If it's just the two of you, then you will be fine without a co-sponsor if you make at least $18,912. While it is country-specific as to the guideline they use (100% vs. 125%), most are looking for a consistent source of income, so the fact that you have a job and receive a regular paycheck is a good thing. No....I-797 form is used for ALL types of notifications.....it could be the NOA1 also!


It depends on which letter, if any, accompanies the I-797 designation. For example, the I-797C is what most folks on VJ call NOA1 (Notice of Action).

The I-797 on its own means the petition/application been been approved.

Please can someone advise us on the best way around this situation. Our I-129F was approved on 30th July 2012. We contacted the NVC a number times and they said that had not received it. The USCIS is telling us it can take up to 3 months to send it the the NVC. We then emailed a copy of of I797 approval to the NVC, they have now said that our file is in the National records centre and that they are waiting for the USCIS to send it to them. When we call the USCIS they just repeat that it can takes 3 months after approval to send it to the NVC.

Its now been 2 months and we have seen on here that many other cases after ours have been received and processed by the NVC. Any help that anyone can provide would be much appreciated as we really want to be together for Christmas.

Any help or advice would be really appreciated.

For London at least, the requirement is to have a passport valid for travel to the United States and have at least eight months validity beyond the issuance date of the visa. There isn't a stipulation that it be X months/years old, however.

That's just to get the K-1 visa. Then you have the adjustment of status costs, passport-sized photos, travel, shipping, etc.

Honestly, in the time you're posting, you could try rebooking the flight. Yes, you'll pay more money, but again, less anxiety on worrying about missing the connecting flight.

Agree with Celeste...if there's one hour between flights, there's no way he'll make the connection. Most flights start boarding 30 minutes prior to departure and depending on where he's sitting, it may take a while to get off the first flight. Best to rebook another flight that accounts for the needed time to get through customs without additional anxiety of missing the flight.

I'm not seeing the complication. You'll have to get a new passport, so why not start the process to get things in order now rather than waiting?

It's possible you're misunderstanding the validity clause. What that means is you must have at least 8 months' before the passport's expiration.

If I'm reading your timeline correctly, you just filed the I-129F petition. As was noted in the other thread you started yesterday on passport, you will have plenty of time to renew your passport between now and when your interview will occur. Depending on how quickly the service center adjudicates your case, you're likely looking at 5-6 months until the petition is approved and then you may have another 2-3 months until the case gets to the embassy and your interview occurs.

Well no - My only concern is that according to the USA Embassy in UK states my Passport may be declined if not valid for at least 8 months before being issued.
Think is I didn't realize this until now and I would need to renew my passport as I think it will expire just before I go.

By the time the interview starts - My passport will probably only be 7 months valid. If they were to decline for that - I would obviously appeal but I was just curious if they did decline and I couldn't appeal.
If something as small as that, if I could re-apply or if they was a short waiting period etc.

If the latter, the short answer is it depends. The approval rate for the K-1 visa is pretty high (over 90%), so the couple would have to know why the interviewing officer gave the thumb's down on the visa application.

For me, the decision on which visa option to petition came down to this: When do I want to be apart from my fiancé?

We opted for the K-1 because we'd rather not start off our marriage being apart for several months. While it's true that with the spousal visa, the spouse will receive a green card shortly after arrival, that doesn't mean they'll wake up on Monday after POE and land a job. So there will still need to be some financial discussions if income is a concern.

For us, our preference is to have him be here for a few months to get his bearings, meet/network with people, and then once the EAD is in hand, start looking for work in time. As always, your mileage may vary, but definitely research and weigh the pros/cons for the visa options with your partner.

The number one piece of advice I can offer is to read the I-129F instructions thoroughly and then read them again. And then come back to them in two days and read them again. So many people going through this process miss some of the "little things" such as where to mail the petition or how much the petition fee is. It's important to go through this process knowing each detail and checkbox matters.

Since you're not planning to start the petition process until a year from now, it would be ideal for you to bookmark the USCIS website and check it in the event changes are made to the I-129F process, the petition forms are updated, etc.

What do we write in the "father info" section if all we know is the last and first name of the father? Can we write the stepdad's info or can we just write "unknown" in the entire section?

My fiancé and I both grew up in single-parent situations and knew little bio info on our respective fathers. For that section, we only put their names and had "unknown" for the birthdate, location, etc. You should go with the bio-father, though, since it will need to match up to what's on the birth certificate.

Yes, that's very normal. It takes, on average, 5-6 months before the petition is adjudicated.

In the meantime, take a few minutes to fill in your VJ timeline along with updating the service center where the petition was sent. It's either Vermont (EAC) or California (WAC). :thumbs:

As mentioned upthread, you will receive a letter from NVC with the consular number and stating the petition is on its way to the embassy/consulate.

On the various documents, you should check with others who have gone through Germany (i.e. visit the Europe sub-forum) to see how the procedures are handled there. Each embassy/consulate varies in how they handle the paperwork.

