Here my question...my Fiancé just retired in April, he will be getting a pension of 1300 dollars a month..also he receives 2000 dollars a month for a insurance settlement for the next 2 years..than in a year an a half he will receive his social security of about 1800 dollars a month...this does not include work he will do beginning in Sept part time teaching....do we have to be concerned about the requirements of the affidavit of support?.? Helppppp

Is it just the two of you or are there any kids to consider? If it's just the two of you, then he's above the minimum poverty guideline.

Yikes. We'll get going on that police certificate thing. It will be pretty easy for her to get a signature, looking over the list. I'm sure she can get a teacher or someone to do it really quickly.

Now what I'm wondering... She's coming June 28. Our NOA2 should come around the same time, really. I suppose once we get the med exam date, she should fly back ASAP to get the exam. Then she'll have to wait a month for the interview, and then a few days, and she'll be able to come back to the US with the visa?

Or do they let us choose the med exam date? Her return flight is September 24 or something like that. If we get her exam date and it's before September 24, would it be better to fly her back? Or should we try to get an exam after September 24? If they want the med exam, say, August 2nd, maybe it would be better to fly her back for that. But then, would I know when to make her return flight (back to the US) for?

Unfortunately, I don't think I'll be able to do much/any visiting. We've got her 84 day trip to the US booked, but it sounds like my budget will be taken up just flying her back and forth. It also sounds like we should only be apart for about a month really before she can return to the US?

Sorry if I'm not understanding all this correctly!! I'm just trying to figure out the most reasonable way to roll with all this. :)


You won't really know when to book the flight to the US until the interview is scheduled, it happens, she's approved, and the visa is delivered back to her. Don't book anything until you know for sure she has her passport back and is ready to travel.

For the UK, your fiancée will need to have the medical exam before the embassy interview can be scheduled.

From what orangedesk posted in the UK forum, her fiancé's interview will likely be scheduled for sometime in August. So, you're likely looking at around three months from receipt of the NOA2 to when the interview occurs, assuming there are no delays in the embassy receiving your information, your fiancée is able to get all needed documentation taken care of, and the medical exam is scheduled as quickly as possible. For example, does she already have her police certificate(s) ready to go?

As always, if you haven't frequented the "London 2012- K1s from NOA2 to interview thread" in the UK regional forum, I highly recommend it as it will give you a realistic idea of what people are experiencing now.

It might be easier to get married and file for the I-130 which is the petition for permanent resident and file the I-485 which is the change of status at the same time.
According to my attorney this is a fast way to get eveyrthing organized and you can be here with your wife while you do this.


If the beneficiary enters with the intent to marry via VWP and attempts to adjust status, they face not only being denied, but being banned.

Hi, my fiance and I are planning to marry in the US where she is a citizen. I am a UK citizen. Having researched our visa options in depth, we've decided the K-1 Fiance Visa looks like the option for us, as the plan is for us to reside together in the USA following our marriage. However I still have a couple of lingering queries about the process, and would appreciate any help. Apologies if they're obvious, but there's a lot of information to filter.

1. From what I can gather, K-1 has no Fast Track option. Is this correct? I understand the process typically takes 8 - 10 months. The UK equivalent Visa has a Priority processing option for a fee, but I can find no evidence of such an option for the US K-1?

2. Is it worth hiring an Immigration Attorney to help ensure a successful application? Completing paperwork isn't really an problem for us, but the thought of waiting almost a year for the process, wondering whether something was missed out seems pretty stressful. You'll find that most people on VJ are going through/have gone through this process without the use of an attorney. Unless you have a complex case, you can do it on your own and use this site to ask questions, check out form examples, etc.

3. I read that my fiance (in the US) can have a family member co-sponsor me on the Affadavit of Support and in our case this may be necessary. On the Affadavit form (I-134), where exactly do you enter the Co-Sponsor's details? The form seems to be geared around just one person declaring support?

For the UK, you only need to supply the I-134 for the co-sponsor if that's whose income is being used to show support for the beneficiary. They would need to fill out the I-134 and then supply the supporting information. If the same co-sponsor will be used for the Adjustment of Status phase, be sure they read the I-864 thoroughly since that is a legally binding document.

I have a letter from my employer verifying my employement and I have 6 months worth of my paystubs. I also have a letter from my bank stating when the account was opened my last year's total deposit and current balacne, dated and signed by the bank officer. I am wondering if I need to include histry of my account or account statments? Do I or I dont?


