Hello again! You guys were so much help before and i got everything ready to go but came to a snag so i'm all ready to file and get this going i just have a few last minute questions about what i need to do :)

First off- When we send the "proof" of relationship ie. my phone records, can i black out all the numbers that aren't his? My parents, friends, and colleagues really don't need to have their numbers mailed out in my opinion.


I wouldn't recommend it. It would raise suspicion more than serving to protect anything.

Secondly- do we send photocopies of the pictures first and bring originals, or should i go to walmart and make copies of all my photos? They were taken on a phone and printed off the computer though i'm sure many people do this, i'm just curious about the correct procedure.


You can either make copies of the photos at a Walgreens, etc., or you can put them into into a Word doc or PowerPoint presentation with the date and location information. If you go the route of making prints, just be sure to secure them in a baggy so they aren't lost.

third- I've read through the step by step guide a thousand times and steps 12-14 do not apply to our situation, should i state somewhere, maybe in the cover letter, that neither of us have been married/ divorced/ convicted of any crimes? or will they figure that out through the other forms (biographic information and such?)

If you've never been married, then the letter of intent will be all you need to confirm that you are free to marry.

Being realistic is often equated with being harsh on VJ, so I'm not surprised that someone's feathers may be ruffled. The petition process is not for the faint of heart and will test your relationship if the petitioner and beneficiary are apart for most of the time between submitting the petition and receiving the visa to enter the country. It's not just about whether someone declares their love on VJ or anywhere else, to be honest, but it is about ensuring both the petitioner and beneficiary are fully aware of what this process entails.

If you can only say "I think she loves me," then you should evaluate the state of the relationship before entering into the petition process. What does she want to do? Since she's the US Citizen, the process begins with her. Whether she opts to file a petition for a fiancé or a spouse, there are lots of steps involved. Read the VJ Guides to get an idea of the K-1 and IR-1/CR-1 visa processes, and again, discuss the process with your girlfriend.

You typically have to marry first to have it qualify as a "life event," but confirm that with your HR dept./insurance administrator since it varies.

The "NOA2" is just VisaJourney vernacular. The petition approval notice is mailed to the petitioner from the USCIS and would have I-797 on it. You can see an example in the gallery: http://www.visajourn...p_display_media

If you haven't received that petition approval/I-797 document, contact the USCIS on Tuesday (Monday is a federal holiday) to confirm your mailing address and to see what happened. You'll need that document for adjustment of status.

Hello!

I've been reading on this sites forums for a few weeks now and have to say it's got the best inofrmation! I'm in england and my Fiancé is in America, I've just come back from seeing her 2 weeks ago and she is going to be sending the K-1 off sometime in the next 2 weeks. I didn't realize that she had to have a passport photo of me so I'm going to have to take one and mail her it. The process is long but we've been in a long distance relationship for 2 years now.

I have a concern though, we met on Xbox and spend all of our time together on Xbox, we use Hotmail to talk when away, but I have no emails past 25/10/12 because of them being deleted and cannot be brought back, will like 50 emails (copied onto word and printed) be enough for the K-1 app? Aswell as our pics together and flight proof?

Welcome! First, fill in your profile and select UK so your post will appear in the UK portal. Be sure the passport photo you send is US-sized and not UK-sized. The flight proof, passport stamps, and receipts are the key evidence to send. Photos and emails are secondary evidence, so while you should send a few photos, you don't have to send hundreds of pages of emails, if you opt to send any at all. I didn't include any emails or Skype logs in the petition for my fiancé.

I have received a letter from US Embassy London asking me to complete the K1 Visa forms including DS 156K. This form mentions a lot of evidential material required to be attached such as birth certificate, financial support, evidence of engagement etc.. The letter from the embassy emphatically says not to send any documents unless specifically requested but it isn't clear if they mean the documents mentioned on the DS 156K form which the form says have to be attached to the Form. Help please. What do we actually send back to the Embassy at this stage for the DS 156K? And when do we send everything else related to the application?

This post on page 1 of that thread provides details on which DS forms need to be mailed to the Embassy. No other documents should be "attached" or mailed at that time...just the DS forms.

