I was actually curious to see if London would actually WANT to see this type of evidence. In Colombia, which I imagine is a little more skeptical than the UK, they never asked me for ANY evidence. I brought a huge packet of evidence with me, they never asked for it.


For most who go through London, they don't request to see any relationship evidence, but there was at least once case on VJ last fall where the embassy gave him a 221(g) and asked for more evidence. (And he was a British-born white guy, so not someone from another region living in the UK.) So while for the majority, it's never asked, there's always the possibility that it will be. Thus, err on the side of caution, regardless of the embassy/consulate involved.

Hi - my fiancee makes enough money to support us and we will suppply pay stubs and employer letter along with form i134.

Therefore do we really have to provide a letter from the bank with deposits and balance etc? Just seems a bit yesterday....

The information you provided should satisfy the requirements for a successful I-129F petition, but depending on which country the beneficiary is from, it may be a red flag that you met and filed so quickly. (Again, it depends on the country.) Where will your fiancé interview?

Hello everybody,

I am wondering if the period that my fiancé and I have been knowing each other before applying for a K-1 Visa does make a difference. Here is the situation : we met online in April 2012, we met in person in July 2012 and we submitted the petition for K-1 Visa in August 2012, do you think it might be considered as a red flag? I just want to clarify that our relationship is genuine and that there are absolutely no hidden intentions from one side or another.

Also, in the declaration of how we met, we only told the circumstances of our PHYSICAL meeting like where and when etc and we didn't mention that we met online because we thought that the USCIS is only concerned about having the evidence of meeting in person and then after the NOA2 and NVC stage we can explain in details at the consulate interview how we met, both online and in person.

Please tell me, what do you think?

Hi - at NOA2 stage and wondering where we actually pay the $240 visa fee. The London embassy site says "applicants to pay the fee to the NVC before they begin processing their application"..

 

First I'd heard of this...confused??

The K-1 is a nonimmigrant visa,you don't pay anything to the NVC as that's not part of the K-1 process.

 

From the Embassy site

 

 

 

K Visa Applicants pay the fee to the Operator Assisted Information Service prior to attending the visa interview.  Instructions concerning payment will be sent to you with the appointment letter.

 

You call the "extortion line," pay the fee, and they will email you a receipt as a PDF. Print out copies of that receipt, sign it, and bring it with you to the interview.

Hi all! 

 

Just wanted to ask a question about documentation that I need to take with me to the K1 visa interview in London. Do I just need to bring everything stated on the US Embassy London website or do I need to bring anything extra? I have read a lot of different reviews and some people said they needed to bring extra documents like their fiance's birth certificate and their original application package. I didn't think this was the case, as I thought it was already sent there from the USCIS and why wouldn't they mention it on the website!?

 

Any helpful answers, would be appreciated.

For the most part, London doesn't request anything beyond what's included on the embassy site of the K-1 applicant. Though, there have been some instances where additional relationship proof was requested, but it's not the norm. 

 

Also, if you haven't read through the pinned K-1: NOA-2 to Interview thread in the UK forum, it would be ideal so you have an idea of what to expect based on the embassy since the interview process can vary in other countries. Good luck!

It takes approximately four weeks from receipt of all the DS forms (including the readiness letter) and receipt of the medical exam results for the interview date to be assigned. It usually takes 4-5 business days for the exam results to arrive at the embassy. You can also call the Dept. of State line to confirm your forms have been logged - (202) 663-1225.

Regarding your response for #5, and filing for AoS;

I work freelance as a web developer from time-to-time and the nature of this role allows me to work at a distance. Considering the possibility that I were still able to earn this way from clients in the UK, while living in the USA following marriage, would I be able to use that income to supplement the household's income for the I-864 sent with the AoS package? I realise this might come up against all kinds of tax-law issues as I'm not even sure where I stand with the idea of earning from the UK while living in the USA.

Per above, as long as your clients are not in the U.S. (i.e. before receiving the EAD or green card), you can continue working remotely. Be sure to read the I-864 instructions on how that needs to be documented to be counted towards your partner's income.

Question 1: Are we likely to come up against any resistance from part of B's income being alimony?

