K-1 Fiance(e) Visa Process & ProceduresDS-230

ok, further through the form and i have more questions haha

It is asking for addresses i have lived for at least 6 months, should i include term time addresses whilst i was at university, also it asks if i received a diplomma or degree, should i put "yes" or do i put the level of degree i received ?

thankyou :)

Yes, any places you lived for more than six months. We attached a sheet to list everything and included the university stays. And yes for the degree/diploma info to include as well.

K-1 Fiance(e) Visa Process & ProceduresDS-230
DS-230 is to be completed by the beneficiary, so it would be their parents. You only need to complete Part I of that form.

I'm currently completing the required forms so i can be ready for when the time comes, there is section on the DS-230 which asks for spousal information it then asks for fathers family name and mothers family name, is this the names of the non existant spouses parents of will it be my parents ?

Also it's looking rather worrying about the amount of N/A i have on the forms, i guess these questions are there to cover a lot of information so it would be expected that there is a lot that are not applicable ?

once again, sorry for the probably dumb questions.

thanks in advance

K-1 Fiance(e) Visa Process & ProceduresI-129F sent a few days ago...

That's assuming you are applying for a k-3.
So those are the forms you'll need to file once you get your k-3, and enter the US.

The K-3 is an obsolete visa. I know you mean well, but please, if you don't know about the K-1 process, it's okay to sit it out.

K-1 Fiance(e) Visa Process & ProceduresI-129F sent a few days ago...

You can begin to prepare your Adjustment of Status application... I-485.
You will also need to do the Affadavit of Support form... I-864.
And if you want to get your work papers ready, you'll need your Employment Authorization form... I-765.

Best of luck!

It's entirely too early to work on the Adjustment of Status, EAD, and AP for a K-1. That won't happen until after the petition is approved, the beneficiary is interviewed and has the visa, enters the U.S., and is married to the petitioner.

OP, get acquainted with people who have been through the consulate where your fiancé will be interviewed. Read through the VJ guides to see what's next in the process. And most importantly, realize that you'll need some patience to get through the process, so there will be quite a bit of time where nothing will happen. Good luck!

Check with the school district/system where you will be living for specific details on what, if any, documentation is required to get your children enrolled. Within each state, school systems can handle things differently.

K-1 Fiance(e) Visa Process & ProceduresHow to prepare photos to be used as evidence for I-129F
Sure can. I put together a PowerPoint deck of photos with the information on location and date on the slide. It was then printed out in color. Others get fancier, others just send a plastic bag with a few photos. Remember, though, that photos are secondary evidence, so you don't have to make this into a huge project.

K-1 Fiance(e) Visa Process & ProceduresConfused. Which Service Center???????
I-129F petitions are currently only processed at either the Vermont Service Center (EAC# on NOA1) or the California Service Center (WAC# on NOA1). All I-129F petition packages are first sent to the Dallas Lockbox for processing the payments and then routed to either VSC or CSC.

K-1 Fiance(e) Visa Process & ProceduresReady to send I-129f, opinions on evidence please.
For the petition, you need to provide evidence of meeting (at least once) within the two years prior to filing. As long as you send solid evidence to support that, it doesn't have to be every single item. If you have multiple boarding passes, make copies and send them on.

London typically doesn't make a big fuss on proof of ongoing relationship, so front-loading with a ton of documentation isn't really needed as it is for petitions for countries considered "high-fraud." You likely will not have to provide additional evidence at the interview stage. (Of course, this is subject to change, but you can read through the London embassy reviews to get an idea of what occurs.)

Thank you for all your kind help and information, it's massively appreciated by us both!

Two short questions to finish up:

1. Will sending the superfluous proof hinder us at all?

2. Regarding boarding passes/flight receipts, would you say that we need every one? Or is a couple sufficient for this stage of the process at least? I know for the interview we can be thorough and include everything, but I wonder if at this point they'll just be happy with the proof we already have.

Thanks!

The cost of filing the I-129F petition is $340. This is found on page 4 of the I-129F instructions: http://www.uscis.gov...i-129finstr.pdf

Once the petition is approved and the beneficiary applies for the K-1 visa, the cost is currently $240.

