she had to send a money order or whatever there called out there (she took the money to a shop and they gave her like a check or something). we dont have them here in the UK so not sure what it is exactly.

Money orders can be tracked as well. Does she still have the receipt with the serial number on it? If so, she should go back to where she purchased it and they can investigate if it's been cashed.

ok, my fiance has the say off work tomorrow so i will get her to give them a call and see what they have to say, lets hope the receipt just got lost.

They're only as accurate as the members of the site. It's dependent upon us to update our information. There are a number of folks who have the wrong Service Center, wrong country, don't list the visa type, etc., which will impact estimates.

Ben made a mistake when he put K1... we'll be getting married and applying for the CR-1 and we know it is going to be a wait...

You should post your question in the CR-1/IR-1 forum to get the best answers on your situation. The K-1 is a different process altogether. Good luck!

In retro we should have done the CR1, less xx in the long run.

K-1 Fiance(e) Visa Process & ProceduresQuestion about which visa we need

I disagree with this advice. I'm sorry.
This is not a family member petitioning and NOT the Intent. The OP clearly states: We wish to Marry. Now, that just seems to be a little mis-leading does'nt it to Immigration. The intent is to Marry.
I also think, it is a TOS violation to give this advice to the OP.
Encourage them to go by the book.

The OP said, in part:

My boyfriend has relatives who already live in the US, his father, and step-sisters. I live in Minnesota, and his relatives live in another state ( at the moment I can't recall what state he said they lived in) but its no where near Minnesota. My question is this. Do we file for the K-1 fiance visa, or do we try to get him here through having relatives here? Andto if he were be able to come here through having relatives in the US, wouldn't he have to start out residing in the state with his relatives? Or could he reside in Minnesota with me? Which option is best, quickest, and easiest? Any info regarding this subject is appreciated, thanks

If she wants information on how his family members can bring him to the U.S., there is a path to do that. I provided her with the links so she could investigate further and determine which option her boyfriend wants to pursue -- entering the country via K-1 or entering by petitioning through a parent.

K-1 Fiance(e) Visa Process & ProceduresQuestion about which visa we need

thanks for your response. yes we would marry within the 90 days. From what I see, it looks like it can take 6 months or so for the fiance visa process. Do you have any idea how long it could take to file through him having family members here? I'd like to let my boyfriend know how long it could possibly take if we went that route, because he feels that's the better way to go, although I feel the fiance visa is the easier, quicker route. Also, what other reasons would it be better to go the fiance visa route? thanks for any extra info

There's a different forum for US citizens and/or permanent residents in the US who want to bring a family member to the US. They would need to file an I-130. The processing time can vary, but it will definitely take longer than the K-1.

The K-1 visa is probably the (relatively) quickest option available. You can live anywhere you want in the U.S. as long as you're married within the 90 days upon arrival in the country. To read up on the K-1 visa process, check the guide here: http://www.visajourn...content/k1guide

K-1 Fiance(e) Visa Process & ProceduresInsufficient funds for K1

she mention the bf work as military so USCIS base it on the 100% poverty guidelines....anyways I read on the USCIS even the I-134 only base on the 100% poverty then after they got married and adjust the status that’s the time they will base it on the 125%(using the I-864 form)....not sure why in this website (visa journey) people base it on the 125% using ONLY the I-134 affidavit support and making everyone confused.

The rationale is if you aren't at the 125% level by the interview, how will you be there in a few months when it's time to adjust status and file the I-864? That's usually why most embassies use the 125% guideline for the I-134 at the interview stage.

K-1 Fiance(e) Visa Process & ProceduresRoller coaster day over 1-134 Please read

3.One last question for now, sorry for the overload! If I go the cosponcer route, how long are they held responcible?

Assuming the co-sponsor you use for the I-134 is the same for when you adjust status and submit the I-864 (both the co-sponsor and yourself will need to complete this form), they will be responsible until:

When Will These Obligations End?

Your obligations under a Form I-864 will end if the person who becomes a permanent resident based on a Form I-864 that
you signed:

  • Becomes a U.S. citizen;
  • Has worked, or can be credited with, 40 quarters of coverage under the Social Security Act;
  • No longer has lawful permanent resident status, and has departed the United States;
  • Becomes subject to removal, but applies for and obtains in removal proceedings a new grant of adjustment of status,
  • based on a new affidavit of support, if one is required; or
  • Dies.

Note that divorce does not terminate your obligations under this Form I-864.

This info is included in the I-864 form, page 7: http://www.uscis.gov...form/i-864.pdf.

K-1 Fiance(e) Visa Process & ProceduresK1 Documents Needed for BENEFECIARY

Where can i find the forms or documents that my fiance needs and the documents i need to send it to her, is the GUIDE here for the K1 pretty accurate?

Yes, read the guide plus check the country's forum where the interview will take place and the embassy reviews section on the site. Some pieces noted in the guides may or may not be needed.

Is your fiancé the petitioner or the beneficiary?

If the petitioner, they can submit the change of address online here: http://1.usa.gov/HJiJqH

If the beneficiary, they will need to follow the non-citizen steps provided on that same link:
Step 1: File a Form AR-11 (This changes your address in our master database.);
Step 2: If you have a pending case, you must also file a Change of Address online or call our National Customer Service Center at (800) 375-5283. (This changes your address for the specific application you have submitted.)
LeftCoastLadyFemaleUnited Kingdom2012-04-11 14:28:00
K-1 Fiance(e) Visa Process & ProceduresSubmitting K-1 Soon, Please Advise!
The filing fee for the petition is $340. That is not changing. Please read more carefully...the change is with visa fee on the embassy side once the petition is approved.

