K-1 Fiance(e) Visa Process & ProceduresNOA1

Thats you notice of acceptance. your noa2 means that its been approved. TOUGH LUCK THOUGH. CSC is still working on August petitions. They are so behind right now

It seems to vary. There was just a couple who submitted their petition in January that was routed to CSC and received NOA2 approval at the end of February. :clock:

K-1 Fiance(e) Visa Process & ProceduresGetting married Jamaica he's from Ghana?

The Virgin Islands. That never crossed my mind. That is a very good idea! So, because the V.I. are apart of the U.S. We can get married there and have no problems with coming back and etc. That's a great idea!

Just be careful that you stay on US soil: http://www.visajourn...enter.html#5.12

Aww man sad face :-( I really wanted a wedding in Jamaica!

You can get married in Jamaica. You just can't do it using the K-1 visa. If you were set on that locale, you should have taken it into consideration before going through the process.

Last I checked, Jamaica is not part of the U.S. :bonk:

If you want to do the K-1 fiance visa, you'll have to be married in the U.S., otherwise go the CR-1 route.

I called my lawyer again today they told me all notices ie noa1 and 2 ect will only come via postal mail from what i had read on vj is people get sms and emails is this something the lawyer might have requested or it is automatic to be sent in all 3 ways?

You have to submit the G-1145 form to receive email/SMS notifications. Those tend to come pretty quickly and then the snail-mail document comes a week or so later.

K-1 Fiance(e) Visa Process & Procedures2nd touch

Our last touch was Nov 3rd which was a few days after NOA1. Nothing since but I am sure it is sitting on someone's desk right now collecting dust

I should have included some type of gift inside our file for the adjudicator as motivation

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support

So when exactly should I provide that child support court order? should I wait for the immigration to let me know that I didn't meet the poverty guidelines or should I included it already on the folder(evidence/proof..such as tax return, w2, employmnt letter and etc.) I made for my fiancé? Now I’m total confused

Include when you send the other financial support information. Why delay the process when you already know you don't meet the guideline?

no problem i got my answer already from the other thread.
my income is between the poverty guideline (3)$19,090-23,862/yr

Alas, the lack of formatting in that post is throwing you off.

The first number, $19,090, is meeting the 100% poverty guideline. The second number, $23,862, is the 125% guideline. There isn't a range, you either meet the minimum number -- and it should be the 125% number -- or you don't.

The only penalty is 8 to 10 months wasted plus $300 thrown away. That's all.

And the time spent on reviewing a pointless petition when the adjudicator could have spent that time on one that wants to follow the legal process.

K-1 Fiance(e) Visa Process & ProceduresSponsor and New Job Questions (3 quick questions)

Pay stubs are not required for I-134 in London.

Perhaps it's a YMMV issue, but we're preparing for our post-NOA2 based on this great, recent thread over in the UK forum: http://www.visajourn...terview-thread/

Since Clare won't have a tax transcript until next year, and assuming she doesn't use a co-sponsor, it doesn't seem like a bad idea to have pay stubs at the ready in addition to the employment letter to show some income history. But again, YMMV.
LeftCoastLadyFemaleUnited Kingdom2012-03-09 06:36:00
K-1 Fiance(e) Visa Process & ProceduresSponsor and New Job Questions (3 quick questions)

Thank you so much for answering my question. I think I should clarify one of them though, I was wondering if a letter from my employer stating what my yearly salary will be is enough to prove my new income once I get the job, or will they only accept that as my income after I am able to show them my 2012 taxes next year?

You'll need the letter from your employer and at least a few pay stubs proving that you're earning a steady income.
LeftCoastLadyFemaleUnited Kingdom2012-03-09 05:44:00
K-1 Fiance(e) Visa Process & ProceduresSponsor and New Job Questions (3 quick questions)

A) Being that I am getting a job in the next few weeks, would I need to work there a full year to get tax returns to prove my income?

You won't have to file taxes for income earned in 2012 until next year, so you won't have an income tax return until then.

C) Can I wait to file the i-134 until after my fiance and are are married & able to combine our income?

If you're planning to go the K-1 route, then no, you cannot. The I-134 you complete is part of the documentation your fiancé would present during the interview.

D) How can I find sponsors? (outside of friends/family)

Ideally, you'd look at friends or family who can co-sponsor your fiancé. If your friends/family don't earn enough or are unwilling to be a co-sponsor, then you should have wait until you have enough employment and steady income history so you don't need one.