If you're using a letter verifying your employment and paystubs and you meet the poverty guideline, you don't need to fill out the bank account, mortgage portions of the form.

Hi everyone,

I am sending package to my fiancee. My I-129F was approved last month. My case is now at the embassy, but we have not receive documents meaning no medical or interview time is set yet. I want to send package since someone is delivering for me. I need to clear a couple things here....

I start my questions and please help everyone!!

1) I have bank statment verifying my funds, signed and dated by the bank officer, do I need to have statments of my bank account with the I-134 or not? Remember it is K1-visa?

2) I-134 questions #7. "I have other personal property, the reasonable value of which is". Is it where I put the home value that I wone one third of or not? Do I do the total value of the home and divided by 3 or how I need to do this?
...... The same question # 7. where it say.." I own real estate valued at" Is this the right place to add the value of the home I own one third of? Also right in the bottom of that it say..." With mortgage or other encumbrances thereon amounting to $------"? What I need to do here?

3). Question # 10. " I have submitted a visa petition to U.S Citizenship and Immigration Services on behalf of the following persons. If none, state None" Do I put my fiancee's name here that I petitioned for her?

4) Question # 11. " I intend or dont intend to make specific contributions to the support of the person anmed in item 3" What to do here? Do I need to check mark the intend or the do not intend to contribute specific amount? Please Please please help me. :bonk: I am so overwelmed.

The $240 is the fee for the visa.

If you file the petition for the fiancé(e) visa now, you'd likely have it by March 2013, true, however, you would need to go through the Adjustment of Status process and apply for Advanced Parole to allow your wife to re-enter the country. That usually takes several months, so June 2013 would be cutting it very close.

Im new here so i aplogise if this information is available somewhere on the site.

Me and my fiancee intend on marrying in the UK next June and moving in with her parents in PA. We thought it would be better for us to apply for a K-1 Fiance Visa (due to the fact we will be moving over days after the wedding) and adjust the status as soon as we get over there.

Would this be the best way to achieve this? The forms tell us that we must intend to marry within 90 days of me actually living in America, but since we will already be married, could we just adjust the status once we arrive?

I will be moving over there in 12 months, do you think the visa will be taken care of by then?

The K-1 visa isn't the right option for you, then. If you want to get married in the UK, you'll have to use the I-130 petition and apply for the IR-1/CR-1 spousal visa. The OMB is an government agency that reviews the various forms used by other agencies. This is an internal reference number for them and not relevant to your or anyone else's petition status.

5 months is the adjudication time. If u have an RFE they usually try to let u know that around the 3/4 month mark.

I'm about 3 weeks away from the 5 months mark myself.

What I've bolded isn't true. The adjudication process is essentially this: the adjudicator opens your file and reviews your petition. At that point, they will decide to either approve the petition, issue an RFE, or deny. They don't pull your petition a series of times to review it for completeness and then put it back on a shelf for a few more months to review it again because no RFE was issued.

The stated goal of the USCIS is to review/adjudicate petitions within a five-month timeframe. However, there are plenty of examples on VJ alone where people have been well under and well over that estimate.

That's the $240 fee mentioned earlier in this thread. You pay that before the interview occurs. Once you have the LDN# (post NOA2 and after NVC has the petition on its way to London), you can pay that fee.

Hey there. me and my girlfriend are aiming for marriage in about 2 -3 years time. and we know that the k-1 visa is the one well need.

but my question isnt what i need to do, but more how much it'll cost.

so far ive got

she files the I-129F - thats $340

then when thats approved, i apply for k-1

application for k-1 - $240
DS-156 - cant see anything as far as this costs
Medical - im not sure as i live in UK and we have NHS
Extras - how much do i set aside for all this? the police records, and other literature?
then the I-485 - $985 + $85 Biometrics

can someone hopefully give me a better idea as im going to need this on top of my travel money to get over there


The medical exam for the K-1 is done at Knightsbridge only for UK beneficiaries. The current cost is £227.

However, as someone else mentioned, the costs could change at any time, so be sure to read through the various documentation on the embassy and USCIS sites when you decide to file.

Just got an RFE and among other things it states the intent to marry. We each submitted the form letter as indicated on this site. His copy was scanned to me...could that be the reason they want new copies? I'm confused about this. Or did they lose this?


