Removing Conditions on Residency General DiscussionInterview Experience at Newark, NJ
I wanted to share my interview experience since not a lot of people have the honor of going to an interview for removing conditions.

I was scheduled to go to the Newark, NJ office of USCIS on Broad Street June 25th at 10:30pm. My wife was with me and as always in my case I was a little late but luckily by only 5 minutes. The lady just took our interview notice and asked us to sit down. The area where the removing conditions interviews take place is different than the one that I went to before for an Info Pass appointment. It is much smaller and a little depressing.

Luckily we only waited for around 20 minutes before my name was called by a USCIS Officer and we were escorted through Door 1 towards his cubicle. I have to say the views of Manhattan from his desk were stunning and a little distracting during the interview.

In any case before we sat down he asked us to raise our right hand and to swear to tell the truth and nothing but the truth, which obviously we did. He then asked us to sit down and wanted to see both our passports and drivers license and my green card. I informed him my green card was taken by this very same office the day I went for an I-551 stamp.

He then started asking a bunch of questions:

How long have you been in the USA? (Almost 8 years)
When did you come to the USA? (August 2001)
Have you ever been in trouble with immigration? (No, ***It's bad enough not being in trouble***)
Have you ever been arrested? (No)
When did you guys meet? (Mothers Day 2005)
Have you ever traveled anywhere together? (Yes)
Where? (Multiple trips to Chicago, Multiple trips to Canada, Pakistan, UK, France)
To me – Have you ever traveled alone (Yes for work)
Where do you work? (Gave my company name)
What do you do? (In IT)
Describe your work? (Gave him all the technical details which I'm sure he didn't understand)
Have you ever been married before? (No for me, Yes for my wife)
To my wife – When did your previous marriage end? (April 2003)
To my wife – How did it end? (Husband Passed Away)
To my wife – How did he die? (Reason Given)
How many children do you have together? (One)
How many children do you have in total? (Two)
Do you have the birth certificate of the child you have together? (Yes – submitted birth certificate original)
Do you have a copy of this? (Yes – submitted copy)
Where do you live? (Gave address)
Do you have any other documents to give me for this petition? (I was a little confused….Basically wanted to ask like what? But I gave him a thick pile of statements from our joint accounts, IRS transcripts and account history of last 3 years of my tax returns. Lease papers, Auto Insurance Copies. He kept everything but the bank statements, saying he already has them. I informed him I also have photographs. He wanted to see them, took a look and returned them.)

He then told us that everything is good and that my application is approved and that I should be receiving my green card in 3 to 6 months but probably earlier (HA!). He escorted us back to the exit and that was that. Whole thing took probably 30 minutes.

I should be saying I'm really overjoyed, but honestly I've moved on after one year lurching in the dark with this petition. I have already filed for Citizenship and that's what interests me now.

However, thank you everyone for the invaluable advice you guys give. This forum is the best. To all those still waiting, good luck and there's no need to worry.

I feel bad for you. All I can say is that you have to deal with this ####### for about a year and a half more.

If USCIS was that efficient my application would have been approved by now (notice June 2008 application date).

US Embassy and Consulate DiscussionK-1 Interview in Skopje Consulate
I had my interview today and everything went well. Still, I have no approval!

It was scheduled at 8am, I was there around 7:20 and had around 15 people ahead of me standing in the waiting line. The security lady went out and started calling our names at 7:50 from her list and told us to stand in front of the front door in pair of two people as our names were called. I was called first (my initials are AA maybe because of that, maybe because of the visa type, I don’t know exactly).
Than she told us to enter as ”couples”, my pair was an older man who was concerned a little bit about his wife who had to stand behind us, but the security lady told him that she will be in in a moment. She was very nice to the crowd. Usual security checks – no cell phones, empty our pockets etc, etc...I had my purse at my mum’s who was waiting for me in a nearby cafe, just my papers with me.

Once inside the other security told us to enter the right door and we will be told what to do. We entered and asked to show our passports and proofs of payment. Than a CO (or maybe not) was checking our documents if they were in the exact order. He asked for all originals and assembled them to the certified translations and briefly reviewed if everything was filled in them. He said, ok, you have everything in order, pls sit there and you’ll be called for your interview in a minute.

My name was called shortly after at window No.2, this young CO was very pleasant to me (he spoke my native language). Once again – my documents was carefully examined for like 15 minutes with sporadicall questions that seemed more like comments to me. So, you have never been to the States, right? No, sir. What’s the name of your fiance. When did You meet? Where does he live? He entered into the computer something all the time, put red stamps on my documents and smiled – I could see that he’s putting my documents in the pink sleep.