HI all , after going through the website along with many others I am reading many conflicting stories concerning visiting fiance during the approval process.
So, basically am I allowed to visit my fiance in the USA while our fiance visa is being processed or not?? I thought they took my passport (I am Canadian BTW)?
We haven't applied yet, as we are looking for fastest way to be approved.
We met 4 yrs ago online and started seeing each other in June 2012. Met first time in person July 2012, and have fallen hard for one another and can't stand being apart..Obviously customs give me a hard time when crossing and this last time has given me a I90 slip with only a 30 day entry :(

Your passport isn't taken until you have your interview and are approved. First, your fiancé files the I-129F petition and then once that is approved, you will apply for the K-1 visa. Take some time to read the pinned thread up top called, "Yes, you can visit!" to get insight on others' experiences who travel to the U.S. while waiting for the petition to be adjudicated.

With this process, quick is relative. It would depend on if you would prefer to marry first and spend time apart while waiting for the spousal petition and visa process goes on, or remain engaged and go through the fiancé petition and visa process. Does anyone know how long it takes for the USCIS to give you updated regarding "Current Case Status"? I have already received the official NOA1 letter, and after checking a few days later i'm still don't see any updates online from the USCIS.


You will not receive regular updates. Your petition is currently sitting in a box awaiting adjudication and will likely be there for a few months. You can use the VJ timeline feature to get an estimate on when an adjudicator will review your file. From there, it will either be approved, receive an RFE (request for further evidence), or denied.

Edit: Be sure to update your timeline based on where the petition was sent -- Vermont Service Center or California. Texas Service Center does not process I-129F petitions. Your petition was sent to the Dallas lockbox, which is not the same as the TSC.

Unless your case is complicated (e.g. multiple divorces, children are involved, overstays in the U.S., serious felony conviction(s), etc.), you likely don't need a lawyer. Take some time to read the K-1 guide on VJ to get an overview of the process. The bulk of the work will be done by the petitioner (US Citizen) since you'd need to provide the information to complete the I-129F as well as the supporting documentation. Get familiar with the process and then ask specific questions on VJ if you run into something you don't understand.

That said, if you do opt to utilize a lawyer, still read through the K-1 guide and flowchart so you know what's involved, next steps, etc. There are so many posts on VJ of people who hire a lawyer, but then don't take the time to read through the information themselves.

Is your fiancée not originally from Stockholm or Scandinavia, in general? Do you know what type of detailed questions they asked? Stockholm seems like it would be pretty low-fraud, otherwise. :unsure:

If you weren't at the interview, you should first get all the details on exactly what happened. Filing an appeal likely won't be a good option, especially if the CO felt there was something fraudulent about the case.

People plan the weddings they want to have and in some cases, that may be an additional means of proof if they're going through a consulate deemed "high-fraud." However, for just the petition, it's not a requirement to have a ring or any of the other traditional trappings of marriage. I'm wearing an engagement ring, but I like jewelry. It's nothing fancy (it's from a local designer who sells her things on Etsy), but serves as a reminder of my fiancé since we decided what it would look like together.

When my fiancé did his interview, he was asked about wedding plans and simply said we're going to do a small ceremony as soon as possible after he enters the US. That's it, no additional details, no having to show any specific details, etc. (However, that is a consulate-dependent item since there are certain cultures where pre-marriage customs are expected.)

After marriage, it will be more about showing proof that you live together, share bills, etc. Many who do the K-1 go for the quick courthouse or small ceremony so they can move forward with the adjustment of status. Good luck!

There have been a number of posts lately talking about engagement rings, receipts, and so on ... making me nervous and I just wanted to set my mind at ease: we are not required to have an engagement ring, are we???

I have no desire for a ring (I'm the USC, female), since I never ever wear jewelry and I'm not big on tradition at all. (I've even told him never to buy me flowers, although chocolate is ok!) And we don't even have any official engagement story or "proposal" -- we started talking about getting married about three years into our six-year relationship, simply because it seemed the only possible way for us to actually live together permanently, in either country. So if anyone proposed, I think it was me, not him!

