Sending all the photos isn't going to help them now when the RFE is specifically seeking photos within the two-year timeframe before filing the petition. As has been mentioned time and time again, the meeting within two years is a strict requirement of the I-129F. The petitioner needs to ensure they read the I-129F instructions carefully and abide by them. Had they read the instructions thoroughly rather than trying their luck, they wouldn't be in this predicament right now where they're facing an even longer wait and more money spent (trip + filing a new petition).

and if we refile again does the waiting period for noa2 will be 5mos again?


Your fiancé would need to contact USCIS with the case number (found on the NOA1 document) and ask them to withdraw the petition. He should do this via phone and following up with a formal letter.

When you refile, you're starting back at step 1, so the usual petition timeframe would apply.

Anyone here? Encountered this kind of situation?
Hi we got RFE last June 20 and got the hardcopy today. It says we have to submit photos from certain year January 2010 to January 2012. But the problem is WE DON'T HAVE! My fiance went here in the Philippines for 3weeks vacation last OCT.2009 and then he flew back to US. We just chat, talk, sending emails since then.

Please advice us in a most possible and positive way to avoid denial of the petition. We are so worried to death and stress strike back again after my concern in k2.

Please help us to solve this please!? :crying:


The key requirement for the petition is providing proof that you've met within two years of filing the petition. If the last visit was in 2009, then that's outside the timeframe. Unfortunately, because you can't produce that proof, the best option would be for your fiancé to withdraw his petition, plan on visiting you (or you visiting him), and then refiling once you have definite proof of meeting within the two year timeframe.

One thing we missed was that we were so focused on NOA2, that we weren't very ready to move forward once it arrived. So I'd suggest finding out about documents you need for the Packet 3. Good luck!

You need to fill in your timeline with the correct information. You currently have the country as Armenia and going through the Texas Service Center. It should be Turkey and then either California Service Center or Vermont Service Center. :thumbs:

July 13th is when they received my packet. I got NOA1 on the 17th. I filled out my timeline, Thank you.

When did you receive the NOA1? It takes on average 5-6 months for the petition to be adjudicated, so you're still within the regular timeframe.

I need some insight and support guys.
Ive been following some of you with your posts and timelines, and quite a few of you received your NOA2 fairly quickly after the NOA1.

We still havent though:*( im starting to get nervous. We didnt get any RFEs or anything either which is a good thing obviously but
the fact the NOA2 isnt here yet is making me wonder have they or are they even looking at our petition? Ive called once recently, but
got the automated system which basically said the same thing that I see on the website, which says we're in the initial review stage.

Just my two-pennyworth.  If you marry and then don't live together, it may be difficult to go for AOS.  That is because you may not be able to show co-mingling of finances.  They would expect to see you with a lease in joint names.  Or a property in joint names.  Lots of things in joint names.  And if you end up getting a second interview, they will start asking you questions that you would only know the answer to if you lived together.

 

However, as mentioned above, you have 6 months to come to the US once your visa is granted and then you have to marry within 90 days.

 

BTW - just my opinion.  Isn't it more important to be married to your beloved rather than the month in which you marry?  There is no guarantee of weather whatever time of year you marry (unless you plan to marry in the desert).  I will be getting married next month (God willing) but the dress I bought is going to be really heavy for the time of year as I expected to get married earlier this year!

 

It's a 50/50 chance for someone who entered on the K-1 being called for an AOS interview. You don't have to include proof of co-mingled finances, etc. as part of the AOS application process. However, if a couple is interviewed, then yes, it would definitely be ideal to bring along any proof of co-mingling/proof of a bona fide marriage. That's even more critical for the ROC stage.

If you opt to make any wedding reservations before the visa is in hand, make sure you are able to make changes to them. There have been many -- too many -- who book a venue with a non-refundable contract or even send out invitations with a specific date and then they're scrambling because their fiancé(e) doesn't have their visa yet. One thing to remember, you do not have much control over the petition and visa process. The USCIS, NVC, and embassy/consulate where the interview will take place dictate about 90% of what happens.

The timeline date provided on VJ is based on a mere fraction of the petitions received by USCIS, so I wouldn't use it as gospel to predict exactly when you will have the NOA2 and definitely don't use it to try to figure out wedding plans.

Many people do a small ceremony shortly after POE and then do a larger party for friends and family as they'll have more time to plan.

ok thanks again for the responses. So lets say the processing takes 5 months from when they received it, that would be March 24, once that gets approved what might be an estimate of total time before she would arrive into the US?

I am just trying to get an idea of the 90 day window for marriage once she gets here. The place for the wedding gets booked usually a year in advance and I need to try to reserve something now if possible.

made it to Miami.. her flight in the morning was cancelled due to engine problems.. was re routed on later flight to Miami..

spent 3 hours in immigration line.. she made it thru.. she will sleep in airpot and take flight in morning to Houston.. i will pick her up at 9:20am!!!!!

FINALLY! SOME CLOSURE!

Interview went extremely well in Montreal. Got in line around 7AM, got back out with our hearts full to bursting by 9AM. The word "approved" never felt so good.

I actually met another VJer in line who's name I can't remember, but she went through CSC and applied after April. Also a few other folks who at least knew of the site, if not directly participated on it. Hoping everyone else there did well, seems like we were the only ones from a Jan filing to be there though.

Now the wait for DHL. We recently had a nightmarish experience with them shipping from the US to Canada where it took nearly three weeks to get a single box to the destination. Doesn't really instil confidence but I'm hoping that since its Canada-to-Canada, and official government documents, that we have more luck with it.

Haven't really had a lot of time to check here lately but I thought I'd share the good news and wish everyone else well again on their own journeys!

