I'm not sure that they accept co-sponsers in a fiance visa. Because I was once reading someone's interview experience & it said that the lady interviewing her told her I can't give you a visa because we don't accept co-sponsers on K1 visas. I think I read this experience on Visa Journey. So please make sure of it by calling NVC. They'll give you an accurate answer. Best of luck :)


Acceptance of co-sponsors for the K-1 varies by embassy/consulate. London does accept co-sponsors.

OP, is your mother still in touch with the people she co-sponsored? That would be one way to find out.

Are you referring to the fiancé(e) petition process or the spousal petition process? As Tahoma stated, the main requirement for the I-229F to be approved by USCIS is showing that you've met within two years and supply the various documentation requested. Any front-loaded documentation that shows proof of an ongoing relationship is more for the embassy/consulate side, which is not part of the same department or agency as USCIS.

Be sure to read the I-134 instructions. It's not speculation. It will tell you what supporting documents are needed. At the interview stage, only the 125% support requirement is what consular officers are seeking in addition to the paystubs, letter of employment, etc. that most supply.

On the content of the letter to write on why you do not file a tax return, it's probably best to use the advanced search feature on this site in addition to reviewing the IRS.gov site to cite specifics on why you are exempt from filing.

So it is merely speculation that I-864 supporting documents are required with the I-134 for interview, I see. I will send them along, but I hope for the sake of others they update the I-134 to reflect this. Think of all the people who do not use these type of forums during this process.

The beneficiary will interview in Singapore, and is a citizen of Singapore.

The first person to reply to my thread stated that I need a statement indicating why I do not legally file taxes, what type of document is required for this? Do I simply type one up and sign it? Once again, none of this is covered in the I-134 instructions.

The I-134 instructions aren't "null and void," they just aren't the legally binding document. The I-864 document is, however, legally binding, which is why most embassies/consulates have an eye towards those requirements when viewing the I-134 that's submitted at interview. The thinking is if you aren't at 125% when submitting the I-134, what is going to change when you adjust status?

Also, in which country will the beneficiary interview? Some countries don't accept co-sponsors for K-1s or give extra scrutiny. So be sure to read up on the country to learn the specifics so you're prepared.

Since it's still possible that you could get an interview in short notice -- there have been some going through London who received notice of their interview in a week's time -- it's probably best that you not travel to the US right now. Also, definitely do not involve the wedding planner. Why arouse suspicion when it's not needed?

Push back the wedding plans as much as possible. Even if you're successful in getting an interview in the next week, you will still have to wait for the visa to arrive, which can take up to 10 business days. (Yes, most get it in less time, but there have been recent cases where it arrived exactly 10 business days after the interview.)

For others reading -- this is why you do not make concrete wedding arrangements until the visa is in your hands. :bonk:

First, you must get married in the U.S. That's the purpose of the K-1 visa. The K-1 visa is a one-time entry, so if you enter the U.S. with the visa in your passport, that will void the visa. If you leave the U.S. before starting the adjustment of status process, which includes filing for the employment authorization and advanced parole documents, you will have to start all over with the spousal petition process.

Please read up on the process before you proceed with your current plan.

Heres my questions:

1. Neither of us have used checks before, can someone tell us how to make it traceable or whatever it is recommended?


If you're writing a check where the amount will be drawn from the bank account, you will be able to trace it by reviewing your bank account online and/or contacting the bank with the check number used. Most banks receive a scan of cashed checked as well, so you'll have access to that.

2. When sending the pictures and other evidence, do they have to be "real" pictures, or can we print them on regular paper?
- With the travel tickets also, can they be photocopies? i am worried that we wont get the evidence back, and so would prefer not to use the original airline tickets and such unless necessary.


I put together a PowerPoint presentation with about 10-12 photos, labeled each slide with the date(s) and location(s) and then printed it out in color. Never send originals of things such as boarding passes.