 

Question 2: What suggested evidence of B's income is either expected or required, considering that she does not have a salary?

 

Question 3: Assuming the Adjustment of Status filing goes ahead around April 2014, when would we be expected to provide proof of B's income? Part of the filing involves an Affidavit of Support which I would imagine will be based on 2013's earnings, but is it likely we will need to further validate her income after filing?

 

Question 4: Following getting married, will I be able to work in the United States by applying for Employment Authorization, and actually find employment before the Adjustment of Status process is complete?

 

Question 5: Assuming that Adjustment of Status does require us to provide proof of income for the year 2014, will I be able to contribute my earnings to the household earnings once I have Employment Authorization?

 

Question 6: My understanding is that we can make up the figures with five times the difference in assets. What defines assets? Would savings count? How about savings that came to us in the form of a gift (specifically, a wedding gift)?

 

 

 

1. & 2. People have used their alimony as being a source, but, be sure to have the appropriate documentation with the I-134 that details how her income qualifies her to cover you, the beneficiary. She should plan on sending you tax transcripts when interview time comes. 

 

3. When filing the Adjustment of Status package, she will have to include the I-864 and supporting documentation (bank statements, letter noting alimony is $X per month, tax transcripts, etc.) that her income meets the income guidelines of her family plus you. 

 

4. You won't be able to legally work in the U.S. until you file the Adjustment of Status (I-485) package. When you file, be sure to do the Employment Authorization application (I-765) as well. It's free when sent with the I-485 and will allow you to work sooner since it takes 60-90 days to receive the EAD. 

 

5. See #4. Unless you're bringing UK-based income paid into a UK bank account, you'll need to file the AOS package before being able to legally work in the U.S. and part of that package must include the I-864 Affidavit of Support.

 

6. Assuming you're referring to assets to qualify for the AOS package, be sure to read the I-864 instructions (Part 7) on what qualifies: http://www.uscis.gov/i-864

Hi. 

 

I'm still building the I-129F package.  My fiancee and I have known each other for seven years.  During that time we communicated via Second Life, then MSN IM and finally, Skype.

 

Presently I have a the log of Skype communications going back to April, 2011.  I am fairly certain I can get the logs of earlier than that, including MSN IM and Second Life.   

 

Now we're talking seven years of logs.  I'm looking at the Skype log file I have, which is only two years, and it's a HUGE file. I'm in the process of editing it so I don't have to give them 30 plus pages of this log alone (not to mention keeping some stuff private), and I'd like to show the logs of prior to and after her trip here and my trip there, but I need some advice.

 

What else, exactly, should I keep?  Should I edit it down to show the times we called?  Should I show some random conversation we had?  Would I even need logs going back to when we first met in 2006?  And I'm looking at a mountain of text files here, and since text files can be created, I can't help myself from asking Is it really worth it?

The main items for the I-129F petition is to prove you've met within two years prior to filing and that you're both free to marry, so be sure you have that covered before printing out hundreds of pages of logs, emails, etc. From what you have on your timeline, your partner is in Germany, correct? I doubt that's a place where front-loading (which is what sending proof of relationship is called because it isn't considered for the petition, but may help at the interview stage) is required.

Since the form says to answer all items, why take the risk? It will also take time and money to send another copy later if the CO wants a completed form at the interview.

yes I agree.  Now I will try to pull my records from the government databases to see how many convictions for marijuana I have.  I don't know how many exactly.  I want to say one or two even though I have been in trouble for it more than that, but they did not result in conviction. 

 

Do you guys think I should get an immigration lawyer?  I dont want to list items on my form if I dont need to.  I don't want it to cause any delays. 

 

Can anyone reccomend a good one who has experience with criminal history.

 

Also, what is the process?

 

1) Get to know her

2) Ask her to marry

3) Get fathers permission

4) Her set up interview w embassy

5) File k1 visa

Most VJers opt to go without a lawyer, but that's completely up to you. You mentioned you were doing a consult with one soon, so go and make the decision after that. We don't know all the details of your life, but you do, and you'll need to weigh whether or not an attorney will be able to assist. 