K-1 Fiance(e) Visa Process & ProceduresWhat do I do after NOA2?

Hey all.
I'm concerned about what I have to get together and all that jazz. I know I need the affidavit of support but as far as I know, that's it. I know that my fiance will get Packet 3 after it goes to London, but when do I get my NVC number? Should I have gotten it with my NOA2?

Once your petition has been transferred from the USCIS to the NVC, the NVC will give you a consular number (LND#). Wait at least 10 business days, and then you can call the NVC to check: 603-334-0700. They will also send you a letter via USPS with the information. Another number to know is the Dept. of State's visa line, (202) 663-1225, press 1, then 0, so you can follow up once your fiancé submits the DS forms and to learn the interview date.

Well, you can't really fly out without the visa, so if you don't have it by the end of the week (e.g. Friday), it's probably best to change your flight date. K-1 Fiance(e) Visa Process & ProceduresG-1145 E-Notification

Hello, i just certified mailed my I-129F Visa off to Dallas and it arrived on Thursday morning, however do you know how long i should wait for the G-1145 E-Notification of application/Petition Acceptance message? How long does it take for them to deposit my check? Just getting anxious about the process.

It can vary and not everyone who sends in the G-1145 notification receives the notifications, alas. When I submitted the I-129F petition, I received a text and email from USCIS about four days after sending it out. The check deposit can vary, but watch your bank account as that will let you know.

In the meantime, continue reading about this process, what's next, and learn more about any items that may be specific to the country where your fiancée will be interviewed. Also, lots of patience is required!

K-1 Fiance(e) Visa Process & Proceduresproof of finance from sponsor
The financial component is based on the poverty guidelines. You can view the 2012 guidelines here: http://www.uscis.gov...form/i-864p.pdf

If it's just the two of you, then your fiancée would need to earn a minimum of $18,912 annually. The co-sponsor has to be a US citizen, so your grandfather will not be able to serve as a co-sponsor.

If you go the self-sponsor route, which is an option for London, then you would need to provide documentation on your savings. Is that 10-14 thousand dollars or pounds? If it's dollars, that will not be enough. You should have at least the $18,912 to match the guidelines. Does your fiancée have a family member who could serve as your sponsor?

You can read more about the support requirements on the embassy site: http://london.usemba...faffidavit.html

hi there me and my fiance are just waiting on are NOA2 and hopefuly shouldnt be much longer, but i have been a little worried about the proof of finance. she goes to school and works full time and is border line on the recomendation of finance about 14,000 a year but dosent really have any substantial savings. were as i should have saved about 10-14 thousand in saving before my interview in london.

i was wondering about a co-signer, her mum is on high disability but im not sure if we could use her as a sponsor because of not working?, my grandad is quiet well off and could more then easily sponsor us and is willing i was just wandering if he could? as hes not american and british.

the whole assets and finance support is getting really confusing, so if anyone could help shine a bit of light on it, on whats the best things to do and prepair. is greatly appretiated

thanks ryan :) x

K-1 Fiance(e) Visa Process & ProceduresG-325A (Biographic information) form Question

Hi everyone,

I have a quick question of the G-325A form. As I understand, I need to submit one for me and one for my fiancee, but how would I get it signed by the person living outside the US? Do I need to have her send a signed hard copy to me, or perhaps could it be faxed/scanned and printed?

Thanks for your time

The form needs to be signed in ink and not submitted as a copy. If the person isn't with you, then they will have to mail it to you via local post/FedEx/UPS, etc. Edit: That also applies for the letter of intent and passport pic that the beneficiary will need to supply for the 1-129F petition package.

K-1 Fiance(e) Visa Process & ProceduresQuestion about error in K-1 packet
Wait until you receive an RFE, if you do receive one. There is no 100% guarantee that the document would be matched up with your petition. There was a note in the VSC newsletter a few months back on trying to reduce attempts to match up additional documentation sent if it doesn't have the appropriate cover sheet in place. It slows them down if they have to stop what they're doing to go dig through something else because the petitioner forgot/neglected to include something in their package. http://www.aila.org/...spx?docid=40032

K-1 Fiance(e) Visa Process & ProceduresBasic Initial Form Questions

Our story, like many of yours, started online. Rick lives in London and I’m a small town girl from Tennessee. After months of falling in love with one another through emails, letters, Skype chats, and phone conversations- we finally got the chance to meet in person. The ten days we had together solidified our foundation and we are now engaged to be married. Starting this process is a bit overwhelming for anyone, and we have some questions that we would like to ask for anyone willing to help two people desperately in love.
First Question: How much proof is enough to show that this isn’t a sham? What type of things are they looking for to show that we have been together???