3. Recommended amount of pictures/skype logs/tickets? A few examples of each, or everything we have (in regards to airline tickets) Should i send a copy of my passport with US entry stamps too?


Again, I only included a handful of images along with copiesof our boarding passes. I did not include Skype logs.

4. The passport pictures with G-325a.... I've read to send in 2 of each person? is this correct, and should they both be US passport size, or just the petitioners?



Both the petitioner and beneficiary need to send two U.S. passport-sized photos with the petition package.

5. Are addresses needed or vital on the letters of intent and I-129f cover letter?


I addressed it to the Dallas Lockbox, but it really doesn't matter if you include a "to" address on the letters of intent or the cover letter.

6. Finally, just to check (im sure im correct), but the address we file the whole package to is:

Correct. Be sure to re-read through the I-129F instructions to ensure you haven't missed anything. Also, go through the I-129F petition to ensure there are no blank spaces. If something doesn't apply to you, it should be answered as "None," or "N/A."

According to your timeline: Based on timeline data, your I129f may be adjudicated between December 20, 2012 and December 26, 2012*.

So that's when you can anticipate your case will be adjudicated, although given it's right around the holiday season, it may be earlier or very possibly later. Calling every month seems like a practice in futility since you're not going to get any more information from the phone drones on the status of your case.

On the affidavit of support, the petitioner has to file that, yes. If you don't earn enough to support your household, you should look into if the embassy/consulate where your fiancé will interview accepts co-sponsors.

Instead of calling the USCIS, be sure to spend time looking ahead at the next steps. Getting the petition approved is just the first of many hurdles you and your partner will be jumping over, so be prepared for what's next by reading the guides, reading the embassy/consulate reviews, the POE reviews, etc.

No, I mean the Dept. of State (DOS). As a K-1, the NVC is done with you at this point once it ships your case to the embassy/consulate. The DOS line will be able to provide you with information on where you case stands in London. You may need to revisit the pinned thread in the UK forum for a refresher. :innocent:

Yes, that link has been my bible for a few weeks, thank you! I'm right with you. We had the forms ready to turn in today, but it was delayed as too late for post office... so yes absolutely it will be sent Special Delivery Monday to match up with the medical. That's why we weren't waiting for the Packet 3. What I wanted to know was if there is a delay (once the readiness forms are turned in) and the time your packet is logged in. Does that make sense? All we needed to clarify was the rumor that it takes a few weeks (once you've mailed your readiness forms) to get an interview date. Something about the Olympics causing a back log?


There was supposedly backlog around the time of the Olympics, however, there have been people recently reporting receiving interview appointments with a week's notice. No one on VJ will be able to confirm how long it will take for the embassy to schedule an interview for your case. The best solution for you is to get the DS forms mailed in right away and then begin contacting DOS to confirm receipt/interview eligibility/interview date.

Thank you for your note. The embassy has electronically acknowledged that it has received our packet from NVC. They haven't issued the packet 3 yet. We are turning in the DS-2001 on Monday. We can add that we'll take any interview slot, that's a great idea. We just thought if there was a delay, we'd just wait patiently here together.


So, to clarify, your case is just getting to London, correct? You don't have to wait for the embassy to send the Packet 3 letter to the beneficiary. Have you read through the K-1: NOA2 to Interview thread in the UK forum?

All the information you need is there, including the link to where the forms can be downloaded from the embassy site. If you haven't sent in any of the DS forms, you won't get an interview appointment. The medical exam results + the DS forms + the DS-2001 readiness letter are the components that need to be at the embassy before you're eligible for an interview and a date can be assigned.

If you already had your medical exam at Knightsbridge, I'm assuming you just received the LND number and did that before sending all of the DS forms? If that's what happened, you should definitely send the DS forms to London tout de suite so everything can be matched up. It's usually best to send the DS forms right around the same time you have the exam, since it takes 4-5 business days for the exam results to be delivered to the embassy.

