So this is my first time asking a post as a member, but I've spent the past 8 months using this website as a wonderful resource and searching the forums, but this time I can't find the answers I need! I'm going through the London Embassy and had my medical yesterday, my forms are ready to go, all I need to do is mail them, however the snag is that I only have my fiance's 2011, 2010 and 2009 tax returns. If I mail off the DS 2001 form of readiness and get an interview date, is it fine to use the 2011 as the most recent, I know people only finishing filing taxes a couple of months ago and I really do not know enough about the US system to know how it all works or when the cut off date for 2011 being most recent is. My fiance is self employed and has various other assets and shares in different investments, so would taking the 2011 return be accepted, or should I wait until the 2012 return shows up before mailing the DS 2001 and other forms?

Sorry to hijack your thread but I am wondering the same thing as you....

 

I got my LND number from NVC on the 3rd and booked my medical for the 18th ( stupidly thinking that would be enough time for them to forward) however NVC still have not sent our file to London! My fiance called today and they won't tell him why they haven't sent it and then hung up on him... so rude! I am starting to get stressed as to why they haven't sent it as I see so many other UK filers around me having theirs sent. Is this random bad luck?

I know I run the risk of them not pairing my results with the file when it finally comes in but given there are three of us having a medical, (my daughters also), I couldn't get an appointment when I called for 3 weeks!! - which I think is quite a long wait. (I called back and managed to get a cancellation saving me 6 days though) Any thoughts?

1 - Hopefully someone else can answer this one better for you, as I have not gone through this bit personally. I have a good friend who's fiance visits frequently from the U.K. and generally never has had any problems over the years. Being honest though will count and they may be concerned about him entering with the intent to marry. 

 

2 - 5 months is the estimate right now, you can always home for it being shorter. But best to use the time to prepare, that is also just till your application gets approved. You still have another couple months to go through the process of interviewing and such.  Some info for Australia: http://www.visajourn...alia&cty=Sydney

 

3 - No choice on which service center will work on your application. From going through it they really fluctuate one isn't really faster than the other. 

 

4 - As far as I know, that will be all on you. It doesn't matter what he has and what his Mom can send. You have the meet the 125% of the poverty lines here: http://www.uscis.gov...form/i-864p.pdf, and from what it sounds like you will need to have a co-sponsor since you're not working. 

 

5 - The fee to file is $340, and to Adjust Status it is $1070, and you will also be looking at fees at the embassy too should be covered in the Australia link above.

 

6 - I don't see any reason why you would have to change your name. :)

Hey guys! 

 

I know I need to update my timeline but my fiance and I received our info packet from the Belgian Consulate!!! YEA!!! 

 

My question is about people's prior experience with the i134. Do they look at if you're making at least 100% of the poverty guidelines income for your state (OR is $15,510 for a 2 person family)? My income gross currently is upwards of $21,000. I don't have any kids and neither does my fiance, so I'll only be supporting the two of us. Does anyone know what the minimum income is they look for? I've heard 100% but also 110% and 115%...

 

So I'm a little confused and worried I won't make enough to be approved by myself and I really don't have a sponsor? 

 

Any encouragement or thoughts would be appreciated! :)

It does sound strange, but once they're past immigration in the US, they should be able to travel freely without anyone asking questions. I mean, logically speaking. 

 

I see it being no different than taking a bus/train from the airport to your final destination. Once you're in the country, you're in, unless your visa expires or you really screw something up with the law.

Thank you all for your advice, I'll talk all this through with him. We have savings and don't live a fancy life when I'm there. We would have no intention on asking the government or the co-sponsor for any kind of help so hopefully it shouldn't be needed.

I did read somewhere on here about being able to do the self sponsor thing for the first part. Is there anywhere with an example of how to fill it out...it looked like it was geared up for being filled out by a USC?

The London Embassy does allow the visa applicant to self-sponsor though. Meaning that they can fill out their own affidavit and supply their own income and assets, for consideration, without using a USC to file affidavit.


True, however, self-sponsoring is only available for the I-134 hurdle. There would still be a need to meet the poverty threshold when it came time to adjust status, which seems to be the OP's primary concern if her fiancé doesn't have the income.

OP: Since the petition was just filed, you and your fiancé have time to figure out the support question. But, if there's a worry about having one of his family members serve as co-sponsor due to concern over the contract with the government part, then he should prepare to secure a job before you land in the U.S. to avoid having you arrive in the country without the ability to work, etc.

Thanks for your prompt response. Yes i did include the readiness form. My fiance also called the london embassy and i'm still not on their system for some unknkwn reason. They said it's normal to take 2 to 4 weeks to appear on their system but it's been 6 weeks including holidays.


