Many of the forms you fiancée will need to complete are online on the embassy's site. Double-check there. Also, once you have a case number from the NVC, call the Embassy regarding the change in address/contact information. The NVC doesn't do much with K-1s, so calling them with the change wouldn't really help.

Also, do note that it is taking the NVC longer than 15 business days to enter petitions. I'm still waiting. During my last call, they asked me to scan a copy of the NOA2 and send on so they can research its status.

Hey everyone. I made a forum last night regarding packet 3 and what is needed. The Montreal website has this list:

1. DS-230 part I only – one copy per each applicant, including children
2. DS-156 – 2 copies https://evisaforms.state.gov/ds156.asp
3. DS-156K – 1 copy http://www.state.gov...ation/82063.pdf
4. Confirmation receipt regarding Form DS-160 - one copy, available online at https://ceac.state.gov/genniv/
5. Below checklist of documents to gather for the interview – one copy per family is sufficient.
6. 2 color photographs (Photograph Requirements)
7. Photocopy of the biographic data page of the applicant’s passport

However, someone on my forum also said I need 2 more forms:
"DS-2001 and DS-157"
I'm looking around the Montreal website and can't find them anywhere! No mention of them in the packet 3 section either. Are these needed? If so, where can I find them?


Obviously, not going through Canada, but I would recommend reviewing recent Embassy reviews to see what was needed. It's possible the Embassy site hasn't been updated if they're requesting additional documentation. The DS-2001 is just a readiness document. You can find these forms by Googling them and/or looking on the Dept. of State website.

Our other questions are, the DS-230 on their website says in the corner that it expires June 30 2012. The form hasn't been updated. Do we wait until they update, or use the form anyways? If we wait for update, how long does it take?

Lastly, we got our NOA-2 on May 22nd. The NVC didn't receive our case until June 29th. The expiration date on the NOA-2 is September 22nd. If we have our interview AFTER Sept. 22nd, is the NOA2 letter still valid? If Montreal is as slow as people say, and they take forever to receive our packet3 and we can't book an interview until after Sept. 22nd, what do we do? PLEASE tell me we don't have to go through another 5 months wait for a new NOA2.

ALSO, I myself fill out everything for packet 3 correct? My fiance is in America, I'm from Canada. Packet 3 is all for me to fill out?


The embassy/consulate will auto-renew the petition. You will not have to go through the process again. And yes, Packet 3 is for the beneficiary to complete.

Now, calm down and take a few breaths. :)

Your order is not correct. You must have met first before he can file the I-129F petition. Part of the petition is sending in proof that you've met in person within the past two years along with legally being free to marry. So, if you meet in May 2013, that would be the earliest he could submit the petition. Any earlier and you'll receive a request for further evidence (RFE) asking for proof of a prior meeting, which you wouldn't have and thus, the petition would be denied.

At this point, I really think you should read up more on the different visa options. You won't be able to do anything until he's free to marry and since he's incarcerated, that would be a tad difficult.

Thank you so much for your response. My partner Michael, has not been charged with anything like murder, rape, smuggling immigrants or anything scary! But he was charged with robbery, felony eluding (assault) and was wanted about a harrassment case but it was only for questioning. His ex is a complete psycho and has been messeging me on facebook with threats so I believe him when he says she was a bit different ha. I understand if I enter the country and marry through a tourist visa and marry, i have to return and apply for a spouse visa. Would this be easier due to his previous convictions or would i be better off going down the k1 route? (in your opinion) as all this is really new to me too. I should also note, i havent met him in person yet and we were going to do that in may 2013, he gets out in april. i could marry him on a tourist visa in may... but, if i were to file a fiance visa now, i'd have to make sure i get over there asap to meet him to confirm we've met in the past 2 years, its confusing!

We are filing for AOS now and we some how missplaced our notice of approval for I-29f. I have literally ripped my house apart looking. What should I do?

Also in addition, with the Medical piece of this adjustment, she has had her shots, unfortunately she said she was never given a copy and the medical center in Santo domingo just sent the info on to the appropriate person. Don't I need these records for this adjustment? What do I do. Any help is greatly appreciated.

Sorry, I'm not a hand-holder. Did you read the link I posted upthread and my suggestion to search for the county where you will be married? Basically, once the ceremony is done, the couple, witness, and officiant have to sign a certificate. The officiant then takes the certificate to the county clerk to file the document stating "Yep, these two are married and everything is in order." Once that is filed, you can request a copy, which will be needed once you begin the adjustment of status process.

For now, focus on getting married considering you have less than two weeks to do so and then take time to read -- thoroughly -- the adjustment of status guide.

No, the county clerk. Your officiant needs to file the signed document with the county and then you can receive a copy of the certificate.

Hey due to my Fiancees work schedule and some other minor complications with plans etc, we have left things to last minute, my I-94 expires July 24th. Tomorrow we will get our license and just do a civil thing before the 24th. But my question is does the certificate and stuff have to be filed and in their office before the 24th or do we just have to married before the 24th? Can anyone please verify?

I'd aim for getting the certificate back to the clerk's office before July 24 to make sure there's absolutely no doubt that the marriage happened within the 90-day window.

