Good morning :-) well last night we received some great news we found a sponsor for me is a aunty who is over the poverty margin she has agreed too help us which is great news. She as asked us what exactly is the role of a sponsor and what do they need too do can anyone please advise or point me in the right direction I have tried explaining but don't think I made it sound right at all thanks david


Assuming she will sponsor you for both the I-134 and the I-864 stages of this process, have her read the Sponsor's Contract portion of the I-864 Affidavit of Support (Part 8): http://www.uscis.gov.../form/i-864.pdf

The I-864 is the legally binding document, so it's key she understands it.

I personally would have gone with the IR1/CR1.

- Both take basically the same time.
- IR1/CR1 is cheaper.
- after filing either one there is a chance of denial at the border.
- if CR1 she will have green card/be able to work almost instantly.

What am I confused about? Why is the K-1 a better choice?


I don't speak for anyone else but myself and my fiancé, but we went with the K-1 because we'd rather have the time spent apart upfront rather than after we get married. Cost isn't really an issue to me and I make enough to support the both of us (plus my cat) while waiting for the AOS/EAD process, so his not working isn't an issue, either. Besides, I'd rather he come here with the time to get used to long-term American life before jumping right into the job search game.

Sure, you can begin the process while she's visiting you. A lot of us do that if we can since we need their signatures on some of the supporting documentation that accompanies the petition. However, she will have to return to Canada for the interview and medical exam process.

So... My name is Al and i live in New York. A little over a year ago i met my future wife. She is the love of my life. Anyway.. we started dating and things got serious, which is awesome. We got engaged on January 29th. Heres the catch shes canadian and im american!!! NOW WHAT?!?!?!

Well, we want to live in New York and we travel often back and forth. I go there for a few days and she comes here for a few days. Today i started doing research online on how to legally make her a citizen.

Here were my initial questions:

What if we spontaneously decided to get married while she is visiting me can we go to city hall and make that happen? Is that a better way?

If we decide to go through the paperwork will i be able to keep visiting each-other (in other words can we travel freely between Canada and the US)?


It appears that the correct way to move forward would be to file a I-129F for a K1 visa. But then what? Can we see each other at all? if so, are there restrictions?

Can anyone help me out?

For one, the K-1 visa is for unmarried couples, so if you plan to get married first, that is not the petition to file. You would need to look at the IR-1/CR-1 information. You should be able to visit one another during the petition process, however, it is up to the Border Patrol on if she will be admitted into the U.S.

I'm having some trouble getting the Employment Verification Letter from my Dad's Work (he is my co-sponsor). They are asking for a form, "immigration form" that he has to fill out and then turn it in to Human Resources so they can fill it out and do it. Problem is, I can't find any form like that anywhere; I already looked in the Department of Labor Website, USCIS, and the Consulate webpage. I didn't have trouble getting mine, I contacted HR and right away I had it. So, I don't know where else to look ... Do any of you know what form could it be??? :unsure:


Is his HR managed by an external company? Some have a form you have to fill out called a "Verification of Employment Request," where it asks various information. Attached is what I would have to fill out for receiving a verification letter. Perhaps his company has something similar?

Hi everyone,

I thought I would follow up with my situation so that if any future applicant gets in my situation, they will know what to do.

I got my application back in the mail 13 working days after it was received by the center director. Unfortunately, my application was rejected not because I sent it to the wrong address, but because of the amount on the check.. I wrote $240 because I read on this forum that the price had gone down $100 from $340 on April 14th. But I called the USCIS and they told me that the fees were still $340. I am a bit confused about that, but any way, I don't care. I was happy to see that my application had not been lost and that it was being processed! After three weeks without news I was starting to lose hope.

If my check had had the correct amount written on it, I think my application would have been processed even though I sent it directly to a processing center instead of to a lockbox. It would just have been delayed a little bit. I can see that they started working on my application (they stamped a number on each sheet of my documents and placed my photos in an envelope that says "Department of Homeland Security" and on the back of my fiancée's passport-style photo, they wrote "I129F").

So, the moral of the story: be patient! If you made a mistake, it should get corrected over time. Do not send a duplicate application, otherwise you might get in trouble like the story in the link above.

The larger moral of the story is: Read the I-129F instructions and follow them. The payment information, where to send the petition, etc. are some of the most commonly asked questions and are easily found in the instructions document.

Now that you've received the petition back, you should go through the documentation to ensure everything else is in place. :thumbs:

In the guide it says to "send all originals of the documentary proof that you submitted for the I-129F to your fiance...". What specifically is meant by this? Documentary proof of my citizenship? Does this mean I need to send him my original birth certificate?

Also, if you want to receive an estimate on VJ of when your petition will be adjudicated, you should update your information to show which Service Center has it. If your number begins with EAC, it's at the Vermont Service Center. If it begins with WAC, it's at the California Service Center. The Dallas Lockbox is not adjudicating your petition.

