1. I attached mine to the cover letter and left it at that. They're going to take everything apart and arrange it in their specific order, so it's best to keep it simple.

2. What you have for the letters of intent is fine. You do have one signed and dated by your fiancé as well, right?

3. Be sure the passport photo fits the guidelines. Did you print it off on paper, or photo paper?

4. As long as everything's legible, you should be fine.

Hi Everyone!

First of all, I'm new to visajourney and hoping that I will get the help I need here. I will be more than happy to return helpful advice once I have some more experience on my plate.

I am engaged to a British man (a WONDERFUL British man), and I have been compiling all of the info needed to submit with the I-129f petition for the K1 visa. I was wondering if people have guidance on a couple of points:

1. Is there a specific, or recommended, method of enclosing the fee of $340? I have a check and was wondering if it should be attached to a piece of paper, placed in a separate envelope, etc?

2. Should the letter of intent to marry be anything extravagant? I found a very simple, general format and just used that. It says:

3. Rob (my fiance) sent me a passport-style photo and I had to print it out on my own computer to save time. It isn't the BEST quality. Is this going to be a big deal?

4. For the G-325A, I had additional cells worth of addresses and employment. I just created a spreadsheet in a similar format to the ones on the form, filled them in, and attached the sheet to the original form. There are some things typed, some things handwritten on the original. Again, is this something that will affect the likelihood of being processed quickly?

Hi we likely have the same case. We also received an RFE to prove that we met in the last 2 years. we also dont have enough proof since my fiance (the petitioner) stayed here in the Philippines for a long time and studied college here in which he graduated 2 years ago. We also dont have receipts in hotels or whatsoever and was also not able to keep our airline tickets, boat tickets since we didnt know before that we'll be able to use this. We did provide some hotel receipts but that was just 2 receipts that we had kept. and others are payments we made for a house we purchased here in the Philippines (for business purposes) and both receipts are under our name which was in track since 2008-present. we also gave them photocopies of his passport and receipts he had when he was still here in the philippines. My fiance's Filipino by blood but was born in US which made him a citizen.. his whole family is here and they have a house here as well.. that's why our proof like itineraries/tickets are not enough, we just had them during our vacations or out-of-town travel.. and most are already gone. but we did save a few. you could provide evidence for the past 2years before you filed since that's what they really need. hope you'll be able to gather enough evidence. Please read the OP's responses. She and her fiancé have not met in person in the past two years. That is a key requirement of the petition.

The last time he was here was in Aug-Sept of 2011. He was not able to come home because he transferred to a diff state( new job with no vacation leaves yet) then he had to file his citizenship so we thought it would be safe for him to wait for his naturalization. (he got hs cert in Oct2011). Does it mean because we have not seen each other for more than 2 years we 'd get denied? even if we have been together for almost 11 years? from 2000-2006 we were living in the same country.then he moved to the US and he has been coming home every year the last time being in AUg-Sept of 2009


Wait, was his last trip August-September 2011 or August-September 2009? You have different years included in your comment.

If his last trip home was August-September 2009 and he filed the petition in November 2011 (going by your timeline), then that's past the two-year timeframe as it would be counting November 2009 to the time he filed the petition.

Since you'd have the option of driving to the U.S., that would definitely keep the estimated costs lower than those of us with fiancé(e) coming from elsewhere. :lol:

As Enigma mentioned, there are the costs associated with the petition and interview process, but also remember you likely will not be authorized to work for about six months upon arrival in the U.S. This depends on how quickly you file for the Adjustment of Status (AOS) and Employment Authorization Document (EAD), but do ensure your fiancé can manage that plus any current financial obligations (i.e. child support).

On the financial criteria, that comes into play after the petition has been approved and is forwarded to the embassy for your interview. I still believe you should read the guides to ensure you know what's involved and also do a lot of research on the various services to ensure you know what they cover/don't cover. Putting together a sales pitch is remarkably easy, but can they actually do what they're promising?

Hmm I didn't know that, that's interesting. What about an agency that specializes in marriage visa. I would assume they would be fast and reliable?


As the petitioner, all of the information would come from you, so you would still have to do a lot of the heavy lifting in this process. Using an attorney or visa service -- again, I recommend doing a search through the forum to see feedback on those who did employ such a service -- will not speed up the petition and visa process. As BrittandDan mentioned, it could even slow down the process.

