Hi everyone,

 

Just received our marriage certificate today, and I've started to translate it from Norwegian to English.

I was wondering if anyone have any feedback on the translation so far...?

(sorry for the poor quality, working on an 11" screen gives little room for photo-editing)

 

The top of the translated document says; "Translation of the document "Vigselsattest" from NORWEGIAN to ENGLISH"

I'm in a similar situation; wife is a USC, we've been married for 12 years and have 2 kids whoever are both USCs. I had a GC which I voluntarily surrendered on exactly 365 days having gone to work overseas knowing that I would not be returning to the US for a few years. I thought it would be a straightforward process to reapply for the GC. How wrong I was! I also assumed that at least there would be some concession for those with kids and a clearly bona fide marriage. My wife & kids are now back in the US for our youngest to start grade school and I also thought family separation might be taken into account... These not insignificant facts make absolutely zero difference. We've been advised to submit a request for assistance to our senator and to wait until all the docs needed for NOA2 are in hand before contacting the senator. A senator may be able to intervene and get your case expedited but there's no guarantee and I'm certainly not relying on this. I've also been knocked back on a B2 visa, but that's another story; I would say your wife is highly unlikely to get a tourist visa.

The whole process sucks and there seems to no way around it. I've gleaned a lot of invaluable info from VJ and you can too. And if you do have to be apart from your wife & kids, the best thing you and your wife can do is to not dwell on your situation and get on with life. At least with Skype you get to see and speak with each other when you want. I couldn't have imagined doing this pre-Internet...

I'm trying to get my husband over from the UK via the I-130.  I asked on VJ a couple weeks ago whether or not it'd be possible for him to visit since Brits don't need to obtain a visa to visit.  The general consensus was 'yes he can probably visit' (I've gotten emails from Brits who've gone back and forth a number of times since their I-130 began.  However, that is with the clear intent of the spouse going back within a specific amount of time and with significant ties to their home country.  For example, if my husband came to visit it would only be for a couple of weeks, and I'd make sure he had copies of the NOA1 (we're stuck in the backlog and are yet to get our NOA2) and such stating that we're in the process and waiting (since Feb) for him to come permanently in a legal manner.  I'd also have my husband bring a note from his work saying that he had to return to the UK by X date for work, and a copy of an apartment rental agreement which shows that he still has his place in the UK and therefore intends to return to his home country after the visit.  Oh, and he'd obviously have his return ticket to show.  We haven't tried yet though so I don't know if he'll get turned away at the boarder.  Thing is, you need to make sure that your spouse brings evidence of ties to their home country which indicate that they'll go back at the end of the visit (regardless of how long the visit is...I know that technically Brits can visit the US for 90 days before they need to get a visitor's visa) or they'll definitely deny entry.  It's a gamble either way, but if your wife and kids enter on a visitor's visa (but don't actually need to apply for one because of the country they're from), the officials need to be assured that they're not intending to move here before the visa process is complete.  If they're in question of whether or not your family is planning on staying, then the officers will deny entry.  That's what the general consensus has been for Brits tho...I'd assume it's similar for the Japanese.  Do you know anyone from Japan on here who's tried it?  Might be worth a search and a PM to find out.

Thank you so much.  That's cutting it really close, but it's really good to know.  When you said "providing there aren't any checklists" does that mean that it just takes a while to verify on their end or to put together on our end? 

 

(I know getting the English police check was a pain and I wish we knew we needed it before so we could have ordered it.  Is it ok to send in the rest while waiting for that to come through, or would that just confuse things?)

 

Are there more steps between the IV and the interview?

Yes, that's what we've done in the past... used the ESTA and visit on that.  The thing is, we're not sure when the interview will be, as it's right about the time we are thinking of travelling.  We're currently waiting on his police check from the UK in order to file the IV Form and for the approval of the stat dec.  Not exactly sure what the waiting time on that part is, but we'd love to have an idea of what we're doing and when the interview might be. 

 

Our lease requires three weeks notice, and we're happy to pay through when we return but we're hoping to move to a new place soon after we return so we don't want to sign a new lease.  With my husband as a stay at home dad and no coursework (he's graduating in December), I'm not sure what else to bring as "proof" other than my own teaching contract.

 

How long is the process once the IV has been filed ? I can't seem to find the timeline anywhere, but that might help in figuring out when the interview might be.

Thanks for that.  I would hate to spend $4,000 on tickets and planning only to get turned down.  Eek!  We're having the baby in November and hoping to bring the baby to meet my grandma / brother (neither of them can travel) in December / Janurary and then return for the start of the Australian school year.  It's just the only time that my family will get to meet their new (first) nephew.  It's hard enough to have a baby alone overseas, but the thought of not being able to have my family meet him while my husband's application is pending is heart-breaking!

