No, just if you click back into the place where it says ds261 completed. So don't do that. You can look at the fees section as often as you want. But you will probably get an email just before it's ready for you to pay the IV fee.

i am filling form DS261, this is asking for beneficiary ID no, while i have IIN and case number and i didnt receice any email instruction from NVC, Shall i put my case number in it or get BIN from NVC. By the way i didnt receive NOA2 hardcopy and now no instruction in my email for ds261. shall i be worry for these things
 
I  just login in ceac website and it showing to start ds 261 application. Please advice.

Yes, it's probably best to wait until you get the email from NVC, which includes the beneficiary id. Some people (like me) have had the ds261 suddenly show as "incomplete" if they fill it in before getting the email. It put me back over 2 weeks. You should get the email within a day or two.

Hi all, 
 
I recently had NOA2 by USCIS and I am working on the NVC process, and specifically the Affidavit of Support.
 
My spouse is a USC, and we all live in France with our newborn kid.
The kid was born in France, but will be a USC as my spouse meets the requirements to give him the US nationality (= she has lived enough in the US before her 16th birthday and other things...).
He will have a US passport soon.
 
My spouse doesn't work in the US (we live in France), and she did not work the last 3 years because we were living abroad (I was expat). Therefore she doesn't have IRS documentation.
We will have a member of her family to be our unique JOINT sponsor.
 
 
I have some questions regarding the Affidavits of Support, thanks a lot for your help ! 












 
Regarding forms I-864

1- AOS for the SPONSOR (my spouse)

QUESTION: does she has to say she will sponsor our kid ?


No, she doesn't have to sponsor your child. But in the section where it says "individuals not sponsored, she will add herself and the child, making a total of 3 in her household.

2- AOS for the JOINT-SPONSOR

QUESTION: does he has to put that he will sponsor my spouse + the kid who are both US citizens... living aborad ?


Again, he doesn't have to sponsor anyone who is a USC. He shouldn't even have to list them as "not sponsored"

1- "FAMILY INFORMATION" part

Following this link instructions, I answered "NO" to the 2 questions asking if she will immigrate with me.

I also will put "NO" to the same 2 questions for the kid.

2- "PREVIOUS TRAVEL INFORMATION"

I received a letter from USCIS telling me they issued an Alien Registartion Number, but:

a- It could be one of these administrative bugs

b- I DON'T have this number (or it is the Bebeficiary ID Number ?)

 

Psl confirm that it is OK to put "NO" at the question about the issue of the Alien#


It is ok. You won't be issued the ARN until you get your visa.

From what I understand, you go through the whole process and then wait to get a denial at your interview to file the waiver.

But we on VJ are not really qualified to help with waivers. You're best to get a lawyer for that part of the process.

Either way, the waiver gets filed after a denial at the interview. Until then, there's nothing to get a waiver for, officially.

Actually, I think you can make it last even longer. You don't need to actually submit anything, just have some contact with them, saying that you're not ready to submit, or something... I think you could keep the file active indefinitely.

I don't really know how you'd go about canceling; I'm sure there's a protocol, but you can keep your application active but unfinished more or less indefinitely at the NVC stage as long as you have some kind of communication with them once a year. Your petition would remain in limbo at that stage for pretty much as long as you might want, and then if you ever do decide to immigrate you would be halfway through the process already.

No, I didn't.  I haven't done taxes in the US for a while because all my income has been foreign for quite some time.  I'm not sure if that's legal, but I can't afford to pay taxes on my income in two countries.  I'd have no money left :(  This income will not continue when I relocate back to the US.

Not filing tax returns is a problem, yes.  File the tax return.  The first $97,000 and change of foreign income is exempt from tax but you are not exempt from filing a return.  You file an extra form to claim the foreign income exclusion.

 

Yes, pushbrk is absolutely right. File your taxes. Speaking from experience (finally got the USC hubby back into the IRS' good books!), depending on how long it's been, there's even a special "Streamlined Filing for Non-resident Nonfilers" that you could check out on the IRS website.

 

The only other hassle really is if any of your foreign income is from self-employment, in which case you definitely want to get a good accountant who's aware of the tax treaties between the country where you live and the US, or else you will wind up paying twice. (Gave me a bit of a heart attack when I tried to use turbotax to do his US taxes)

You as the petitioner must fill in an i864.

Your i864/a will not be sufficient by itself, since you are unemployed (unless you get a new job)

So,

You will have to find a joint sponsor who fulfills the financial qualifications.

That person will also fill in an I 864.

You will submit both i864s to NVC.

As far as filing taxes, check the IRS website for the "streamlined program" for getting up to date with taxes. As someone said, US taxes are based on citizenship not residency, so she will have to file back taxes (for 3 years with the streamlined process).
It should be pretty straightforward, and she can claim the foreign income waiver, so she shouldn't owe anything. But in the next stage of the process, she will have to submit tax returns or transcripts, so she should file now to give them time to process.

As far as the address, TBD is fine for now, but it would be a good idea to decide on a city and maybe book a trip for her to find a place or at least get a mailbox somewhere in that city to list on your later paperwork.

You know it's a double edge sword for us all....

The people whom are coming from the VCS might be processed a bit faster.....

However the people who were already at the CSC might take a bit longer since the work load was increased.

I had gotten three touches this month.. I was getting excited.... then the transfers came from VSC and nothing since..

Don't get me wrong I am happy for anyone who gets there cases finished... I just hope it doesn't change the CSC in to a office like the VSC and we all suffer a slowdown..

