Thank you very much for your tip about chat log wich actually has over 500 pages, how should I make it smaller? by leaving like 1 page for the day? I just wanna prove then that we been talking every day on skype, fb and stuff, and the best way was printing all the skype conversation.

:time:

It would be helpful to know which country is involved because not all of them need to see a huge amount of proof upfront, especially when it comes to chat logs.

K-1 Fiance(e) Visa Process & ProceduresK1 visa fee changing?

The instruction sheet I read said $340.00. Did I send wrong amount?
http://www.uscis.gov...i-129finstr.pdf

That is the correct amount. The fee change was for the visa fee paid at the embassy level, which will be, through this Friday, $350.

Quick reminder: USCIS is under the Dept. of Homeland Security. The K-1 visa interview is handled at the embassy level, which falls under the Dept. of State. The visa fee change was posted on the Dept. of State's website.

K-1 Fiance(e) Visa Process & ProceduresHow much in total we will spend for the K1?

Please correct me if i'm wrong, but isn't it possible to get EA free after marriage, as part of AOS? if you opt to not do this as fiancee? thx.

Nope, you're correct, I forgot to add an asterisk to that one.

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 together with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of a Form I-485.

K-1 Fiance(e) Visa Process & ProceduresHow much in total we will spend for the K1?

Hello you!

How much in total we will spend for the K1?

I know first is 340 for I129F, AND THEN, 240 for interwiew, but I saw something like 1000 next, Do you know? + mails + hotel + exam etc etc.

Good Luck for all!

To start:
I-129F Petition: $340
Medical Exam: Varies and in some countries the cost has gone up recently, add on the additional cost of any vaccines if you choose to get them during the exam
Visa Interview: $240
Additional Passport-style Photos: Varies
Travel to the embassy/consulate for Interview, possible hotel stay: Varies (add on more if you opt to travel and attend the interview with your fiancé)
Airfare to U.S.: Varies
Shipping your fiancé's things to the US: Varies greatly
Marriage Certificate: Varies by state or even by county depending on where you live
Social Security Card: Free (yay!)
Driver's License or State ID: Varies by state
I-485 Application to Register Permanent Status: $1070
I-765 Application for Employment Authorization: $380* (free if filed with or after the I-485)

Then add on food, clothing, shelter, health insurance, and entertainment. And then add on the costs for the naturalization process...

When your petition is reviewed. They will either approve it, send you a request for evidence if something is missing, or deny.

I received my NOA-1 on December 27, 2011 and the last time my application was touched according to USCIS website was on January 4, 2012. Its been a long time and it hasn't been touched since. Why??

According to your timeline: Processing Estimates/Stats : Based on timeline data, your I129f may be adjudicated between April 30, 2012 and May 7, 2012*.

When you send off the petition, it won't be looked at for months. Touches mean nothing in regards to the adjudication process.

K-1 Fiance(e) Visa Process & ProceduresK1 Petition - Delays in Processing
To clarify, since this comes up quite often, the Texas Service Center is not the same as the Dallas Lockbox where the I-129F petition and supporting materials are to be mailed. The TSC handles different types of petitions, but no longer the I-129F. The Dallas Lockbox simply processes payments and then forwards your files to the appropriate Service Center -- either California or Vermont.

K-1 Fiance(e) Visa Process & ProceduresQuestion about criminal past

I know i have to check yes, but with 129F do you think i should send court documents with? I would have to order or pick them up! I have about 8 weeks before I send so i was wondering if dates were enough or if I had to get the actual documents. I intend to be fully honest-past is the past

Better to have the court documents with the petition than to receive an RFE asking for them later. Also, be sure your soon-to-be-fiancée knows about every aspect of the crimes because at the interview level, it's very likely she will be asked about it.

K-1 Fiance(e) Visa Process & ProceduresQuestion about criminal past

Alright new to this site and thanks for the great info---met a someone and will be visiting her on june 15th in poland and may be filing for k1 in future. So being ####### im basically documenting everything right off the bat every sunday so hopefully it will go smooth. The only rough spot i see is my criminal past. Here goes
1 Count Possess Drug Paraphernalia 08-21-97
2 Possession Marijuana and drug paraphernalia 09-13-00
3 Possession Marijuana and drug paraphernalia 02-15-06
4 AI Alcohol Intoxication 03-12-12

I also had a disorderly conduct ticket back in 1997

I no longer use drugs so get off my case :)---been sober forever and the one time i drink i slept in my car and got AI ticket-which is 4 hour community service and they will wipe off my record. Was wondering if i need police reports or anything to send with 129F or just being honest works. Has anyone had them ask for additional information from drug crimes? I want to get police reports ordered soon if a problem might arise. thanks in advance oh and im us citizen. Her record is clean.