 

We have lease papers, but it's month by month, and my husband is graduating from his Australian Uni in December and then going to be a stay at home dad.  I have a contract, but obviously I'm a citizen.  What have people experienced with this?  Do people get turned down at the US airport a lot?  Yikes!

Hi there,

 

My husband and I are currently in the process of applying for his green card.  We live in Sydney and will be interviewing at the Sydney US Embassy.  

However, we're about to have a baby, and we're not sure the green card will be processed in time.

 

Are we allowed to travel to the States and back while the visa is still processing?  I couldn't find any restrictions, but I"m not sure this would work... would he just apply for a tourist visa in the meantime?

Also, we haven't heard yet if the case has been succesfully transferred or that it's IN Sydney yet.  We just know that the NVC has moved it to Sydney and that Sydney will schedule it and let us know.  How do we check on it's travelling status?

 

How do we check the with the DoS Hotline for when they have/will open the file?

We have finished MOST doc intake at the NVC (we're missing two things, but they said to just bring them to the interview and that we've moved on to scheduling that). 

 

We called the NVC and talked to someone a few days ago (not a supervisor, but someone pretty helpful, regardless).  They told us to email the NVC and the Sydney embassy (which we've done), and that the scheduling is handled by Sydney.

 

Neither one seems to be very responsive, though, which is why we're a bit concerned.  I heard that you can only postpone your interview so much, and I'm not sure that we can postpone for that long.  

 

If only we had just stopped at the last step.... 

 

We'll give the NVC a call again to speak with a supervisor, but in the meantime, is there anything else we should be doing?  I fear that we've messed up our whole process...

Thanks for the link.  We'd read through that information, but it doesn't really cover where we are.

 

We've already been notified that we're in line for an interview, and we're waiting for that interview to be scheduled.  As I understand it, once they schedule you it's a different kind of situation.  We'll want to postpone for close to a year, and then travel for breif visit(s) within that year (so technically we're waiting for the interview to be scheduled).

 

I sent an email asking the NVC and the Sydney Consulate not to schedule the interview and to put our application on hold, but I'm not sure how that works or the logistics around that.  Does anyone know?

My husband and I have been frantically trying to put our packet together and we finally got an email telling us that we're in line to get an interview in Sydney.

 

The only thing is that prompted us to look at the expiration, and we didn't realise that we had to use the Immigrant visa and stay in the States within 6 months.

 

After all this, we're not quite ready to move from Australia.  We most likely will move permanently in about a year.  However, we're about to have our first baby born any day now, and we want to make sure we can visit the States to introduce the little baby to my 86 year old grandmother and my family.

 

Two questions:

 

1. Can we postpone our interview? If so, for how long?  We read somewhere that this is possible, but we're not sure how to go about it.

2. If we postpone, can we still travel to the States before the case is reopened and/or an interview is scheduled?  We'd only want to go for about a 2-3 week visit to introduce our little boy to the family.

3.  Is there anything else we should know about how these deadlines/etc.. might work? Have we completely messed up everything?!?

 

Any help would be greatly apprecaited.  Between being 38 weeks pregnant and trying to figure out a future immigration, things are a little stressful these days!

Hi all,

My wife and I currently have a CR-1 application pending.
We received our receipt on the 7th of August, so the process has now been underway for around 4 months.

I (beneficiary - Australian citizen) am currently in the USA visiting my wife on the visa waiver program. I arrived mid October to ensure that I would be here for the birth of our son in November.
As I can only stay here for 3 months, my time is almost up and I must return home at the end of December.

Naturally, my wife and I would prefer to spend as little time apart as possible.
My questions are...

If my wife and son were to come to Australia while the application is pending, is there a danger of this hindering the progress in any way?
Is there is any reason USCIS would require them to remain in America?
Does anyone advise against this visit? If so, why?

Any assistance would be greatly appreciated. Thank you in advance.

Hi all,

I (petitioner/sponsor) am currently in the process of filling out the I-864 for my husband (beneficiary/principal applicant) and have a few questions.

As I am not currently employed due to the recent birth of our first child, I will require the assistance of a co-sponsor. This being my father.

My understanding is that we are both required to fill out our own individual I-864 forms... Is this correct?

Secondly, we were intending on adding my step mother as a sponsor also. Given that her and my father live in the same household, is it correct that we can tie their income together?
Am I correct in assuming that she would be required to complete the I-864A?

For form I-864, Part 1., Items 1.d and 1.e, would my father say he is the only joint sponsor.... or that he is the first of two joint sponsors?
If my step mother were to complete a I-864A does this mean she is considered as a 'joint-sponsor'?