..... As a reference I was looking at the left side of my profile page where it had the "time line" link where you can click on and see an estimate of where your file should be finished. Of course that date changes with everyone filling out there time-lines too. So over the course of last week I saw it get farther away.. that is where I got it from. Yes I know that that date is not used by USCIS, however it's an estimate, that like your self most (not all) people look at for an end.

..... On that note.. Congratulations to MsZ for getting her approval today she was Moved to California 8/6. Acknowledged as received on 8/9. Touched 8/11, 8/12 and 8/15, 8/20, 8/25, NOA2/approved by CSC 8/26. good.gif

..... I AM happy for everyone who gets approves.. I never asked for anyone to feel sorry for me nor any sympathy .. (if you do, well then, thank you.. I will do the same for many other people here).

The reason I waited to file is that I moved back here to the U.S. from Japan to helped start up a new Advertising firm. My wife and I wanted to wait to be sure it would not fail. Also, so that I had a good income for the I-864 AOS.

So after I / we felt the company was doing well and my income was where it should be for my position in the company. I / we filed our I-130.

I know I should not feel this way but.......


This month on the 8th, the 9th and then the 12th. I got some touches, I checked my VJ 'time line' on my profile and it was saying that I should be approved by Sept. 28 - Oct 10th 2008 Needless to say I was happy and content thinking it would not be much longer...

Now since all the transfers from the VSC office to the CSC office my VJ 'time line had my approval date as March 2009.... so that just added 6 more months since all the transfers..

Please don't get me wrong... I am in no way mad at you the other filers... I am frustrated with this system and how slow it is.. I read the post from the ex-immigration worker (some of you I'm sure read, if not click here.) that a typical I-130 form takes about 15-20 min to approve.. so why is VSC so slow..

Is it all the FBI background checks? Communications with foreign country's? or just not enough employees?

I said it before and I'll say it again... I would be willing to pay a higher fee for them to higher more people or I would be willing to pay a "rush" fee to get this done faster...

Would anyone else be willing to pay more for a 'rush' or higher fees so they could hire more people? Or what about this.. Heir people whom have gone through the process them self. Maybe things would move a bit faster..

Nothing of lately here,,,

I was getting excited seeing that I had three touched last week, and was checking the I-130 spreadsheet of other California I-130 fliers and seeing that we were next in line to get our I-130 approved (maybe wishful thinking), but all we got so far was passed up..

So disappointment has started again.. Although we are trying to keep our chins up. "Soon it will happen" we keep telling each other. Still with the frustration in our voices that anyone listening in can hear we talk about other things like news family and the Olympics. Checking how her country is doing and mine too. Asking 'Who are you going to cheer for during this or that event?' when one from each others country is competing against each other.

Still when the call comes to an end, the sadness and reality return and we hope for another touch and the approval will come soon...

Go Japan, Go U.S.

California office:

I-129F = Jan. 17th 2008
I-130 = Jan. 17th 2008


Vermont Office:

I-129F = Jan. 17th 2008
I-130 = Jan. 17th 2008

Funny they are the same dates. The employees must work at the same pace... ha ha...

Hello all,

I just lodged on to this site and joined in mid June. I hope to find some hope here in this long and confusing process and time.

I was living and working in Japan got married on 03/27/06 and moved back to the US and got a good job as to support my wife, (also for the I-864 form A.O.S.) and filed my I-130 this month, they received it June 15th. You should be able to check my time line..

I hope the wait is not as long as some places I've read. I have read from other web places that it can take 2+ years to be with my wife again..

I have some photos of us posted and would like to see some of the June Filers too..

SO... If the USICS is worried about fake marriage why is it a shorter process to do the fiancée process vs. the "We are already married" I-130 process.

However after reading this forum, would it or why is it faster with the I-129F..?

On the down side of the I-129F visa... Is it true that once your spouse gets that visa (I-129F) that they can not leave the U.S. for about 2 years?

Why would the I-129F be faster over the I-130..?

I-129F Fiancée visa - so he/she gets a visa and they come to the U.S. and then the marriage takes place..

I-130 - Marriage took place outside the U.S. and you want to bring your Husband / Wife home with you..


SO... If the USICS is worried about fake marriage why is it a shorter process to do the fiancée process vs. the "We are already married" I-130 process.

Myself, My wife and I met in Japan while I was working there, and we got married their over two years ago and now I moved back to the U.S., got a job and filed for the I-130 and have everything ready for the I-864 A.O.S. However after reading this forum, would it or why is it faster with the I-129F..?

On the down side of the I-129F visa... Is it true that once your spouse gets that visa (I-129F) that they can not leave the U.S. for about 2 years?

Just curious,

If you file the I-130 then also send in the I-129F would not that take longer since the office would have to do more background check, more paper work and would it slow down the system for everyone?

I have been looking at the time line from the USICS website Processing Dates; and the I-130 and I-129F are about the same dates.. As of today 07/14/2008 the California service center are at December 2007 for both I-130 and I-129F

So if there were less forms for them (USICS) to go thru, wouldn't it go faster for everyone?

Hi guys,

 

We're in the process of gathering documents for the NVC stage, and I just received my police certificate in the mail. To my surprise I had a speeding ticket from 2005 mentioned on the certificate, but after a few minutes I remembered why it was there. I appealed the cased in order to try to lower my fine, cause it was a ridiculous amount, and for me who was a student at the time, it was too much. I went to court and asked if I could get some slack, but it was a no go and I had to pay the fine. It was either pay the fine or alternatively spend a few weeks in prison, and I did not want to go to prison.

 

Now my question is, and I can already guess the answer, would I need to acquire the court documents for this specific case since its on my police certificate?

 

And also, I know that on the DS-260 it asks about convictions and criminal records, I guess I would have to answer yes to this question due to it being on my record?