K-1 Fiance(e) Visa Process & ProceduresQuestions about I-129F, Petition for Alien Fiancé(e)
I'll just put this out there. Helping your fiancée prepare what she'll need to submit is a great thing, but the details do matter in this process. If the preparation of the documents is stressing you out, then maybe you need to take a breather for a few days (or longer) until you're both ready to refocus on what needs to be done.

What documents do you refer to? The name I use is on everything. The only time my old name is present is on my birth certificate. Everything else is my current name. My bank card, license, government stuff... all use my current name. So I suppose I don't need to put my old name in Other Names section? That one bugs me. Either way I'll send a copy of the name change to my fiance. Just might leave the Other Names section blank. What do you think?

Since your old name is on your birth certificate, I would include that information on your G-325A form.

K-1 Fiance(e) Visa Process & ProceduresQuestions about I-129F, Petition for Alien Fiancé(e)

Where's the edit button? Seems like it's gone after a while.

13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

Why can't I understand this? lol. Relevant documents; which relevant documents? The only time I'm using my name is on the petition, cover letter, fiance letter of intent and a couple other forms. Which is my current name. I changed my name long time ago in the past. So I'm still not sure if they need to know about this. But I guess I might as well send it a long with all my other stuff.

Also, no where in the guide it says I need MY birth certificate. Only my fiance (U.S. citizen) - So I guess I don't have to send it out?

If the name you currently use isn't on the documents you'll need to supply -- I recommend looking ahead to see what you'll need to provide at the interview stage -- then you should include documentation noting your name change. Did you change your name on your government documents?

You don't need to supply your birth certificate at this stage, but you will need it for the interview preparation down the road, which again, is why it's important that if you have a different name on the documents you'll need for the interview that there's a clear explanation/document stating this.

K-1 Fiance(e) Visa Process & ProceduresQuestions about I-129F, Petition for Alien Fiancé(e)

I really appreciate the replies guys. It helps and means a lot to me. I know there's guides and stuff but sometimes I just need to get a real answer about specific things. I appreciate the help and I feel I know more now.

After these replies I have a couple more questions:

1. Cover letters and letters of intent, things that require my signature.. how do I get this to my fiance? Can I take a digital photo and send it to her so she can print it out? Do I need to really send that by mail?

Yes, you will have to snail-mail the documents you have to sign to your fiancée. You have to submit actual signatures for the letter of intent and G-325A form.

2. They say photos must be taken within 30 days of filing the form. Why? I have spare passport photos here from 3 months ago and I look exactly the same. How would they even tell the difference? Can I not just use those?

Since I don't know which country you're from...your passport photos should match the criteria for the US (white background, sizing, etc.).

3. On the g-325a form how would I attach photos? Clips or something? Obviously can't glue them and let them fall around the whole package. And this one requires me birth certificate? Again, how do I get that + this form to my fiance... by mail? digital photo?

This is covered in the K-1 guide on the VJ site, but you can use a plastic baggy for containing the photos and clip them (not staple or glue) to the appropriate documents.

4. I have had my name changed in the past.. so again, do I need to send this out by mail or can I take a digital photo and she can print it out.

Sorry for the questions again..... I just don't wanna do one mistake and seeing how big all this is, mistakes can happen. Oh boy :(

Since you're going to have to snail-mail her the other documents, you can always throw in the name change documentation, too.

As has been mentioned, this process can be easily done as long as you (and your fiancée) are ready to embark on the journey. (And it really is a journey.) You can search the forum to see how those who used the services of a lawyer have fared.

K-1 Fiance(e) Visa Process & ProceduresQuestions about I-129F, Petition for Alien Fiancé(e)

So trying to do this form, but have a few questions about the requirements. I've been reading for like 2 days straight on the process... getting mixed answers.

1. How and when do you pay for this form.. when you send it out? Or do you pay after? I can't find on any websites that tell you WHEN you have to pay.

2. I have changed my name before in the past. It has nothing to do with marriages or anything, just changed it when I was younger. (Im a guy btw) I'm talking about the "Other Names" section on the form. Can I leave it blank, or I must mention my changed name? That means I'll have to send a copy of the change name to my fiance in America? Thats gonna delay everything :(

3. Do you need a photograph on the form? I dunno where I read this but I saw it somewhere. I sure hope not. Makes everything harder.

4. Form expiry date says 02/29/2012 down below it says (Rev. 11/23/10) - apparently it's still okay according to the website saying edition 11/23/10 is still okay to use. Just wanted to double check with you guys.

I was hoping it was as easy as filling out the form, sending it, wham bam, approved.

Anything else I need to know before my fiance sends out that form? Don't want any mistakes and delays.

First and foremost, please:
:guides:

There are example forms on this site as well that will help you. Please read through everything at least twice, especially the instruction docs as that provides you with the payment information, where to send your information, etc.

