It should just be prepared to have the money to pay for all of them. And I think I read somewhere that they don't accept immunization records from Iran anyway so you would still need them.

You need at least 48 hours and yes my finance is Turkish and made his appointment on line. Though I had to help him with some of the English on it. You can always call them too and make sure they have all you need in regards to immunizations

Good luck I leave for turkey on January 8 and we come to USA on jan 15. When I first met Bulent he was living in Ankara. Some things to see are kocatepe mosque. Ata Turk memorial anitkabir and the Ankara archeology museum. And some good food. Kizilay is the center. Bulent was living in the altindag area. Now he is in nazilli which is why I'm flying to Antalya. I love the whole area of turkey he is in near Ephesus and bodrum. Good luck

I remember when me and my South African wife were trying to get married in South Africa. I had to type up a letter stating that I was not married at the time and took it into the US embassy. All they did was notarize it as me say "Yes I swear that all facts in this letter are true". Because the US government does not keep records for non-marriages or people that have not been married.

 

One the the funnest damn things I have ever had to do.

To prove that you do not need to file a tax return, you must go to the CFR (Code of Federal Regualtions) or to this site on the IRS and follow it around until you find the information that matches your situation. So I would print out the page and then print out Table 1-1 and then include proof that your gross income does not exceed the requirements.  Plus you have no other type of income that the IRS requires you to file a return on.

 

You are the petitioner, the person you submitted the petition for is the beneficiary and as the petitioner you must include everything for the I-864 you must complete.  The US government wants to make certain that the beneficiary is supported by the petitioner and will not become a public charge.  To do this they have established guidelines for income in order to qualify.  You, as the petitioner, do not qualify.  So you ask someone who is willing to be "on-the-hook" for the beneficiary should the petitioner, you, be unable to pay back the government.  This person becomes a co-sponsor.  You are the main sponsor and in your case, your Mother, is the co-sponsor as your income is below the 125% of the poverty level.  The USCIS wants fiancial information from the petitioner even if the petitioner's income is zero and the petitioner has zero income.  Plus they want all the proof that the co-sponsor can meet the poverty guideline for their family size plus the beneficiary.

there's 2 paths here..
1. proof of domicile. You maintained a residency through either outright ownership or paying a lease or
2. proof of re-establishing domicile . You show new lease, new job, letters from parents, etc.

I'm betting you have to choose option 2, for some reason, and NOT option 1.

Canadiens have this problem, and write about it often.

it's my understanding that the I-864A COULD NOT APPLY in your case, as you DO NOT have domicile there.

again, this is one them slippery things.

Ya just joined, we have an advanced search tool - and many of those i-864 questions get covered in the NVC forum and the IR-1/CR-1 forums. I'm not an I-864 expert by any means - my I-864 was weird as well.... (No, don't ask - I'll write about it maybe after the interview) ..

the i-864A is only used (to the best of my understanding)
if

the joint sponser / co-sponser (your mother) is domiciled at the same address as the sponser (you).

OR

a joint sponser filing the I-864 has joint income with a spouse, that 2nd spouse files the I-864A.

I could, of course, be dead wrong.

Yes the IRS gives proof - you send the pages of IRS instructions/ rules that clearly state who does not need to file.

You will need to prepare documentation of re-establishing U.S.A. domicile and put that in with the I-864.

So, that's one I-864 on you.
and ONE I-864 on your mother.
If she filed joint taxes with her husband, then the husband files a I-864A.



 

I am the husband. Wouldn't my mother need to complete a I-864a also?

 

I have documentation showing domicile in the US.

 

I still need help on what address goes were on this form.

You are the petitioner. You are sponsoring her.

 

Your mother is the co-sponsor.

 

A letter will not complete the documentation as to why you did not file. You will have to include IRS proof as to why you are not required to file taxes.

 

 

I'm including my payslips along with my wife's and I year to date banking statements showing the deposits from my work.

 

The IRS doesn't give proof they can only show that I did not file. Its really dumb if you think about it because why would I hind the fact if I were to file. The more money I make the easier it is to support the immigrate right?

 

But my question is do mark 1.a or 1.d or even 1.e on the new form? Because it clearly shows that I can only be a Petitioner, Sponsor, or a Joint Sponsor but not more then one. So I'm the Petitioner do I still need to enter my financial information even though I have a vary good Sponsor?

I really hate creating new threads but in this case since the I-864 form has been re-designed I'm having trouble understanding the old information with the new.

