Just a guess, but here goes.

Suppose CSC gets evaluated on average approval time, just as VJ measures. They've approved lots of March/April/May people in the last few weeks, as they should. But it means their average wait unitl approval time has gone up dramatically, especially compared to Vermont. How to get it down fast? Approve some of the straight forward July applicaitons on the new forms.

Then once their measurement date passes (who knows when), maybe they'll go back to the NOA1 date, they way they should have.

The idea of putting new staff on straight forward cases also sounds reasonable to me.

There was a bunch of us June NOA1's who had used the old pre-IMBRA form but never got RFE's when they seemed to be bulk mailing them. Since there were some who got RFE's despite using the new forms, my hunch is that CSC designated a cut off date in June sometime (12th?) and assumed any petitions received after that date used the new forms which explains why we never got an RFE. Then, for awhile there, it seemed they were consistent about approving only the petitions that were affected by IMBRA (March - June).

Looking at Gary's latest table on approvals, there's only a handful here on VJ that are left from March, April and May. Then this weekend, several of Juner's got emails stating that an RFE was mailed to us. Perhaps, they are really down to July petitions left that they know for sure were filed using the new form?

I've noticed that there have been about 10 approvals yesterday (and I guess today) and they've all been for people with first or second week of July NOA1s, with the exception of one.

I'm not complaining that they didn't have to wait long (I've only been waiting since June myself) but it seems odd that they're all from the same weeks when that doesn't seem to be where CSC is in terms of processing times...

What gives?

I mailed mine USPS express for the tracking number and put ATT.RFE with red marker
on the express envelope. Have not gotten anything to confirm receipt, no touch ....still waiting.

Just my observation but I recalled during the mass mailings of RFE's back in July, many people had done the same thing as you and it didn't seem to get there any faster (I'm sure it gets to their mail room, but as far as being sorted, perhaps those who do the initial sorting of the mail only sort out the original return envelopes for RFE). Anyhow, I'm heading over to the Post Office now to send mine certified so we'll see which way is the speediest. :star:

I received mine on Tuesday Sept. 25th and mailed it out the same day via USPS next day. I still have not received anything saying they have processed it or received it. I used the envelope they provided and sealed it in that but then placed that envelope in the USPS overnight envelope. I also wrote my WAC number on the outside of the envelope.

No idea how long this will take.



I don't think it's a good idea to write your receipt number on the outside for anyone to see - just like your ss#.

The letter I received has a blue page on top, stapled to the questionaire. The blue page instructions state for me to send that page back and on top so I'm going to keep it stapled as such. The return envelope says on it, Att: RFE - I believe that is good enough info for them to process it. I'm going to go ahead and use that envelope but send it certified with a return receipt.



We got an RFE in the mail too. California recieved our I-129F on June 30. (even though we sent it on the 19th to Nebraska). Was your RFE an IMBRA RFE? I swore we filled out the new form that included that info...
How long did it take to get there from when you got an email or checked online? We got a notice on Friday 15th and still have not received anything... My mail however is temporarily being forwarded to my mom's while I'm in England.
Anyone know also if the RFE will forward ok? It's not one of those things that won't forward is it?? Am slightly worried about that....(my mom's mail is a PO Box too)



I got the email notice on Monday morning and it stated that a request for more info (RFE) was sent to me on the 16th. On the outside envelope, the post office stamp has it dated received on the 19th. However, I'm in Laguna Beach with is only minutes away from Laguna Niguel where the CSC's PO Box is located - if that makes any difference.

I'd recommend that when your mom sends it to you, she using international express delivery service (the USPS has it as well as FedEx), that way you'll get a tracking number and it still make a take a couple of days to get to you in England. I'd recommend you send it back to your mom the same way and then have her mail it here in the states as certified (I'm thinking so that the return envelope can be used).

BTW, in the letter, it states I have until Dec. 9, 2006 to return it, so you'll have plenty of time.

First...RELAX!!! LOL I can just picture you sat there going all nutz. Ian and I never even got anything in the mail in regards to our RFE being sent back and recieved. We only got an email. We never even got an email saying that we were approved for the K-3. I only found out by checking the USCIS site which I gave up long before our approval to even look at or count on being right.

I believe in my heart that your approval will be coming soon. Not by the touches, but by the time it has been since you filed. Keep the faith and things will work out the way you want them hun.

I received NOA1 dated 8/7/06. Today I received an email from CSC stating my case has been approved on 9/20/06! That's amazing!!