He opened my medical, the I-134, my own savings and tax returns and I also gave explanation which he didn’t really asked on what I’ve included in my visa application. Than he asked: do you have any proof of your relationship with your fiance. Of, course, here you are and I passed him over the window a bunch of e-mails, screenshots, pictures of us together and of our video chats, half of the I-129 petition with our statements that we want to get married and intend to do so in 90 days upon my arrival....he smiled very sincerely when he saw a Bridal Magazine that my fiancé had subscription for ?!? (I adore my baby :D ) He also looked at my wedding dress receipt paid by my fiance’s mother and our purchased cards for Manu Chao and Thievery Corporation in June  as well as the hotel reservation for the event. Also I pointed to a document with my name on it in which my fiance authorizes me as a second cardholder for a of a huge supermarket (BJ’s I think).

Very nice, he said, sit for a while, the Consul will be here soon, he will take your fingerprints and sworn statement and your visa can be ready later this afternoon, if approved. It was around 8:30.

I waited ‘till 11:30 ?!?

Everybody’s name was called (I could hear the consul voice from the window) but not mine. The waiting was killing me and I suddenly got scared. Three more people in the room including me....and than my name was called at window No 1.

The consul or vice-consul was very young man with glasses looking very relaxed and friendly looking. He started in my language and then asked me if I’m comfortable with my English. Of course. The whole conversation was very spontaneous and I never felt like I was interviewed. Once again, very similar questions as he was looking into the screen and entering some stuff from my documents: how did you meet, did you sit on the same table at your friend’s wedding when you first met your fiancé? I explained. What are your plans? When are you planning to go? I said that our general plan is to wait for my sister and British brother in law to come from the UK and have sort of family reunion and than to travel on May 18 (no plane ticket, of course).

And than he said that he has no doubts that our relationship is real and no suspicion that we have serious wedding plans BUT that I don’t have my Police clearance !!!!
STUPID ME, STUPID ME I only had court certificate !!!

He was extremely patient and nice to me and explained that he has a procedure to follow, and that the States need both certificates – police and court in order to issue the visa. Still, you know, this is an immigrant visa and you need to have them both, he said, and than the whole thing will be much clearer, he assured me and sounded like he was very sorry in a way saying that once I provide my police certificate it will be fine....

He than gave me a peace of paper with marked section of 221(g) in which he wrote: Police clearance needed with his signature on and also gave me a business card with "consularskopje" email that I have to write to, when I have the document in my possession and told me that I’ll be additionally invited at the embassy and asked to present the original and the certified copy.
Than he gently smiled and said that hopefully our wedding plans won’t be ruined because of this but that it only depended on how quick my officials will issue my police certificate.

....that was about it...all in all, I’m satisfied with the treatment at the Skopje consulate and didn’t worried a bit (ok, yes, I’m lying) because I haven’t been arrested in my life or haven’t had any kind of police problems, or even a traffic ticket or any other of minor offence.

I had no clue that the police in my country issues this clearance and I went to the Ministry of Interior after my interview. I GOT IT IMMEDIATELY AFTER I FILLED due to extreme emergency :)
So today I’m taking the document for translation and I’m going to write an e-mail for my readiness to show this document when they schedule new appointment for me.

I hope and pray that my visa will be approved....I really do.
And I will never give up!

p.s. My worries are for my family who panicked, my sister who wasn’t with me felt completely frustrated about it, my fiancé’s family that didn’t know what to say or how or react about this problem but most of all – for my poor baby who got herpes on his mouth this week out of worries for me and who had his "stres sindrome" (indecribable ear pain) shown once again during this period :(
He dropped his phone when I told him I wasn’t approved today...
I feel like I betrayed them all...love you honey! (L)
I'll be with you very soon!!!

K-1 Fiance(e) Visa Case Filing and Progress Reportsk1 visa is APPROVED by USCIS!!

So sad to know that after long waitin to get NO2 @ USCIS , there are still a posibility to get denied upon interview!

Please let other know what are the reasons.........y its happen?! so starters like me is aware!!

1. FIANCE or FIANCEE finacial status not met below 1.25% poverty line!

2. carrier of any communicable diseases for ex (HEPAB )

As I see it the whole K-1 process is divided into two separate but correlated parts:

1. Petitioner part – preformed by the USCIS which gives permission for a USC to get married to a foreigner in the States
2. The visa applicant part – it is of concern of NVC and the foreign consulate to examine if the alien meets the requirements for entering in USA in accordance with the provisions given by the law - INA

Both parts and both individuals are equally important in different stages of the whole process of course.
As everybody here is aware the NOA2 approval itself does not guarantee visa approval as the alien applicant in many ways may be find ineligible for US visa per se.
In my modest opinion this is normal, logical procedure and makes sense, at least to me.