I'm making the assumption that you have not filed the I-129F petition for your fiancé yet. With that...there are two types of proof -- primary and secondary. Boarding passes, receipts, and passport stamps help. Photos and Skype/call logs are secondary. That said, do provide a mix of both keeping in mind the goal is to show you've met at least once within the two years prior to filing the petition. London is one of the easier embassies (read: "low-fraud"), so you will likely not have to compile thousands of call logs, etc. to show proof of an ongoing relationship like some of the folks who've responded as part of the initial petition package, which is called front-loading.

Second Question: How long do the interviews last???
I’m sure there will be more questions as we get further into this process, but thank you for anyone taking the time to respond.
~Jordan<3

Just to clarify, the interview for the K-1 visa is for the beneficiary (your fiancé), you will not be interviewed. Also, you're many months away from an interview since the petition process takes several months. You can get an idea of the interview experience by reading reviews from those who have gone through London: http://www.visajourn...&cty=&dfilter=5

For most, the embassy visit takes about two hours, but again, read through the K-1 interview reviews at the link above to get an idea of other's experiences.

But that's getting far too ahead. First, start by reading the VJ guide on the I-129F petition to get your package together and to get an idea of the entire process. Getting the K-1 visa is just the first step in a long process. Good luck!

Having the alcohol-related offenses won't automatically deny the petition. But you will have to submit all court records related to each offense as well as making sure your fiancée knows all of the details as it's very likely it will come up during the interview.

Also, the K-3 visa is essentially obsolete. Your options would be to file the I-129F petition for a fiancée or, if you decide to marry first, the I-130 for a spouse. You can read more about the options in the VJ Guides. http://www.visajourn...content/compare

K-1 Fiance(e) Visa Process & ProceduresCome over on Visa Waiver and then start K-1
To clarify, the K-1 visa process starts with you, the US Citizen, filing a petition (I-129F). The K-1 visa application would happen in your fiancée's home country. (Similarly, if you opt for the spousal visa, you would initiate the process by filing the I-130 petition.)

As far as entering the U.S. on VWP after the petition is filed, many people do that. Be sure to check the pinned thread up top called, "Yes, you can visit!" to get insight on others who have traveled to the U.S. Is there a risk of her not being able to enter? Yes, which is why it's important she travel with proof that she will be returning home after the allotted stay in the U.S.

Good luck!

I meant the VWP, not the Tourist Visa.

Definitely, we don't want to do anything risky...especially fraud. She would be going home after the 3 months to wait out the additional (hopefully) 3 months that it may take to finish the paperwork. No AOS's until she goes home and comes back on a K-1 and we get married.

We don't plan on getting married when she comes over, so that would indeed be a spontaneous thing if it did happen. If we did she would go home and wait for the paperwork to be completed.

We visited in the last 2 years. In fact she was here on the VWP from July-Sept.

What I worry about, if she files for the K-1 before she comes here, is that her chances of being denied entry on a VWP would be increased due to the fact that she applied for the K-1. I've read about that before. Any comments on this?

It is ok for her to file for a K-1 while she is in the US on a VWP though right?

Being told now the never recived any of the medical stuff or my ds 2001 Ds 2001 form. Now on the 16th of Ocober i was told that they had recived this info. I put my Appication way back in jan 24th. So either theres a Problem or they have decided to decline me anyway even befour the interview.I stress this is causing a lot of upset it been over a year since i have seen her and its taking so long.

I would recommend calling the Dept. of State, hopefully they will reopen on Wednesday, and checking on the case that way. Or, you can call the extortion line again and request a code so you can send an email to the embassy to get more specific information on your case. When you call the UK number, it's not actually at the embassy, which is likely why you're being told different things each time and why they're speculating on the interview date. If you go the email route, be specific and include dates of when you sent in the DS forms (156, 156k, 230), when you had the medical, and when you sent in the DS-2001 readiness letter.