My NOA1 is issued on 1st, May( 145 days till now), but money was chashed on 10th, July(74 days). no touch, no rfe(old form i use). I just realized something when I had called the USCIS. There is a prompt to select if you've received a request for further evidence and need furher instruction. If you listen carefully to the choices, you will be placed on hold to speak with a representative. Once you get a live person on the phone, ask them pointedly if they have the evidence you sent them. If they cannot answer that question, then I'd follow Mew's advice and resend what you already sent for evidence (in case it was lost) but include more photos and as I mentioned, hotel receipts, ATM withdrawals, restaurant receipts.

Okay guys, here goes . . .

I finally received my RFE. I don’t know why it took an entire week to receive my RFE in the mail when I only live about 40 miles from CSC, but anyway . . . Well, they are asking for more evidence and also sent me the IMBRA questions. I submitted much evidence with my petition, and I honestly think they lost it, I cannot believe it. I had labeled everything for them nice and easy, with a COVER LETTER for the evidence and they want more. Oh yeah, not to mention that I submitted the new I-129F with IMBRA INCLUDED.

Okay, so here’s what the letter says they want. I need your guys input, please. They want 3 things.
1) Meeting in person: The petitioner and the beneficiary must have met in person within the 2 year period prior to the filing of this petition. Please submit photographs of the petitioner and the beneficiary together. Blah blah blah, HELLO I SUBMITTED PLENTY OF DATED PICTURES

2) Last meeting: The petitioner and the beneficiary must have met in person between June 2004 and June 2006 (I filed in June 2006). Submit evidence of meeting the beneficiary in person within the 2 year period preceding the filing of the petition.

3) Circumstance of the meeting: Submit information regarding the circumstances under which the petitioner and beneficiary met to establish the relationship. I WROTE ABOUT ¾ OF A PAGE, WHAT MORE DO THEY WANT?

What do you guys think? What else do they want from me? What else should I submit. I had originally sent them passport stamps with dates of entry into Mexico, boarding passes, pictures, (emails and letters, although they are secondary evidence). I’m sending them around 15 pictures this time, is that overdoing it? (because if they have pictures I have over 300 of my fiancé and myself. What should I do??? I am going crazy sorry guys, it’s just that I have been with my fiancé since July 2001, (and have known him since July 1999), how can they possibly think we do not have a valid relationship!! I am so mad right now! :angry:



I'm sorry to hear that. What about hotel receipts, ATM withdrawals, restaurant receipts? As for pictures - just send more, perhaps 30?

I feel awful for you but now that answers the question in my mind about the RFE I just received which was only for IMBRA - I wondered if they would send a separate RFE for anything else or if they would include it all together.

Hang in there. When you return the RFE, I'd include a cover letter listing what evidence you've included and reaffirming what evidence you had sent in earlier.

6. Emails - How important are these? What about editing out personal stuff?

7. Greeting Cards - my fiancee has sent me a ton of cards - should I make copies of the both the outside and inside - should I make color copies?

8. Passport style photos in plastic bags - Did you use a small office style bag or would a ziploc bag be ok?

You never said, but I am presuming you are preparing your I-129F packet to mail to USCIS. If so, you are wanting to enclose far too much information at this point. Emails, greeting cards, and chats won't be needed until your fiancee is preparing for her interview. At this point, the only steps you have listed that are necessary are #1 (do not use stapels-use paperclips), #2 (manila envelopes are good, Fed-Ex is good), #3 (I made color copies, but b/w will suffice for the I-129F), #4 (one page is plenty long-just summerize your relationship from when you met to present date), #8 (I used sandwich bags), and #9 (again, sandwich bags-paperclipped to the copies from #3). Number 9 would/could be used in conjunction with supporting evidence that you have met in the previous 2 years. 5. Yahoo Messenger Archives - Should I print out all the chats we've had? If so, this will make the packet enormously thick? How much is too much?

6. Emails - How important are these? What about editing out personal stuff?

7. Greeting Cards - my fiancee has sent me a ton of cards - should I make copies of the both the outside and inside - should I make color copies?

8. Passport style photos in plastic bags - Did you use a small office style bag or would a ziploc bag be ok?

9. Photos of us together - I have about eight, 4 X 8 prints. How should these be attached to the document? Can they just be loose inside the envelope?


Thank you for any help. I know these sound like silly questions, but I just don't want my application to be delayed for any silly reason.

Has anybody considered how expansive this change is? I can guarantee you that USCIS has their lawyers sifting through the regs looking for all the areas IMBRA has an effect on. Regulation and policy may have to be rewritten. Adjudicators and CO's are going to have to be given new directives. I'm not trying to $hit in anybody's mess kit here, but I would not even BEGIN to try and second-guess what USCIS/DHS is going to require to FIX these petitions that are caught in the crossfire.