Plus, those services are expensive. There have been forum members who have spent thousands of dollars for something you can do on your own for probably $400 (including the petition filing fee). Again, if your situation is fairly simple, sitting down and reading through everything will help immensely. If nothing else, if you do decide to use a service, you'll know the right questions to ask.

This forum is incredibly helpful, so if you have a question, it can usually be answered by reading the guide, doing a search for a similar situation, or posting a question to get feedback from everyone.

Thank you LeftCoastLady! The reason I want to seek professional help is because I'm only 22 years old and this is all new to me. My fear is that I would not file a certain paper correctly and the process delayed weeks, maybe months!


If that's the concern, I would just say to set aside time to read through everything -- the guides, the forms, etc. -- very carefully before you begin. Using an attorney does not guarantee that a petition will be error-free.

You can also search through this forum to see examples of people who have employed an immigration attorney for their cases to see their results. Some good, some bad.

I am just about ready to start the K1 visa process and I want professional help on this. My question is, should I go with an immigration attorney or marriage agency? The cost is not an issue for me, I just want it done right and done as quickly as possible. My only concern would be the I-134 Affidavit of support. This will be my first year filing taxes. I have made about 20k. (125% over the poverty line in my state is 18 something.) I can get multiple co-sponsors, so maybe it won't be an issue.

With that in mind, who should I go with? (immigration attorney or marriage agency) All input is greatly appreciated!!!

Most people on this site file the petition and go through the process on their own without any legal assistance. If your situation is fairly simple -- no kids, no divorces, no felony record -- you should be able to follow the K-1 Guide on this site and do it on your own.

On the I-134, if it's just your fiancé(e) and yourself, then $20k is over the minimum and you wouldn't need a co-sponsor.

Here are the some of my concerns. Any input would be greatly appreciated.
1. Do I need to submit the form 134 (Affidavit of Support) for K1 visa? If yes Do I have to send it with copies of my bank account statements, stocks and share account statements and Paystubs/Tax Returns? I just started my job so don't have the tax return yet.


The I-134 is not part of the initial petition package. It will be sent to your fiancée once you receive petition approval so she has it for the interview at the embassy. When you get to that point, if you make above the minimum poverty guideline for your household, then you would need to include recent pay stubs and employment verification. Did you not work at all last year and thus, didn't file a tax return? If you had income in 2011, then you may need to file by April 17, 2012. Check irs.gov before it's too late. Once you file, you will be able to order a tax return transcript.

Also What do you put in the line 11 for Form 134? There are two check boxes for I intend to make specific contribution Or I don't. As per ***removed*** for K1 visa you can put N/A. Is this what I should do or should I declare something?

I am married to an immigrant from Mexico. We separated in 2010, but I could not pay for the divorce until now. The divorce will be finalized in May or June if all goes well. I never completed the case. It sat at NVC and they finally terminated the case.

I am now engaged to a man from England. I want to file the I-129F as soon as the divorce is final. How will this effect my case with my current fiance? I want to do this right and prove that we are in a true relationship. We have talked on Skype daily since Nov 2010. He came to visit for a week in Feb 2012 and then extended his stay another week. I tried to get transcripts off Yahoo from our talks, but only got back to Aug 2011 as it must have erased after they updated their program.

Any suggestions will be helpful.

Also if we file the I-129F in May can he come visit in August?


Was your other marriage via K-1? Before you file the I-129F petition, finalize the divorce first. You both must be 100% free to marry upon filing, so if your state has a waiting period after a divorce, be sure to investigate that as well.

Your fiancé should be fine to visit in August as long as he shows ties to the UK -- a job, lease/rental agreement, etc. But, it is ultimately up to the agent to permit someone to enter the country, so there's always a risk.

No longer has lawful permanent resident status, and has departed the United States;
Becomes subject to removal, but applies for and obtains in removal proceedings a new grant of adjustment of status,
based on a new affidavit of support, if one is required; or
Dies

Note that divorce does not terminate your obligations under this Form I-864.