 

On the process, start by reading the guides on this site, http://www.visajourn...ontent/k1guide, and the forms on the USCIS.gov website. And then read them twice more. Even if you do choose to hire an attorney, you need to know this process forwards and backwards. 

 

Finally, before you start this process, you should both be sure that her moving to the U.S. and marrying you is what you want to do. For one, that will be something you'll need to state as part of the initial petition package. The K-1 visa isn't a "get to know my fiancé better" visa.

question #2 asks, "Have you ever been convicted by a court of law (civil or criminal) for any of the following crimes: -Domestic Violence.. -Homicide...>>>> -Three or more convictions for crimes relating to a crontrolled substance or alcohol not arising from a single act.

 

 

I can honestly answer no to these questions.  

 

Where is your supporting evidence regarding your response.  I am not trying to sound cocky or anything(I know how text on the internet comes across), but I am wondering if you have any factual data to support your response.

Yay! Thank you. At which stage in the filing process is that, though? His interview? Or after he's got the visa already? I'm hoping the whole process of getting him here is less than 9 months. : / Most estimates I've heard seem to be 5-7?

 

Be sure to have a look at the K-1 Guide and the flowchart to get an idea of where things fall into place. On timing, it definitely will take longer than 5-7 months in total (petition to visa). More realistic is it will be around 10 months to a year, assuming the current service center trends remain and that you don't have an RFE.

Hi, thanks for all of you who replied,, let me explain my situation,, 2 and half years ago I was on a trip overseas and I met him at the airport and also saw him few times during my trip we became friends talking every once a while , I was in a relation with another man at that time but things didn't work out and we broke up. Me & my fiancée got in a love relation about a year ago, I applied for him in Oct 2012 , I asked my lawyer but he didn't tell me I have to have that requirement to meet him in person and have pics and he told me it will take 90 days , I waited more than 6 month now thinking we might get the approval any time. I found this site and start to learn more and here I am trying to find out what would be the best for us to do..We wanted to see each other everyday and minute but the hold and wait put me in this position.. till this day my lawyer says we can waive that requirement as you can not travel there..so I really don't know where is he taking me with that or what to do.. should I tell him back off!! he charged me over $2000 so far! Should I make a waiver and see if they accept it or should I just withdraw the petition and start all over..

 

The money you spent on the lawyer could have been used to purchase a ticket to see your fiancé before filing the petition. Getting a waiver for the two-year meeting requirement isn't a regular occurrence. You'd be best served by following the advice offered upthread -- formally withdraw your petition (you don't have to wait for a denial), visit your fiancé and gather plenty of proof, and refile the I-129F, or visit and opt to get married and file the I-130.

It's too bad you didn't visit the UK forum and read the thread on preparing for the K-1 interview. (But, you can still read it now and be a bit more prepared going forward for interview day.) Why was there a delay in getting the forms to the embassy? The embassy only reaches out if they haven't heard from/received anything from the visa applicant before the NOA2 expires. Your visa journey could have ended had they not reached out...

 

In any event, I'd recommend taking copies of the DS forms, and if possible, having your partner send you another copy of the I-134 and supporting documentation just in case.

I'm calling the US Embassy in London on 09042-450-100......and they have agreed to do a interview (which is coming up this week).....does it mean that they are happy and ready?.....and that the case is still ok?.......because the last time I talked to them on the phone they said that I had contacted them in February 2013 and said that I didn't want to continue to get a K1....this didn't happen!.....
 
....they asked me if I wanted to proceed...and I said yes I want to proceed......and then a appointment was made for a interview.

 

 

Assuming you're going for a K-1 visa, if the embassy has assigned you an interview date, then it means they've received all of the documentation and medical exam results. As to whether or not your case is "OK" will depend on the CO interviewing you.

If they give you a authorisation code on the phone...(because the I-797, Notice of Action was about to run out) that then enables you to communicate with them via email.....does it mean that all other communications don't mean anything?....its been highly confusing.

 

For example i've had one really concerning letter sent to me and one really concerning phone call ....and yet the authorisation code was given to me after I said the I-797, Notice of Action was going to run out soon....and led to somebody at the other end contradicting both snail mail letter and phone call....however phone call was much much later.

 

Who are you calling? Where are you in the process?