Please forgive my ignorance as I'm a newbie here and I'm about to mail my first I-129F submission this coming Tuesday, but I'm confused about all this talk of IMBRA. If I understand the threads clearly, has USCIS/DHS taken current and also incoming submissions and put them on some kind of hold, until they decide what kind of changes they need to make to the process? Because, I'm seeing people here getting approved and getting the Visa's. From what I've gathered looking through the numerous member's timelines, most have gotten through the entire process in less than 6 months.

If USCIS/DHS requires additional info - background checks, it is my hunch that they would first have to officially announce it and then designate a date when it goes into effect. All this second guessing and hearsay seems a bit unnerving. Don't get me wrong, I'm grateful that people here are willing to share information but I hope that we're all careful not to spread disinformation or rumor. Just my 2 cents. :help:

Congratulations! :yes: I was kind of waiting to see when you would get your NOA1, because I mailed off my I-129F on 05/31/06 and still haven't seen anything yet.

This process really is a lesson in patience.

Sorry to ask stupid questions but one kind of notice is it? Could you tell what it was from the envelope (the address, etc)? What exactly does the NOA1 say? Do you now have a file number and are registered with USCIS website to receive email notifications?

Your NOA1/receipt will come via regular mail in an envelope from US Department of Homeland Security. The actual NOA says "Notice Type: Receipt Notice" and will have your receipt number that you can use to register on the website. I think you can also get this number from the back of your cancelled check.

Hey guys!

I have just joined this site in the hope that my situation may become a bit clearer to me through the help of you guys!

My boyfriend and I are thinking of getting married. He is American I am British and we have been together a year next month. The prospect of being able to live together as a married couple is exciting but the process and paperwork isn't and all seems very daunting...

We are really not sure how to proceed. We have been reading a million websites and have talked things over but a little advice would be brilliant.

Which is the best way to proceed? Is it better to file for a fiancee visa or for me to go visit him there on a temporary visa waiver and get married whilst i'm over there? In terms of time for processing etc which would be the best opition as I would like to get out there ASAP as you can imagine!!! :P

Also in your opinion is it best to seek the advice and services of an immigration lawyer throughout the process or once explained can the paperwork and process be easy enough for us to handle ourselves. We're pretty clued up kids but it is rather scary with all the different numbers of forms and different things we need to do for working etc...

I think I've probably bombarded you with enough questions for my first post... I'm sure i'll have LOADS more for you if thats okay....

Finger's crossed someone can help me... :D

Hi Beth and welcome! I'm fairly new to this also, but for sure, DON'T come here on a tourist visa with the intent that you will marry him - you would end up with all kinds of legal problems.

From what I read and learned is that the K-1 Fiance Visa is the best route to go if you intend on marrying.

I used this website to help me put together my I-129F application with any lawyer. If you want to save money, I'd avoid using a lawyer as they are no guarantee your application will be processed any more effeciently.

What I am wondering right now is if they'll also expedite us that were supposed to have been approved soon, if there hadn't been any recalls, 'cus we also were put on hold for over a month. They should work on our petitions fast as well, no?

And I also hope that the RFE will be sent to us as well, not just to the recalled petitions, 'cus that too would be a hard blow, although they do say 10.000 petitions, and there were only 1.100 recalled.



I'm just speculating, but it would have made sense for them to have gone through petitions received up to this point and possibly tag them with a 'conditional approval' until the additional info in the form of an RFE is received. That would certainly expedite the process as they could just update the information.

Or maybe I'm just fantasizing...hehehe. :lol:

Hi all,
I am using an immigration attorney for the K1 processing..I spoke to him yesterday and he told me that there should be no RFE's comming since the old 129f form was still vaild until the new one is approved.I told him about this site and what everyones been speculating about and he said not to listen to all this stuff...that his firm is well aware of whats going on and that i wont recieve any RFE's coz of the new draft 129f form.
So i guess we'll see what happens..he just said it might take a bit longer due to how backlogged they are due to the ones comming back for more securtiy checks.The firm does advertise on this site..if anyone is interested the firms name is Roth,Livingston,&Poles...I hope he is correct..he seemed offened when i told him waht was being said on this site,rather than what he knows from his expertise in the immigration field.

Chris Bentley, a Homeland Security spokesman, said about 10,000 applications are currently being held because they did not address the criminal or marriage broker issues.

"They did not have all of the information needed to determine whether someone qualified or not," said Bentley, who works for the department's Citizenship and Immigration Services.

He added: "It's certainly an inconvenience brought about by the new requirements of the law."

Homeland Security said Tuesday it would send additional forms to the estimated 10,000 couples in wedding purgatory to get answers to the questions about criminal pasts and marriage brokers. But it said it was still waiting for the White House Office of Management and Budget for approval of those forms and the new application.

OMB spokeswoman Andrea Wuebker did not have details immediately on the additional forms, but said the new applications were approved Monday in an emergency clearance process. It was not clear when the new applications would be distributed to the public.
