He won't be able to work at all. He'll need at least the Employment Authorization Document (EAD) and Social Security Card/Number before he's legally eligible to work in the US. You can file for the EAD at the same time as the Adjustment of Status.

Correct. And considering you've yet to file the petition, you'll need the Tax Year 2012 tax return transcript by the time the I-134 is needed.

The current guideline for four is $28,812. Assuming you have the new job by the time the interview occurs, you can provide paystubs showing ongoing income along with a letter from your employer stating you make $X annually.

Hi Everyone! My fiance and I have had a relationship for 2 and a half years. We've met up twice, once in Canada and the latest was last March in the UK where he lives. The problem is neither one of us make a lot of money. I'm a waitress going to school full time and still have a full year to go. I want to start the K-1 Fiance process in February, but I'm afraid my income will not be enough. I don't know anyone who could or would agree to being a sponsor. We're getting really fed up with not being together especially around the holidays and they wont even let him visit due to not having enough ties in the UK. Any ideas or helpful thoughts would be appreciated.


If it's just the two of you, the current* poverty guideline is $18,912. He also has the option to self-sponsor in London. If you don't make that amount (or higher) and/or he isn't able to self-sponsor, it may be best to wait until you're through with school and secure a job that pays a higher salary. Or start the petition process a bit later -- perhaps April or May? -- to when you will be finishing school since it takes 5-6 months to get approved and then another 2 or so months for the interview.

*The poverty guideline may be subject to change depending on the new amounts to be released at the end of January.

Each time, it's at the discretion of Customs & Border Patrol (CBP) to allow you to enter the U.S. That's why it's important to bring strong proof that you will return to the UK and not overstay the allotted time.

Yes, but you will need to ensure to provide proof that you will be returning each time. Be sure to read the "Yes, you can visit" thread pinned at the top on what others have encountered and typically bring just in case CBP requests additional information.

Will the authorites give any priority to those with children? As my fiance will give birth in september and I would like to be there to suport them both finacially and obviously not miss out on my childs first months of life.

The US embassy response is correct...you can visit as long as you're able to provide strong ties/proof that you will be returning to the UK. Since you're the beneficiary, your US partner would need to contact USCIS to get any information on the pending petition. Nick - I only used dangerous at the time with reference to the info on the form. After it happened, I regretted it straight away and made myself sick. I don't believe myself to be dangerous, have never had any problems since, work full time in a busy office environment and am a relatively normal 22 year old woman.

I phoned the US Embassy today and he just said he wasn't qualified to make that decision, and to call the US Border Agency. The US Border Agency bloke said he wasn't qualified either and to discuss it with the officer. I said I know, it's not that I need advice for, it's about the DS-156 form. He still pretty much still said discuss it at the interview.

So - I'm assuming I click no then? :S


The question is "have you ever..." to which it would lean more toward answering "yes" than "no." As Nich-Nick noted, the medical questionnaire will also ask specific questions (see questions #8 and #12), so it's best to be honest and consistent. As I noted upthread, there have been others who have self-harmed in the past, interviewed at London, and received a visa.

To confirm, your partner has yet to actually file the I-129F petition, correct? If that's the case, it's way early for you to worry about the visa application forms. The DS forms are not part of the petition package. The forms could be changed/updated by the time it's filed and approved, so it's best to wait to complete them until the petition approval is received.

Hey all. I'm new here so I wonder if anyone can help me with a few concerns. Firstly, I had depression when I was younger (15, I'm almost 23 now) and had one suicide attempt aged 16 and didn't get treated for it as I was in an abusive relationship and took steps to resolve it myself. I was working a few months later and had no problems. I have one tiny scar on my lower left arm in an inconspicuous place. I had depression for 3 months recently while my parents went through a very messy divorce, took medication etc, and told my GP then that I wouldn't self harm or ever kill myself as there are different ways to cope. I feel fine now, and am off the pills.

We've not submitted the application yet, but before my medical, I intend to get a full letter from my GP stating these things aren't an issue.

My first question is - when they send you the packet 3 and you have to fill out the Part 1 form, there's a question about ' has or has had a mental condition that poses or is likely to pose a threat to the welfare of the alien or others'. Do I select yes or no for that? There is no way it would ever cause a problem to myself or anyone else, but I'm concerned that if I put No, will that be concealing information because I HAD a condition 8 years ago that posed a threat to me at the time?


Since you're planning to have your GP write a letter to give to the Knightsbridge doc, it will be noted elsewhere, so best to answer that question honestly. (Since your partner hasn't filed the petition yet, you have a while before you'll have to go to the exam at Knightsbridge, though.) There have been others from the UK who have had similar events in their lives, were open about it, and they were approved for a visa without issue.

Also I may have a heart condition called ARVC as my dad has just been diagnosed with it, however I went for an ECG, chest X-Ray and blood test at the hospital and they said everything looked perfectly normal. The only way to even tell would be to get a genetics screening to see if I've inherited the genes that can cause it. Is this likely to cause a problem too?


