Today I have received an e-mail stating that they have mailed me RFE letter on July 2. My NOA1 is Jan 16 & got transferred to TSC.  I was expecting it anyway, so happy that it moved one step ahead.  Now waiting for hard copy, might be for G325A & Letter of intent with my original signatures (beneficiary), but let us see once the hard copy is received. 

 

Hi HunnyBunny, I'm a Feb 2013 filer of K1. My Fiance is also in Mumbai. I'd be interested to know more about what you received the RFE for. Can you please keep me updated? I have been reading the master RFE list and one thing I found out yesterday is that on the form I-129F on Part C, Question #3, everyone who has not checked any boxes seem to be getting an RFE for this.

NO RFE!!!!!

 

I'm soooo happy and excited!!! I can say that this forum was a huge help for in in putting together my K1 package together.

Hey Guys, 

 

I am a Feb filer and just got my Approval Email. The file was transferred from VSC to Texas June 21st. We also got an RFE, but after exactly a day of them getting my RFE backl, it was approved.

 

Does anyone know the process from here on out. I am bit confused about when the file will be transferred to the Indian consulate for visa. I understand that it goes to National Visa office next, but is it sent to the Indian Consulate at the same time??

Does anyone know about an approx. timeframe?

 

 

Hi Kinnu554, looks like we have a similar case. I'm feb 2013 filer and my case was also transferred to Texas on June 21st. I never got any RFE and received an email 2 days ago that my NOA2 was approved. My fiance is also in Mumbai. As far as I know, I believe it's going to take a little more than a month for the file to get to the indian consulate. I think you're basically looking at about 2.5-3 months on average to getting your visa. This is what I was told by a fellow VJ member on this forum (thanks Cooltoon79!)

 

I think in the meantime you should be ready with the next set of documents mentioned below. I think I have them all but let me know if you think I'm missing anything.

  • copy of NOA2
  • affidavit of support
  • my past 3 years tax return
  • pay stubs
  • letter of employment
  • letter of intent
  • copy of the entire I-129-F package.

Each senator has their own website, so you can google search for your local one, and find the contact information online.  What happens is after you contact them, they will get you a form you have to sign and submit which legally allows them to look into your case for you.  All of this is usually done by an aide or intern or some other assistant type person working for the Senator.  Once they receive that form, they contact CSC and inquire about your case officially. Each service center has dedicated employees who deal with congressional requests.  They have a time limit to reply to any of these requests.  They must look up your case and reply to them by that date and then your congress person replies to you.  If there are no snags in your petition then this will generally get your application out of any possible black hole and onto the desk of an adjudicator.  

 

 

Many times, I've actually read where people were in the midst of starting to work with their senator when they get approved, and sometimes there's an issue with background checks or something else that is an actual cause for the delay, but at least you can get a reason out of them if not an approval or RFE.  

 

Thanks UK-USA-K1, that's very helpful. I will be sure to keep in mind. I'm reaching my 5 months in about 15 days so I may give this a try if I don't hear anything by then.

Hi Guys, I do hear this a lot here about people getting in touch with their congressman, etc. Does this really help you think? Also, how did you get them to write the email/letter? Is there a online process for this or do you just have to call them up and request one?

Same here. Got a letter in mail few days ago that said that On June 21, 2013, we transferred your I129F, PETITION FOR FIANCE(E), to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed

 

I filed in end of Feb 2013. I hope this transfer will expedite the process. Can't wait to get my NOA2 :) Good luck to everyone here!!!

I'm a Feb 2013 filer of K1. I have been reading the master RFE list and one thing I found out yesterday is that on the form I-129F on Part C, Question #3, everyone who has not checked any boxes seem to be getting an RFE for this.

 

Here's the question.

