Unfortunately, I seems that those applicants who got caught in the middle of the IMBRA debacle are not getting processed while more recent applicants are. That really sucks. I'm sorry for you on that.

I have no idea where you got that information. There is no evidence that anyone is being processed at this moment. In fact there is evidence that until all the IMBRA RFEs are complete, that CSC is not processing anything.

Anyone that used the new form (available after Jun 15th, I think) should not get a IMBRA RFE. The form was modified to account for the new requirements.



Sorry. I should have been more clear. There have been at least a few NOA2's from VSC that were newer applicants (see Gomez - I believe June 30th), while others that applied back in March haven't gotten their NOA2.

I know I've seen at least a few people post from CSC post IMBRA that have been approved.

NOA2 Approval on 7/25/2006! Haven't received it in the mail yet, but got the email and uscis.gov shows the approval! Pretty strange that is is to soon since their website says they are processing apps from March 6 and mine went in on June 9.... I'm not complaining!

Steven and Jinky, the answers I've been getting is that until they start processing the form they won't send an RFE. For those who were approved and had to come back they've been processed.

Keep up with the processing dates on the website but I wouldn't expect any real news for up to 120 days or so.



120 days? My God - there's been CSC applicants with June NOA1's that received their IMBRA RFE's already. I understand that everything went topsy-turvy as they expedited those with RFE's filled out and returned, but if there was any organizational methods involved, I would assume my file would be in a pile of all petitions filed that day (June 14th), yes?

It's like they jumped forward with some applicants ahead of the earlier one's (March/April) but stopped at some point to go back to the older petitions and putting all June and later ones on hold. This is making me go nuckin' futz. :wacko:

If not, please please please:

1) Find your senator or congressman’s website.
2) Go to the section for Constituent Services.
3) Download the privacy form.
4) Fill out all the relevant case information.
5) FAX it to their office.
6) Call to follow up. Find out the name of the specific person assigned to your case and get their direct phone number.

If your senator doesn’t have a privacy form on the website, call them directly.

Should I go ahead and contact my Senator also? My NOA1 is dated June 14th (I mailed it May 30th so it was the pre-IMBRA form). My case has not been touched and when I called to request a new RFE to be mailed, I was told none was ever sent. The person couldn't answer whether they have mailed off all IMBRA RFE's but I remember reading some of the threads that stated USCIS was going to have all IMBRA RFE's mailed off by the end of June. I'm wondering if they decided (assumed) that any application after the new form became available would not need IMBRA RFE, so now I'm in limbo? I'm just not sure when it's time to take action.

I just talked to Congressman Bill Thomas' office (specifically Bonnie Fagan who is his immigration case worker). She informed me that they had faxed a letter to CSC late wednesday (with congressman's signature on) asking why our petition had not been approved and asked that CSC respond with the reason for delay. Considering that CSC picked up the fax thursday morning, then on Friday we got touched for first time since 6 July then approved on 6 August (saturday) I would say that the congressman's inquiry had alot to do with it!!!!

My hat is off to the first congressional representative that I have ever encountered that actually did something and did it in a timely manner. Bonnie Fagan was very polite and professional every time I talked to her and did an excellent job of taking care of our request. I am sending a letter of thanks to his office along with some flowers for Bonnie. I also intend on submitting the same letter to our local paper to let others know that the congressman does take an interest.

Moral of the story. Contacting your congressman can have an effect!!!!!!

Lessons learned.

Congressman are much more responsive than senators (still cant get answer from them)
Fill out all requested paperwork that the staffer asks for and write down everything pertaining to your case in non passionate manner stating the facts only.

Back it up with factual data on other approvals and issues encountered at the service center.

Above all give the congressional staffer feedback. Bonnie told me she would hold case open until we received our visa in hand, and if we needed any other help to just call her!!!

The I-134 is not legally binding and only used for a conof to determine if the applicant will or wont become a public charge prior to granting a visa. Thats it.