Doubtful it will be a problem. My now-husband had a pulmonary embolism (one of our bonding points...), but was given a clean bill of health after being treated. It was noted by his GP, but didn't come up during the Knightsbridge exam beyond asking about any medications he's taking (which was none by then).

Yes, you can, provided you have all of the other supporting documentation and the I-134 affidavit of support and proof so you're truly ready for an interview. Then, once the embassy received your medical exam results, the interview schedule clock begins.

Another letter of intent isn't needed for London. Most don't accompany their partners, but if you opt to go to the interview, you'll have to make arrangements with the embassy in advance so you can attend.

If you don't have a co-sponsor option for the I-134, then definitely head back to Florida so you have income to list on the I-134.

Yep, this is for him to come to the States. Thanks for all your feedback. We are just in the middle of deciding when to end our contract with our current landlord for our flat. We were thinking of having myself, heading back to Florida to get back to my old job and US life (its been 3 and a half years) and he can live with his parents till he can get to Florida. What exactly does he need again to get to the US?

Jobs in the UK are ####### at the moment and we just want to work and live together and make money and be happy! :P

Yes. It can take anywhere from just a couple of days to a month (that happened to us).

For us, it took about four months from when the petition was approved to when my then-fiancé traveled to London for the interview. It would have likely been less time, but as I noted, it took USCIS a month to ship our approved petition to the NVC.

unfortunately, they do need the un-abridged version of birth certificate. I went to home affairs and was told could take up to 6 months to get, i ranted and raged but applied for it and paid the fee. I was very pleasantly surprised when i got a message saying it was ready for collection 1 week later. Get the long version certificate- it will take longer if you get a RFE for incorrect docs

Hi guys!

My Fiance'e, Lindsey and I sent in all of our documents(I-129f etc)for the K1(Fiance) visa...anyways, we waited a crazy amount of time and finally after lots of stress and unhappiness, the documents have arrived in Johannesburg, South Africa(my home country) and they have emailed us packet 3, which is the checklist and a few forms you need to send back or take with to the interview. So after all of our hard work and preparation in the 7 months we have been waiting to get to this stage, we have found out that the birth certificate that they want at the interview is an "unabridged" one, which means it must have the details of both of my parents on it. I am obviously very unhappy about this as I was born in 1984 and was given a proof of registration of birth which has my DOB and my parents ID number on it,their names are not printed at all.I also have an original South African birth certificate which was issued to me(or probably my mom as I was too young) in 1984, it is green in color and only has my details of birth(DOB, names etc.). The birth certificate that they expect us to bring to the interview is neither of these according to my research but if I were to apply for the unabridged one it would possibly take up to 4 months which is very upsetting as we have all of the other documents(police clearance, forms etc.)ready for the interview. Does anybody know if they will accept my original birth certificate or even my proof of registration of birth(or both)? I really hope so because I would not like our marriage to be delayed 4 months due to 1 dumb piece of paper! :o

What A&B posted is the correct information. As noted, the petition for the I-129F is handled by the Dept. of Homeland Security and the actual visa is handled by the Dept. of State. Also, the K-3 process is essentially obsolete at this point.

It's better to link folks to the correct departments -- petition information on USCIS, embassy/interview/visas on DOS -- than to just point to the DOS for information. That's where confusion is introduced.

I would disagree. Even if she does call and they tell her to send a letter, what if it doesn't get matched up to her petition? Then, she will get an RFE. So yes, there will be some worrying in the meantime.

You can't contact USCIS about the petition. Instead, you'll have to wait to see if you receive an RFE notice.

Hi VJ these is my first time to post here.I was denied k1 visa in January these year after one year of waiting.The reason i was denied was lack of a bone fade relationship despite all the questions i answered correctly and all the evidence i had.My petion was prepared by an immigrant lawyer who assured us that everything will be in order.I was interviewed for almost two hours.I knew almost all answers except some personal information about my fiancée's daughter since they don't communicate with my fiancée .The documents i provided as proof were chat logs.phone bills,emails.letters and pictures.
I was given a letter explaining my denial.Named 221(g)when i look on the website i see that such kind of a document asks for more information but in that letter there is no where explaining that.My concern is that we decided to get married here and did a wedding in march, and apply for a Cr1 what should i do to avoid another dissapointments because i cant afford another heart break?Your help will always be highly appreciated,Thank you.


It's not clear from your post, but did you two meet in person? You mention pictures that were submitted as proof, but were there any documents that showed actual travel such as passport stamps, receipts, etc.?

If you read through the I-129F instructions and ask any questions on things you don't understand, you can do this on your own. If your situation is straightforward, then involving an attorney may not be the best use of your money. You can do it for far less than $6k, that's for sure.