If it was scanned, that means the version you submitted didn't have his real signature on it in ink. You would have to submit a new, non-scanned version with his signature.

Hello everyone. I am looking for a little information and reassurance regarding my K1 packet. In looking around on the site I saw many photos of folks packets which seem large and have many papers in them. When going through the guides I followed what was suggested to send and my packet is no where near the size as those I have seen. Is it really imperative to provide hundreds of emails/chats/phone logs for the initial application? I have included along with all the forms and certificates required, a copy of my passport and the stamps showing my two trips to visit my fiance, a copy of his passport and stamps showing his three trips here to the US to visit me, the boarding passes and flight information we have (not all unfortunately), about two emails, two envelopes, a copy of the receipt for the engagement ring. I have many, many emails, yahoo logs, and other documentation but is this really necessary to send initially. My concern is too much sometimes bogs things down, right?

Any advice would be appreciated. We have been waiting a year to start this process and I am concerned about any other hold ups!!

There are definitely folks who send 100s of documentation with their petition. I think ours was maybe 30 pages tops and that's inclusive of the I-129F, G-325a docs for the both of us, and the G-1145. What you have listed seems fine. At the interview level, it may be necessary to show proof of an ongoing relationship (this varies by country), so things like chat logs and the like may be needed, but that doesn't qualify as primary evidence to include with the petition.

I think it should be original they said signatures must be original :) but if she signed it and dated it using a blue pen i think it will be ok, a scanned copy using black pen on the signature will make the copy look like xerox copy. I have a friend that sent their packet using scanned copies, they didn't get rfe or any news yet they're still waiting for their noa2 :)


If they're still waiting for their NOA2, then they aren't out of the woods for receiving an RFE requesting originals.

According to your timeline, you just filed the petition, correct? You won't need the I-134 document until the beneficiary goes to the interview in London, which will likely be early next year going by current estimates. So, as long as your father files his taxes by the end of the year, you should be fine to get the needed information in time.

Thanks so much for your input. Is the AOS a requirement after marriage? I've seen people respond that there is no time requirement as to when you must file for the AOS after marriage. The reason I ask is because my soon-to-be-husband (hopefully) is a musician and can earn money "outside of the system" anyway so it doesn't look like, for him, it would be immediately necessary. Of course, down the road, once we're financially stable, he will probably want a regular "in the system" job (i.e. teaching music classes) and at that time would file for the AOS - without my mom as a sponsor.


To be legally able to work in the U.S., you would need to adjust status along with filing the document for employment authorization.

smacks of the Affadavit of Support presented at a K-1 interview at the IV Unit, on interview day.

That particular Affadavit of Support is the I-134, and is NOT legally binding.
IMO (and others) it truly expires when one of two things happen:
1. foreign fiance gets married to the US Citizen or
2. the I-94 issued at the POE expires.

so, to the OP - remember.....

Short on Cash? You are not in a rush to file the Adjustment of Status after marriage - so take yer time, build up yer financial portfolio - heck - even file a year later when your financial position improves after marriage. There is no regulation for WHEN you must file the Adjustment of Status for your WIFE after marriage, but you must marry within 90 days of her arrival in the USA (there's a regulation about that one bit) .

The main issue there is the OP would need to determine if they will also need a co-sponsor to adjust status. While it's true there is no time limit on adjusting status, it also means the beneficiary can't work until authorization is received, which is usually done with the adjustment of status petition since it's at no additional cost (outside the $1070). If the OP isn't able to be in a financial situation on their own for the adjustment of status process, it's not a bad idea to keep an eye on what's needed for the I-864 and get a co-sponsor lined up, whether it's mum or someone else.

Hey everyone...

Just to follow on from my first post about timing...I've had a look at a lot of other couples' timelines, and they seem to be getting approved for the visa in around 8 months sometimes shorter. I should be receiving my NOA2 in the next week or so, the general time for approval after this date is 2-3 months, which would take me to beginning of August/Sept...so I'm thinking I could be OK for the wedding in October...or do you guys think this is too close and could end in disaster??

According to the VJ estimate based on your timeline info, your case may be adjudicated as late as July 9. (And of course, fingers crossed your fiancé doesn't receive an RFE!)

Considering there are a number of VJers with petitions at the Vermont Service Center, who also filed in January and are past the five-month mark, I'd recommend erring on the side of moving the wedding date. This process is pretty much out of your hands at the moment, so I would do what I could to control the things I can.
