smile.gif I'm so happy that you finally got your NOA-2. For Panama there is only a Packet 3 and that packet has to be picked up by your fiance. But, to make things easier for him, call the NVC so you can get your new case number and ask when they sent the paperwork to Panama. Una vez que este en Panama entonces dale esa info a tu fiance para que el lo vaya a recoger, it'll take approx 1 month for that packet to reach Panama, maybe sooner. Also, when he goes to pick up the packet, he can ONLY go on Mondays and Wed between 8-11. In the packet he'll find some forms he has to fill out and turn in so that way they can schedule him an interview. Also, the Medcial exam, record policivo and the I-134 is stuff he has to take to the interview. It sounds a little confusing but they'll explain it better at te embassy when he picks up the packet. Good news he doesn't need to translate any of his documents, they can stay in spanish! And that's it! you're almost there girly! I'm sooooo happy for you! if you have any questions let me know. My fiance just picked up his packet on monday and he's turning in the forms next week on monday, I'll keep you posted!

Gracias paisana. No sabes como me siento ahora.Estaba tan tencionada,y ahora me siento mil veces mejor.kicking.gif Do I have to send him anything to bring to the interview ?

Since a person needs the visa in there passport when they present themselves at a border crossing post... it would be difficult for them get it if it was issued inside the USA.... smile.gif

I know that.I was just wondering if they give it there or do they send it from here.Thank you for the enlightenment. good.gif

Apply for the I-130 if you decide to get married.

I know. But what I really need to know is if he would have to wait another year for his visa.Couldn't I just bring him home with me ?
