Hey Everyone,

So we're currently waiting for NOA2 and it'll be 6mnths on 6th Aug since receiving NOA1...checked the USCIS website which states there is a request for evidence! I rang them, and they can't tell me anything as Im not the petitioner. Can anyone tell me what reasons/sorts of evidence others have needed to send? Is this just concerning the petitioner or could it be a problem with me? I'm just a little worried as it's taken them so long to get in touch?

Thanks for any advice/info - I know no-one here can give me answers as to why this has happened to us, but your own experiences would be appreciated!


Your fiancé (the petitioner) will receive a letter in the mail stating what additional information they need. The request can be for a variety of things...you can check the pinned RFE thread at the top of the forum to see what others have encountered. But the best thing to do is have him go through what he sent to see if he can get an idea of what could have triggered the RFE and then get it ready so he can quickly mail back the documentation.

NOA1 and NOA2 go to my USC fiancee petitioner. Then the approved petition goes to NVC who collect payment and give me a case number. Then it's forwarded to the Sydney consulate where I go for my interview?


The NVC doesn't collect your visa fee payment. That's done once the case, which will be assigned a consular number, reaches Sydney.

First, the petition is not at the Texas Service Center. It was, hopefully, sent to the Dallas Lockbox, which is not the same as the TSC. From there, the petitioner would have received a letter stating which service center would adjudicate the case -- EAC (Vermont) or WAC (California). Check which service center has the petition. If it's been 5 months, you're still within the standard processing time, however.

It's best to wait until you receive the RFE notice. In a recent newsletter from the VSC, they noted how they will start sending back any items sent to them without the RFE cover page. http://www.aila.org/...spx?docid=40032

If you're following the mm-dd-yyyy format noted on the G-325A, everything should fit. What were you trying to type that didn't fit? Again, it may be just a "small" edit to you and perhaps no one will notice, but why risk having the forms tossed because they aren't exact?

Well all I did is edit the space where you type. I find most forms funny. The form that does not take date was g-325a.
So I stretch the date box to be bigger. You can download any form and find something that will not fit. Why not stretch to fit 1 single letter? It is only the fill in box....

Note you can not change font size on forms due that they are locked out.

PS: It is not editing forms but editing of where boxes are for typing so it is safe. I am not good with handwriting so I better type it.

It's really not wise to alter government forms in any way. Instead, type/write "See attached document." on the form and then attach a separate sheet with the information that doesn't fit. Why risk having the visa denied/refused?

When I file my K-1 There was couple forms that would not take date. It cut out some digits. Some times the box was smaller then it should be.
So when I was preparing papers for my fiancee. The one for interview. I used software to unlock pdf and then use pdf editor software to adjust boxes.

If you have same problem and would like to fit some info in form just google for software that unlock pdf and the one that can edit.

The USCIS site still lists processing times for I-129Fs for the TSC, which seems to throw a lot of folks off. Bottom line: The Texas Service Center is not the same as the Dallas Lockbox.

I didnt get an email, but either way its not going to update you that they received it, they will send you an update they approved your petition. That can take up to two weeks to get in the mail


Actually, USCIS does send you an email and SMS on when the petition has been received and routed to the service center. The email provides the USCIS case #. However, there are plenty of instances of people on VJ who filed the G-1145 form with their petition package, but never received the electronic notification. USCIS will tell you to wait up to 30 business days to receive the hard copy of the receipt notice (NOA1), but most receive it within a week to 10 business days.

No, the adjudication period can take about five months on average -- sometimes it can be shorter or longer. What the petitioner (USC) will receive is a notification of acceptance from USCIS. This will let you know they've received the petition, its location (California or Vermont), and have the case number on it.

However, if you're like me, it will sit in a mailroom for four weeks before being sent to NVC. I would give it more than a couple of days before calling, though. There are currently only two service centers adjudicating I-129F petitions -- Vermont and California. You don't get to choose which one gets your petition, however. Simply follow the I-129F instructions on where to send the petition package and then be prepared to wait. :thumbs:

So I think I have everything put together for my K1 visa application to be filed here in the US. At one time I found a site that gave me estimates of how long the four different places I could file would take but now I'm not finding it. Does anyone know what is currently the fastest place to file to start the K1 visa. I know I'm looking at 8 long months on the lucky side but hoping to cut down any unluckyness if possible.

