Hey Everyone,

Currently awaiting my NOA2, should be any day now, and putting together plans for the wedding. What we are doing is getting married in the USA, and the following week have a party in the UK for family who couldnt make it to the wedding. I havent really thought about my change in status or the next stage after this tbh, but my question is this - will there be a problem travelling back to the UK after we've been married? Im aware we'll need to prove that we've been married, but I don't want to be denied back to the USA?

Any advice would be fantastic, thanks


You will not be able to re-enter the U.S. if you leave before receiving Advanced Parole or your green card. The AP can take about three months or so to receive. If you leave without either document, your then-spouse would need to file the spousal petition for you.

Hey guys, so I just requested 2011 tax transcripts for my I-134. I know you do not need the previous 3 years, that's optional, but I know on the form you do need to write how much you made for those 3 years. Anyway my question is, in 2010 I did not work at all, I babysat for 3 months but they just gave me personal checks and I also started an online class towards the end of the year. I just spoke to the IRS and they said they show I have no income that year. So do I need to show proof of anything on the visa or will writing 0 income that year be ok?

Please please please, I need any answers I can get about this, I got my NOA2 and I'm trying to hurry and send my fiance everything I need to.

Where on the I-134 form do you see that you need to include the past three years of income? You only include your current/ongoing income and/or any income derived from savings, property, etc.

Are your existing income/assets are above the poverty guideline?

Unless you're hiring someone who will go through the adjustment of status with you as well, it will serve you well to know which questions to ask and have an understanding of the various steps in this journey.

Any advice will be greatly appreciated and please be kind as this is all new to me. I met the girl of my dreams in Colombia, i have traveled twice once for 2 weeks and the other for 2 months. I'm ex military, Army, and currently in college, im only 24 but after meeting her we decided that we want to pursue her coming to the US and us getting married. I just have no earthly idea where to start or what to do. I thought about hiring an immigration lawyer or the easyfiancevisa website but after readings ome posts on here alot of people say thats unnecessary. If someone could just tell me where to start or what to do I would greatly appreciate it. Thanks

Take a look at the I-129F instructions on the USCIS site as well and be sure to ask questions if don't understand something. Ideally, before you mail in the petition package to avoid receiving an RFE. Good luck!

I'm just double checking, I received the Form I-797C, NOA receipt. (I'm the American, btw). Is there anything else I have to do, or do we just wait until we get the interview information?

Also, how does the interview information get to us? Does the government send the info to me (USA) or him (Canada)? Is it in a letter? or an Email? etc. He's going to try to visit me this weekend for about a month, and I'm just concerned he'll get the interview letter while he's visiting and have to drive back in such a hurry because the interview would be tomorrow (or something). Do they give you a weeks notice?

You have many months before you get to the interview stage if you're just receiving the NOA1. :lol: Take a look at your timeline and you'll see the estimated adjudication timeframe. Your petition likely won't stay at the NVC long enough to have any extra items matched to it. You will be better off sending it on to the beneficiary with your other documents (e.g. I-134, etc.).

At first i used to count the two years period within like say, from 2009 june to 2011 june which is the two years period b4 i submitted my application. I was sure that since i file in march then my third yr counting will be in june 2012, but i submitted my application b4 the third year. If you travel now, it wouldn't help your existing petition, no. If your last meeting was in June 2009, you would have had to file a petition by May 2011 to have it be within the two year timeframe. To save yourself a headache, it would be best to withdraw your current petition -- contact USCIS and send a letter. Then, travel to meet with your fiancé, ensuring to gather plenty of proof (passport stamps, receipts, cards, photos, etc.) before resubmitting.

Hello all,

Like many of you, I look at the timelines every day. Okay, maybe two or three times a day. But there is something I don't understand.

It shows that the CSC or VSC are processing cases from a certain day. For instance, today it says CSC is processing cases with NOA1 dates of March 7. That's 138 days.