On the I-129F petition, you'll need to check the "yes" box on question #2 in Part C and include a separate sheet detailing each item since you have more than three separate incidents related to drugs/alcohol.

Hey everyone… I can't find the phone number to call from the United States to pay for the K1 Visa through the operated assisted number to the London Embassy. I tried calling the number that is on my fiance's letter but I can't call from the states… It is restricted calls only from the U.K. I had seen a post somewhere that I could call a different number from within the states to pay for the visa. I have tried the advance search for the place I found the number with no luck. I know that In the post that had the number it stated that it was $16.00 for up to 7 minutes calling the number. Anyone know the number to call if calling from the United States? Thanks so much! :)

K-1 Fiance(e) Visa Process & ProceduresOne question about the Affidavit of Support/ I-134

We are in the last part of the process for the k1 Fiance Visa…. My fiance received "packet 3" or the letter with instructions on filling out the forms. He is visiting me in the states and we completed the forms online and mailed in the forms and the DS 2001 ready letter…. We have included his medical date which in one week from today…. So………… My question is…. Where do we send our i-134 for to? I read someones topic that it needs to be mailed the "slow way" but it did not say to mail it off in the instructions of forms to mail to the U.S Embassy in London. SO….. Do we just have him take it to the interview with him or were we supposed to mail it off to the Embassy as well? Thanks so much for all of your help.. I would be lost without this place :)

K-1 Fiance(e) Visa Process & Proceduresdo I need a SSN for getting married in Maryland or DC?

We got married in Montgomery County, Maryland. It was not required. I had mine, they didnt ask for his. On their website it states "

Social Security Number of each party who has one"

However, if you drive an hour north to Baltimore County, they do specify that a SS# is needed. Moral of the story: check your locale to get confirmation on what's needed, optional, etc.

K-1 Fiance(e) Visa Process & Proceduresdo I need a SSN for getting married in Maryland or DC?

I could be wrong but SSN would not be mandatory requirement to get married.

It really depends on the state/county where one resides or is getting married. For instance, some locales require some sort of state-issued ID and a Social Security number could be used to secure one. Plus, it's recommended to get a Social Security number as soon as you can.

K-1 Fiance(e) Visa Process & Proceduresdo I need a SSN for getting married in Maryland or DC?

Hello everyone!

I came to DC, USA on the 25th and now we are working on our marriage ceremony, to file AOS we will have a quick and private ceremony follow by a big one later this year.

I was reading on the law to get a marriage certificate and most states need a SSN? is the correct?

Thanks

Are you getting married in DC or MD? Each state (or district in DC's case) is different in their rules for issuing marriage licenses.

DC Marriage License information: http://www.dccourts....ge/marriage.jsf

In Maryland, the marriage licenses are handled at the county level, so you'd need to look up the county, e.g. Montgomery County, to see the specific requirements.

K-1 Fiance(e) Visa Process & ProceduresQuestion about fees for I-129F

Hi everyone

I've been looking for information on the fee to send with the I-129F form. On the USCIS site it says $340 but I've also seen $350 somewhere and somewhere else saying that the fees for K1 visa were reduced to $240 as of April 13th... thinking the USCIS site has to be correct, but what is that about a reduced fee?

I'm sure this question has been asked already but I haven't been able to track it down and I really want to send our petition asap.

Many thanks to everyone on this community, so far I've had such helpful responses to my questions. Really means a lot :)

Lucy

The petition fee -- the one that will accompany the I-129F petition and supporting materials -- is still $340. The fee that changed was the cost of the visa that is paid at the embassy stage of the process.

Always follow the instructions provided in the I-129F.

K-1 Fiance(e) Visa Process & ProceduresI-129F RETURNED REJECTED

As an advice, you should re-check your whole package and documents and be sure it meets all the requirements in the USCIS instructions... or you're going to lose some time later again if they send you a RFE. :)

Agree, consider this a blessing in disguise. Re-read the K-1 guide on this site as well as the I-129F instructions and make sure everything is correct -- including the $340 check -- before you send in your petition and supporting materials again.

The OMB expiration date doesn't have anything to do with your NOA2. That's an internal process date used by the various government agencies for when it's time for another review. The OMB is tasked, in part, with managing various forms to determine if it's redundant, if any updates are needed, etc.

K-1 Fiance(e) Visa Process & ProceduresName Change During K-1 Process?
Agree with Anh Map, check with the embassy where the interview will occur. Your fiancé should also weigh how much time it will take to make the name change on his ID and passport, especially since you're close to NOA2.

