I think the age of the beneficiary (you, in this case) is more a factor in the interview than the age gap, and since you are beyond the minimum age requirement that the Philippine government requires, I wouldn't worry too much about the age gap, if I were you.

Yes, we are, and you can't speak for what that poster "implies" or not. Words mean things, and you're paraphrasing that poster's statement. Read accurately and interpret literally. What "dirty tactics"? What other "do-it-yourself" sites (plural) are they advertising on, and why would that poster care?


Really? So, back in college, after reading a piece of literature when the professor asked us students what the author meant, instead of writing a two page synopsis, we should have written, "Sorry professor, we can't speak for the author beyond a literal interpretation of his or her words?" Hmmm...that's quite an interesting way of approaching language and communication. If language were only that simple, we wouldn't need lawyers and judges to interpret law, we could simply understand them based on the literal meaning of words. Sorry, but not only do I disagree with that viewpoint, but you'd be hard pressed to find any experts who adhere to such a rigid approach to language.

We should then only have one single authority on immigration law here and that would be the law itself. No need for immigration lawyers or so-called immigration specialists. The language of the laws are plainly written and require no interpretation. I think we've answered the OP's question then.

In the process of VJ Moderation's having removed several purportedly off-topic posts (the reasons behind which are acknowledged), an unverifiable claim has been allowed to remain unchallenged in this thread:


Sometimes people do need advice about immigration matters. I've always felt EVERYONE should seek professional advice before they start down this road. We did. And we consulted with two other attorneys during my husband's AOS.

Just make sure you seek a licensed attorney who specializes in family cases. Don't use your family lawyer. Don't use an immigration lawyer that practices employment based law. Use a family specialist.

And don't use a service that fishes for customers off of DIY sites. It's not just about their dirty tactics. They aren't licensed and you have no recourse if they screw up your case.


No one can paint an entire industry with this broad a brush. There are certainly as many excellent, capable visa firms as there are incapable or incompetent ones. Potential customers should trust their gut feelings when reading these firms' claims and when interacting with the firms' personnel during the process of initial contact. Outrageous promises and careless or incomplete responses should be one warning sign.

Any VJ member's claim that all services like this are 100% bad (or "good") should be viewed with a very dubious eye. Some members should know better.

This post is 100% pertinent to the OP's OP (meaning "on-topic").


I've included RJ's entire post because context matters here. She wasn't implying that all immigration services are bad, just ones that fish for customers off of DIY sites. She expressed her opinion that doing so is dirty. We are allowed to express our opinions about such matters here, aren't we?

Again, none of us knows what any other CAN do. We only know what WE can do, and sometimes don't even know that. Folk, please realize this. Do it yourself is NOT for EVERYBODY. It takes good language skills, attention to detail, confidence and diligent study to manage a visa process. Not everybody has those in sufficient measure. Others would simply rather spend their time doing other things and leave the study and details to others.



I've never tried garlic ice cream, but the amazing thing about the human brain is that we can get a pretty good idea what garlic ice cream might taste like without actually tasting it. Also, I enjoy a good meal and know how to cook, but maybe I'd rather go some place where they'd cook my food for me. Then it comes down to what you consider good value. For some, that means they'll happily spend $30 a plate for a decent meal, while others think the $7 value meals at McDonald's provides them the most bang for their buck. I personally prefer my ice cream without garlic and my meals to taste like a real chef prepared them and not some pimple-headed teenager with bad hygiene who thinks it's funny to spit on my patty.

From what I've been reading on VJ (I lurked for a few months before finally signing up), most tend to send the past three years. You can order the transcripts from the IRS for free from their website (see link I posted earlier). It will take a couple of weeks to get them, but you won't have to go back to the tax prep group.

(We've just submitted the paperwork, but I'm always one for being prepared in advance. :D)

It should work on Windows, too, just as long as you have the Firefox browser. It was easy to do and you can export the data to a .csv (comma delimited) file that can be opened in Excel, Google Spreadsheets, etc. I use Skype for work, so I cleaned up the document to remove work-related calls. Did you try searching for it using Finder? Search for main.db.

Edit: Try this...

In the "Terminal," type:

defaults write com.apple.finder AppleShowAllFiles TRUE

followed by the command

killall Finder

You should be able to see your Skype files in the folder User/Local User Name/Library/Application Support/Skype/

I tried to follow these instructions, I have a mac too, but my skype folder is not there where it's supposed to be.... I read that iOS Lion hides it and dont know where to dig it out!! :( I guess I can go "old school" with copy and paste but its quite a long work! any advice?

Ummmm, I never expected my attorney to take the place of me being informed, and quite frankly I WAS asking the correct questions several times.... she told me at least 4 times I did not need it. Obviously I thought I did or I wouldn't hacve continued asking. I don't know if you meant that directly to me or if you were stating thats generally what happens but I am a very well educated person and I think I have done a great job throughout the process thus far :)


I don't want to speak for anyone else, but one would have to wonder why you agreed to pay so much money if you did know what was involved in the process. :bonk: That's a serious chunk of change and it doesn't include the upcoming costs!