I'm also not going to change my name when we get married, nor are we planning any sort of elaborate ceremony -- at most, just my immediate family when we go to the justice of the peace, or something along those lines, with maybe a nice family dinner afterwards. Nothing traditional whatsoever, and I might not even wear a skirt! (Not big on dresses either.)

None of that means I love him any less, or that our relationship isn't real ... and I certainly hope USCIS doesn't insist on things that would mean nothing to us, personally.

So, just needing to make sure: will the lack of a proposal, lack of an engagement ring, lack of a big wedding party ... any of that be a problem or cause for concern, at either the interview stage or later, when we adjust status and eventually remove conditions? I can't see why traditions like that would ever be required, but so many posts lately seem to focus on wedding plans and rings, that it has me feeling a bit out of place and nervous!

When the adjudicator is reviewing the petition package, they will either approve it, deny it, or issue an RFE. If they issue an RFE, that means they would have approved it had the missing information been included.

My bad, K1 Visas are a different animal and submitted to two places in Texas. One for US Postal mail, and the other for Fedex and other special mail. I was referring to CR-1 visas in my previous reply.


There aren't two separate places. One address is a PO Box, the other is a physical address for those who want to send via courier, FedEx, or UPS, i.e. services that require a physical address and not a PO Box. However, they all end up at the Dallas lockbox location.

The costs you included are accurate, save for the visa fee...that doesn't happen at the NVC stage for the K-1. It's paid at the embassy/consulate prior to or at your interview. You should also include the costs of making copies, photos, mailing/shipping items, airfare, etc. There are other "true cost of the K-1" threads on VJ, but it can vary.

In the end, both processes are not inexpensive. If you opt for the spousal visa, there's the cost of traveling, any required periods of stay within the country (if the wedding happens outside the U.S.), the marriage license, etc. Anyone who includes the words "cheaper" in this process is speaking in relative terms. Definitely review the comparison chart and think about what items are more important to you. It's a personal decision that each couple has to make on their own. Good luck! :thumbs:

Hi,

Does anyone know if I am required to bring a police certificate from the US government to my k1 visa interview if I spent 1 year working there under a non-immigrant visa several years ago. I already have my UK police certificate, but I suddenly realised I may also require a US one.

Also does anyone know the current interview-wait time for London - I submitted my packet 3 at the end of october and wanted to get an idea of when I may hear back regarding an interview date.

On the interview date, have you already had your medical and submitted the DS-2001? The embassy doesn't consider you eligible for interview until all DS forms, including the readiness letter (DS-2001), and the medical exam results have been delivered to them. For my fiancé, he received the interview letter about three weeks after his medical exam and the interview was four weeks away from that date.

Also, did you include a specific date in your cover letter and/or state that you're open to taking any cancellations? Those may help push things along.

What is the number for the DoS hotline? I have called USCIS and they have her address correct as to where she currently lives. NVC said that I needed to update her address with them not the USCIS. But the NVC didn't have her info in July. They didn't receive it until November 10th. I've called the Singapore Embassy and the Manila Embassy with no help at all. And I've also emailed them both and only Singapore responded. I'm about to go bald!!! LOL!!!! :(

The NVC and the embassies are under the Dept. of State. USCIS is under Dept. of Homeland Security. They don't always talk to one another, so your best option is to call the DOS line.

The OP asked if the signed and dated copy has to be an original. As others have pointed out, they have had their fiancé(e) sign and date the document, scan it and send it to them via email for the petition filing. That is what the OP is asking. Signed and dated != original ink copy.

Please re-read what I wrote:

The instructions for the I-129f state they want the form signed and dated. Follow the instructions.

The I-129F is only signed by the USC/petitioner. The question is more focused on the G-325.

The letter of intent from your fiancé(e) will have to be an original version with an ink signature, so if they're sending you that via mail (along with passport-size photos if you don't have them already), adding the G-325 to that stack shouldn't be much of an issue.

The link Jay-Kay posted is where you should start reading. However, a lot of it needs to wait until you've received the NOA2 (or are close to receiving it) to ensure it's all still valid by the time it arrives in London. Your fiancé can definitely visit his regular GP, ensure all vaccinations needed are done and get the documentation from the GP so it can all be recorded when he goes for the Knightsbridge exam.