If you thought this would be easy, please read these forums to disrupt that theory.

On your changed names, if you changed it legally, then yes, you need to note that.

K-1 Fiance(e) Visa Process & ProceduresWhat forms should i get?

Hey guys! I am preparing to go visit my girlfriend in just over a week. It looks like it will be the last visit before we get our application started, so heres where i need a little help. I know i can get "example forms" from this site. I am just confused as to which to look at. I want to prepare a sort of "mock folder" for her/us, so that we can print out the forms that we will actually need in the future, make sure we understand everything and know how to fill all the forms out correctly and minimize the risk of any mistakes on our final forms on our actual application if that makes sense?

But for now i want to be able to study them with her. Which of the forms exactly should i take with me for her?
Also, as she will be starting the process off, whats the order of the forms that we need to complete.

I have read the guides and glanced at the forms myself, but my mind is all over the place as to what we need and when we need it etc. So any help is appreciated. Explain it in "for dummies" style to me if you have to haha!!

Thanks for any help guys! Much appreciated

There's two addresses for I-129f that you can send it to. What is the difference? and does the processing time differ on where you send it to?

The PO Box address is if you're using USPS. The second one is for express mail (FedEx, UPS, etc.) or courier delivery. There's no difference in processing time as your materials will end up at the same place.

K-1 Fiance(e) Visa Process & ProceduresLeaving the US for honeymoon
You can't leave the U.S. until you get your AP, which you get after you apply to adjust status, which means you would already be married. If you plan to marry outside of the states, you'd have to get a spousal visa since your fiance would be entering the U.S. as your spouse. You could potentially do Puerto Rico, US Virgin Islands, Hawaii, etc. if you want to stay in the US, but have a tropical destination. It usually takes 1-2 months to get the AP after you apply for AOS, so you can't do a typical honeymoon abroad (meaning directly after your wedding). I know we decided upon a U.S. destination for our honeymoon because of this.

Good luck.

They don't take hair samples.

And if it's just # don't worry, they don't test against that. The traces are gone in a few weeks, and they are mainly interested in testing you for HIV and communicable diseases (TB etc).

Agreed that there are no drug tests, so you don't need to worry about that. fyi - they also no longer test for HIV, just for TB and syphilis I believe (not positive which they test for, but I know HIV is no longer relevant for the communicable disease aspect).

K-1 Fiance(e) Visa Process & ProceduresInternational gay marriages in New York
Be aware that getting married can make it difficult for your girlfriend to enter the U.S. because of the question of immigrant intent. It is often recommended for same-sex couples to not get married because of that. However, if you decide to move to Australia, getting married now could benefit you in the future since you'll likely be married over 2 years when USCIS starts recognizing your marriage (which I have no doubt will happen sometime in the next decade). Contact Immigration Equality (http://www.immigrationequality.org) - they have legal staff that can help you determine the best action for your situation (no cost). Good luck - I hope you find a way to be together soon!

K-1 Fiance(e) Visa Process & ProceduresLegal Parents

I really need help on this worry.
I am the named "Alien" in this situation. My fiance and I are now applying for a K1 Visa, my Fathers name is missing on my Birth Certificate and I know nothing about him, my Mothers name and place of residence at that time is listed on the Certificate but that is all I know about her.
I was fostered at a very early age (my legal Guardians being Banardos Foster Care) but both my Foster Parents are now deceased. I am worried about putting anything misleading or confusing (unintentionaly) on any forms concerning my Parents in any way.
I would appreciate any advice about this matter from anyone who has been through or knows about this problem as such, Thankyou.

I agree with others - just explain the situation. My wife's birth certificate has "unknown" listed as the father and we just put that on the paperwork. It was no problem.

If you look at the instructions for the I-130, it'll give you the info. Basically, you can if it has been 5 years since you became an LPR, you can prove 1st marriage was entered in good faith, or first marriage ended due to death of the USC spouse.

HPV is insanely common and says nothing bad about you as a person. I would absolutely check yes on the form - they probably wouldn't find out, but it's best to just never lie when so much is at stake. Especially since it's a lie for no reason other than the fact that you seem to be a little ashamed of it. I am a healthcare provider and I can tell you that this is something seen every day with every type of person. Work on getting over your shame about this and don't let such an inconsequential matter cause you so much distress when it doesn't need to. It won't have any impact on your application whatsoever.

Ok wait...is that $350 what we paid when we filed the petition or is this in addition?