You can change the address once the petition is submitted, but you will have to be diligent in making sure the address is indeed updated and is passed on to the embassy once USCIS approves the petition. If it were me, I'd take the extra time and submit the petition and materials once receiving an updated form.

Also, if you're planning to send the materials via UPS, then you'll have to use the street address provided in the instructions. The PO Box is only for mailing via USPS.

K-1 Fiance(e) Visa Process & ProceduresWedding Planning

Hi all,

We applied for the K1 visa in February and we would like to start planning our wedding. We have decided to go to Vegas (where we met) but an organised event rather than a little white chapel. What experiences can anyone share about planning and basically guessing when it will be held. Could we be more confident about booking a date when the NOA2 comes through?

Any thoughts would be grateful

Thanks

You should wait until the visa is in your hand before making any concrete plans.

Thanks for this, I do work for a cruise line and would be returning for work. Do you think my entry may still be denied??

There's always that chance. The best you can do is bring rock solid proof that you will not be staying in the country. Get a letter from your employer stating that you must return to work by X date.

K-1 Fiance(e) Visa Process & ProceduresK1 interview issued

Hi all,
I need some help. I have just recieved my packet 4 and my interview is in a month and not 2 weeks like I was expecting (apparently Sydney only interviews once a week!!!)
I need to travel back to the states before this because my wedding is booked and paid for and i believed i had more than enough time to complete this process If I abandon my K1 visa what will happen when I enter the states again??

Well, that's unfortunate. If you abandon the process before receiving the visa, then you'll have to file for the spousal visa (IR-1/CR-1) and start back at square one.

So, you can go to the US and assuming you're admitted with no issues, get married, but then you must return to your home country. However, since you're clearly coming with the intent to marry, there is a risk that you may not be allowed in the country, so if you're going to keep your wedding plans, bring rock solid ties to your home country that show you will be returning home.

Reminder to others who may be reading this thread, do not book/reserve/finalize any plans until you have received the visa and it's in your possession.

K-1 Fiance(e) Visa Process & ProceduresFiance with Kids?

Hi all,

I am actually writing on behalf of a friend that wants to bring her fiance' over to the states. She has two kids from previous relationships. She has begun filling out the I-129F but did not see anywhere where it requested information about her kids, only her fiance's kids. She wants everything to be as transparent as possible and does not want it to seem as if she is withholding information. Should she indicate this anywhere on the application or will it come up down the line?
Furthermore, from people's experience, does this have a negative effect on the application/interview process?

Thanks in Advance!

Kids from the petitioner's previous relationships don't have to be included on the I-129F. The petition is for the fiancé and any child(ren) he has, whether they're coming to the US or not. If your friend's current fiancé isn't the bio father of the other two kids, then no, they don't have to be listed.

ETA: To add on to what JerseyDomRep said, yes, your friend will need to count her dependents as part of her household + her fiancé when it comes time to do the I-134 and I-864 forms. So, be sure she looks at the appropriate minimum income guideline for her situation.

K-1 Fiance(e) Visa Process & ProceduresLockbox Questions

Hi All.....

I am so very close to having the I-129F ready for mailing. Must have gone over every page a dozen times now. Help me out with this though.

In the VISA guide it says to mail the package to the Lockbox location in Dallas TX, but the example cover letter says to fill in the address of the filing location. I guess that would be the one in Texas? Right?

Then if you look at the e-notification instructions, it says there are three Lockbox locations. It lists Chicago, Phoenix, and Lewisville Texas...... but does not mention Dallas?

Thanks for the help, and I think on Monday this is going in the mail.

Joe

Lewisville is a town in the Dallas metro area. For the I-129F petition, you want to send it to the Lewisville address, where they will process payment and then forward it to either the Vermont or California Service Center for adjudication. The Chicago and Phoenix lockboxes are used for other petitions.

Weren't those geared towards a specific country?

Your signature on the I-129F petition plus the letter of intent that you include with the initial package. Sure, one could risk the wrath of the government (the penalties are laid out in the I-129F, too) by submitting the petition without being 100% free to marry...

Hi people!!

So after you send the package, instead beeing waiting doing nothing we can always start to do the next step right? I mean prepare the interwiew part, NOW the question is, can I fill all the files after I send the package? pay the fee and stuff and just wait for the medical exam to be read?

Another question:

After is approved whats next step? apply for AOS? can I work there without it? and after OAS what would be the next step?

Thank you.

The post-NOA2 steps are included on that page...you know, the one you said you've memorized?

Once the I-129F petition and supporting materials are sent off, the waiting game begins. You can't do the medical exam until the petition is approved and is sent to Dept. of State side of the process.

Beyond reading the K-1 guide, read the K-1 flowchart, the Adjustment of Status guide, and get acquainted with the country where the interview will be held.

I responded to your other question above as well:

The embassy won't look at your fiancé's bills. They want to see a history of income via paystubs and tax returns and proof of employment. So, if your fiancé actually makes $60k per year, then he's well over the poverty line.

Hello you!

I still dont get this poverty thing, How much should my fiance make or how much is the minimum for 2 ppl leave in the usa? I read something about 15.000 is fine, but does that depend on the place you live or what? So lets say he makes 1500 per month = 18.000 per year would be enough for 2 ppl to live? and that is enought to show in the interwiew? why cant I show my incoming and stuff?

Thank you.

Here are the poverty guidelines for 2012: http://www.uscis.gov...form/i-864p.pdf

You'll want to look at the 125% column, unless the USC is active duty military. So, if your fiancé is not active duty, then the amount he needs to make -- at a minimum -- for two people is $18,912.