But when I view my own timeline, it says my petition should be adjudicated within a date range that is 126-134 days from my NOA1 date. How are these estimates made? Anyone know?

It's all VJ user driven, so it's dependent on how soon someone updates their timeline. Just use it as an estimate, but don't take it as gospel.

I'm working on my financial information to send to my fiance. If I make over the required income threshhold, do I have to include the letter from my bank, or if was not planning on including the account information as part of the dollar amounts, since I make enough to cover it without, can I leave that out?

My bank is a credit union that is very strict about that sort of thing, and I know this will be a nightmare to get from them.

Also, what exactly happens once the NOA2 is received? Do I need to start calling and asking for the case/file number? Or do they send that info to me? If so, how is it sent? I can't seem to find any actual info about the actual process beyond "start calling and gathering the info".

If you're choosing to use income from a job (e.g. paystubs, letter from employer) for the I-134, you don't have to fill in the bank account details or provide a letter from the bank.

VSC seems to be faster in sending approved petitions to the NVC, so you should probably be able to call them to receive your consular number.

I live in Scotland and have to travel down to London for the medical and also the interview for the K-1 VISA. Can anyone help me out with how far apart these have to be. I completely accept if I have to make 2 trips down...you gotta do what you gotta do! However...IF the medical can be done the day before the interview it would be great!

You'll more than likely be making two trips to London. The best I've seen lately is kittylondon who has about a two week space between the exam and the interview, but it can be further apart than that.

Hey guys I need your help, was told via NVC letter that my approved K1 petition was forwarded to US Embassy, Moscow on July 05, 2012 many of you are listing on their Time line the date the petition was received by the US Embassy, Moscow or in any other countries. How I could know the Embassy receiving date. I cannot search it via DHL, because I do not have airway bill tracking #. By the way my fiancée have not received any notification from the Embassy up to the present time. Any input and help will be appreciated. Thanks



There was a shipment from NVC to Moscow on July 6 (DHL waybill #9325817620) and July 9 (DHL waybill #9325818283). It's possible your case was in one of those.

Welcome!

Hey guys. First off, I'm new here as you can probably tell. I'd like to start by saying that you're all really awesome and a great help, and this site is an absolute godsend!

As you all know the process of applying for a visa is incredibly stressful, and my journey is only just beginning. I'm currently in the process of putting together a K-1 I-129F package with my fiancée whilst she is here in England with me. I feel like I've gotten to the point where we're almost ready to send it but I had a few specific, and slightly random questions to ask, and thought I'd better run them through those with a good amount of experience. I'd also like to break down our package so far to see if it's considered worthy enough of sending at this point, if that's alright. Here goes:

Starting with a quick overview of our package thus far:

Cover letter, signed by petitioner (needs to be dated?).

I-129f, signed and dated.

I-129f supplement (Q. 18), signed and dated. For this one we outlined how we came to meet each other (online through a mutual friend) and then we made a small timeline of all the dates we've visited each other over the past 3 years, with little details underneath. Is this too much or is there no such thing?


They don't want to know you life story, but do provide enough details so it relates to the other evidence your fiancée will submit with the petition.

G-325A for both of us, with pictures in plastic wallets attached to a sheet of paper behind corresponding form.

Scan of Petitioners birth certificate.

Letters of intent, signed (needs to be dated?).


We signed and dated ours.

Proof of having met/ongoing relationship. This is a big one of course, probably the cause for concern with most people. Here's how I compiled our evidence (hopefully it's okay to do it this way). I made a separate document in Word for each time we've met in the past 3 years. In this document I have supplied information that's related to the specific trip. For instance, one of our visits went from December 15th 2009, to January 6th 2010. I have attached two pictures to the document and labelled them with captions stating the date and location they were taken. Beneath the pictures I have paperwork from the flight that's been scanned, it clearly states the date, my name etc. We've basically done this six times, for the six different visits. Is this enough evidence to provide? Does it also prove that we have an ongoing relationship or do I need more? We have chat logs but they're from MSN, and I feel it'd perhaps be a little useless and/or annoying to take a screenshot of all of our chatlogs in a folder and use that.