When was the last time a call was made? If there hasn't been a call made recently, plan on calling again to follow up. With the holidays over, I hope things start moving again for those waiting!

I had a question abou the fiance visa; im not sure if this is the right place to ask it, but i ll give it a shot and someone will hopefully tell me where the right place is at least!
Im applying for the visa from London, uk. I received embassy's letter regarding uscis's apporval on november 15th, which asked me to send some additional forms & do my medical test. The embassy has received my filled forms on november 22nd and medical results on november 29th. However i haven't got my interview letter yet. Any ideas why it's taking too long and what's gonna happen? Im sort of stressed now!

When you sent in the forms, did you also include the DS-2001 readiness letter? Have you or your fiancé(e) called the Dept. of State number (202-663-1225, press 1, then 0) to confirm they've logged the forms and that you're eligible for an interview?

Ah that is a bit clearer thank you, didnt spot that one.

Still, for example the affidavit of support, which seems to be the main form i will need. My fiance and her family (her co-sponser) want to fill in the form and get the details/backup now. But considering we only got NOA1 in December, would this information be considered to old when we submit it (hopefully in June/July)? I guess thats what im trying to say..

Assuming this may also be the case for some of the other documents like proof of vaccinations or the like..


It's far too early to send the I-134 to you, especially since your interview will occur after April 15, the co-sponsor will need to provide you with a Tax Year 2012 tax return transcript. Wait until the NOA2 is received and then move forward with getting that documentation.

On the vaccinations, you can go to a GP now to get the needed vaccinations, but you will need to be sure to bring proof to the Knightsbridge exam, which won't happen until post-NOA2. You will need to have them recorded during the Knightsbridge exam on the DS-3025. Be sure to get a copy of that sheet!

Last, but not least, you should fill in your country information. It will serve as a bat signal for those who have gone/are going through London and they can weigh in. Once you get to the NOA2 and the approved petition is forwarded to the embassy/consulate, the procedures vary greatly.

K-1s don't have to pay the $165 fee. That's for CR-1/IR-1 visas (aka immigrant visas) to pay for green card production.

Im confused on where to send the i-129F application. On the paperwork it states the dallas office, but when I look at processing times it doesn't even show the Dallas office processing that application. It shows it at the California Center. Do I send it there? Where is the info that says that? Or do I just pick an office?


The petition package should be sent to the address noted in the I-129F instructions. The Dallas Lockbox is where they process payments and then forward the petition on to either the Vermont or California Service Center. Always follow the instructions!

1. As part of the visa process, do they check up on my entire medical history and would mental health issues pose any problems?

If there is a history, you should visit your GP to see if they can provide you with a letter stating you're no longer a danger to yourself/others.

2. Does it matter if i am unemployed? Recently became unemployed and wondered if it would be an issue with USCIS? Should we tell them about

Once the visa reaches the embassy, it falls with the Dept. of State. It doesn't matter if the visa applicant is unemployed.

3. I've also changed my UK address, how soon should they be notified about this?


Do you still have access to your mail at the former address? The two things they mail to the visa applicant are the P3 letter (stating they've received the approved petition, here's a link to the DS forms, etc.) and the interview letter. Once the petition reaches the embassy, call the Operator-Assistance line and ask for a code so you can email the embassy directly with your change of address information.

4. Finally, if there is anyone here already in the USA awaiting their EAD or AOS, what has anyone done for work/income before getting their EAD?

You cannot legally work in the U.S. for a U.S.-based place of employment without the Employment Authorization Document or a green card.

If your plan is to get married in 2014, then submitting a petition this year is a good idea.

Be sure to read the VJ K-1 guide to fully understand the beginning of this process and the flowchart as well. Usually, once the visa is issued, the fiancé has six months to enter the U.S. and then once they enter, they have 90 days to marry.

Unless your situation is complex (e.g. criminal record, overstays, etc.), you likely will not need an attorney. If you can read the instructions and the guides on this site, you can do it yourself. Good luck!

my boyfriend and I have been together for about 3 years now. We met in college and he graduated last December 2011 and had to move back to the Bahamas and began working full time. I am still in school and will be graduating this December 2013, and we plan to get engaged before I graduate and married sometime after. I am starting to put together a scrapbook of everything for our documentation, but what we need to know (I am the American citizen) is when do we need to file the I-129F form. We dont want to be rushed in the 90 days to get married, so should we wait to file that? Also is it wise to get a immigration lawyer? Any help is much appreciated!!!

The OP left out required portions of the petition package. The USCIS adjudicator denied the petition because the requirements weren't met. If it's appealed, they will probably uphold that decision. Thus, the better use of time is to resubmit the petition with the missing required details vs. waiting for the appeal response.