No, you won't receive a letter when the approved petition is sent from USCIS to NVC, but you will receive a letter when the case leaves the NVC and is headed to the embassy/consulate. After our petition was approved, it took four weeks for the file to leave USCIS' mailroom and make its way to the NVC.

I suppose I was thinking that using the visa for 90 days might be our last chance to see each other if they really won't let her into the country anymore. But obviously what I'd prefer is if she were able to visit me in the US whenever she has a break at school.

Do I just e-mail them to ask for a delay? With visa or without, she wants to come for 88 days (or whatever) in February or March. The original plan way back when, was that she'd come in June 2012 and stay until August 2013, but we obviously found out quickly that that's simply not how things work. If we could find some way for her to stay here from March until August 2013, we'd do it, but I don't think there is any way.


There is a way for that to work...proceed with the K-1 visa as planned where she'll move to the US with the intention of staying for the long-term. Do not use the K-1 visa as a "see each other" visa. If all that is left is the medical exam, then do as Nich-Nick says and contact the Embassy to ask for a delay as soon as possible.

Your situation isn't really that complicated. It comes down to what your fiancée wants to do and when -- either go to the school of her choice or move forward with the K-1 visa, which would mean moving (and going to school) in the US sooner.

The former will include much more time apart than the latter, of course. I do think the waffling about on what to do should have been decided far earlier, however, but that's between you and she. However, one other implication to investigate is if the K-1 is issued and she arrives in the US, but then leaves, she will definitely have a harder time getting back in for a visit without another visa. I believe the VWP option goes away post-K-1, so whatever decision is made should be done before the K-1 is issued. Otherwise, you will be the one having to travel to the UK until she's ready to re-enter the US on a spousal visa.

Also, update your timeline to show where you are in the process. That's why I thought you were still waiting for the petition to be approved. :yes:

Hi, I'm really sorry for the confusing topic.

Basically, we have a K-1 almost completed, but the fact of the matter is that my fiancee has her heart set on going to school in England (where she is native). We want to finish the K-1 just in case she can't get into school there. However, I think she definitely will be able to get in, and I personally feel if she were to come here instead, she wouldn't be satisfied.


Was her desire to go to school in the UK discussed prior to starting the petition process? In looking at your timeline, I noticed you're still waiting for the petition to be approved, so there's still quite a bit more time between the petition being approved to when she'll go for the visa interview. When will she definitively know her school status?

I have a few questions, and they are, or might, both be off-topic. I'm sorry about that, too. I'm not thinking particularly clearly.

First off, if I was somehow able to move to the UK, and once she was done with school we decided to go back to the US, how would we accomplish this? We would be married at this point, so could we get a K-3 visa for her to come back to the US, despite me being in the UK? Or would I have to move back to the US first and spend a year apart getting a K-3 visa? (That would be awful.)


The K-3 visa is essentially obsolete. Your option would be the IR-1/CR-1 spousal visa. If you are able to legally stay in the UK, then the DCF would also be an option, but...

Secondly, and this is definitely off-topic (but maybe someone can point me to where to go)--I do not currently see any way for me to move to the UK. They did at one point have a spousal visa, so I figured we could get married here, then get me a spousal visa to come to the UK. They've changed the rules now, however, and my sponsor, who could only be my wife (fiancee at the moment), would need to either make $30,000 a year (US conversion-- 18,600 pounds is the actual amount, I believe), or have $100,000 US (60,000 pounds) in savings in order to sponsor me. As she is a student, obviously she doesn't make that kind of money or have that kind of money. Is there even any way for me to get into the UK?


...the likelihood of you being able to stay in the UK beyond a tourist visit is not likely given your fiancée's financial situation. I highly recommend reading this pinned thread in the UK forum for more information.

I feel like a wet noodle stuck to a wall at this point, totally gutted. I can't go to be with her in the UK, and I also can't ask her to give up on her school and come to be with me in the US, so it seems we'll continue being apart, which is something I don't know if either of us can tolerate.


This isn't just about you. She will need to make a decision and it seems that's where the sticking point lies from what you've written. Either she wants to go to school in the UK and be apart from you longer or the two of you proceed with the K-1 process and she can pick up schooling in the US. Is there something specific that she's studying where there isn't an equivalent in the US?

Regardless, if the decision is made to be apart while she goes to school, she should still plan on bringing plenty of proof that she will return to the UK. Plus, the fact that you've filed a K-1 shows there is some intent to move to the U.S., so she'll need to be completely upfront with customs if they ask beyond the cursory questions.

In most cases, this isn't needed for London. However, there was one recent case where the consular officer requested proof of an ongoing relationship and because of that, many of us are planning to at least take a bit of proof as a CYA. This can be emails, Skype logs, any cards that were mailed, etc.

I haven't seen the letter but my fiance tells me that i need to contact my consulate, there is no contact listed on the letter, so does this mean i need to contact the U.S Embassy in London and arrange an interview ? Sorry for asking questions which probaby seem really dumb.

I'd just like a kind of check list i can work through so i can't go wrong anywhere, i would hate to have gotten this far and somehow mess it up.