At this point, it's probably for the best to finish up with this lawyer and move on. While her behavior is very unprofessional, if she can provide dozens of successful applicants, you would be in for an uphill battle to prove significant malpractice and I doubt you'll gather enough support for a class-action. Plus, you could very well be one of those couples who don't submit the signed LOI and get through the process with no problems.

Consider it a learning experience. And you may want to tell your parents the next time they want you to use an attorney, they should pick up the tab.

My fiance and I met via a Christian dating site and we chat everyday on facebook and talk on the phone whenever we can but we did not video chat too often because of the conflicts on our schedules. She work for a call center with an American account and works at night (which is morning in the US) and I work on 2nd shift (3pm to 11Pm). She also works on the weekends so we really don't have a lot of time to have video conversations. Are video conversations very important proof of the on going relationship? Will we still be approved even if we only had a few?


Do you email one another on a regular basis? That would also show an ongoing relationship as well, especially if you're like most of us and have a gazillion of them going back and forth over a period of time. :D

USCIS changed which visas go to different Service Centers. The Texas Service Center (different from the Lockbox) processes other applications, just not the I-129F.

Thanks for the quick replies, that makes me feel a bit better. :) I don't have the copy of the NOA he showed me, here at work, but I'll look later.

Curious though, if they don't process in Texas, then why is it listed as one of the service centers?

I'll be consulting Wisconsin attorneys and attempting to call the USCIS and will report back with what I find out. The catch is that I would NOT be a Wisconsin resident anymore when I file this. So the bad news would be a 4 + 6 + 6 month wait at minimum and we've already been in a relationship for over a year going back and forth - very frustrating, and I'm just pissed off at this state's draconian laws and the general total chaos of state laws. All this for the purely theoretical question of whether or not I would be able to remarry at the time of filing, which is guaranteed to be an entirely moot point by the time it would be possible anyway. I really won't have enough vacation time to deal with a 16 month wait, might try to take this job in the EU after all...which is why I'm trying to figure this all out before making this decision.

Should also point out the I-129F asks to certify this statement: "I am legally able to and intend to marry my alien fiance(e) within 90 days of his or her arrival in the United States." It's not even clear that it's saying "I am legally able to marry now". In fact it doesn't say that at all.

Another theoretical possibility - what if we got married in the EU after I was a California resident, assuming a court in the EU would ignore the laughable Wisconsin 6 month waiting period, and filed for a K-3 visa - could this potentially chop off 3 months?


Your best bet will be to get proper legal advice before doing anything that could jeopardize a petition for any visa. Also, the K-3 visa is no longer used. If you married abroad (assuming you're able to do so), you would have to file a petition for the IR-1/CR-1 visa, which still asks for your final divorce documents. Thus, it could still be possible you'll encounter the same issue(s).

Touches don't really mean anything. It could literally be the file is being moved from one stack to another, it doesn't mean someone is looking at it, though.. Most people will tell you their file wasn't touched at all and they were approved.

On the interview and medical exam, yes, those will take place in the beneficiary's country. There is a specific medical exam that is part of the process before your interview. Check the VJ guides for more details.

What is the wait time at other airports? I know there is extra paperwork required as opposed to tourist or student visa.

and some times i wonder if the success rate would change between fiance visa VS spousal visa? I would prefer the fiance visa,,, but I also prefer to have my love in the most secure manner whatever it takes to ensure approval :D


The approval rate is incredibly high, so I doubt there's any quota in place. More likely is people are denied because they filed for the wrong type of visa, don't meet the guidelines, etc. As I mentioned upthread, read the guides to make sure you're prepared to move forward with this process.

If you had income last year, whether in the US or in Greece, you may have to file taxes for 2011 (remember 2011 taxes are due April 17, 2012). Check the IRS' site to see if you need to file.

But yes, you will need to supply a tax return (e.g. the one you may have to file for 2011) when you send the I-134. If you're using a co-sponsor, they will also need to complete the I-134 and supply the relevant paperwork. (Note, this is all covered in the guide link I sent, in case you want more details.)

If you move while your case is pending, please call our customer service center at 1-800-375-5283.

HUH????


Translation: A snail mail document of the NOA2 acceptance has been mailed to you. If you don't receive it within 30 days of today (March 6), call them. If you move during that timeframe, call them.

In the Oath section, I interpret that line as providing your (the USC) initials and then your full signature and date just below.

Q1.In question num 7 it has a part saying "I have on deposit in savings banks in the United states $ ____________ "
(Actually there r two types of account one is current and other is savings, my fiance only has current account and no savings account now what does the question actually mean? does it mean any amount save in bank whether in current account or savings account OR does it mean amount which is present ONLY in savings account? what should she fill in that? she has no savings account


On the savings account, question, if your fiancée opts to complete that information (as noted previously, not necessary if the annual income is sufficient on its own), she'll need to provide a letter/statement from her bank noting her account(s), when they were opened, total amount deposited in the past year, and current balance. This is described in the I-134 Instructions on page 1.

It seems to vary. There was just a couple who submitted their petition in January that was routed to CSC and received NOA2 approval at the end of February. :clock:
