My personal observation is that old (divorced) American men, who cannot find women in the States, go after young filipinas who need to get a US visa. The women "love" the men (who are old enough to be their dads), but both parties are basically using each other. The man uses the woman for sex and a for a loyal wife, and the filipina uses the man to get into the US and support her family back home. Why are people so afraid to admit this? I've been to the Philippines 3 times and it is soooo obvious that this is the case. If not, then why don't you ever see young filipinas with older filipino men?

So the age difference is pretty shameful in most cases. I'm marrying a filipina and filed the I-129F back in October. I'm 25 and my fiance is 26. Whenever I'm walking around with my fiance in the Philippines, all the girls stop and stare because they are so shocked that a young white guy is down there with a filipina girl. Again, this is my observation, and everyone knows it's true!


So why is it different in your case? You also want a wife for sex and her loyalty too. Simply because your fiance is not marrying an older guy, why does that mean she's not interested in getting into the U.S. and supporting her family back home as well? Just because a couple are similar in age, doesn't take away the fact that they are using each other...whether it's for love, money, happiness, security, etc. They want something and the relationship they are in hopefully gives them that. I also know of several American men that live in PI with their wives, so assuming that the wife is only doing it to get into USA isn't always the case. Even my wife tried to convince me to live with her instead of her coming here. So all the older white guys can't find a woman back home in your opinion....what's your excuse then? You're a young white guy and you're not finding a woman back home either. Don't bash others for doing the same exact thing you're doing. You'll only make yourself out to be an idiot in the process.

As far as not seeing younger Filipinas with older Filipinos, I saw it plenty of times. Even my father-in-law was with a lady the same age as his daughter. The girls stop and stare simply because you're white, not because you're with a girl your age. Walking through Montalban I had entire groups of people turn around and look at me. Every time I was in a mall I got plenty of looks. As white guys, we stand out in a crowd of non-whites, it's as simple as that.

I'll admit that I was overwhelmed what I first started looking into this process too. So many steps, and so much paperwork. It was really confusing. I looked at several online sites like the one you're talking about and even called a couple of them with questions. I am thankful I stumbled across Visajourney and found the Guides section. After I read through them a few times it all made sense. I downloaded the I-130 (I filed for a CR-1 visa) and looked at it. Everything on those forms is pretty straight forward...your address, where you work, things like that. The things I didn't understand, I searched here on VJ or posted questions and always got quick, accurate, answers. Everyone is very helpful here. It's really not very difficult once you understand the steps involved. Unless you've got money to burn (all those sites are doing is filling out the forms with the information you provide), you might consider doing it yourself like so many of us here on VJ have done. A Filipina friend of ours was married to an American man for nearly 2 years.  He passed away about 2 weeks ago.  His adult children, from a previous marrige, kicked her out of the house and told her she won't get a penny of their Dad's money.  Her 2 year green card is going to expire in June so she needs to start the paperwork for that in a couple of months.  What rights does she have regarding the house, his money, and also will she be allowed to stay in the U.S?   Who does she need to contact for these things...the police?  a lawyer?

 

Any help would be greatly appreciated!

We've been married for about 2 1/2 years and until now, my wife is using her maiden last name.  We decided not to change it before since her passport and other ID already had her maiden name on them.  We were getting close to her CR-1 visa being completed and didn't want to cause any delays or problems.  Now, she's been here in the U.S. since September of 2012 and her 2 year green card is getting close to expiring.  She would like to change her last name to mine but we're not sure exactly where to start.  Should she begin with the Philippine embassy with her ID from her country?  Should she go to the local courthouse here to change it?

 

Any help would be greatly appreciated as we're just not sure what the smartest first step is...

I think I know the answers but I'm being as cautious as possible so I have to ask:

Question #16 asks if my relative has ever been under immigration proceedings. A couple of years ago, my wife previously had begun a K1 Visa with her ex-boyfriend but (due to him being caught cheating) they canceled it before it got to the med exam/interview. I think I should answer this question with "Yes"...is that correct? If I do say "Yes", which box, if any, do I check? (The choices are: Removal, Exclussion/Deportation, Recisision, Judicial Proceedings). Do I need to explain what happened with that K1 on another sheet?

Question #21 asks us to list the last address that we lived together. Besides the two trips that I've made there, we never have lived together. Should I write "n/a" or should I list the my last 3 week trip as time living together?

The problem is, some of the words I'm tying aren't showing up correctly, like the bottom 1/3 of the letters cannot be seen (especially letters like "y" that hang down further than most letters)...I hope that makes sense. I think it asks for a Certified copy of your divorce decree. Just to be safe, I got a Certified copy from my county courthouse instead of just running my papers though a copy machine. It was only $12 and they stamped the page where the judge signed. Maybe I was being paranoid but better to be safe than get a dreaded RFE.

NOA = Notice of Action. After sending in your I130, you get the first NOA (NOA1) usually within a few days. This just means that they have received your application, nothing more. After that is the long wait while they process your I130. When that is finished you will get the second notice (NOA2).

Agreed. At the time I did our papers the mantra here on VJ by the experts was to front-load, front-load, front-load. Oh, did I forget, FRONT-LOAD. This is serious business. Why take a chance. Yes it's an extra effort, but give yourself the benefit of the doubt. At interview time the OP's spouse doesn't want to get a "non bona fide" and then think in hindsight, "If only I had sent those photos."