Just search for your county's clerk office. It's likely similar to SF's, but still make sure there are no additional requirements. :thumbs:

Check with the county you're planning to be married in, but it's typically one witness who needs to be in attendance.

"Your case is indeed outside normal processing times. As a result, we have approved the expeditious handling of your petition. The petition will be reviewed and you should be receiving notification from this office very shortly."

Does the expeditious end here or it goes till the interview stage ? When should I start bothering NVC?


I'd recommend waiting at least 15 business days before contacting NVC. Things are slow there. A lot of us approved in mid-June are still waiting, alas.

Yes, a very bad thing. Until the beneficiary has the employment authorization document or green card, they cannot work.

You would likely have to inquire with the owner of the loan on if it can be transferred and/or if there are any penalties incurred.

Do know that the petitioner (the US Citizen) has to show proof of ongoing income and/or enough assets to provide for the beneficiary during this process. If I recall correctly, your fiancé is currently incarcerated until next year and you have two children, correct? He will likely need to secure a co-sponsor if he doesn't have enough assets/income to support you and your family. Also, you won't be able to work right away with the K-1, so if you are planning to take out quite a substantial loan, be sure you have a plan on how to pay it off.

It's very unlikely that his insurance would cover your medical care in a different country. Be sure he reads through the policy information thoroughly to see what is/isn't covered and if there are any restrictions.

You're likely looking at a 5-6 month wait between the acceptance of your petition package and when you will next receive notification from USCIS. That notification will either be an approval, a request for further evidence (RFE), or a denial. Fill in your VJ timeline and you will get an estimate. Good luck!

My girlfriend (Swiss) and I (American), intend to file for a K1 visa in the next few months, but we're wondering when we should do so. She's going to be coming on vwp starting in late August, and we're worried that she won't be able to enter the country if we start the process now. Is it possible to wait until she enters the country, and then file for the K1 when she arrives? Does it even make sense to worry about this?

If it's possible, it would be easier to start the petition process while she's there with you. Otherwise, she would have to mail you the G-325a, letter of intent and U.S. passport-sized photos for the petition package.

Actually, I would give it longer than 10 business days to reach the NVC. Our petition was approved on June 15 from CSC and it still isn't in the NVC system as of this morning when I called. I was told to send a scan via email so they can research its status since it's past 15 business days, but I will plan on calling the NVC again at the end of the week to follow up again.

For London, it's not recommended to schedule the medical exam until the approved petition has arrived at the embassy. They will likely ask for the LND#, which would only happen once the approved petition is forwarded to the NVC. The police certificate, getting any vaccines from the GP to avoid having to get them done at Knightsbridge or in the U.S. can be done in advance.

You should plan on withdrawing your K-1 petition and plan on filing for a spousal visa if your wedding date isn't able to be moved. It takes, on average, about 2-3 months from receipt of the NOA2 to interview for the K-1 for UK beneficiaries. Considering it's taking a while for cases to get to and through NVC, that would add on additional time. There really aren't any steps you can do in advance until you have the petition approved and it's on the way to London.

Yes, your fiancé should receive the NOA1 in the mail within 30 days. If he sent a check to pay the filing fee, he can watch for when it was cashed. Did he use a delivery confirmation to track receipt of the package?

Yes, the NOA1 is the acknowledgement and assigning of the USCIS case number. The G-1145 is for the electronic notification -- email and SMS. If he received the email, the case number is listed within and notes that a formal letter is forthcoming. However, there are instances of people filling out that form and never receiving a text or email.

The I-129F package for K1 was sent to the Dallas Lock box Saturday 7 July.
I see on some of your timelines: "CSC has received the package".
Will I be notified when they have received the package or is this the same as receiving NOA 1?

And another question I am confused by California Service centre, Nebraska Service Centre, etc. I sent it to Dallas, that is correct, right? Do they sent it on to another service centre? I am confused.


Assuming you are the petitioner, yes, you will receive a letter in the mail noting receipt of your I-129F petition. This will include your USCIS case number.

The Dallas lockbox is used to sort the petitions and process payments. From there, it will be forwarded to either the Vermont Service Center (EAC) or the California Service Center (WAC).

Was your I-129F petition approved? If so, when?

There were petitions from the California Service Center that were incorrectly sent to the National Records Center instead of the National Visa Center back in May. That error was discovered and apparently, the petitions are being re-confirmed before being sent to the NVC.

The I-129F/K-1 process is not the same as the spousal process. There are no payments made at the NVC stage.

It normally takes 2-3 months from NOA2 to Interview date. It is country specific. It will take any time till 2 weeks for the file to reach NVC after the I-130 approval. Then about 1-2 weeks to get the case number assigned. Then couple of weeks to get the case complete at NVC (provided you make payments on time and have all documents ready). Then the interview date will be assigned based on your country's consulate traffic.

