First, a quick check on semantics:
Petitioner = Person who filed the I-129F petition and provides the I-134 and its supporting documentation to...

Beneficiary/Visa Applicant = Person applying for the K-1 visa, who will attend the medical at Knightsbridge and be interviewed at the U.S. Embassy in London

You can download the forms and complete them from the embassy website. There isn't a formal "packet" of forms sent. You'll just receive a letter with the same web address telling you to download the forms, complete them, and mail them back in.

Again, I highly recommend visiting the K1: NOA2 to Interview thread in the UK forum so you can be as prepared as possible. :thumbs:

(Yes, it's a huge thread, but it's filled with a lot of great information that tends to get asked repeatedly, so it's worth reading.) In addition to needing your LND to book the medical, you will also need passport-sized photos and a copy of your police certificate to take to Knightsbridge.

Hi - We have been approved at USCIS and the case is with NVC at the moment. I am keen to get the medical done and dusted but have no details on where to get this done.

Where / when do I find out this information?

Help appreciated!

Marriage license requirements vary by state and even by county within a state so what I did in Oregon may vary from what's done in New Jersey. Click on the "find a county" link in my signature to find the county website where you're planning to be married in NJ. From there, you'll be able to look up (or call) the department that issues marriage licenses to learn the specifics. Good luck!

 

Edit: You don't have to take his last name, that's completely up to you. If you want to change it later, you'll just need to follow the state details on changing one's name due to marriage.

It was accepted because the payment was processed, but the processing center doesn't adjudicate the petition package. If you're lucky it will be five months. Many folks going through the petition process now have been waiting for 8+ months for their petition to be reviewed.

Hello everybody!!

 

 

Soon is gonna be 5 months since we received NOA1. Seems that the estimate gets shorter everyday! How accurate is that? Did it work for you guys?

I check my case status at least 5 times a day. From which one I`ll hear first? Mail to my fiancé or the USCIS website?

Another question...when we filled for my K1 unfortunately  we didn`t know yet about the Visajourney, so we follow the instructions on the website USCIS, we sent the form with the payment only, we thought that they would ask for evidences and documents right after, but the only thing that we know is that they accepted the case. What might happen?

First, checking the USCIS website that frequently will only drive you mad. Throughout this journey, there will be many times where things are out of your control -- this is one of them.

 

On only sending the K-1 and payment...at best, you'll receive an RFE and will have an opportunity to send in the remaining documentation. At worst, you'll receive a denial. You won't know until you receive documentation in the mail from USCIS stating which it will be. At this stage, instead of checking the USCIS website, gather up the documentation you left out, which includes things you'll need from the beneficiary, and hope for an RFE.

Feeling lost. I know people who got married on tourist visa or even with tourist visa expired. I need to know my options. It's a sad day for me but was kind of expected. It's so unfair to us to have to go through all this pressure. Me for example, I might have lost 3 kg, I'm not sleeping well for the past 2 weeks waiting for the answer which wasn't good and now we don't know which direction take to make it less painful as it is already.

 

Your options have already been outlined in this thread -- opt to refile the fiancé(e) petition and go the K-1 route, or get married and file the spousal petition for the CR-1 visa. Unfortunately, you've learned what can occur if the instructions aren't followed correctly. It's a setback, but in the grand scheme, if you want to be together, you'll review your options and move forward. Many of us have had to endure months or more being apart from our loved ones. In the end, it's worth it. :thumbs:

I agree with Harpa, decide where you want to get married and then prepare accordingly. Whether you refile the K-1 or get married and start the spousal petition journey, there will be time apart while waiting for the petition to be approved, the interview stage, etc.

An ad hominem attack on me doesn't invalidate the point.  The standard USCIS and DOS use to determine eligibility is whether the couple is free to marry in the petitioner's state.  And having done quite a bit of research on these forums, I've seen more people say they DIDN'T have a problem with this than those who DID. And nearly universally, the ones that DID have a problem were in India or West Africa.  And in those countries, the couple ran afoul of the LEGAL requirement to be free to wed - because the ceremonies they engaged in carried an unintentional legal consequence.

 

And you know what?  I agree with the "safer rather than sorry" mentality.  But what I'm fighting against here is the idea that there's superstitious voodoo causing denials on a whim.  In the vast majority of cases, it's not C.O, malevolence creating denials - it's inadvertent violations of the rules.  I feel this community is more helpful if people are guided by *facts* and a clear knowledge of the requirements of the process, and not instilling an unneeded fear of the boogie-man.