So my sweetie and I finally ready to mail our package in a couple of weeks (we are waiting till I'm out there) - I know we've got a long wait ahead of us. Does anyone roughly know the sort of minimum time I'll be unable to apply for jobs in the US once we are married? Obviously trying to keep this to as shorter time as possible. Also do you put our electronic notification form on top of the entire package, or shall we put the check as the first thing they see? We've decided to cut out a lot of the skype chats and e-tickets and just send as much primary evidence as we have. Just got my passport copies today in colour and I've got around 12 stamps into the US clearly showing the dates and type of visa, hopefully this will be enough to convince thema along with a few photographs!

Hello board, I've been lurking for a while trying to gain knowledge, but haven't been able to find anything through Google that addresses this specific issue.

My girlfriend (Colombian) and I (American) have been dating since she was here on an F-1 visa from January 2011. She left the country at the end of the semester in mid-April, but we've continued our relationship through Skype and such and are thinking about getting married. A couple of the timeframes we had tossed around were October/November or February/March of next year. As I've looked into the K-1 visa, my understanding is that it takes about 8 months from first filing before she can actually come here to get married, correct?

She also has a B-2 travel visa good to enter for a few years. My understanding is that if she enters on the B-2 to get married and then file an AoS that is a big no-no (based on the intent). The wisest course of action - as I understand it - is to wait on the K-1 visa. The scenario (and question, now that I finally rambled into it) is this: Can we file all the paperwork and such for the K-1 visa, have her enter on the B-2, get married, then have her catch a flight back to Colombia and bounce right back on the K-1 when it is ready? That way she never enters on the B-2 with the intent to stay, but I'm unfamiliar enough with the process to know if this is even feasible. Any enlightenment you fine folks can give me is greatly appreciated!


Short answer: No.

The K-1 is for fiancé(e)s to enter the U.S. You can't get married before receiving the K-1 visa. Instead, you'd have to apply for the CR-1/IR-1 visa for spouses to allow her to join you in the U.S.

I'm a UK citizen born in Sussex (and living here) and getting married to a dual UK/US citizen. I would like to live / work in the USA with him as soon as possible. What is the best way to do this? I've heard of a few ways but am unsure which is best.

- Getting married in UK and going together to USA and asking to adjust status there?
- Going to US on VWP, getting married there, coming back here and apply through the embassy to live there?
- Getting married in UK and going through embassy? (heard this takes ages).

So i haven't received the hardcopy of our NOA2 and it's the 30th day since they said they mailed it on april 16. I called USCIS and they told me to file 1-824. I asked to speak to a supervisor and he told me the same thing. I asked if he could just send me a copy or send me the orignal since i really didn't get it and that i don't want to pay $405 for a duplicate. He said that i can file i-192 to ask to waive the fee. But I don't want to do that too because that means i have to prove i'm below proverty line which i'm not. I asked if they have a tracking number or if there's ny way we cn track th letter and th supervisor transferred to someone else but all of the sudden the phone call cut. Now i want a congressman to help me with my case. What will be the number to call?

By filling in your timeline, you can get an idea of when your petition will be adjudicated by USCIS. Do note that most petitions take approximately 5-6 months before they're adjudicated. Sometimes, it's shorter, sometimes it's not.

Applications processed by the Embassy in London - You are required to obtain the original documents or certified copies, and one photocopy (with the exception of your passport and photographs) for yourself and each family member applying for a visa. My boyfriend and I did not get some good news today - he was trying to get a job transfer (L1 visa) and his company said that they can't do it now and may be able to do it in 2 - 3 months. We have decided to just take things in our own hands and file for the fiance visa. Otherwise we will just be waiting for who knows how long.

He is from South Africa and I was living there for 2 years but came back to the US a month ago.

I assume most people on this site haven't used visa agencies - that assist you? They are expensive, but I am wondering if people have found them helpful and faster? I am thinking it will be more affordable if we use one that is based in South Africa rather than a US company.

We got married in a court room with a criminal judge marrying us. There is no requirement of/on how you marry. Just that you marry within the 90 days of entry on the K-1.


I would add that there may be certain requirements based on where you get married to have it count as official. Be sure to check the specifics when applying for the marriage license. For example, some places require two witnesses to view the wedding.

Your petition is either at the Vermont Service Center or the California Service Center. The reason your timeline is off is because you have Texas Service Center selected. The TSC does not process I-129F petitions. You need to update your timeline accordingly to see a better estimate.