 

If you have provided information about a conviction for a crime listed above and you were being battered or subjected to extreme cruelty by your spouse, parent, or adult child at the time of your conviction, check all that apply to you

 

(1) I was acting in self-defense

(2) I violated a protection order issue for my own protection

(3) I committed, was arrested for, was convicted of, or plead guilty of committing a crime that did not result in serious bodily injury, and there was a connection between the crime committed and my having been battered or subjected to extreme cruelty

 

Since none of this applied to me, I didn't check any boxes. It does say check all the apply. How can they send an RFE for something like this? This will create unnecessary delay.

Thanks but I was told that the process has changed already. It seems that you don't need to send them any forms anymore. You just take them all to your interview.

quick question. We're basically waiting to receive our appointment letter at this point.

 

Did you wait to receive your appointment letter before you sent them any Packet 3 related stuff? I'm assuming that's how it's supposed to go but it's kind of confusing if you look at this URL

where they're saying that Appointment letter will come as part of Packet 4? Is that correct? Should we just not wait for the letter to come in mail or email and just send them DS230 form and the checklist as specified there?

Hi Guys, I really need some help here as we're not able to find out what the procedure for this is. My fiancee went to Mumbai passport office and spent the whole day there. They're telling her that it's going to take more than a month to get the PCC for Mumbai because the address on her passport is not the current address where she's living. Anyway, at least we have that going. Now the other thing is that she's spent some time in Australia (she got her masters from there) so if I understand correctly, she's gonna have to get a PCC for Australia as well. Anyone knows how to get that or what the process is for applying for that?

Removing Conditions on Residency General DiscussionWhat are the best steps for a divorce after filing I-751?

Hello everyone i am seeking much needed advice. We filled the I-751 jointly in February. I got the one year extension letter shortly after. Did my biometrics late march.

However, my spouse wants a divorce. i'll tell you why, she doesn't see the point of being with someone who makes less than her so she wants out and i cant talk her out of it this time. She is beyond words becuase she had me move out in (may) and served me devorce papers the following month.
So what do i do after the divorce is finalized to preserve my status and continue living legally in the US?

i have no police record, i work and go to college. and i did the best i could for my wife but apparently it wasn't what she wanted.
i welcome any helpful and positive adviceadvice.

We had our first interview 2 years back and the reason i beileve its a stoke interview other than it being the second interview is that the letter they sent me said that the interview will be recorded. But she isnt comming i know her, the only reason she divorced me was to spite me and screw up my immigration matters. The property is hers, so there will be no letter from a land lord. they requested the both of us in the letter.


PS i emailed her twice and she has not responded. that was 3 weeks ago when i got the letter from immigration.

hello all, i have my stokes interview comming up in a few days and i wanted some helpful advice please on how to handle it since my spouse/sponsor will not be attending due to our divorce. we filed removal of conditions jointly then immigration requested additionla evidence. i submitted my waiver to file alone and now the want an interview. i guess its mainly becuase i  dont have the main evidence they require joint mortgage utility bills car payment. and the reason for that is becuase my spouse was already established before we met so everything was already in my spouses name.

 

everything else i have, pics, greeting cards, travel documents, letters from friends attesting to our union, car insurance, joint bank accounts, school douments showing both our names and addresses, work IDs showing both our names, social security cards with same address, joint taxes, love letters, emails. and also hard proof of what cause our relationshipto go downhill. 

 

I consulted with attorneys and they are charging big dollars just to attend the interview and i simply cant get my hands on that kind of money. i have no crimal record, i spend most my time studying for school (which is one of the reasons why my marriage went down hill becuase my spouse believes i should be working more than spending time studying for my degree). sorry for rambling guys, i would like to know what to expect or how to prepare for the interview when i go in by myself in a few days, so any helpful advice will be tremendously appreciated.

if anyone is familiar with the options i have which would allow me continue to live in the U.S i would be grateful if you shared them. i am not trying to gain sympathy, but i have no family left and life has gotten worse back home. i have established life here and i would like to keep it. 

no criminal history, paid taxes, kept all my jobs, part time student. 

i live in the Hudson Valley, NY. please feel welcomed to share your experience or positive advice. Attorney Contact info, etc.