Unfortunately just as Lainie B explained its an additional $350 visa fee on top of the original $340 filing fee! The kicker is that you need to call a premium number to pay it and it took me about 10 tries to get through to somebody due the helpline staff being so busy. It must of cost me an extra £20 to make all of those calls.

K-1 Fiance(e) Visa Process & ProceduresNext step of the process....(London)
I'm a little ahead of yourself and have recently had my medical at the Knightsbridge doctors surgery plus I fired off my packet 3 docs to the London embassy about 3 weeks ago.

1, The only fee due at the Embassy (whilst there for interview) is the courier fee for getting your passport with the k1 visa in back to you. Depending on the delivery requested you are looking at between £15 and £35 i.e. regular delivery or before 8am

2, The visa itself costs $350 like a previous poster has explained. You need to call the embassy premium rate number to pay it which costs £1.23 per min. They will then email you a receipt which you'll need to print off and take with you to interview.

3, My medical cost £210 but it would have been more if I opted to have the required shots/vaccinations there instead of having them for free via my gp

4, Get the police cert now as like the other guy said its valid for 12 months and can take a couple of weeks to show up, also make copies

5, You will need ongoing proof of your relationship which you should take to the interview for example photo's taken/dated between your original application and the interview or plane tickets.

6, I would take the copies with you, it can hardly hurt.

The embassy have added my medical results to my file but I'm still waiting on the packet 3 docs to be processed, as previously mentioned they were sent 3 weeks ago so I'm hoping they will pass through the system soon meaning that I will become 'interview ready' and get my appointment letter.

Good luck

K-1 Fiance(e) Visa Process & ProceduresPacket 3

Still haven't heard a thing about a date for my fiance's interview. It's been a week since I called DOS. All the woman would tell me was that the "Embassy has packet 3". I've been looking at similar timelines, as well, hoping that I could get an idea of when we might get word regarding the interview, but...it appears that from the time people send packet 3 until they get packet 4, it takes close to a month, and in some cases 2 months. There doesn't seem to be any consistency. This Thursday it will be 1 month since we mailed our packet.

I've read so many pros and cons about calling DOS that I'm just not sure what to do. When I called them the first time, which was about a week earlier than my last call, they didn't have any information on our packet 3, but the lady was very kind and told me I could call anytime. So, I called the second time, and I got the answer I mentioned above. But then, I felt as though I was just panicking, so I decided that I should just calm down, and wait...and not call again.

I guess my panic is really somewhat of an external thing, because I have so many people (friends, co-workers, etc) pressing me for a date for the wedding. I have co-workers that are planning a bridal shower for me. Last night, several ladies from my church told me that they have planned a bridal shower for me for November 13th and they are inviting the ENTIRE church. My caterer wants a date so she can start making preparations. It's so hard to explain to people the uncertainty of this process. I really don't expect them to understand, but I keep asking them (almost begging them) to remain flexible. Sometimes I just feel so exasperated.

If I hear anything from the Embassy, I'll let you know. :)

Your story sounds near identical to ours! We've also tried to begin organising the actual wedding as family and friends are pushing for a date in order to book their flights to California but we all know how risky that can be until the visa is actually in hand....Much like your friends, they don't fully understand the complicated and drawn out process we've gone through. At least you can take some comfort in the fact that the embassy has your packet 3 docs!! Mine still aren't on file and its been a month now although I'm considering re-sending them with a cover letter explaining why.....surely it can't hurt??

I'm trying to direct my frustration into other things such as claiming back UK taxes for this financial year (P85 Form), investigating the AOS process and looking into getting my US driving license as its a way to keep my mind busy. I appreciate you keeping me up to date and I'll do the same for you. I also appreciate all of the replies from the other members....thanks

So what's the latest news on your case?

The only reason I ask is because I'm on a near identical timeline to you and I've been told by the embassy that they have my medical exam results on file but not the packet 3 docs, its 4.5 weeks since I sent them off. I'm hoping that I can gauge when I'll get my interview letter based on VJ'rs on similar timeline's to myself.

It should be as close to a proper fit as possible, enough to hold papers, but not enough to add a jacket into as well. Backpacks and large bags scare the security people.

Thanks for the info. Its nice hearing from people that have recently gone through the same process at the same Embassy as myself.....

On a side note I had an email from the Embassy today confirming that they have lost/misplaced/never received my original packet 3 docs and that I will need to re-submit them, its a delay I could really do without right now but I'm hoping that they will accept the scans of the originals as enough to schedule my interview, then have me bring 'new' originals with me on the day. I find it unreal that docs regularly go missing after being signed for at the embassy gate...oh well!

Depends on what your "bag" is.

A laptop/courier bag as described in my original post.