Most of the photos I sent with our petition were taken on either my Android or a friend's iPhone and that wasn't a problem. Don't get hung up on timestamps on photos, though. As mentioned, it's secondary evidence and you don't have to send a photo catalogue of your relationship...just a few to show further evidence of meeting. :thumbs:

Hello, Everyone!

My name is Amber, and I have a few questions about some forms that my Fiance, Brian, and I need to fill out.

We're currently in the process of getting things started for the Interview in London, but, my question is about the affidavit of support.

We JUST got the letter from the Consulate with instructions, and I was reading through the information on the I134, but I've seen some conflicting information.

Let me first start off by stating, that I make under the %125 of the Poverty Guidelines, so I am having my Uncle fill the I-134 out as the sponsor for my fiance. Do I have to file as a Co-Sponsor, or is that later when I fill out the I-864 for the AOS?

One person stated that you needed tax returns to go along with the I-134, then I seen a post stating that you did NOT need the I-134. So I'm just a mite confused.

When you load the instructions for the I-134, it doesn't state that you need the tax forms.

Also, I need to write a letter with my intent to marry Brian. Is there one that is already written as an example of what this one needs to state? I know when I was filling out the K1 Fiance Visa paperwork there was one that we wrote and there was an example that we followed and just signed at the bottom.

Sorry to ramble on, just didn't see the need to ask the questions in separate posts, but I'm hoping for an end to my confusion. Thanks in advance for any help that I might receive.


Welcome! First and foremost, regardless of your financial situation, you are always the primary sponsor of your fiancé. Anyone else, e.g. your uncle, is a co-sponsor for your fiancé...even if you don't need to fill out/submit a personal I-134 for London.

While you'll get great advice in the K-1 forum, it's best to read up on the embassy-specific needs at this stage since they vary on what's needed/not needed. :thumbs:

Not that I care about 15 dollars I just don't want a rejection as I read last week for paying different then the amount... What is fee for 129F??? I need to stay on this sight and forget the "official" USCIS website as it is confusing... Thanks

You seem to be confusing the I-129 and I-129F petitions. They are two separate items. That memo doesn't necessarily apply to the I-129F.

First post, I am a US citizen and have been engaged to a lovely Khmer women for about 8 months.
I have been staying in Cambodia for about 10 months, planning to return to USA in June. I will be unemployed when I return.

1. Should I wait until I have a steady job/income before I file the 129?
2. Is there a way to include my income in Cambodia on the 134 ? or if I have my sister/dad/etc co-sponsor is this not necessary?

As I was not in the US for 5 months of 2011 my income will not make the cut. And my 2012 income will not make the cut as well.
No assets outside of a tiny 401k.

Any advice or helpful hints would be awesome


Did you include the income you earned in Cambodia on your income tax return for 2011? If not, you should have since as a US citizen, any income you earn on this planet is subject to US taxes. (It's why one of the Facebook founders recently denounced his citizenship, since he realized how much he'd be paying despite not physically living in the US.)

You will likely have to file an amended return for 2011 that includes the income from Cambodia.

In addition to that, since you will be unemployed when you return to the US, it would be good to have a co-sponsor until you have a steady stream of income again.

We received our NOA2 about 4 weeks ago after about a 5 1/2 month wait, saying we were approved. Today my fiance received a letter stated that the NVC has received our approval and that I (the beneficiary) should be expecting a package in the mail soon. It stated that the petition will be forwarded within a week to visa-issuing post where my interview will take place. Can someone let me know what I should be expecting in this package? I am from Canada, and it's being forwarded to Montreal.



You should visit the Canada forum on VJ to chat with others who have been through Montreal and can provide you with info on the package. Once you get to the NOA2 stage, the process can vary by country.