I have read the guide this evening and also the visa requirements on travel.state.gov. Everything seems to be more complicated than I expected. Regarding any originals they say that they will return them to you at the interview if you either send copies with the original or bring copies to the interview. I guess the best thing would be to work through all this step by step ;-)

At this stage, your best bet is to read the guide on VJ and read the information on USCIS.gov. While the State Dept. site is helpful, for the petition stage, you'll be better served by going to the USCIS.gov site.

USCIS < - Handles the receipt, processing, and adjudication of the I-129F petition.

DOS < - Handles the approved petition and actual issuing of the K-1 visa at the embassy level.

Assuming you're referring to the DS-156. That form will not be needed until the petition is approved and it's on the way to the embassy. You have quite a few months before that is needed.

On your other question, it's best to send a certified copy of any divorce decrees because you will not get it back.

Also, as A&B mentioned, please be sure you and your fiancé read the guides on what to include (and what not to include) with the petition.

Hello everybody. Iv been browsing this site for days and have decided it would probably be better if I signed up. Its been very helpful.

My husband to be and I just started this journey (very long one from what Ive learned). I sent the I-129F petition a week and a half ago and received the first NOA today. He is in Chile, while im here in WA.

I sent all the documents (triple checked...) and everything they asked for, but as for the evidence of our meeting... we sent A LOT of photographs from the last 4 years. Each one of us wrote statements (extremely long ones) detailing our relationship, we got his family and friends to write letters, also copies from my US passport with all my stamps of the many arrivals and departures from Chile...

Anyways, I keep reading about all the RFE people receive... and im scared I sent too much along with the I-129F form and documents. I have no idea what else I could possibly send if they end up asking us for more evidence if or when I get a RFE. Also, how long does it take (aprox.) for us to know if we do have to send more things?

Maybe im getting way ahead of myself, but I want to be prepared.

Determining what's too much/too little is relative as it depends on the country, it seems. Some want "front-loaded" petitions, while others are fine with the minimum requirements. Whether you'll receive an RFE will not be known until your petition is adjudicated. Per your timeline, that is currently estimated to occur in October. So, spend this time reading up on the next steps in the process and getting familiar with those in the regional forum who can answer questions specific to Chile.

We filed back in November, and we FINALLY got the NOA-2 on Tuesday! Thank God!

I just had a couple questions now.
First, is all the paperwork that they're going to send us to fill out next on this website? Or just some of it. I'm going to visit my fiance in the states next week for then entire month! We're gunna fill it out together.
Second, what kind of fees are going to be charged to us from now - when I move down? I live in Canada, and will be doing the medical exam in Toronto. Do I have to pay for this, or is it covered under the Health Insurance?
And last, when should I book the medical? Like I said, we just got the NOA-2 two day ago. The website says to call and book the medical as soon as I get an interview date, but I'm worried if I get an earlier date, I won't get a medical appointment on time. Is it acceptable to make an appointment for the medical exam for next month if possible, and bring the results to the interview, even though I don't have the interview date yet?

Any help is appreciated. I'm so excited for everything coming up.

The fees were outlined upthread. Please note the word usage of petition and visa application...this is where people get tripped up and start sending more/less money for the I-129F submission.

Thanks everyone for the responses in regards to the two years... we have plenty of evidence (photos passport stamps credit card receipts for hotels etc.. Im going back end of June for 5 weeks as well for Independance Day and my birthday) so I wasnt too worried about that but glad to have the confusion cleared up. also just something quickly - the 'having met within the last two years' mean that you have had to have known them for a minimum of two years? As when we apply we would have only known eachother for a month and a half (have met plenty of times in person)

On your second question, the requirement isn't that you have to know one another for two years. It's that you've met within the two years prior to submitting the petition and supporting materials. There are many of us who have known our future spouses for less than two years.

Hello all,

I am new here. It seems like it is a very usfual and helpful site. I just wanted to tell you guys a little about me. I am petitioning K1-visa for my fiancee. I am a US citizen and my fiancee is an Afghan national. I didn't know about this site, but it seems like I had done things correctly becuase my I-129F was approved with no RFE. Right now I am waiting for the embassy to contact us. Has anyone have any idea what to do and what to expect. Thank you all.

To give you an idea of current processing times for the advance parole, I sent my AOS, EAD and AP applications at the end of December 2011 and received the AP and EAD 2 weeks back. Maybe you will get yours a bit faster as each case can be different but that was my experience....like the others have said leaving the U.S without A.P or even better a green card will be a massive ball ache for you when you try to re-enter.

How long does it take for NOA2 to get approved? Also what is the reason for it not to get approved. I am a bit worried am sending mine this Monday.

Do you mean you're submitting the I-129F and supporting materials on Monday? If so, expect to wait a while before receiving the NOA2. Check the timelines (see the link above) to get an idea, but even that's just an estimate as it's based on people on this site who take the time to fill in their timelines. The length of time could depend on the country as well. You should fill in your information so people can provide more detailed responses.