This also creates confusion for me regarding Part 3, item 1 and how to answer that.

Any help will be greatly appreciated.

I know you might heard this many times already, but i would strongly advise NOT TO HIRE A LAWYER.

Me and my husband  are suffering the consequence of hiring the  immigration attorney right at this moment.

As you are , we did not want to deal with paperwork and thought that hiring someone who knows the process the best would be the best option to go.

We met while working in Afghanistan on US Airbase. After almost 2 years of dating decided to get married. Being overseas we wanted to have someone knowledgeable to deal with our case. So here we are researching for the BEST immigration law firm in the States. Here it comes Carl Shusterman's Immigration Firm. We called them and hired them to be our lawyers.

Guess what.....they suck. It just slowed down our process. I did not know about visa journey forum that time, being naïve thought that one of the best attorney firms will do it all.

Law firms don't get the sense of urgency. We had to keep emailing/calling to ensure our paperwork was sent out to USCIS.

After some research I found this website. After going through many posts I realized that our lawyers filed our forms only, without attaching any evidence of our relationship. They did not tell us a word about evidence part but again thinking they should know the best I did not pay attention to it.

Today, after waiting for 8 months since our NOA1, I got this "Request For Evidence" email. I have this feeling this will be the request for the evidence of our relationship. This all could be avoided if we did more research and filed our paperwork on our own. At this point we are thinking of firing our lawyer and move forward on our own.

During this 8 month they never called to USCIS to get the status of our case, I been following all the forums and keeping track on all news and movements.

Please do not repeat our mistake, get all info you can and do It yourself.

My Thai wife and I are I130 CR1 August filers.  She informed me today that she wants to change her first name for good luck.  I told her that this is a bad idea while our I130 application is pending.  I said she should wait until after she gets her visa, but she really wants to change her first name now.  Does anyone on the group have any thoughts on this subject?  Do you know of anyone who has changed their first name while their I130 application is pending?  I would appreciate any of your thoughts or experiences.  Thank you.

The reason I had to file for an extension is because my accountant said I need an ITIN(individual taxpayer identification number) for my wife.  According to the IRS it will take at least 8-10 weeks for us to get ITIN after they receive our W-7 form.  I really don't want to wait 2-3 months to file my I864.

I had to file for an extension on my 2013 tax return so I will not be able to send IRS tax transcript for 2013 with my I864.  Will it be ok to send my 2013 W2's along with my form I used to file an extension?  I will also be sending 2011 and 2012 tax transcripts plus employment letter and 6 months of pay stubs.  Your advice is greatly appreciated.

Most of your questions have been answered but I just wanted to say that you guys can do it. As hard as it seems, try not to focus on being apart but focus on the future and the fact that you will be together after this process. Also, I believe you can visit your wife so use that to your advantage. Visiting will serve as evidence in the form of itineraries and it will give you a chance to be with her again for a short while. Good luck with beginning the process!!

Well after several days and several repeated posts about the liars and cheats in MENA who use women for green cards, I've decided maybe I am really just being used for a green card too! So I will be divorcing my husband and spamming the board from this point on with my tragic story. I know it comes as a shock to those that know me here for the last year, but obviously my eyes have been closed all this time and I just didn't know. How silly of me!

well, again as I said before in maybe this thread, maybe another, I am not particularly interested in bashing Arab men. Yes theirs is a different culture than mine, but guess what? this entire site would not exist if multi cultural relationships were impossible. they can and do work beautifully every single day and month and year. I am enriched by my contact with my husbands cultural differences as he is by mine and we've had a great time integrating it all into our own personal melting pot. Sure we've had some troubles in the first years of our marriage but I think if you take an honest poll of marriages, leaving any cross cultural differences out of it, most people will say that the first year or two of marriage is difficult! Its a LOT Of adjusting, ESPECIALLY if you add in immigration #######. No, I am not blind to the fact that immigration fraud can and does occur. Divorces occur. Lying and cheating occurs. But its not the focus of this forum, at least it shouldnt be. Yeah, everyone should pay attention to any warning signs and not wear blinders, but thats true in any relationship.
I for one fell certain that IF my marriage were to ever end, I would be heartbroken and everything that goes along with it but I would not immediately decide it was immigration fraud.

Furthermore, I think if anyone wants to look at the recent examples on THIS board, we have no reason to believe that Jackie's problems are immigration related, they were married 5 years and he's had his green card for a long time so until we hear it from her we dont need to conclude that this was a 'fraud' situation at all.

Anyway honestly I think there should be a law that if you become an american through another american and get your papers that you should then not be alloud to marry a women from your country and bring her here.

Really this goes for women and men if you obtain your paper through marriage and then become divorce you should not be able to bring another alien here.

