Question - your profile states you filed at the Bangkok Embassy - are you using direct filing or filing in the U.S.. Direct filing has a much different (and shorter) time line if you have the required six-months residence.

I read somewhere that 5 months is a maximum.

Part of the income for qualification came from SS and the rest from my IRA

These combined incomes met the minimum income requirement for my spouse an me

Hi All

I was a retired American in Thailand for the past 5 years. I have returned to the states and established residence here.
We have an NOA 1 received and my wife is with me in the US on a tourist Visa. She will return to Thailand in the near future.

Question:
I have collected SS payments and I have an IRA that I have removed funds from each year.
The SS payment and the withdrawals from the IRA do reach the minimum income requirement for each of the past three years
(125% of poverty level)....Though I have not worked,

I wonder what effect my "not working" will have in this process. I believe I have sufficient funds in the bank as well to help me qualify for the income requirement

We wanted to get all the documents we will be filing together now and filled out so we are sure are on the same page so to speak

We are filing for a CR-1 visa

NOA 2 DATE OCT 20TH OR??

Here are the documents we have downloaded

OF- 169 Medical report
OF - 230 Parts I and II - Biographic Date
I-864 Affadavit of support
Biographic page copy from passport
Long Birth Certificate
Marriage Certificate
Police certificate

Others don't apply to us


There is a packet #3 and #4 -- Wonder what is the difference?

#3 pre interview forms and #4 interview forms.

Do we send originals or copy's of the marriage certificate and birth certificate in packet #3?

I notice that originals of these are a must at the interview.... so I guess I send in copies ??? and hold on to the originals for the interview
Don't get it?

Should she seek the police certificate when she arrives in Thailand on Oct 8th or wait for a notice?

Same question regarding the vaccinations she needs (medical certificate)


Also There don't seem to be any record of her vaccinations.
She knows she some vaccinations... chicken pox etc.

Its my understanding that only my Thai wife who is immigrating must fill these out... Is that accurrate?

We are filing for a CR-1 visa so it is also my understanding that both parts are completed but part II is left unsigned

My fiance spoke to a tier2 today and was told 58 days!!! (where are they getting these numbers from?) If so that is not a 5 months processing time at all, I make that 7 months..  Add to that NVC, medical and a 2-3 month wait for London embassy interview and I am feeling pretty fed up right about now.

Ah right ok, my fiance called them last week and all they would say to him was that we are still within processing time and that was that. I can't see that VSC has even touched November yet, the time they have spent so far on October is a bit worrying...unless they have a push this month I don't see how they are going to remain within the 5 months stated. Also, is London still taking 2-3 months for interviews? If so does anyone know if it is possible to get an expedite on that part? Would that be down to the NVC or the Embassy?

I wouldn't have thought it would be much of an issue for the US citizen coming into the UK, more likely the other way around if there is going to be a problem...Besides they can hardly expect couples to not see each other for the whole length of the visa application process!!?... 5 months, 6 days and counting.. ClockWatch2.gif 

btw what is the whole 'month 0' nonsense about?

Did USCIS tell you that you would get NOA2 within the next 43 days?

Hello. I came to the UK in 2006 and February 2012 married my British husband. Throughout this time I've been in the UK under a student visa, but it expired 24 November 2012 and am now here as a visitor until 24 February when I go back to the States. I'm preparing to file the I-130 for my husband to go to the States, but am unsure where to send it. I see that if I'm classed as a 'legal resident' I can send it to London and it'll be processed faster. I can show that I've had valid UK Entry Clearance that I have/had permission from the UK Home Office to legally reside in the United Kingdom; and I can show that I have resided in the United Kingdom for at least six months from the date of arrival following approval of the UK Entry Clearance. I came here legally and can show my now expired visa, and the fact that I've been living here, but I'm unsure whether or not this is enough to classify me as a legal resident given the fact that I'm going back to the States at the end of February.

Can anyone tell me if I should file at the Embassy in London or if I should just send it to the US?

Hi all.

So I'm looking into the Police Certificate that my husband needs to get. He's from Birmingham England and moved to Scotland for university about 20 years ago. I understand that the ACRO will give him one for his entire life in the whole of the UK, however, I have a question on the Scottish portion. According to the ACRO website, Scotland isn't subject to the Step-down model of reporting. My husband had an 'admonishment of breach of the peace' about 6 years ago, does this mean that the record will still show this since it took place in Scotland and Scotland doesn't adhere to the Step-down model? Also, does anyone know if he is going to need to get court records for it? He spent a night in jail, but didn't go to court for it or anything.