My fiance and I received our NOA1 on Aug. 6, 2012, and in the meantime have read a lot about putting together the necessary documents we might need for the next step, in the meantime.

Where can I find those? The VJ K1 Visa Timeline says: "Start gathering documents needed by beneficiary (MY FIANCE) after submitting I-129F" And I've done just that, but I'm still not finding what we need to gather.

I am the U.S. citizen, he is a British citizen and the Embassy assigned is London, UK.

Could anyone point me in the right direction? Thank you so much for your assistance! :)

Sending the G-325A for both the petitioner and beneficiary is one of the required items to include in the petition package. She should prepare to receive an RFE once the case is adjudicated, which will unfortunately lengthen the process for the two of you. In the meantime, you should fill out the form, sign it (in ink) and mail it to her as soon as you can. Be sure to share the VJ website with her so she can be better informed.

Thanks for all your advice, everyone. I'm guessing (and hoping lol) the UK isn't a high fraud location. We had already put in just a screencap of our chat log together, just to show online communication, as well as a screencap of skype logs along with a collection of photos together.

Yes, primary evidence isn't a problem, we have photocopies of pages from both our passports showing our entry stamps going to eachothers home country over more than 2 years, as well as copies of boarding passes from the flights. I was wondering is an affidavit from both our parents claiming that the respective person was staying with their partner in their family home would be a worthwhile addition as secondary evidence?


For many (not all), and especially if the beneficiary is a native-born Brit, going through London is relatively painless. You can read embassy reviews from other K-1s on this site who have gone through London recently to get an idea. My now-husband was terrified before going in, but quickly relaxed and then happy-danced out the gates. :lol:

Skip the affidavits and focus on ensuring the primary evidence is strong and will get your case approved. :thumbs:

I still didn't change my address because we are waiting for noa2 hard copy , should I change it now? We got our noa2 November 27th by text and email.Still no hard copy! Do they only send the packet 3 after we get noa2 in the mail? I'm so confused!

"Packet 3" is sent once the petition has passed through the NVC and sent to the embassy/consulate where the interview will occur. Have you or your partner called the NVC to confirm they've received the petition? You can call (603) 334-0700 to learn its status. Also, many embassies/consulates post the forms that need to be completed online, depending on where your interview will take place, check that site for more details.

Once the petition is approved and is sent to the embassy/consulate, the visa application fee (currently at $240) will need to be paid. Be sure to review the K-1 flowchart to see the various steps involved.

And co-sign on what others have said, this process is not in any way cheap. (It's why I don't like when in comparing the K1 and CR-1, some use the word "cheaper." Saving a thousand, if that, in a process that costs several Ks over the course of the journey is laughable.)

I know that thank I am talking about the $240 application fee when do they ask for that after you send out the first packet and they review...? when in the K-1 process is what I'm asking do they ask for the $240 application fee. I know the $340 is the first money order you send... :)

It's probably best to see how the embassy responds. Your situation is not the norm, so it's hard to say if they'll accept an email or faxed version of his docs given his active duty status.

That will answer most of your questions. First and foremost, you need to send everything that is requested for the I-129F petition with the initial package. If you don't, it will further delay you.

As far as having a plan for when you want to get married...throw that out the window. The federal government doesn't care about your plans or reservations and are on their own timeline, so the first lesson -- and most difficult for some -- to learn is once you enter this process, very little will remain in your control.

The Texas Service Center does not process I-129F petitions. The petition package will be sent to a lockbox in Dallas where they will process the payment and send it to either Vermont or California. I am new to this ;-)

My fiancé and I plan to get married next summer, I would wanna get there kind of early, so I can get myself into university and my kids into school.
So July would be good.

Now I wonder, we haven't started the filing yet, do you think we have any chances of getting this through till June????? I thought it was 4-6 months, but posts here have really concerned me.

The document that is supposed to assist with filling out the I129F, does it make sense to send all the needed paperwork (divorce papers, copies of passport, Form G325a, passport photoes) along with that first petition? Or do they prefer to prompt you for them?