The key is to provide concrete primary evidence that you've met within the past two years, so anytime from August 2010 - now. Do you have receipts, passport stamps, boarding passes? Photos are great, but they are secondary evidence. Chat logs don't show proof of meeting, either, so don't spend time compiling that. Besides, you won't need it at the interview. More on that in a bit...

Now for some specific questions.

When filling out the forms, I-129F, G-325A etc. should we leave boxes blank that do not apply or should we fill all boxes with N/A unless stated otherwise?


It is absolutely critical that every box/field on the I-129F be completed. If it isn't relevant to you, put "none" or "n/a." Do not leave anything blank. Be sure to check, double-check, and triple-check. This process takes its toll and to think a missed check on the I-129F form could further delay the process could be horrible. The top portion of the G-325A forms technically do not have to be filled in again, but we did anyway just to be on the safe side.

Should we sign the papers we compiled as evidence or is that unnecessary?


Only sign the documents where your signature is needed -- I-129F (your fiancée), the G-325A docs, the letters of intent, and the passport-sized photos.

We plan on putting the package together by hole-punching the top and using split pins, then using plastic tabs at the bottom of the entire document to provide easy access to specific areas of our petition. Would this be relatively hassle free for the guys handling our petition?


Once the petition package arrives at the lockbox, they will take it apart and sort it the way they want the information. We left our documents hole-free. I put everything in a folder to keep it together, then paper-clipped the photos to our respective G-325A forms and put the check on top.

I'm an English citizen moving to America (obviously). Is there any specific tips from those of you who've been through this already regarding the process? Is it going to be any easier for me (here's hoping :lol:)?


Compared to other embassies/consulates, the UK is one of the easier places. You don't need to provide proof of ongoing relationship or other items that some countries require. You can visit the UK regional forum to chat with others going through London and/or read the embassy reviews others have posted.

As my fiancé and I are about to enter the embassy portion of this process, I can tell you that it will be hard at times being apart. Thank Buddha for Skype! But, it will be worth it. Just be sure to take the time to read through the I-129F instructions as well as the VJ K-1 guide before mailing everything to the lockbox. And be sure to ask questions! No one can help if they aren't asked. :thumbs: Good luck!

Thank you! I will start with what you gave me. She is a U.S Citizen and makes well above the level..i just wanted to make sure that her residing in another state wouldn't be an issue.

Another question for anyone: Do you have to show you have accomodation? For example, in the UK you have to show that you have a residence that is big enough for your entire family. Is that a requirement for the US as well?


I don't believe that's a question asked generally and it's not a requirement, but it could be a embassy/consulate-specific question if they feel there's reason to believe the relationship isn't genuine. :unsure: You may want to check out the embassy/consulate reviews and check the regional forum covering Tunisia to see if anyone has been asked that sort of question previously.

On your co-sponsor, they don't have to live in the same state. It's more important that they are a U.S. citizen or legal permanent resident and can show proof that they can support your fiancé. Be sure to review the poverty guidelines for 2012: http://www.uscis.gov...form/i-864p.pdf .

Personally I'd be using the diplomatic visa to bring her here, get married quickly, file the K-3, and send her back to Albania before she overstays. All of that is perfectly legal and part of the K-3 wait time will be spent together in the US. Make sure she gets a check-up before flying back pregnant, because any complication might prevent her flight. Once the baby is born in Albania, file the CRBA and both the Albanian passport and US passport.


Except the K-3 is obsolete.

Basically while I was planning on marrying her, the sudden rush is that she is pregnant, which I have only known about for around 4 weeks. I travel constantly and frankly haven't been on top of it for the last month.

Can I get her in on a fiancee visa soon?


From submitting the petition to interview to having the fiancé(e) visa in hand takes, on average, 7-9 months. If you're already planning to get married in September, you will not have the visa by then. So, plan on filing the spousal visa and look up the Consular Report of Birth info for your child.