I absolutely agree. There has NEVER been an I-130 denied due to too much evidence! Why risk it with not enough?

I'll repeat myself:

Does anyone here realize that at the I-130 stage you just need to prove there is a petition-able relationship?

Wedding Pics and such would go towards proving a "Bone Fide" Marriage which is a completely different standard and isn't in question until the Immigrant Visa Interview at the Embassy.

For the I-130 you prove the petition-able relationship (in this case marriage) by providing a copy of the Marriage Contract (I said contract not certificate because this is the Philippines). A copy of the NSO Registered Marriage Contract is best but in all honesty we only provided a "Certified True Copy" of the Civil Registry version (again a Philippines thing) and encountered no problems.



I'm not sure, but I think the OP is sending pics for proving the Bona Fide marriage, which is asked for in the I-130 instructions on the USCIS site (and in the instruction guides here on VJ). Many people don't have joint bank accounts, co-owned property, sworn affidavits, or birth certificates of children so they will send in photos, chat logs, or anything else they think may help prove that Bona Fide marriage.

Yes that looks fine (assuming the spacing is not like in your example haha). I don't think I would bother listing the chronological order of the pics on the cover letter. Many people write a sentence on the back of the pictures, stating when and where it took place. Mine was a simple list (I copy/pasted this from an example I found here on VJ):

Often the devil is in the details an YOU are not paying attention to them. She would not be applying for a tourist visa. She already HAS one. That was in the first paragraph of post #1. If she were applying for one and said she was coming to get married, the chances of obtaining one are extremely slim, to NONE. That is irrelevant.

B and C are correct.






The only thing that matters are the requirements for YOU to get married in the Philippines. You're going to need to be there for at least two week, just to accomplish a legal marriage, not counting any honeymoon.


Is it really that difficult to respond in a somewhat polite manner? So I missed the part that she already has her tourist visa....Lord forgive me!!! "A" is also correct, as I said that since they're not breaking any laws, it IS legal to marry on a tourist visa, and that it wouldn't be a problem with their CR-1. Also, about needing 2 weeks to get married in the Philippines...yes there is a 10 day waiting period but as with many things in the Philippines, if you know the right people and pay them, that can be skipped. It also depends if the couple is going to have a church wedding (in which case there are a few extra steps) or a civil wedding (which is much easier).

A - If she applies for a tourist visa, and says that she's coming here to get married, they may not give her that tourist visa (as I originally stated, pushbrk said no, and grrrreat said it might hahaha). If she does come and get married on that tourist visa, and goes back home, then you won't have a problem with the CR-1 visa later on because you didn't break any laws or do anything wrong. It IS legal to marry on a tourist visa, they simply fear that once married, the immigrant won't leave. If they are sure that she'll go back home, then she'll get the tourist visa.

B - I got married in the Philippines last July. As a U.S. Citizen, you'll need to make an appointment at the U.S. Embassy in Manila and get an ""Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage". It cost me $50 (you'll only need to bring money, passport, and divorce papers (if you were previously married)). It took me about 1-2 hours to get that done in the embassy. If your fiancee is 18-21, she'll need parental consent, and if she's 22-24 parental advice. She will also need her CENOMAR (showing that she's not already married). You then get the marriage license after you marry.

C - CR-1 visa (spousal visas) take roughly 8-12 months from the time you send in your I-130 until your wife will have her Visa in hand.

The above is a fallacy. Tourists marry in the USA every day, thousands of them. It's entering the USA on a tourist visa with BOTH the intent to get married AND stay to adjust status that CAN be considered visa fraud in some cases.

To the OP, make your life decision and then follow the immigration path that fits that decision. Marriage in the P.I. is NOT an option using the fiancee visa path, because the marriage MUST take place IN THE USA.....AFTER....the foreigner uses the K1 visa to enter the USA.

The K1 fiancee visa is usually a little faster, but not much really, maybe a couple of months faster. Look at the comparison guide here for more info on both. If your fiancee comes to the U.S. on a tourist visa and you get married, that will probably raise a big red flag (i.e. visa fraud since her purpose wasn't to tour, but instead to get married). If you really want to get married in the Philippines, then go get married there, come back, then begin the CR-1 visa...or instead you could begin the K1 fiancee visa right now and get married here in the U.S. after she has that visa (not a tourist visa).

Your application is processing (or more accurately, in line to be processed, as there are thousands ahead of yours). Since your NOA1 is only 2 months old, your case will continue to show "Initial Review" until your application is approved and you get your NOA2. Most likely, it will still be 2-4 more months before anything changes. My case showed Initial Review for over 5 months until I got my NOA2. You can call National Customer Service Center (NCSC): 1-800-375-5283 if you wish, but all they will likely tell you is that they've got your application.

She had already gotten her NBI Clearance in Late Feb 2012, also she has the original marriage certificate from the NSO ( I have it as well ), she also has original birth certificate. All others should be a breeze to get =) . Would you know if she is able to take her "medical exam" now or does she need to wait until its been approved?

Also , would you know if she is considered an "immediate relative"?


I'm sure others can answer this better than I can but I *think* her visa will only be valid for as long as her medical exam is valid (and sorry, I'm not sure how long the med exam is valid)...so it's probably best to wait until a month or two before her interview date before getting the med exam.