Reaching USA before 25th August is not realistic until any miracle happens :)

Sorry to hear about your situation - especially since you did try to do the research beforehand.
As someone earlier mentioned: Get your fiance to get all the forms reads (it takes a surprising amount of time - at least it did for me - to figure out all the random things they are asking, like "list all countries you visited the last 5 (10?) years, every trip to the US, which MM/DD/YYYY did he start school etc), get a copy of the police certificate and look at the immunization form and if necessary get any shots outstanding now while you are still waiting for NOA2.
Once you have NOA2, chase up your case number with the NVC, with that you can book your medical appointment and make friends with the people at DOS who can tell you when your case is logged in London, when your interview is scheduled etc - last year some people succeeded to move their interview date forward by a few weeks because of things like booked flights. I tried to stay on the ball, got lucky with my NOA2, too admittedly, but filed in March and visa in hand by 9th Sept. HOWEVER: Someone on another post mentioned that there was a memo about London cutting back on cases processed over the summer due to higher security needs because of the olympics. Maybe it would be worthwhile to try and call the extortion line (i.e. London US embassy) and check if that also affects K1 visas.

Hello all

So half of the wedding has agreed to move. If i can convince the other half, the question is, when to move it to? We seem to be so close, so I thought end of october sounded nice. we do like halloween.

it's a bit too much to ask them to hold my deposit until an undetermined time, when we could plan it with 100% assurance. So I am guessing on when would be the next best date.


Any answer to the question "when to move it to?" would be an estimate/guess at best.

I think the most frustrating part of all is that all the government officials i speak to have differing opinions.
Incase you have a similar situation this is what i found:

It is not suggested to visit (ie come for a wedding/party and leave), but it is not technically wrong.

Yes the congressional office can be of service to you, by basically calling the NVC on your behalf. As well as looking up your case in their government computers. Their name carries more weight than yours.

If you get a request for more information, its essentially game over for all your plans, as all timelines are now void.


That may be true for some, but I wouldn't say that would happen to everyone who reaches out to their congressperson. At best, their intervention helps push things forward and you get the interview faster, at worse, you're just added to their mailing list since it's an election year and they want your vote and financial contribution.

Still, the best advice for anyone else going through this journey is to not make confirmed plans until that visa is in their possession. There are only few parts of this journey that are in the hands of the petitioner and beneficiary, for the rest, you're depending on someone else to help you out.

Weddings are not refundable. They point this out, and unfortunately that was the only thing I did understand. When you are within 90 days of the wedding you have completely paid for it. You will not be getting any of that money back, and in our case, it is a considerable sum.

I guess part of me wanted a normal person wedding, because if you live in a city, and you want a wedding, you cannot plan one in the 90 days they give you. You would have to get married twice.

We are discussing options of changing our wedding into a party, and not making it official. But this involves risking that the border protection people won't believe us, and won't let him come to his now downgraded wedding/party.

We are also looking into pushing the application along after is it through USCIS. Has anyone had any luck with this? Does congressional help work?

Not sure what a "normal person" wedding is, but being in a relationship with someone from another country makes people on VJ anything but normal. Unfortunately, once you mail off the petition, the process is in someone else's hands. I doubt a member of Congress could assist you once it goes to the embassy level, though.

Hello Visa Journey:

I made a huge mistake and scheduled our wedding (read: paid for it), before we were given our NOA2. Filled I-129F in January 18 , NOA1 Feb 8th. Called USCIS to ask about the filing time, because i didn't understand, they told me that after the 5 months he would have a K1 visa in his hand. I have since learned this was not true, but scheduled an entire wedding for mid August.

I have tried to push USCIS to process it faster, and am at my wits end. I now have a wedding, and guests, and everything all set up, but have no idea if the papers will make it in time for me to have a groom.

Do you have any suggestions? I realize a huge mistake has been made, I am now wondering how to fix it.



Can you call the vendors, wedding site, etc., and ask if they can move your reservations to another date -- ideally, one far in the future -- rather than canceling altogether? Otherwise, there's not much you can do.

This is why "Make no plans until a visa is in your hand" is a common refrain on VJ's K-1 forum. The USCIS does not care about our wedding plans and the process is what it is.

If you got married 2 days before your visa is expired, you will have to at least 3 days until your marriage is recorded and you can order a certified marriage certificate to be attached to your i485 application, and the application needs to be accepted by USCIS before your visa expired.

As for SSN, better apply now when your visa is still valid, and later after you got married you can report for name change. later after you received your greencard, you need to report your new status too. good luck !


This is incorrect. For one, the K-1 visa expires once the beneficiary enters the U.S. The adjustment of status can be done at any time, but it doesn't have to be within the 90 days. The only requirement is that the petitioner and beneficiary be married before the date noted on the K-1 visa, which is 90 days. OP, be absolutely sure of that date!

Hey Everyone,

Currently awaiting my NOA2, should be any day now, and putting together plans for the wedding. What we are doing is getting married in the USA, and the following week have a party in the UK for family who couldnt make it to the wedding. I havent really thought about my change in status or the next stage after this tbh, but my question is this - will there be a problem travelling back to the UK after we've been married? Im aware we'll need to prove that we've been married, but I don't want to be denied back to the USA?

Any advice would be fantastic, thanks


You will not be able to re-enter the U.S. if you leave before receiving Advanced Parole or your green card. The AP can take about three months or so to receive. If you leave without either document, your then-spouse would need to file the spousal petition for you.