Did the RFE specify what specifically was wrong with the G-325A? Did you both send signed copies? Go over both documents to make sure everything is filled in completely, including the spots where it should be "None" or "N/A."

So my fiance and I have received the NAO1 for the K1 Visa and we are expected to get the NAO2 in October. I have a few questions in regards to what the process will be like once she gets the NAO2.

1) It says we need police records of the previous countries she has lived in past 6 months. Can she start this process before we get the NAO2 since i hear this takes a long time


Just be sure that the police certificates won't expire before your fiancée gets to the interview phase. I know some certificates are only valid for six months, so time it accordingly.

2) If i can not start the process before the NAO2, and the process takes 3 months on top of the NAO2, would my 90 day window be closed because of the delay and the process start all over again?

3) When you get the NAO2, does the 90 days start or is that once she gets to the US?


I think you're misunderstanding the 90-day requirement. The 90 days refers to the amount of time you and your fiancée have to get married once she enters the U.S. When issued, the approved petition (NOA2) is typically valid for four months and the consular can renew it if the interview has yet to occur by the expiration date.

Not everybody can afford to leave their jobs for 90 days or 120 days, to see if they should go on with the plan or not.
I am sure it is more difficult for people who is bringing their kids who had to leave school.

But I am always in favor to trust my feelings, sometimes going back home is not the worst that can happen.
People can change or show how they really are when they are in their normal environment.

When I left home, my father gave me a round ticket and he told me "If he is not good to you come back, don't let him disrespect you, do not let him ever hit you, if he does, just come back, or call me and I will go for you; I will not ask questions and I will not let anybody else ask you questions"

I think he may have known I would feel ashamed if I failed and probabily would not want to go back eeven if things were not good.
( I miss my father so much this week is 4 years without him )


If neither the petitioner nor the beneficiary can afford to take the steps before filing the petition to ensure they're a) serious about the commitment and b) ready for a major life change that not only includes moving to a new country, but the very act of getting married and living with someone, then they should not file the petition until they can afford to make the time.

This is why my fiancé visited me twice in the US -- to make sure he likes where he'll be living (taking time to explore the city, etc.) and more importantly, that he'll like living with me and my stupid cat. We were certain after his first visit, but we still waited to file until his second visit here to make 100% certain that we want to do this.

In most cases, fiancé(e) petitions don't remain at the NVC for very long. In my case, it was there for about a business day, they assigned the consular number and shipped it to London.

The adjustment of status is the I-485. The current cost of filing is $1070.

The other item to think about is if you want the time spent apart upfront or after marriage. As Cathy mentioned upthread, it's a personal decision, so do take time to look at the pros/cons and talk about them with your fiancé to ensure you're both on the same page.

Also, the fact that the lawyer recommended the K-3...don't go to that person should you decide to hire an attorney. :lol:

I don't believe that USCIS has the right do disclose her medical information at an interview due to the The Health Insurance Portability and Accountability Act (HIPAA). And if she were to seek any medical treatment in the USA she has the right to privacy, even from her husband unless she signs permission for him to know.
It's up to the OP to decide to tell him.

It's not bullying when people are telling the OP the possible consequences of keeping this to herself, especially when there are government agencies involved throughout this process who could inform her fiancé as noted in the scenario Jim mentioned upthread. And, as we all know, there are only so many things we can control on this journey. Being fully informed of what could happen is in no way trying to coerce someone into doing something they don't want to do. Ultimately, it's up to the OP to make the decision and determine what's best for her situation.

Yes, hide a major event in your life from your future spouse until after you're here...and look forward to a return trip should he decide not to marry you. Plus, what if this comes out and he thinks you may be hiding other things from him? Being in a successful relationship, especially one where you're going to marry the person and uproot your life, should be based on honesty and openness. If you're scared to tell him this, then perhaps you're not ready for marriage.

Also, I wouldn't rely on Google, MD to determine what a doctor can/cannot tell upon examining you.