No. As was told to you in this thread and your earlier thread, if a marriage does occur, but doesn't happen before the I-94 expires, you would have to concurrently file the I-130 and I-485. She would not be able to leave the U.S. until she receives her green card because she would have a very difficult time re-entering.

You cannot have her come LATER on a tourist visa, then get married, and then attempt to adjust status based on that marriage.  If you're thinking you can, I don't understand your reasoning.

 

On a tourist visa: she could get married but would have to leave the USA and wait in Spain while you file a brand-new CR-1 process, including the 8-12 month wait for that.  She cannot stay in the USA because she would have immigrant intent, and that is violating the terms of her tourist visa, it will lead to fraud charges and a lifetime ban on entry into the USA.

 

On the K-1: you must marry within 90 days.  That's it.  If you don't marry within 90 days on the K-1, you cannot adjust her status to legal residency afterwards.

 

Marriage within 90 days or go home, most likely forever since a second K-1 would prove difficult.

 

I've seen several of these threads now and I have to admit I'm running out of patience/empathy for the posters.  If you wanted to "get to know her" that was NOT a reason to file the K-1, as the K-1 specifically leads to marriage.  I also feel very badly for her, if this is your unilateral decision that is majorly impacting her life and legal status.

But, if you know before the 90 days are up that no marriage will occur, it's best for her to return home as soon as possible rather than be out of status.

It means you didn't read the instructions. You might want to read them again if you sent your papers to the Texas Service Center. Thats the wrong place. Texas does not process k-1 petitions.

You're only able to pay by phone. The rep will ask for your email address and will send you the MRV receipt as a PDF attachment. As noted on the embassy site, be sure to bring this with you on interview day.

I've received a letter saying I should prepare all the forms 2xDS-156, DS-156K, 2xDS-157  - yet further down the letter there's a notice to not send any documents until instructed. Do I wait until package 3 arrives (I'm assuming this letter isn't package 3), to send all these forms off, as I already have them all filled in and ready to go?

What you received is the "packet 3" letter. They don't send you the forms, the letter includes a link to the embassy site where you can download everything.

 

Forms = the DS paperwork

 

Documents = the supporting information needed with the DS forms.

I've read a little bit about my fiancé getting employment authorization when he comes over on the I-129f visa but was wondering, can he file for this as soon as he enters or does it have to be after we are married? Also, how long does it usually take to get the ead so he can start looking for jobs? I am confused with some of the things I was reading, I read that the ead you file before you file for adjustment of status is only valid for 90 days, so does this mean its valid for 90 days after you receive it? And is it still valid when you send off the adjustment of status and he can work while his adjustment of status is pending? While you can technically apply for the EAD upon entry, it would only be valid for as long as the expiration date on the I-94. Thus, it's not recommended because he would only be able to work for a short period of time.

 

Instead, get married, file the Adjustment of Status (I-485) and add on the EAD (I-765) and Advanced Parole (I-131). When mailed together with the AOS form and documentation, the EAD and AP fees are waived. The EAD and AP take 60-90 days to receive.

Sorry to post a question on someone elses thread, but I thought that the EAD and AP both had fees of $300-400. Are they free to apply for if you send them along with your AOS forms?

 

Yes, the fees for the EAD (I-765) and AP (I-131) are waived when sent with the AOS (I-485) package.

While I will be in thge USA, someone on this forum suggested that sign just the part 1 of DS-230 and fill out two copies of it.

 

I was wondering, can any other forms or anything else I can give my fiancee in advance, while I visit her, since she will be filling it that can be used for later use and make some our job easier?

You don't need that as part of the initial petition package. The DS-230 isn't needed until after the I-129F petition is approved and you're applying for the actual K-1 visa.

Chicago's is the worst in regards to that line! If Dublin doesn't pan out, and depending on where you're ultimately flying to, try San Francisco as well. There are direct flights from LHR to SFO. Good luck!

Well I sent proof of our son being born and proof that I flew back to do the paperwork for his citizenship, I guess that was not enough

Correct, they must have original signatures, not copies -- it's right in the I-129F instructions on page 2, #5: http://www.uscis.gov...i-129finstr.pdf