Like I said upthread, another option would be to see if the male can change his name at the marriage license process in the same manner a woman can. That way, the documentation you'll submit for AOS will have his "new" name in place.
LeftCoastLadyFemaleUnited Kingdom2012-05-06 10:59:00
K-1 Fiance(e) Visa Process & ProceduresName Change During K-1 Process?

Okay, so I have an odd situation. My fiance in Australia is wanting to change his last name, and we're unsure of the best time he should do this. We've already started the K-1 and should be pretty close to NOA2 at this point. Could he get his name changed before the interview stage and then bring all relevant forms documenting the name change? Or does that screw everything up? And if it does, when is the best possible time to get the name change?

He'd like to change his name back to his biological father's name (as he currently has his step father's name, but started out with the other), and some of his relatives are taking interest, especially now that he is getting married. We don't want to wait till the naturalization process if possible, because that's years away. We'd like to get this taken care of as soon as we can.

Is his stepfather's name on his birth certificate, or is it just what he's used on ID/passport? Was the inclusion of his bio-father's name included on the initial petition under "other names used"?

Before risking a delay in the process, check with your local marriage laws to see if there are any issues with the man changing his name once he's arrived in the U.S. (Some places prohibit the male spouse from changing his name.) This varies across the U.S., so if you're planning to apply for a marriage license in a different location from where you live, check out their application (usually available for viewing online).

If it's just you and your fiancé with no kids, divorces, or a serious criminal record involved, you should be fine without hiring an attorney. But, even if you do decide to use their services, your fiancé should still read up on all the ins and outs of this process to understand the different pieces of the puzzle and to know which questions to ask of the attorney.

Take a deep breath, this site is here for support and advice. You should fill in/ create a timeline. It would help others to be able to better answer you.
Was the marriage cert. already expired by the time you sent in your I-129F packet?
Unfortunately, the status of your case is up to the USCIS reviewer who has your file at this point... You could get an RFE (request for evidence) or they could deny your visa if they think you are already married. No one can tell you for sure.

From what the OP has stated, he received the marriage certificate on January 3 and received the NOA1 on February 2, so the petition package was sent in before the certificate expired. Thirty days from January 3 is February 2.

K-1 Fiance(e) Visa Process & ProceduresNOA dated february 2012

She left the the US on January 4th, a day after I got the marriage certificate since her father passed away in Moscow. (she was here in Houston for with her father's work visa, she had a one year visa, she was here also 4 years ago with the same visa...)

Her father went to Moscow for the new year's holidays and passed away before making it back to US. She went to Moscow to attend the funeral, but since her father passed away, her visa expires... and since the marriage certificate was not valid, we applied for K1.

Please comment! Thanks

But the adjudicator who will review your file won't know all of that backstory when reviewing the contents of your file. They'll see your I-129F fiancé(e) petition, flip through and see a marriage certificate included as well and make a conclusion that you may already be married, which makes you ineligible for filing the I-129F.

At this point, you can wait to see what happens, but also have a plan b in the event your petition is returned or denied. Plan b would include looking into the CR-1/IR-1 process (go here to read up on it), where you would marry and then file to have her join you in the U.S.

on February 28, 2012 i sent all the papers for the K1 visa.. till now my Case Status for Form I129F, PETITION FOR FIANCE(E) is still on Acceptance. i have called there office i was told everything is fine, but i do not believe them, pls guys how long will this take. i want my man to join me before the end of june, he is from nigeria

On average, it takes five months for the petition to be adjudicated. One of the Nigerian VJ-ers can provide information on how long it would take post-NOA2 to receive an interview and then receipt of the actual K-1 visa in hand, but the likelihood of him being here by the end of June is fairly low.

Please fill in your timeline to get an estimate based on the date listed on your Notice of Acceptance received from USCIS.

Dear Applicant/Petitioner:

Your USCIS application/petition has been received and routed to the Vermont Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number EAC*********. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your application using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

This confirmation provides notification of the date USCIS received your application/petition. This notice does NOT grant any immigration status or benefit. You MAY NOT present this notice as evidence that you have been granted any immigration status or benefit. Further, this notice does NOT constitute evidence that your application remains pending with USCIS. The current status of your application/petition must be verified with USCIS.

Also, what does the EAC in front of the numbers mean? Thanks guys :)

The sponsor and co-sponsor are there to ensure you do not become a public charge. If your fiancée's income is below the poverty line for her household, then the qualifying co-sponsor would be used to sponsor you. That doesn't mean they'll cut you a check whenever you want it, however. So, if you have savings that you plan to use once you have a visa and are living in the U.S., that's fine.

Assuming she will sponsor you for both the I-134 and the I-864 stages of this process, have her read the Sponsor's Contract portion of the I-864 Affidavit of Support (Part 8): http://www.uscis.gov.../form/i-864.pdf

The I-864 is the legally binding document, so it's key she understands it.