It’s sad and frustrating I know, being apart, stressed, waiting, scared and under pressure for all this time but it seems that’s the way things are for the matters of bringing “latent” or future USC citizen into the States on a non-immigrant visa based on love, feelings and marriage intentions that is pretty much tricky to prove.

Anyway, I’m happy that this K-1 possibility exists and that the officials and laws provide this opportunity. After all, we’re all humans and if you are honest to yourself and to the officials it will all turn ok (F)

I’m trying to rationalize the whole matter here because I thing it’s the only way for me to stay calm, patient and stable....

AND YES, CONGRATULATIONS ON YOUR APPROVAL AND GOOD LUCK FOR THE REST OF YOUR VISA JOURNEY !!!

K-1 Fiance(e) Visa Process & ProceduresCourthouse weddings?

Check the rules in the state where you live. In California, for example (in nearly every county, I believe, and in several other states), practically anyone can become a "Deputy Commissioner of Civil Marriages" - which entails going to the county clerk or recorder and getting sworn in, paying a small fee, and emerging with the ability to marry a specific couple. That's a way to make a personal ceremony outside of a church or a city hall. You can have your beloved uncle or the best friend who introduced you, etc, conduct the ceremony according to however you want it done instead of some anonymous city official or justice of the peace (can be cheaper than a private "officiant" as well).

I've officiated one couple's wedding and another friend officiated another sets - both were very personal, lovely ceremonies.

I'm having trouble coming up with anything for New Jersey :(

I think this can help to you and others...you can also chose any state...

K-1 Fiance(e) Visa Process & ProceduresCrying!

Does anyone else spend time crying over all this visa stuff? Sometimes I just feel like spending the day in my bed crying over the visa and how frustrating it can be. I mean planning a wedding is difficult enough, and then to have all this extra paperwork, planning and money to spend. Not to mention, trying to plan something around the world and not knowing when things will go through... ARGHHHH! :crying: I know it will be worth it when we are finally together in the US and I know it will just make us a stronger couple, but it's just so tough sometimes! Sorry, this is a little off topic I suppose, but I just want to know I'm not the only one out here crying! :crying:

No, you’re not the only one crying...it is difficult indeed, the whole process, the whole idea that actually I have to move abroad for good and get married (change of location and marital status at once is not small thing)....I haven’t been even for a walk anywhere in weeks, living some kind of withdrawn life, lost contact with many of my friends, have the feeling that nobody can understand me and our situation and not even have the will to explain....than, decreased productivity at work (I have to be honest for this one), haven’t been interested for nothing but “the petition” and everything connected to it...and of course: the difference in time zones were killing us....like living 2 lives at the same time...
Lot’s of trouble and worries of how to prove that we’re actually communicating because the petitioner is naturalized USC and we talk in our native language not in English due to no possibility of submitting e-mails or some kind of evidence that other couples usually can.
Being scared, being totally scared all the time how things will turn, RFE’s...and than again...what my life will be like in the States being all alone, without possibility to work for some time, change of mentality and lifestyle, insecurity for my English proficiency or having an accent or even computer skills or drivers skills, or any other capability that a person can normally rely on when being in their home country...it hurts like hell ALL the time without him ...and I can’t stop crying sometimes...
He can afford I suppose to be absent or relaxed or even not really interested in details that I’m trying to explain sometimes when having our video-chats (he’s at home of course and he knows how his officials work, he's been through it - I’m on stand-by right now or at least I feel like being on crossroad) I’m the one that simply can not afford it..... or maybe he just wants to send me a signal that everything is going to be great and suppress his own feelings of loneliness because of me.....and I can’t stop worrying about everything all the time...it hurts and it’s a very bad feeling.
I guess the whole journey and the separation time just makes us stronger as individuals being on our own most of the time, more patient with each other and better couple after all.

...so, no, you’re not the only one...

K-3 Spouse Visa Process & ProceduresApproved March Filers past NVC
Zolanden, this waiting for the transfer from CSC to NVC make me crazy. This was even more painful than waiting for approval. We waited a month and three weeks. I know that this is very difficult. They will receive it I hope by the end of this week. Call CSC too. Try to find out something. After we have waited a month my husband called them every day. He received even a remark by CSC for calling too often innocent.gif
I think that my and your petitions have been reviewed by one and the same officer who is lazy and wait with weeks to collect more petitions and after that give them for transfer. Wish you luck good.gif good.gif good.gif

just got a mean person on the phone who said I called in to "request" too much.. I called from 10/15, 10/16, 10/19, 10/22, 10/23.. to bug them to hurry up and take a look at my case.. she said just call once a month from now on even if it is after 180 days.. I tell her that I see March people who already have their interview date and she said that "each case is different".. no other explanation.. she was just a mean person who probably hasn't waken up yet.. crying.gif crying.gif crying.gif What do you guys think? Should I call more and bug them or wait some more? If I do call too much, they might put my case back at the bottom again... Isn't there somewhere we can complain about that? I was going argue and tell her off, but that might ruin my visa chances.. They said they are looking at my case and doing the "security checks".. do you guys know how long that will be? Is that the 1 year checks I see some people getting??.. I asked to see which "security check" it was to (me or her?) and the USCIS person said she didn't know..