 

Nothing in anything I write is meant to be of any offense or belittle anyone - but if my interpretation of things doesn't jive with yours, perhaps you might step off the ad hominem attack and instead address the facts I lay down?  I think the DOS web site, USCIS web site, an interview with a USCIS executive and an email from an embassy C.O. create a powerful case for my point.

I'm quoting your post so now you'll know that I'm addressing you. My earlier post was not specifically addressing your situation. However, many of the people who feel it's OK to run the risk tend to be those who either haven't attended the K-1 interview and/or have yet to arrive in the U.S. They tend to think inside their vacuum that all's well and not care about what the next person may do. Those who have been on VJ for a few years have seen those attempting their luck when ultimately, they have no control over how the CO or CBP officer decides. The stance taken is that everyone is trying to enter the country and they'll lie if they can. The beneficiary's goal is to prove otherwise. Thus, why further complicate things by introducing something that can be read as if you're not free to marry?

 

I'm not sure why you're so upset, but perhaps my words (or those of others who have posted similar words as mine) hit a nerve. *shrugs*

 

It's not a bogeyman or voodoo when there are specific posts, including one from a couple who wasn't from Africa or India who was turned away at LAX because the CBP thought she was already married and attempting to enter on the K-1. Most people on VJ want others to succeed through this journey, which is why the resounding advice is to not do anything that has "wedding" in it until one is in the U.S.

 

There are so many hurdles to jump over for the next few years. Don't start with one that's 60 feet high and enflamed. Good luck on your journey.

Folks like TBone have been on VJ for some time and have seen plenty of instances of people shooting themselves in the proverbial foot as they attempt to game the system. What works for even 10 people on VJ is not indicative of what may work for the 11th person who tries it.

wow didn't even notice that the embassy was wrong on timeline, corrected it now though. also thanks for the reply. lets just hope that someone whos had there interview can shed a little more light on if i should send them or not, i have the affidavit and my fiancee's tax returns, but like i said, not sure if i should send with the printed paper work or hold onto them until the interview

 

I highly recommend reading through the thread that UK-USA-K1 linked you to, especially the first 10 or so posts. You only send in the DS forms to the embassy. Supporting documentation, the affidavit of support, etc. should be in your folder when you arrive at the embassy for your interview.

I just posted off the various documents to th embassy including the DS-156. On question 14 of the DS-156 the form asks for my national identification number (if applicable)....I filled in my national issurance number, but have now just read on here that I should I have left Q14 blank. Will I have to re-submit the form?

My interview is on a Monday so we're probably expecting the visa to arrive on 1st July as that's the following Monday then I suppose. I guess I'll book the flight the day it comes! Haha! Of course this is all dependent on how well the interview goes! Thanks guys!

 

In our case, we were just aiming to have him in the U.S. before Thanksgiving since he's never experienced that holiday. He received the delivery on October 31 and while we were on Skype that day, we booked the flight. :thumbs:

I have no dog in this fight so don't care what you do one way or the other. But if you think you are not cheating the system, you are deluding us or perhaps yourself. You and your fiancee signed a letter of intent that says you will marry within 90 days, not that you will see how it goes when you live together. Now some people do get together and change their minds or something happens within the 90 days but this does not seem to be the case here. You filed with the intention to live together before marriage. I'm no immigration lawyer but it sounds fraudulent to me.

 

And people are pissed because the K1 process is long and hard for precisely these sort of reasons - that some people try to circumvent the system.

 

Maybe I'm misunderstanding you but the more you post the clearer it appears that your methodology is not within the spirit of the K1.

 

Just sayin'...

 

I haven't done any cheating of the system though, we still have time to get married.  If you want to criticize me for taking risky measures to live with my girlfriend, that's fine.

your money is a bank account is not enough. my sweetheart which is my current husband right now has more than 15,000$ in his bank account plus his assets. so generally, I passed a record of his saving from bank account and copy of his assets that is convertible to money, such as title of cars under his name. I also took with me his tax transcript in the interview and everything went smooth plus a lot of prayers :).

those 18,000$ should be in you bank account. CO likes to see that written in a paper and don't forget to get a statement from one of the bankers or official from your bank account in case you made that money in a short period of time and send it to your sweetheart. You need to get a co-sponsor but if your sweetheart is from Philippines, I'm not sure if they want to see a co-sponsor because from what I know the US embassy in Philippines don't accept a co-sponsor. My husband wanted to do that before but he didn't. If you wanna try to get a co-sponsor it's up to you, you don't have to take my words for that.