Thank God for that. I mean, God forbid any of us would have to go through that but with regard to the 90 day period for getting married once they are on U.S. soil - there's pressure to get it done sooner in order for them to qualify to work as well as travel outside of the U.S.. I almost wish the government would automatically grant a temporary card for employment just so that isn't influencing applicants to marry quickly vs. waiting within the 90 day period.

If you've received a transfer notice regarding your case, please inform the National Customer Service Center at the time you submit your inquiry. The National Customer Service is available Monday through Friday, 8:00 AM to 5:00 PM, PST.


(Although I'm looking at it now and confused because I first thought it said they forwarded my inquiry to the NCSC. Whatever I did, the call or email got them to touch my file 3 times.)

Congratulations to all who are moving right along with this process. I have a question and I hope someone has some information to help me get some clarification. I see several people with June NOA1 dates from CSC who have received RFE's already. I have not received an RFE to date - I have not even been touched. When I contacted CSC they told me that they are only processing applications that have been received as of March 6 and back - NOTHING AFTER THIS DATE HAS BEEN TOUCHED per the representative. The lady also told me that they won't mail me an RFE until they start to process applications received for my NOA1 date. I know this can't be right as I see several people are receiving RFE's and/or approvals after the March 6 date. They seem to be very "robotic" in their answers and won't go into any detail other than what you can read on their website for yourself. I know it is still early in the process for me compared to others but can anyone provide clarification on this or any suggestions as how to maybe word my questions better to CSC to get the answers I am looking for?

I started a thread on those of us who filed in June using the old form. In that thread I explain how I finally got touches after I called USCIS as well as emailed CSC stating that I was expecting the IMBRA RFE. The person on the phone couldn't tell me when they were going to mail the RFE, but when I aske her if it would be okay for me to send in the new form as an amendment and she said as long as I make it clear with stickies that I already made an original submission. I would recommend doing this as I personally don't think it will hurt and certainly might speed things up if they are going to be sitting awhile before they send anymore IMBRA RFE's.

Here's my thoughts - my hunch is that since the new form was available online around June 6, 2006, USCIS decided to set aside those incoming petitions so they could deal with the backlog of all the IMBRA affected petitions from March to June. They had indicated that those petitions would be expedited. So I'm thinking that they assumed any petitions received after a certain cutoff day in June would not need IMBRA RFE's.

In any case, hopefully, once they've gone through the backlog of petitions from IMBRA, they'll get back to our petitions. This is all my speculation but if you look at the petition dates, it makes sense.

Then touched again today. Wondering why that is.

I hate to say it, but touches appear to be random. You could pop up with an approval at any minute, with no touches or even an update. As proven by that other thread.

I am beginning to get worried. Many of my new friends here on VJ are being touched this weekend and I don't even get a sniff! My only hope is that sometimes a NOA2 is received without having many recent touches.

our lawyer had old forms filled up before January 15th (June 14 to be exact), but our application was received by USCIS June 29th.... i think June 15th was the day the new form was posted on the USCIS site....

anyhow.. yup, I've seen some VJers who used the new form and got their IMBRA RFE's anyways... except that maybe, just maybe, some questions were left blank when they filled up the new form that should've been answered??? sometimes the questions leave one wondering how to properly answer them.. N/A???... None???.. leave blank??.... just speculating

and then some who filed in May and gotten their NOA1's early June but not IMBRA RFE's....



That is a good guess, but as I am an obsessive IMBRA researcher that was not the reason, you guessed it I was one of those who used the new form and got a RFE. according to the VSC they were so overwhelmed with returned forms that they simply threw the new ones in with the old ones and RFE'ed everyone. If I can find it we had a thread examining the new form and the RFE to see if some language change was the reason, but alas it was a simple bureaucratic foul-up

There are some serious problems with this process.

Those that filed in June, relax. You are in good shape, but need to realize that you are behind hundreds that filed well before you.

If you are approved soon, great. However, your expectations, with respect to proper processing order should be reserved at this point.

I am at 143 days now. Give that a go.