Also, here http://www.visajourn...content/k1guide it shows what my fiance should do once we get our NOA2. Some of the things we do not have (i.e a full copy of our petition, I know we should have but we never made an extra copy). We have some of the PDF forms filled out but that's about it. Also, does he have to send me bank statements and pay stubs? My fiance has a letter from his employee stating that he is employed full time, but it doesn't state how much he gets paid since it is hourly and not a salary yet, will that still be ok? Is he supposed to send that letter to me as well? He's not rich or anything, and we don't have much saved, is this going to be a problem? He can support me on his salary (I lived with him for 6 months) but is that enough for them?


The I-129F petition and supporting documentation will have been forwarded from USCIS -- > NVC --> Embassy. The point of having a copy is in case something gets lost, so you can quickly have access to it.

Along with the completed I-134, he will need to show proof of employment and income, such as recent paystubs. If it's just the two of you, he will need to earn $18,912 at a minimum or else he'll need to secure a co-sponsor.

I know its way to early for me to be worried in this long process, but I sent out our I-129F on May 21st and still have not received an email/txt notification about an NOA1. The package was confirmed received at the Dallas Lockbox on May 23rd via USPS. I've noticed others who sent our I-129F on May 23rd and have already received an email and/or txt.

I created an account on the USCIS website, but its asking for a receipt number, which obviously I don't yet have.


It may take up to 30 days to receive the NOA1. Some people who sign up to receive the email/text notifications never receive them, it seems.

Agree with L+T, it would be good to know when he overnighted the package. Assuming the package is accepted, your fiancé should plan to visit you in the next few months to avoid any claims of fraud once you get to the interview since at that point, it will be well over two years since you've seen one another in person.

On 1/23/12, sent the I-129F Original Submission.

Received the I-797C, Notice of Action, dated 1/31/12, which noted Rejection Notice. We sent TOO MUCH MONEY!
IS THIS CONSIDERED THE NOA1?

On 2/7/12, we mailed the I-129F Corrected Submission with the correct amount $340.

Received I-797C, Notice of Action, dated 2/14/12, which noted "Receipt".
Is this considered the NOA2?

No, both are NOA1. As noted, it's a receipt notice that they have your petition. For creating a timeline, use the 2/14 date to get an estimate on when the petition will be adjudicated.

In my state (Minnesota) 3/4 community colleges I looked at charged the same for in state and out of state tuition. University was a different story.


This varies by state. For the OP, the out-of-state cost is more than 2x that of the in-state tuition.

Based on what you've outlined, she won't qualify for the in-state tuition rate for at least a year. First, she will need to establish residency in Virginia along with proving legal presence to qualify. Because she will need some sort of state-issued identification as part of the requirement, your best bet is to get married, start the adjustment of status process, and get the green card so there's no question about her legal status.

I see a lot of people writing checks to pay for their $340 I-129F payment, and for example.. what if I couldn't pay with a check from myself.. how would I go about doing this? You may not be able to find much info on the USCIS site, but here is a link to the DoS Nonimmigrant K-1 Fiance(e) FAQs. It has some good information about the K1/K2 (derivative) process.

Initially I was wondering the same thing about a K-2 guide, but after finding the DoS FAQs listed above and following the directions on the few assorted forms, the process become clearer, and, for me, negated the need for a guide. A little site thread searching with Google also provided some great info. There also seems to be some distinct differences (as always) as to how these visas are handled at the interviewing consulate/embassy level. Since this is a DIY site, if you feel so inclined, put together a K-2 guide and present it to the site's admin for site inclusion. Future Vjers will likely be appreciative of your efforts. :star:

Stay tuned, my fiance(e) (K-1) and her son (K-2) are scheduled to have their visa interviews in about 10 days in Guangzhou. Afterwords, I will be posting a review, maybe it can help others in their visa journey. :D

The address you include on your letter of intent doesn't really matter. What does matter -- if you want the petition to be processed in a timely manner -- is where it's sent. So, again, please read all of the instructions and follow them.

Here my question...my Fiancé just retired in April, he will be getting a pension of 1300 dollars a month..also he receives 2000 dollars a month for a insurance settlement for the next 2 years..than in a year an a half he will receive his social security of about 1800 dollars a month...this does not include work he will do beginning in Sept part time teaching....do we have to be concerned about the requirements of the affidavit of support?.? Helppppp