Hello, 

 

I'm currently a law school student and I'm starting an unpaid internship next week so I don't have enough money to show I can support my fiance right now. My fiance is planning on being the provider for at least the first couple years of our marriage. I'm going to have my mom be a co-sponser, but I have some questions about it and any help would be great. 

 

(1) Do I need to fill out a I-134 in addition to my mother's I-134, despite the fact I have pretty much nothing? No pay stubs, very few assets, no business, etc. 

 

(2) Does South Korea consider applications with a co-sponser?

 

(3) I think I will write on my mom's I-134's "relationship to beneficiary" box, "future son-in-law"--> does this work?

I'm getting ready to send in my I-129F. I'm definitely front-loading since my fiance is Ecuadorian and we'll be going through the Guayaquil consulate. Thanks to all who have forged the path before me, and left great advice and warnings!

Here's what I have:

- G-1145
- Payment of $340
- I-129F
- I-129F Supplement: Part B, Question 18, explanation of meeting in person
- My G-325A + signed, dated supplements
- My passport style photo
- His G-325A + signed, dated supplement
- His passport style photo
- Copy of my birth certificate, front and back (back is blank, so I noted that on the blank page I copied)
- My letter of intent to marry
- His letter of intent to marry
- Proof of having met in person in the past two years:
- Boarding passes from most recent trip (November 2012)
- Passport pages from most recent trip (this will overlap with some of the passport pages in the "proof of ongoing relationship" section, but I wanted to make things as easy as possible for them to reference)
- Boarding passes from two flights we took together within Ecuador
- Hotel receipts and translations
- Bank statement showing ATM withdrawal in Ecuador
- Proof of ongoing relationship:
- Header page summarizing all trips to Ecuador and noting which passport page the entry/exit stamps can be found on

Maybe I am worrying too much, but how exactly are you organizing all of this within the packet you send to the USCIS office? A folder? Loose papers in the correct order? Everything stapled together? I'm having nightmares that they'll throw out my application if they see I made a mistake in the formatting!

I am working on the G-325A forms for myself and my fiancé. On the top it's asking me to fill out "File Number" and starts with the letter A. I'm confused about what this is––it seems to me that we don't have file numbers yet as we haven't submitted the petition. Can anyone shed some light on this?

If your father will sponsor your fiancé, then you would only need to send the I-134 form that he completed and signed along with the supporting documents such as paystubs, tax transcripts, etc.

Get thee to the K1: Post-NOA2 to Interview thread to start preparing what you'll need to send to your fiancé. Also, there are a number of items your fiancé can start moving forward on, namely securing the police certificate, the long-form birth certificate, and any vaccinations from their GP in advance of the Knightsbridge exam.

You would only need the completed I-134 form and supporting documents (e.g. paystubs, tax transcripts, etc.) from the co-sponsor. Your fiancé would not need to fill out the I-134.

... I would caution about a power point unless you print it, media is not accepted (CD's, DVD'd or USB's. In your petition it asks if you have been married and this is sufficant with the letter of intent. USCIS and the NVC will do background checks for the USC and a police certificate will be needed at the interview by your fiancee. Good luck!!! :thumbs:


To clarify, yes, if you opt to paste digital photos into Word, PowerPoint, etc., then yes, you will have to print it out and include with the petition package. :thumbs:

Hello again! You guys were so much help before and i got everything ready to go but came to a snag so i'm all ready to file and get this going i just have a few last minute questions about what i need to do :)

First off- When we send the "proof" of relationship ie. my phone records, can i black out all the numbers that aren't his? My parents, friends, and colleagues really don't need to have their numbers mailed out in my opinion.


I wouldn't recommend it. It would raise suspicion more than serving to protect anything.

Secondly- do we send photocopies of the pictures first and bring originals, or should i go to walmart and make copies of all my photos? They were taken on a phone and printed off the computer though i'm sure many people do this, i'm just curious about the correct procedure.


You can either make copies of the photos at a Walgreens, etc., or you can put them into into a Word doc or PowerPoint presentation with the date and location information. If you go the route of making prints, just be sure to secure them in a baggy so they aren't lost.

third- I've read through the step by step guide a thousand times and steps 12-14 do not apply to our situation, should i state somewhere, maybe in the cover letter, that neither of us have been married/ divorced/ convicted of any crimes? or will they figure that out through the other forms (biographic information and such?)

If you've never been married, then the letter of intent will be all you need to confirm that you are free to marry.