K-1 Fiance(e) Visa Process & Procedurescousin marriage

Since immigration is federal, does it matter what the state he lives in recognizes in terms of marriage? Just question as I am curious. You can move to a state that recognizes same-sex marriage, doesn't mean USCIS will approve the petition.

Anyway, OP - how closely are you two cousins? 1st? or like 6th twice removed?

Good luck

Same-sex marriage is the only instance where a state-recognized marriage won't be recognized by USCIS because legislators singled it out in the Defense of Marriage Act. Every other federal benefit of marriage (including immigration) is granted if the person lives in a state where their marriage is recognized. Cousin marriages are recognized in some states and not others, but my understanding is that you can get married in a state recognizing cousin marriages and that every other state has to honor that. So, you don't necessarily have to move, but just get married in state where the marriage is legal. Differences between federal and state definitions of marriage doesn't apply here since it's not a same-sex couple.

K-1 Fiance(e) Visa Process & ProceduresK-1/3 visa question

absolutely my friend - new at this and need some information! :)
ive read some things about the K1 visa. Basically, eventually, I am hoping to migrate to US. The business route I had is not possible so the only option left is to see if my girlfriend would want to marry. If so.... then great and I would need all the info/help I need!

but in general, what is the interview process all about? What happens?

As I am a little confused, you say K1 is a fiance visa. Does this mean that you must get married within 90 days and then apply for citizenship?

the CR1 you refer to - what is this and the process?

You should start by reading the comparison chart to learn more about the pros/cons of choosing the K-1 or IR-1/CR-1: http://www.visajourn...content/compare

Long story, short: If you go the K-1 route, your fiancée would need to first file a petition (I-129F) on your behalf. Once it's approved and sent to the US Embassy in London, you (the beneficiary) would need to file additional paperwork, attend a medical exam, and have an interview at the Embassy. (For more details on the interview, visit the Embassy Reviews section for the UK.) Once the K-1 is issued you will have about 6 months to enter the US. Once you enter, the K-1 visa is voided as it's a one-time entry visa. From there, you are required to get married in the US within 90 days. You will not be able to leave and re-enter the US until you receive either Advanced Parole or a green card, which can take several months.

So, if your goal is to save money before moving to the US, you may want to opt for the spousal visa where you'll get married and then your wife would file the I-130 petition.

But again, start with the comparison chart to see which option is best for your situation.

6. As for wedding plans, ours will be a simple picnic wedding, hopefully in September. How did you all handle reservations and preparations not knowing when and if your partner will get a visa.

I'm sure others will chime in on your other questions, but I'll chime in on #6 since I'm currently dealing with that. :) I've been upfront with the vendors and venues I've visited. I told them a tentative date, but also added the caveat that it could change. I've been visiting various venues and gathering information and then sending photos/videos to my fiancé so he can see.

So far, everyone has been very understanding, either because they've dealt with similar couples in the past, or I've rambled enough describing what's going on. Definitely be sure to know their reservation policy and if you can, wait as long as you can before signing anything!

If your goal isn't to get married until next year, your fiancé should move forward with filing the petition now. If he files this month, it likely wouldn't be adjudicated until January 2013 at the earliest. Unless you're in a super-specialized career where an employer can justify sponsoring you and want to spend the $$ to bring you over, you'll have better success with filing the fiancé petition.

Ok. First, be sure to read the K-1 guide: http://www.visajourn...content/k1guide

There are folks on VJ who are petitioning for someone while living abroad. However, she will likely need to have a US Citizen or US Permanent Resident co-sponsor if she doesn't meet the financial guidelines since she's living abroad.

Many of the forms you fiancée will need to complete are online on the embassy's site. Double-check there. Also, once you have a case number from the NVC, call the Embassy regarding the change in address/contact information. The NVC doesn't do much with K-1s, so calling them with the change wouldn't really help.

Also, do note that it is taking the NVC longer than 15 business days to enter petitions. I'm still waiting. During my last call, they asked me to scan a copy of the NOA2 and send on so they can research its status.
