Sorry if im posting this in the wrong area!

I have a BF who lives in ireland, And we have met before and He wants to live here in the USA, Yes i am an American Citizen Born and bred and i have my own stuff (so dont think im not)

And obviously he is Irish Born, We want to Be together and right now distance/ Not knowing what to do stops it, we KNOW if we he were to come here to live we would need a K-1 Fiance visa, BUT we’ve been told by a USCIS Lady that if he came on the VWP (Visa Waiver Program) we can get married and he can file the I-539 and then the I-130, which is a Petition for Permanent Residence which costs $420 and the waiting time is about 5 months and she said we can download these forms on the USCIS site, Then we rang back to double check and we got a different lady who said he can NOT do that and we would get jailed & fined, if so..
So what can we say? He wants to live here, we wanna be together? and we’re getting NOTHING but mixed results even from the USCIS who DEAL with these things.

It is not acceptable to enter the US on the VWP with the intent or for the purpose of getting married. The VWP is a tourist visa and any activity outside of sight-seeing and recreation, such as working a job or getting married, are in violation of it. Some people do fly over and get married on VWP, but in order to then move to legally stay, the beneficiary should leave the country while the US citizen/petitioner files for the I-130 and then return on the Visa they will receive when the whole process has been completed. If it is found that the beneficiary is still in the US, that will cause problems, and breaking any of the USCIS rules can result in a ban on entry to the country.

The I-130 is a Petition for Alien Relative, I-539 is an Application To Extend/Change Nonimmigrant Status. I suggest you read through this website and study the forms and which ones apply to the process you want to go through. http://www.uscis.gov...00045f3d6a1RCRD

Finally, in an important matter like the relationship with a loved one, is it really worth risking being forcefully separated by the law just to spend, in the grand scheme of things, a little extra time with each other?

For our case, we put together our package of original documents and digital scans of things like passport pages and stamps. Once it was put together, we made 2 copies of the whole thing using a photocopier and scanner. So we sent off the one main package and both myself and my S.O have one copy each. If ever we need to send off another copy of the package, the one who sends it can make another copy of their package, so that we will both always have a full copy at all times.

Also, any copies of documents that require a signature, make sure they are signed in ink like the originals, or put a second signature on them.

We used 6 photos for our K1 package, which is a reasonable ammount, there's no real need to submit loads of photos as it isn't considered a top form of evidence. Plus, the person reviewing your case will only need to see a "picture of the smiling couple" so many times before it becomes unnecessary. Besides, some couples/people just don't take photos as often as others.

I just went thru the AOS process for my husband, the fee is $1070.00 for green card application, work permit and advanced parole (ability to travel)    but............   before that we had to see a civil surgeon and get a second round of immunizations.   i already had added him to my insurance and they got billed as routine so my insurance covered them at 100% (she billed about $600.00 for 3 different shots)   but she charged me a $200.00 paperwork fee and put all details in a sealed envelope that i sent to USCIS with the AOS application.

 

we filed on 4/19/13, biometrics was done on 5/24/13 and we got work permit and advanced parole on 6/29/13

 

 

 

The one thing I'll miss about Europe is medical bills are much lower than the states and we don't have to worry about insurance. I'm going to have a hard time adjusting to these kinds of things. But can I ask why he needed a second round of shots? I hope I won't have to do the same and so I'd like to get everything covered over here first because shots here cost no more than 20 bucks a shot. 

 

I too am curious about these extra shots. I was under the impression that any shots you need are done at the medical appointment you have before you leave for the US.

If she brings documented proof that she is earning over the poverty level, in London they probably won't even talk about the I-134. Since it's a new job and not documented on her tax return, then a letter from her employer and some pay stubs would be good proof and accepted by London.

Yes, for London, another sponsor would be accepted instead of your fiancé

So in short, my fiancée is going to be sorting out the support documents in the coming week, I-134 and all that. Now, currently, she is in a new job of 2 weeks, earning just over 125% of the poverty line, but she has very little savings saved up because she is fresh out of University this year, so we were going to have her Mom be a co-sponsor. She herself earns very well and would make a valid co-sponsor.

Now fingers crossed, my fiancée gets this new job she has an interview for on Monday (teaching, what she went to University for) and if so she'll be on around $40k a year, even more than what she is earning now in this current job.

 

My question is, in either job situation she is earning over the poverty guideline but she has very little saved up right now, would a co-sponsor still be accepted in our application? Would they question or deny it at all when presented with the financial evidences?

My interview is this Tues the 10th June. Can anyone tell me if this is paid at the interview or can I pay afterwards? If anyone has specific experience with the DUBLIN embassy that would be great. Also just wondering if they take credit card there?

Hey Palomino - we are also going through Dublin embassy interview, but not until July 8th.  Be sure to let us know how everything goes.  The fee just needs to be paid online before departing for the US.  Read the POE section from the below link.  They have a link there too to a copy of the letter explaining the process there.

Hi everyone...

I'm so glad to be a member of VJ, at least i know i'm not the only one waiting. Me and fiance are both stressed about the long wait, he forward the visa application to Vermnt in January 14 2013 and he got the receipt after 2 days. He again received an email that the application has been approved, by reading the comments here in the forum, i think that is the NOA2 if im not mistaken... After that , it's been 3 months and we haven't heared anything , my fiance tried to call NVC and the operator said that there is nothing he could do but wait.... We are so stressed about it, we dont have any idea if until when is the wait, our son is 6 months old now and we are hoping to be all together before his first birthday... Such a long wait.... But we are optimistic and my fiance keep telling me, as everyday passes it brings us to be closer together..... So this wait, really needs patience :-)

Does anyone has an idea how long will it take to receive A news about it? Or do u think its not impossible that we get there before our sons forst birthday?

I hope to hear from u guys.

National Visa Center (Dept of State)Anyone With This Experience?

We got our NOA2 Oct 15th and had been calling NVC for case number at least twic a week but they told us that they have not received our file yet from USCIS so the supervisor adviced my fiancée to call USCIS she called them today and spoke to a supervisor who told her that our file has been sent to the consulate directly without going through NVC. Is that normal? Had anybody experienced this before? Is almost 2 months since we got approved and I heard the petition is only valid for 4 months from the date of approval. Please I will like to know if anyone had experience this in the past. Thanks every one.



I think all approved petition will be sent to NVC. Keep calling NVC again and if you are lucky u get answer from someone who really doing their job!

i have a friend who flew MNL-NRT-JFK.. there was no problem.. except that at that moment NRT didnt have AC and it was so hot... no special permission or clearance since they wont be leaving the airport.. but better check with airlines .. double check...

yes i know that is one of the requirements, its just weird since i already got a CENOMAR here in the philippines, stating that i have never been married or married. Yet the civil registrar said i still need to get the "legal capacity to marry" considering im a dual citizen (US/Filpino).
 
 
does anyone know if i need to bring any id's or what not in getting the legal capacity to marry? 
 
 
i cant bring my US passport the moment since its still under renewal process :(

Hi marcgrace,yes , it's one of the requirements if the foreigner applies for marriage license here in PI.. The USC can obtain that at USEM in manila or US consular office in cebu.. It is like a certificate as proof that they are free to marry.

Hello, we got our son US passport and CRBA last january without getting philippine passport...its up to u if u get him PI passport so there no need to get an exit permit when he wants to exit the country.... But my fiance ( also in US Navy) prefer not to get him PI passport and we will just pay the exit permit when we leave.. Exit permit is less than 2000 pesos.