Have you been FILING a US income tax return on the income (or lack there of) you have been earning in South Africa?  If not, then the USCIS will be asking for a tax return from you as the petitioner so I would FILE a 2012 tax return or you will have to show no income and cite from the IRS CFR why you were not REQUIRED to file a US income tax return--this is the one item that trips up most people when they have been living overseas and the USCIS sends an RFE for income tax returns from the petitioner.  Take care of this requirement first.

My wife and I are starting to freak out over this application process and no one will help us because we are in the middle of our application process.

 

Here is our back story:

 

I'm a US citizen by birth and have lived in Minnesota in tell I moved to South Africa two years ago. My wife and I meet in Minnesota while we were working five years ago and we married in South Africa two years ago. Now we both want to move to Minnesota to live and work but we are in over our heads.

 

We have completed the interview at the Jo'burg embassy and they have asked for more paper work. What I really need help with is this new I-864 form because every time I look at it my understanding of what it is asking changes.

 

My mother is going to be the sponsor since I have no income to show for 2012 and she makes over the 125% poverty line.

 

So my first question is if I'm the petitioner must I also be a sponsor?

 

If I'm not a sponsor must I still enter my South African income?

 

If I'm living in South Africa with my wife but we are both moving to my mothers address in Minnesota how do I fill out the I-864 correctly?

Is your marriage legal within India and does the Indian government have a record of the marriage?

 

You should be able to request what is commonly called a long form marriage certificate from the India government. You may need to get a translation of the form because the embassy only really accepts English.

I can easily say that you will need a sponsor someone that is legally related to you in the US. You will need a letter explaining the reason why you have not filed in the last three years. But I'm also still trying to nail down the letter part because everyone is telling me something different.

I still don't understand what Pakistan/India/Sri Lanka has to do with any type of green card that happen to say EXPIRED....I don't understand because when you exit US no one cares, when you enter into Pakistan/India/Sri Lanka they only want to see your Pakistani/Indian/Sri Lanka passport that it's valid, so that as a citizen you do not need any visa, or anything to ENTER the country, that is your homecountry. On the way back, Pakistan/India/Sri Lanka waves goodbye to you no matter if you exit with your passport, or your valid green card, or your expired green card, or your US passport etc...doesn't matter they don't care, you're leaving the country. When you land in the US that's where they want to see: Are you on visa? What visa are you on? What program are you working/studying under? How long are you staying with your B visa, or your VWP? If you are on US passport, "welcome home", if you are on a valid Green card, "welcome back, immigrant!" if you are on an expired green card, then "may I see your valid passport, and your extension letter so that I can see I can allow you back into our country as an immigrant, or you no longer qualify to enter as an immigrant and you should go back to your home country and apply for a visa". Why on Earth would Pakistan/India/Sri Lanka care about your expired green card? It is not the valid green card that allows you to enter the country....US is the one that is concerned as you're entering here...but US knows the extension letter issue otherwise they would not be issued by USCIS....so I still don't understand why you had to do this...but your call....if you feel more confident this way....I would just follow the instruction that they give me instead of trying to figure out some changes that I could do....they know what they are doing...I don't! Anyhow, at the end of the day the decision is yours....just don't be shocked if they see the stamp and still say they need the extension letter to let you back because than you suck big time for your lies....Good luck!

-- Because they want to make sure Airline do NOT carry someone who eventually gets denied admission to the States. Then, the airlines have to carry the deported person back at the cost of their own expense . This is also why customs back there are too worried in the wrong way (any thing expired to them considered as a matter of objection & investigation). Neither they are aware of our immigration rules nor they are interested. I know from my words the reply will come to your mind: "Then just don't go", but I wish I could just do that. Anyway, I firmly believe I-551 is efficient to pass by their security & that's what plan to do only. Only we get back home we are in good hands.

Thanks for all the honest opinions, but honesty at this point wouldn't cut it for us. I am sure none will be there to help us if we get denied of boarding the flight back home so we did whatever was needed to get the job done. Our return flight is also at 3 AM local time & no supervisor from Airlines or immigrations will be assisting us. The only choice we had left is to lie & get the I-551 stamp.

I think the MOST important thing to immigration/customs back in countries like SriLanka,India,Bangladesh,Pakistan is the word EXPIRED. The moment they hear word EXPIRED, you are treated like worthless. Common sense/logic is something they lack of or do not wish to follow.