Your obligations under a Form I-864 also end if you die. Therefore, if you die, your Estate will not be required to take
responsibility for the person's support after your death. Your Estate may, however, be responsible for any support that
you owed before you died.

As long as he provides the supporting documentation for the Affidavit of Support, including income, tax return transcript, proof of citizenship/naturalization, you shouldn't run into any issues. As a co-sponsor, be sure he meets the guideline based on his household plus your fiancée.

QUESTIONS: should I get a lawyer to help out, given my situation above? I already went to see one, and I didn't like what I heard. Basically, the lawyer has no idea if she can help and won't lift a finger to research what needs to be done until I pay $1000 for filing the I-129F. That money would be lost of course when she mails the form, but she has never worked on a case involving Mexicans. Apart from this she had never heard of the CRBA (consular report of birth abroad) process, and that makes me wary.

Should I get a co-sponsor, such as my girlfriends father? He agreed to co-sponsor her, but I want to know what would be best in this situation. The home and the cash I have are sufficient to supplement my low income, am I correct?


The co-sponsor has to be a US Citizen or legal permanent resident. Is your fiancée's father one or the other? If not, you wouldn't be able to use him as a co-sponsor.

Can I apply for a work permit at the same moment that the I-129F is sent for my girlfriend? She's ready, willing, and able to work over here. Perhaps a note from a doctor that states that she's in excellent health would help for this as well? When she had a c-section, the doctors were amazed with how strong she is physically and how well she handled the procedure.


Short answer: no. Assuming the petition is approved, your fiancée would first need to come to the U.S., marry you, apply for a Social Security number, and then you would need to go through the Adjustment of Status (AOS) process, which includes submitting documents to receive an Employment Authorization Document. She cannot work before receiving the EAD. To do so would be illegal.

When writing in the form the places I have lived in the past 5 years, would I put in the address in Mexico, or the addresses on my ID and driver license? In the last 2 years, I've been here in Texas mostly, but before that I spent more time in Mexico.


You would need to include all addresses where you've resided in the past five years.

3. According to the requirement my co-sponsor has to have 33,762. So, i think my co-sponsor need the tax transcript of 2009.2010. and 2011. but the question is, in 2009, my parents' tax transcript does not meet the requirement of 33,762. it does meet the requirement in 2010 and 2011.so is it going to be any problem?? my dad does have a house under his name, and good bank balance.


It will be important that your co-sponsor's existing income and tax transcripts show they meet the specific income required.

You have to have met in person within two years of filing the petition, not file after the two year period is up. So, since his last visit is March 28 - April 17, then he would have until April 16, 2014 to file the petition. (Not that I would suggest waiting until April 16, 2014 to file, but this gives you an idea of how the requirement plays out.)

The likelihood of the K-1 visa being in your hand by August is pretty slim. Sure, there are exceptions to the rule, but having the entire process done in under six months -- from filing the petition to being interviewed and receiving the visa -- is not something I'd gamble on. There's a popular saying on this board, "Don't make plans until the visa is in your hand."

In any event, if having the wedding in August is that important, your fiancé should withdraw the I-129F petition. Have your wedding in August and then file for the IR-1/CR-1. But, as others have mentioned, there is a chance CBP may not allow you to enter the country. Do you have enough ties that would show that you absolutely 100% will be returning to your country? If you're working, get a letter from your employer stating you're expected back at work by X date, for example.

Better planning should have been in place if your heart was set on getting married by a specific date. But you two need to decide which is more important -- getting married by a specific date or waiting until the K-1 visa is in your hand, and then making plans for a wedding.

Yes my plan was to go on ESTA (in case my K1 is not ready by then) get married and then come back and apply for the spouse visa.

The process usually takes 5+ months before one's case is adjudicated. If your plan was to travel to the US to get married and then go home, then why did you two file a petition for the K-1 in February? By getting married, you would no longer be eligible for the K-1 and would have to start over again. You would be resetting the clock on when you two would be together in one place for the long-term.

The petitioner has to complete the I-134 and I-864, regardless because they are the primary sponsor of the fiancé(e). If they don't meet the minimum, a co-sponsor may be an option. The co-sponsor would need to count the fiancé(e) as part of their household in addition to anyone else they claim as a dependent. The I-864 is legally binding, so they should read through the document very clearly to understand what they're signing. (Note: The ability to use a co-sponsor for the K-1 may vary by embassy, so please check with the relevant country first.)