Hello all!

We're married!! The wedding ceremony and reception were so great and went off without a hitch. It was so much fun! We went to the county office to turn in the certificate and get certified copies first thing this morning and then went to the Social Security office to get our new cards going. If all goes well, we'll have them in about a week.

We finalized the details on our wedding cake for our day earlier this morning. It will be a chocolate cake with vanilla frosting. I said, "Vanilla and Chocolate...like us!" It will be topped with fresh flowers to match my bouquet. Just 72 hours from now to go! We'll be running around on Friday to do a few last-minute things and then Saturday afternoon is showtime!

Wedding and all have been amazing, now that we are back we are going to send my AOS as soon as we can... at the moment still waiting for my money being sent from Italy to reach our account... this has been the second try as the italian employee messed it up the first time..... asa we receive it we are ready to send that big check and start the process again!

I wonder how old that information is because all the other threads on VJ along with a checklist we're following from Nich-Nick, you don't have to send in the I-693 if the DS-3025 was completed and recorded during the pre-interview medical exam.

I just spent hours researching this same topic!!! Ahh!!! I finally decided that he did get all of the required vaccines aside from a flu shot (which we both got at Walgreen's a couple of weeks ago anyway)....so I thought that we were set to just send in the copy of the ds2035 BUT THEN I found this: http://www.visajourn...m/content/k1aos And it says that you have to take the ds2035 and the first page of the 693 to a civil surgeon anyway!!!! I am sooooooooo confused. WHY do I need to go to another civil surgeon just for them to sign something and seal it in an envelope?! Help, guys! :help:

Our Thanksgiving was great! Despite our sleeping in, and thus starting the turkey breast later than expected, everything turned out well. I'm making turkey & dumplings today to use up the rest of the turkey.

We met with our wedding officiant on Friday evening over a bottle of wine to talk about this Saturday's ceremony. I practiced doing my wedding make-up and it turned out well and my dress fits perfectly. Hooray for small miracles! Chatting with a caterer today to get the food organized and then we'll do a bunch of rushing about on Friday to get fiancé hair trimmed up, shoes shined, etc. My GBFF (G=gay :D) ordered a flower bouquet and a boutonniere. In between work and everything else, I need to finish the wedding playlist and get that loaded on my iPod.

Fiancé has been in Portland for one week as of last night! He's already registered for a library card and will be hitting the shelves tomorrow. Fortunately, you only need to show a photo ID and proof of residence in the county to get one.

We'll be back at the marriage license office first thing next Monday to get copies of the official certificate and will then put together the AOS package.

So much craziness, but so worth it!! Hope everyone else is doing well! I cannot believe this year is almost over! Remember where we all were back in January? Going through the waiting process seemed as if it took forever, but now, looking back, it feels as if it flew by.

Okay guys, it has been a roller coaster for the last month since we got the visa. We finally sorted out most of the things and just bought a plane ticket today. I pick up my sweetheart on Thursday! My wish has come true and he will be here for Thanksgiving! I was hoping he would be here a little before and not the day of, but I am very happy no matter what!! Just got a text. He must have sprinted off the plane because he was towards the front of the queue for customs. He just went through customs and is officially in the country!


I'll hear more about how POE went later tonight, but it was really quick! His text to me just before turning off his phone as he entered the queue was at 5:14PM. I got the text that he was through customs at 5:31PM.

Will do! His flight lands in San Francisco in just under three hours from now. Not surprising, the flight left Heathrow late, but at least it was only about 30 minutes. I've been on a flight out of LHR that was delayed by over an hour.

My fiancé was the same way! :lol: He waited until we were on Skype to carefully open the package. The infamous "do not open" package was clearly marked as such and his passport was sitting on top of it with a letter.

Hey I have a question for anyone who did a small/courthouse wedding and are doing a bigger one later on - did you exchange rings at your first/legal wedding? Or just sign the papers?
I'm trying to figure out if we need to buy rings soon, or if we have a few months! (Legal wedding will be 01/01/13, as long as POE goes smoothly before Christmas, big wedding is 05/18/13)


We're planning on exchanging rings at the small/legal wedding in December, which will be attended by just a handful of people. And then in January, we're having the big party for a larger group of friends.

Yes I arrived to the US on November 1st, I was going through JFK but thankfully my flights were on time. I had my POE in Dublin and I can't imagine it being any easier... no questions , just smiles and wishing me a happy life! :)

Then we headed to Miami and Orlando and just last night we got HOME! :)

We're slowly getting there. I think a lot of us are in the post-interview stage where either POE has just happened or will be happening in the coming weeks. Texas22 has a bit longer of a wait for her interview, but we're all rooting for her to arrive in the US soon.

It's crazy how much the requirements vary by state. I'm planning on getting my marriage license today and was slightly worried because the website states that a SS # is required before you can have one. Then I called and the first woman I spoke to said I would also need a US driver's license for my fiance. She transferred me to another woman, and thankfully, she said that I didn't need a US driver's license for him and that we can fill out an affidavit since I doubt we could get an SS card by the wedding. I really wish that the US would make the marriage/SS card/driver's license requirements for K1 holders to be be the same for each state.


That will never happen, alas. The crazy part is it's not even by state, but by county on what's required for obtaining a marriage license. Thankfully, for where we'll marry in Oregon, the license form is pretty straightforward.

Looks like late spring / early summer for us! But, that will give us time to plan, save $$, de-clutter, pack up my house, give proper notice to my landlord, let the kids finish their school year (I'm going to pull them out as early as I can without them losing their year - so they will have an extra long summer :) ). Yes the wait is hard, but with each day and and each step forward, it gets easier knowing that we will have forever together to make up for it! :D