OK, so me & wife (Wife citizen, me GC holder) had our InfoPass appointment yesterday at local USCIS office regarding I-551 stamp. We plan to visit native country SriLanka soon & what we were told by friends back home that expired green cards are thrown at face & customs at Colombo airport won't even look at the extension letter. So we lied to USCIS saying our extension letter is lost & we need a I-551 stamp. The office just told us to return the expired green card & stamped my passport (1 year validity). We were told that we will need to get my passport stamped if we wish to go out of country after I-551 expires & also told us that we should get my 10 year GC within 6-8 more months. I am now confused by the fact that what to say to officer on our return at Newark airport if immigration folks asks for the expired GC & extension letter ? I guess we will say that we exchanged the GC & NOA1 with I-551. We will carry the copies of exired GC,NOA1 letter & the infoPass appointment token.

I seriously believe USCIS should get rid off the extension letter & replace it with something else (3 year GC may be). What's the point of having the letter when many countries do not even honor it? (Just my own thought)

Was pleasantly surprised over the weekend to find the approval letter and card - hadn't checked my mail box for a couple of weeks... didnt realize that the approval times had improved and was not really expecting the approval to come through this month. Sooo glad the wait is over. Good Luck to everyone who are waiting.

For future applicants i submitted the following docs(in no particualr order),
bank stmts (under both our names)
home deed with mortgage details (both names listed)
IRA accounts with beneficiaries (both our accounts)
pics
marriage cert and birth certificates of kids (first one before the 2 year period and second one was born during this last 2 years)

did NOT submit letters of recommendation. so its not absolutely essential, however, i was confident in our case as we had a lot of other evidence. so each case is different i guess.

We did an engagement ceremony and got well over 500 pictures, over 100 of the wedding (thanks to my American friend Tabby who brought her awesome camera to the mangani...she had studied with me on the CLS last year and had come again this year).


I'm not who to evaluate your case but... you said wedding?? K1 Visa is a Fiance visa, if you are already married you need to file for a different one.

For months, the VCS was running at about 140 days. Just as my wait reached 135 days, VCS times jumped to 150. Now it has jumped to 160+. I am a disappointed tax payer. Signed Powerless


I feel you. My VJ timeline started with an expected NOA2 August 20th and has been changing non stop... today it reached October 5th. What are these people doing up there in Vermont? Start working! I miss my other half!!! (L) :(

Yes they will, but if you are carrying less than 10,000 you'll be just fine because that is the limit you are allowed to take out of the country without giving explanations. :)

When I came to the US in April, that was not an issue yet; BUT i think the only solution might be to come with ARS and exchange them at the airport.

For example: I changed some dirhams I had left from Dubai at the airport in Atlanta. Not at any Currency Exchange of the airport, I did it at the currency exchange post right after immigration. http://www.atlanta-a...alServices.aspx

So, the Argentine citizen may be able to:

1) Ask for the authorization from AFIP to buy dollars.

2) May be able to bring Argentine Pesos and Exchange them at the airport. The best airports to do this, will be the POE, the big international terminals.

3) Exchange it in Argentina into REALS (Brazilian) or British Pounds and exchange it at the airport. I'm sure he'll lose some money on the exchange, but he'll at least be able to exchange it.

Have you planned the POE yet? You may be able to call and ask if they exchange the currency. http://www.travelex.com/

I will have to correct you there Celes. Nobody will take pesos outside of Argentina. So don't take them out of the country thinking that you will be able to easily change them. Also, the restriction is not just for dollars but for any other currency too.
You can try doing the AFIP route, but as far as I know, the hassle is more than the amount of money you will get authorized for.
What did I do? Arbolitos, cuevas de calle Florida which is what everybody is doing ( of course at blue rate, not the official one which is unreal). Your fiance being from Argentina should be aware of today's exchange 'methods'. Good luck!

Respondo porque creo entender la emergencia de tu mensaje. Yo fui visa K1 en 2012 y tardo 4 dias habiles en llegar a DHL (estaba apurada yo tambien, asi que pedi de retirarlo en DHL- que fue lo que me ofrecio la embajada- en vez de esperar que llegara a mi casa). Lo unico que te voy a decir, y tomalo mas que nada como un consejo de buena fe, es que antes de tomarte el avion con otro pasaporte y llegar aca pensando que no van a reconocer que sos la misma persona; avisa a a embajada por las dudas. Una vez que tenes la visa otorgada tenes que entrar con esa, cualquier otra o waiver pierde validez, y no quisiera que llegues hasta aca y te generes un problema mas grande con los agentes de border patrol (y tal vez no puedas ni entrar) del que ya tenes de por si con tu mujer enferma. El que avisa no traiciona, y tal vez la embajada logre acelerar aun mas el proceso y entregarte la visa de urgencia manana mismo en la embajada (despues de todo, lograste dos expedited already, asi que esta mas que demostrada la situacion de urgencia). Mucha suerte con todo y que se mejore tu mujer!