Ah, you didn't mention which part of the couple you were. Sorry!

In that case, you should check the regional forum to see which forms are needed for your interview. For example, if you need a police certificate, find out if how long it's good for in advance of the interview. Or, gathering vaccination records. You could also gather information showing the ongoing relationship from your perspective, too.

The time for receiving a green card depends on when you receive the K-1 visa. Once you arrive in the US, you'll have 90 days to get married. After that, you will need to do an Adjustment of Status. Hello everyone, my name is Tabitha and Elvis and I just started the visa process. My fiance is from Kenya and yes I know its funny to have a kenyan named Elvis! lol! We just started the process on Wendsday, April 04, 2012, and we are very nervous but excited at the same time. However, I am very nervous because when i check the processing time for Texas it shows they are 16 months behind but I have seen others who have been through the process in my state as early as december who are being processed and interviewed. Please note, your petition will not be adjudicated in Texas. Your petition should have been mailed to the Dallas Lockbox address where they will process the payment and then forward it to either the California or Vermont Service Center. Those are the only two service centers adjudicating on I-129F petitions. Once you receive your NOA1, please update your timeline to include the appropriate service center. You can bet your azz that if you said it was a ''trial period' or 'cooling off' period, that you'd never have gotten approved. I think you're being a bit semantical in nature here...because while it's not a problem to marry at the end of the 90, it's not designed for the purpose of 'cooling off'. I mean focking hell, your fiance just got here and you're gonna 'cool off'????

Don't use the 80s to justify marrying a stranger.

Maybe you should have spent more time getting to know her before you filed for the K1 Visa! Key-loggers, pre-nups, looking for red-flags! There is no substitute for being under the same roof, sleeping in the same bed, using the same bathroom, spending money from the same account and trying to share lives that were once 2 seperate people. It brings out our best and our worst. But if you have gone through this long K1 Visa process and have impersonated loving her, yet you don't even know her well enough to trust her, that should make both of you do some serious soul searching. Talk about a red flag!



I partially agree. If you are bringing your foreign spouse here to put them under a microscope, you'll be setting yourself up for a lot of grief and perhaps a failed marriage. My wife, gave up her family, friends, her career, everything to come and start a life together with me. At the point that we became engaged, we cut off all exits short of anything drastic that would cause us to have second thoughts.

That said, the adjustment time was difficult for both of us and there were times where we both probably wondered if we've just made a huge mistake ...but that's normal in ALL marriages.

Spend the time BEFORE getting engaged to get to know your foreign fiance(e)....staying with them in their place, get to know their friends and family, etc. Trying to figure out just who you are marrying in those 90 days is reckless, IMO.

If you have been through this process with a fiance/spouse in/from the Philippines, would you please help me with something? I am looking for a GOOD list of the items she will need to gather on her end during this process...

I know she will need an Birth Certificate, a Passport and some extra Passport photos - but what else? I heard she may need some police records and college transcripts? It's so hard finding a comprehensive list of the things she needs to have at some point soon...

If you've been through this process, in the Philippines, would you please list the items you remember needing to have? Just a quick list, nothing fancy... If I just knew everything she needed, I could search online for some addresses or phone numbers so she can call and work on getting those things.

Pleeeeeease help me! I love this woman, and I don't want anything tying up our paperwork. I would really appreciate your help.

Why had I not visited Thailand during 2009? Did she know I was divorced? How many kids do I have? Did we travel together in Thailand? All easy to answer questions, no complications whatsoever.

She got the white slip, and was told to pick up the visa on Wed July 1st.
She's flying out Thursday night and I'll pick her up at O'Hare on Friday morning, in time for the long weekend!!

is the age gap will be a problem during interview for K1 petition? I am 24 and my fiancee is 57 i dont mind about our age gap i know to my self how i feel to him and how much i love him and he feel the same way too so our age gap wont bothering us specially our relationship...

I think the age of the beneficiary (you, in this case) is more a factor in the interview than the age gap, and since you are beyond the minimum age requirement that the Philippine government requires, I wouldn't worry too much about the age gap, if I were you.