My petition was denied on 1/10/2013. The mailed reason stated that the petition that was filed did not contain any initial evidence or supporting documentation. You have failed to comply with the regulatory requirements for documents to support your petition, as outlined in the instructions on the From Petition for Alie Finance Form 129-F.

In visa petition proceedings, the petitioner bears the burden of establishing eligibility for the benefits sought.

In view of the above, the petition is denied.

Can someone help me out? There is nothing in the letter informing me that I did not send in a certain form. Of course I am going to file an appeal but I am not sure what documents the USCIS needs if they have not told me in the letter. I called the office and they told me that they can't comment on what I need to send in which makes no sense at all.

Please help.

Calling won't do you any good. Follow what Gary wrote -- withdraw the current petition. While doing that, get a new I-129 petition package together following the VJ guide. Don't wait 7-8 months just to get a denial when you could have done something about it. And an appeal is pointless since you didn't follow the instructions. It would take just as long. You're better off spending the time restarting now. YMMV

With whom did you speak? Unfortunately, the tier 1 level of the USCIS help line isn't the most helpful or reliable. There have been many instances of people hearing similar comments from them, particularly in cases where the petitioner only sent the I-129F and payment with no supporting documentation. There have been some threads where the petitioner received an RFE for the remaining information, but you should prepare for a denial, which may not come for some months. Ah i see. The thing is we kinda wanted the ceremony in August whilst its still nice rather than later, and also for various other reasons such as people being able to attend in that month but not later in the year. On top of that it doesnt give you very much time to plan, and also once we finally get this thing we want me to get over there asap! Not another wait whilst wedding planning, since being together is paramount..

So our idea was maybe just to not do the legal bit if we dont have the Visa in time, but keep the rest of the plans in place and do the legal part once we have the Visa, obviously I would have to return to the UK till we had the visa too.


The K-1 visa is typically valid for six months and then you have 90 days from entry into the U.S. to marry. That's plenty of time to plan...after you have the visa in your hands. If you want to get married on a specific day/timeframe, then scrap the I-129F fiancé petition/K-1 visa and go with the I-130 spousal petition/CR-1 visa after you're married.

I am filing for K1 pretty soon. I was looking at the processing times for all the four service centers, but the instruction for 129F states to file the application to Texas Center for all the US citizens living here and abroad. I have seen various timelines here in Visajourney which suggests people have filed to other service centers as well. Has it changed for all the states, or it will be forwarded to another service center after getting there (Dallas Lock BOX)?


There are only two service centers that process the I-129F petitions -- California and Vermont. However, you mail the petition and supporting materials to the Dallas Lockbox, which is not the same as the Texas Service Center. At the lockbox, your payment will be processed and then the materials will be sent on to California or Vermont for review.

Hey everyone,

I posted a thread here a few days ago but it didn't get much attention, but things are really down to the wire now so I think we just need someone who has been through this already to ease our fears about it and tell us we're doing the right thing!

We will be living here in Chicago, Illinois, while she is from Vancouver, Canada. She is currently living with me in Chicago on the 6-month visitor Visa, but we are buying her plane ticket TONIGHT to head back to Vancouver so we can start filing papers. We've done extensive research, and we are still second-guessing ourselves! As is stands, this is our current gameplan:


1. She leaves Chicago on January 29th
2. I file the spouse application immediately afterward.
3. Once the application is approved, she files her application from Vancouver.
4. So on and so forth.


Our starting process is rock-solid, right? For the smoothest/shortest process, we should both be in our own respective countries when filing our applications, correct? Additionally, is it okay for me to visit HER while this is going on? Additionally, is it okay for her to visit ME while the process is going on? We want this to be as short, painless, and smooth as possible, but obviously we're ready to ride it out no matter how long it takes. Obviously being able to visit each other would be a blessing, though!

Would REALLY appreciate any insight on this, please let us know! Thanks again.

The 90 day timeframe in which you need to get married starts once your partner goes through U.S. POE and is in the country. The CBP will give them an I-94 with a date stamped on it. That will be the "deadline" date.

The date printed on the K-1 visa is the deadline for using it. Once your partner enters the country, the K-1 is voided as it's a single-entry visa.

I was actually curious to see if London would actually WANT to see this type of evidence. In Colombia, which I imagine is a little more skeptical than the UK, they never asked me for ANY evidence. I brought a huge packet of evidence with me, they never asked for it.


For most who go through London, they don't request to see any relationship evidence, but there was at least once case on VJ last fall where the embassy gave him a 221(g) and asked for more evidence. (And he was a British-born white guy, so not someone from another region living in the UK.) So while for the majority, it's never asked, there's always the possibility that it will be. Thus, err on the side of caution, regardless of the embassy/consulate involved.