From what I've read on here, there seems to be a delay in the time between when London receives packet 3 and them issuing the interview date, usually with the interview date a bit away. Does anyone know if this is the case? If so, we're thinking my fiance will fly here and wait it out (may as well be together!). Thank you in advance for any help!


Did you also send in the DS-2001? If so, did you include a note stating that you would be available to take any appointment slot on short notice? There was a backlog, but considering some going through London have received interviews with a week's notice, it possible that an interview date will be assigned at any time. Just keep calling the DOS line to inquire.

Also, please update your timeline. You don't have anything that notes that Packet 3 was received by the beneficiary and/or when it was logged by the embassy.

When you receive the NOA1 (I-797C Notice of Action) receipt letter, it will include a number that begins with either EAC (Vermont Service Center) or WAC (California Service Center). You can view samples of the NOA docs in the VJ Gallery.

Yes, the specific language of Peace Corps policy is that if you want to marry a national of another country during your service, you must talk with Peace Corps for approval. I don't plan to marry her until after my service. I am trying to fill out the forms now so she can come back with me to the United States. I have also heard that the K1 would make it easier for my fiance to get the CR1 too.


Sorry, but that is not correct. Either you're going for the K-1 or the CR-1. The CR-1 is for married couples, the K-1 is for unmarried couples. It's hard to say because depending on which service center receives it, the adjudication time could vary. The K-1 isn't really for those who want a specific wedding date as you're not really in control of the process. You could submit the petition this month and be approved in December or March...it depends. In my case, we filed in late January 2012 and my fiancé's interview is tomorrow morning, so about 9 months from receipt of the I-129F petition package. Once the visa is issued, you usually have 6 months to enter the U.S. (this is dependent on the medical exam) and then 90 days after entering the U.S. to marry.

We have not yet started. We are still in the process of gathering things and wanted to make sure things would be ok when it gets to his end. If my mom is a co-sponsor, would I still have to send the I-134 for myself and the additional one for my mom?


If you haven't started the process, then you have a long time before you need to be concerned about the I-134. You won't need that until after the petition is approved and the case is in London for the visa interview. The I-134 is not needed for the initial I-129F petition package.

Once your petition is approved and you're sending items to your fiancé in advance of their interview, if the situation is still that you aren't work or don't earn enough to serve as the sponsor, then your mother would complete the I-134 form and supply the supporting documents.

Does anyone know if it is ok for me to just send a w2 to my fiance for his visa interview (along with the I 134 of course) I didn't file taxes this year because I didn't make enough. My dad is cosigning for us so of course we are going to send his tax return transcripts and a few pay stubs. I also can get a letter from the couple I work for (I am a nanny) stating that I work for them for how much I work a week. Is there anything else I'm missing?

For London, you only need the I-134 for the sponsor who makes over the 125%. So, you would only need to provide the I-134 and supporting documents from your father to your fiancé.

It's not a "silly condition." It's one of the primary requirements for having a petition approved and requires specific proof. What will likely happen is you'll receive an RFE asking for proof of meeting in-person within the two years prior to filing the petition. Because you're not able to do that, the petition will be denied.

Did you collect proof while visiting? You'll need it should you choose to refile for the I-129F.

They wouldn't have gotten to the adjustment of status stage if he weren't free to marry considering the divorce decree would have been a requirement in the petition stage.

The ex-wife's actions are irrelevant.

You should be concern that your marriage iis invalid because your husband was not free to marry you.

Your husband has a US marriage certificate and no divorce or annulment paperwork. He then married you. That's bifamy on his part.

The burden is on your husband to prove that his first marriage was invalid. He did nothing. He filed no paperwork to ask the court to invalidate his first marriage. He should have done this before marrying you.

It is not important what his ex-wide did. It is important what your husband did or rather did not do. He never challenged the validity of his first marriage.

Go see a family lawyer.

You only need to complete Part I. Part II is not needed.

Yes, any places you lived for more than six months. We attached a sheet to list everything and included the university stays. And yes for the degree/diploma info to include as well.