Hola a todos! My fiance and I are preparing the i129 application for the K1 visa and I have a question, specific to Argentina. I am from the U.S. and am here in Argentina on a tourist visa. I have been living and working here since 2011 (with my fiance) although I am technically a tourist. I am SO confused about what to put as my address on the i129 and Biometric forms!!! If I am technically just a tourist here, then do I "live" in the US and should put my permanent address (my parents' house), or do I "live" in Argentina since I have spent more time here than in the US in the past 3 years?? Any advice will be much appreciated!!!

We had the same situation as you do guys. My husband (back then fiancé)had been living as a "tourist" in Argentina for 3 years by the time we filed the petition. The only difference is that he always kept his condo, which was being rented out, and that was the address we use in the form I-129F (you would have to use you parent's from what you're saying). Now, when it comes to the G-325A Form (Biographic Information) make sure that you complete "Applicant's residence for the last five years" with your Argentinean address. In that way, you are not lying about the fact you are in Argentina but you also completed the 129 form with the US address that they are requesting.
My husband had his own company and he was filing US taxes from Argentina during those year, I don't know how your situation is (working as a "tourist" in Argentina)... but I'm sure you know you have to show that you've been making certain amount of money to support you and your future husband/wife, and you need to send your tax returns from previous years. (read the guides, you can have you parents or someone as a co-sponsor if you don't meet the requirements).

Tengo otra pregunta: Hay problema si en la aplicación i-129F anotamos la dirección donde mi prometido prefiere que le llegue la correspondencia, y no la dirección del DNI?


Yo no tenia la direccion cambiada en el DNI, asi que la direccion donde vivia, y que puse en el formulario, no era la del DNI y no tuve problema. Igualmente a esa altura del proceso a el no le va a llegar nada por correspondencia, sino todo a vos aca en USA, asi que la direccion me parece que es mas una cuestion de info biografica que otra cosa.

Hola a todos! Tuve la dicha de encontrar este sitio, y he leido todas sus experiencias! De verdad que estuve una madrugada, hasta las 2:00 am, leyendo todo lo que ustedes han comentado aquí, y me siento mas motivada que nunca, y con un optimismo que nadie me lo quita :) Mi prometido es de Argentina (yo tuve la dicha de viajar/conocer su lindo país en 2 oportunidades este año; una vez en Enero y la segunda vez en Septiembre). Conocí al afortunado (jeje) hace un par de años, mientras el estaba acá en EEUU en un programa de intercambio laboral. Y bueno, desde el 2008 nos conocemos pero... fue hace un año que hablamos seriamente acerca de nuestro futuro juntos y nos pusimos de novios. Yo ahora estoy lista para empezar a llenar la aplicación para visa K-1, y empezar el proceso por el cual muchos/todos ustedes han pasado. Quería compartir un poco! Saludos.


Bienvenida! Yo, que soy la Argentina de esta pareja, estoy a 11 dias de entrar a USA con mi K1 Visa otorgada. Empezamos todo el proceso en Abril de 2012. Depende el Service Center que te toque (Vermont o California segun el estado donde vivis) y de lo atrasados o no que esten en ese momento, tu proceso puede llegar a ser mas rapido.

Te deseo mucha paciencia, porque sin duda es lo que se necesita para este proceso! :)

1= despues de enviar mis papeles y recibir mi NOA 1 tenia que hacer algo mas? porque en la pagina oficial donde chequeo mi status dice que ellos me enviaron un email que nunca nos llego,

2- alguien sabe porque la fecha probable de mi Time line, cambia justo cuando llega el dia que me dice que es probable,? primero me decia el 14 de Octubre, llegado el dia, cambio a 24 de Octubre, llegado el dia, cambio al 10 de noviembre, despues al 25 de noviembre, ahora al 29, la verdad me tiene loco eso, porque te da espectativas y despues pumba para abajo, a todos les pasa lo mismo?