Also, could somebody also confirm that he only needs to get one certificate and make a couple copies for himself and the medical? The Embassy website seems to say that if the original went to the NVC then it will be forwarded to the Embassy and he'll get it back although he's required to give them a copy at the medical. However, in my research, other VJ folk are talking about having multiple copies (for the medical and to send into the NVC). Just hoping for confirmation either way.

I was in the UK and I was allowed to add my British husband to my checking account there.  Then I got the people at the bank to type up a letter saying that we had a joint account.  When I got back to the States, I had an American credit card and my American bank let me add my husband onto the card without a SSN as long as I was willing to pay for anything he charged.  As soon as I got him a card in his name, I made him charge something in the UK (I'm in the States so it could have only been him).  I've got the bill showing that he used the card in the UK and that I've used the card in the US which shows co-mingling as well.

I am here to see what kind of support I can get. I am engaged to the love of my life we have set the date to be 08-08-13! We have a beautiful baby girl (well shes 2)
We met here in the stats when my love was here for a visit! he had a I-94. Ok he ended up Overstaying that. he went back to mexico on his own free will and was given the option to sign a voluntary departure which he did, he was told there would be a 5 year bar on re entry. well the thing is that i am going to mexico to marry him but then i have to come straight back the the states because i have Anxiety and depression(started after he left). We were told that we need to file a I-601 along with the I-130 and I-129

I would like to file all of these documents alone as to save money for our daughter.

What is some advise you can give me for filing alone and what should i include in the (proofs)

his family is in the USA - so if any one of them is a LPR or a USCitizen, then they can be a co-sponser for him. 

 

Ask around, about 'status', with the family who's house you moved out of. 

His Brother is currently Filing for his LPR here in Oregon. they Just squeese past the guidelines for there Family of 4.

Ok so I am the mommy of a beautiful baby girl. (she is 2) Her daddy went to mexico when i was 7 months pregnant to take care of some certificates he needed processed. He had never had issues with re admission. but he over stayed his i-94. so on July 4,2010 he was given the option to sign the voluntarily departure (not thinking he did) Now he has a 5 year bar, we are filing the I-130 but i have a problem. after he left i lost all my support he was my everything not to mention he was my financial stability (his family let us stay there and took care of us he did odd jobs for ppl ) after he left i had to leave his brothers place and i was forced to go on Temporary Assistance For Needy Families. Being 7 months Pregnant I couldn't find a Job and not to mention child care.  So I am STILL on assistance and looking for work. the thing is that i obviously cant count my income! and My mom is disabled so we cant count her income and i have nobody else to ask.  But i need hubby here is there any Ideas out there to get him a sponsor PLEASE help me

Ok a few days i posted about not having a sponcer for my husband but we have talked with my parents and they are planing to help me sponcer him.(household member support)  so the NEW question is 

My dads in come and my income is MORE then what we need (if combined) does my father have to make enough to Support All of his Dependents PLUS me my hubby and our daughter or is it ok if we just Combine the 2 incomes????

We just got a checklist for the Affidavit of Support because apparently we had our tax information wrong (or my dad did, since he had to co-sponsor, since my income is in Australia).  We sent it back in and are waiting to hear, and in the meantime gathering our documents for the IV Form and waiting to get the police check back.  

 

Is there anything else we should be preparing for in the meantime?  I'll work on the timeline.  I filled out a bit of it, but a lot of the abbreviations don't make sense to me.  I know that's horrible, but I think we're ok, as we're putting together our IV now.  

 

Is there a way to look at other people's timelines that file with your consulate (we're in Sydney).

Ok.  Getting ready to apply for a CR-1 visa for my Thai wife.  I have a question about the box where it says "last address outside the USA for more than one year".  I have been working as a contractor for the US military in Afghanistan from September 2008 until present.  During this time my legal residence has always been at my US address.  I use my US address on all my tax returns, my bank statements, my mortgage statements, credit card statements, etc.  I have only been physically present in the US for about three weeks each year for the past five years.  While working, I am physically present in Afghanistan,  and my other vacations have been spent in Thailand with my lady.  I have an APO(army post office) address for whatever particular military base I happen to be working at in Afghanistan.  Should I include my APO address in the G-325a form?  Even though my legal residence has always been in the US.

And did they ever tell you why they put you in ap or why it took so long! 11 months is too much.. dont they know that k1 is for people who are in love and want to be together. I dont understand at least they could have told him why they are putting him under ap that would relief some stress