It will be really sad if this "security check" does take another year... =( I already work for the government and they did my background checks already... so I really don't know what is going on here.. crying.gif crying.gif crying.gif I thought at least we will zip by the security check portion.. What does it take to hurry it up? You have to be related to them or something?.. even with a US Citizen (government worker), it still is uncertain when it will get approved...

My husband called them too often and they make to him the same remark. I think that this will not delay your case but call them again at least after 10 working days. According to me it is time for your approval good.gif good.gif good.gif Wish you luck!!!

K-3 Spouse Visa Process & ProceduresQuestions on the DS-156
QUOTE (ara @ Oct 25 2007, 06:12 PM) <{POST_SNAPBACK}>
Hello VJ,
Please help me tell my husband what to put for some of the answers on the DS-156 as I am not sure. We are married and have a K3 visa interview on Oct. 31st and don't want to make any mistakes.

On #31. Have you ever been refused a U.S. Visa? Yes or No-When?-Where?-What type of visa?
Well I am not sure what to put when we got married my husband applied for a tourist visa to come visit I told him they would deny it but he said he had to know for sure he paid the visa fee and of course he was denied. He is saying he was not denied only advised that his wife had to go back to the US and file the necessary paperwork like the I-130. So what do ya'll think should we answer the question yes or no?

On #36 Has anyone ever filed an Immigrant Visa Petition on your Behalf? Yes or No If yes Who?
Since it is a K3 interview do we mark yes that his wife has filed the I-130 as well or say no.
Noone has ever filed for him before except me. THe questions are a bit tricky.

Thanks you so much!

According to me you have to answer with Yes to both questions. Wish you luck good.gif good.gif good.gif

Greetings to all and luck in getting to the goal !!!! helpsmilie.gif

We have been approved on the i-129f and i-130 on 10 Sept 2007. 5 weeks later, NVC says they still have not recieved the approved petition.

I called NVC and they say it can take up to 90 days and to be patient.

Can anyone tell me if there is a way to see if USCIS still has it and why it has not been sent after 5 weeks.

Is this a normal time frame ? My heart.gif wife heart.gif is from Colombia and I filed a k-3 visa for her.

Its so hard waiting, not knowing why it is taking so long for the USCIS to send the approved petition to NVC.

Any advice or help from your experiences would be greatly appreciated !!!! good.gif

THANK-YOU FOR READING MY POST innocent.gif

In last two months CSC send papers to NVC with big delays. Five or six weeks become normal. Our was approved on 15 August and NVC received it on 28 September. I know how difficult is to wait for this but it is time for your papers to be received. Wish you luck good.gif good.gif good.gif

Hi all! Just wanted to check in and tell you that my wife is now in the USA with me and we are VERY happy! We even were able to bring her cat and dog (not easy, but somehow we got it done)! I couldn't believe it because we flew in through Atlanta, and got the bags (4 huge bags at 23+ kg each), cat, dog, and through all the immigration stuff in about 15 minutes. It usually takes me an hour with just one bag, so we were really lucky this day. They didn't ask us any questions at all. So everything is good and finally we are together. Good luck to everyone else and thanks for all the great help and support you have all provided to us here! God bless!

Congratulations and wish you all the best!!!
Wait for you to join AOS section of the forum smile.gif

Hello all, we have safely landed in the US. As much of a hassle we had to go throughtout this journey....coming here we had 0 hassles. The immigration asked no questions and it took us 30 minutes to get out of the airport from the time the plane landed. It feels like a dream, I can't believe I am finally in our house with my wife.

Good luck to you all. I hope all of you get to have a simiar feeling very soon. smile.gif

That's great, Kalina! Congratulations! I take it the POE experience went ok?

Yes, at POE had not problems. We enter through Chicago and they asked me only how long I am married. The only problem there was a big queue and we have to wait long for our turn.
Jas S sorry to hear about your problems. It is not fair mad.gif mad.gif mad.gif Hope that everything will be o.k. good.gif good.gif good.gif