It's an estimate on when your petition will be adjudicated by USCIS...the petition will either be approved, denied, or the adjudicator will issue an RFE (request for further evidence).

When you fill in the time line and it gives you an estimate for your case, what does it mean by "adjudicated"?

In my case it says "we estimate your case will be adjudicated between April 1st and April 15th"

...does this mean decision passed by USCIS and therefore NOA2, or the final interview???

Im still new and therefore very impatient!!! Xxx

When I read the 130 form, it referenced using the 129f form in order to get my wife to the USA while the 130 is pending.

Is this now the incorrect procedure?

My scenario is as I've described. I am not aware of anything that could complicate the process.

You say, "interview in the Phillipines instead of Canada?" Wow!...now that sounds complicated due to travel and timing.

Must do some more research but I will read what you've recommended.

Where are you seeing reference to the I-129F form within the I-130?

The I-129F is used for the K-1 fiancé(e) petition process. As mentioned upthread, the K-3 visa is obsolete, so there is really only the IR-1/CR-1 option for you since you two are already married.

Hello All....

This is my scenario...

I am an American citizen by birth (born and raised in the USA).

I recently married my girlfriend who resides in Canada.

She is there on an open work permit.

Her citizenship is from the Phillipines.

As easy as it sounds, completing government documentation can have it's complexities and as such, I want to do it right the first time.

I am filing the I-130 and I-129f and G325 forms in order to get her here so we can commence with our future.

The forms are self explanatory and quite easy to complete.

My question is....

"should I hire a lawyer or paralegal to review my docs, or should I complete the docs and meet with an immigration officer and have them review the docs?"

Seems simple enough....right?

The forms you listed are for the K-3, which is essentially obsolete at this point. You should read the guide on the IR-1/CR-1, which is just the I-130 and G-325a: http://www.visajourn...tent/i130guide1

If you can read through the guide, the sample forms, and ask any questions you have on VJ, you should be able to do everything on your own without hiring an attorney. Unless there's something more complex about your situation that you haven't included, you should be OK. :thumbs:

Hello everyone,

Just reading through the I-864 to make sure I have all the info required and in section 6 and 7 it starts to question around income and savings and tax returns etc. Now here is the confusing part, both myself and my wife (the petitioner) are employed in Ireland at present and have quite a good amount in savings but I am unsure what information to submit and on which parts. Does anybody know if I put our current employment and salaries in section 6 and convert the salary value from € to $? And leading on from that the latter part of section 6 (Q25) requires Federal Tax Return information that relates to present employment, that's if I understand it correctly. You say wife, but have K-1 listed as the visa type. The K-1 is for fiancé(e)s. If you're already married, you should post your question -- or ask to have this post moved -- in the CR-1/IR-1 forum. :thumbs:

According to the guy we hired to help with the paperwork, we can file for a fiancé visa even though we're already married. He's legit and came highly recommended, so I believed him and that's what we did. Not necessarily. The acceptance phase means your petition was received and the payment was processed. It is possible to receive a denial at that point if documentation is missing, but that doesn't mean they catch everything.

Unfortunately, the person you hired steered you in the wrong direction. I'm not sure why he would recommend you file a petition that is for unmarried people. If this person was intending you file for a K-3 visa where you would need to file both the I-130 and I-129F, then they aren't too knowledgable since that visa is essentially obsolete these days. You should read the guides on this site to become more familiar with the process so you can ask informed questions of this person to ensure they're steering you in the right direction.

In the meantime, wait for the RFE details to arrive to know exactly what they want.

Your signature notes you also filed an I-130. Did you file with the intention of receiving the K-3 visa?

I'm hoping someone here can help me out. My wife and I have filed a petition for a K-1 visa. Although we're already legally married, I was told that it's easier that way (shorter wait time) than filing for a CR-1 visa. Anyhow, along with all the other paperwork, I included our marriage certificate, the translation of the marriage certificate, as well as our son's documents (birth certificate, translation of birth certificate, report of foreign birth abroad from the U.S. Embassy, U.S. passport).

I checked the USCIS website today for a status update and learned a "Request for Evidence" was mailed to me on July 9th. I haven't received it yet, so I don't know what it is they are requesting. I'm currently in Afghanistan, so when my parents get it in the mail, the will scan the document and email it to me.

Should my wife and I be concerned about this request? I can't imagine what more they could possibly want from us. Does anyone here know the type of information they may be looking for, and will it be easy to appease them? Being in Afghanistan makes it difficult to get the simplest of things accomplished, and the visa process is long enough as it is without everything being placed on hold while some guy in a cubical wants more "evidence." Frustrating, to say the least.
