Hi Brian,

It's going to depend on the custodial laws of your fiancee's country. If he has no legal custody of his daughter, then you shouldn't need his permission. If he shares legal custody of the child, I'd recommend that your wife find a lawyer in her country to draft up the necessary legal paperwork and then have her ex-husband sign it.

We were fortunate because my wife was never married and Philippine Law gives no custodial rights to the father of the child without him petitioning through the courts for custodianship.

I'd first find out for sure if the ex-husband has any legal custody of the child. Definitely contact a local lawyer where your fiancee resides.

Save your chat logs if haven't already. Also your phone records - no matter how little you talk on the phone. Do you webcam when you chat? Take photos of each other from the chats as well. In a long distance relationship - the only viable evidence of a bonafide relationship are records of communication, so the both of should be prepared to demonstrate that beyond him being the daddy's baby.

HUSKER I think you are getting more than you bargained for! But those of us who have chewed our nails to the bone waiting are glad you are here to shed some light.

Now, my question :) Since Texas and Nebraska are no longer servicing I-129F's, it all seems to be going to California, with CSC now handling 3/4 of the work load and taking 2.5 monts minimum. Yet, Vermont has them cranked out in a few days sometimes. Why did TSC and NSC quit processing those apps, and why on Earth did they shovel all the work disproportionately to CSC?

Ha, that 1% had to be in my county, learned that lesson the hard way when my ex decided to divorce me. And why not, was severely injured in an auto accident, so she didn't think I could no longer support her extravagant life style. Very next day, hires a man hating attorney. I didn't want to hire an attorney, but ex's attorney told such outrageous lies, had no choice. And the judge appointed more guardian type attorneys for me kids, even though the testified they wanted to stay with me. Learned later, the judge could not do this without my permission, he did it anyway. And those bills from the guardians were outrageous claiming they were in meeting with my kids when they were in school.

I reported the entire flock to the WI state bar, only to get a letter back on each attorney that the bar does not deal with billing issues it was up to me to sign a very well spelled out contract. Ha, have to hire yet another attorney to verify that contract, and maybe another one to check out the second attorney. Also learned that judge came from a law firm where most of these attorneys were appointed from, so reported him as well. The only satisfaction I received was each of them had to send a very long letter explaining what they did, and my complaint would be on their records. But I had to pay all these bastards.

If a lesson was to be learned, really do your research when hiring an attorney, and check his background, did that for other matters in my divorce that had to be cleaned up and especially for my immigration attorney all based on a flat fee and what they were expected to do for that fee. That worked out nice.

It shouldn't be any trouble.. There are two ways for this..

First.... Fill it out with your current address, and then once you moved you call them and tell them you moved and this will also got your I-129F a touch.. witch are like gold around here... ha ha ha....

Second use your parents address as the "contact" address until you move and then again call them and change it to your new N.Y. address..

Where are you going to stay at? (who's house, or hotel name and address)

Why are you here? To visit a friend and do some sightseeing around the S.F. area.

What do you do for work? Tell them you are a office worker for a company like 'Valor market', or work for a store like 'K's Denki'.... They will not know where you work they don't have that information on their screen. Or tell them you are a house wife.

Did you bring any food with you? You can bring some food like rice crackers but no fruit or vegetables.

Definitely do not go without a green card or Advanced Parole. The fact that you entered on a K1 visa holds no bearing on future trips. Good luck with the rest of your journey and have a fun trip. I am surprised it has taken so long to get a green card though. Is this your temporary or 10 year green card?

It is the 2 years temporary one.

if you are flying from the US, then no, you just need drivers license...you are not leaving the US..you may need another ID for the airline, but there is no immigration check for flights from state to state

:( I wish we could get our RFE.......the e-mail notice came on the 16th saying they mailed it......and it's nowhere in sight!! I'm in Kentucky, but nothing in the history of the US postal service has ever taken this long to come from California. Well...it feels like it to me anyway :P



That date is most likely not accurate as mine also said the 16th of September but the USPS stamp showed a date of the 19th. It wouldn't be far fetched to believe they do mass mailings on specific weekdays.

After a week of waiting, I finally received my REF today :thumbs: Have to fill this out and send put in in the mail (Certified, Return Receipt), first thing Monday :whistle: :yes:



:thumbs: That's how I mailed mine back on Thursday morning. The lady at the Post Office says that CSC receives tumblers full of bulk mail everyday and recommended that I send it in the original envelope (Certified, Return Receipt) to help CSC with sorting out their mail. :yes: I've told Jinky I have a feeling we'll get our NOA2 this coming Thursday....God I hope I'm right.

I just FedEx'd my I-129F last week and I am concerned after reading this site extensively.

Can anyone comment on -

1 - The passport photos that were included were not perfectly to the dimensions requested, they were alittle bigger if memory serves. They were actually taken in Manila.

2 - My G-325a was the new form and my Fiancee's was the old form (good through 10/1) which I just realized looking at my original packet. Anyone know if this will blow the brain circuits of some USCIS person?



1. I went to a local mail box business to have my passport photos taken and when the owner cut them, I later came home to find them a different size than Jinky's so I carefully cut them to the same size. I honestly don't think they measure them with a stick.

2. As long as the old form hasn't expired (10/1), they should accept it.

According to that source, there were 32,900 K1 entrants in 2005. Suppose that this is a reasonable guess of how many applications they have.

Looking at the Immigration Timelines, we have 1150 applications so far in 2006, which will probably mean about 1500 for the year. Thus we are about 5% of the applications.

When presidential polls are done of 100,000,000 voters (a guess), they poll about 1000-1500 people, and get results that are accurate within 3%. If our membership is typical of K1 applicants, then analysis of our applications is probably a pretty good picture of what's going on with all applicants.

Overall, Internet users may be more affluent and/or computer savy than others. But if you don't meet the poverty guidelines (directly or with help), then you probably won't start the process. Thus it would surprise me if VJ members are substantially different than the rest of the applicant pool.

Also some steps in the process are totally independent of income. For instance, a name check at NVC or shipment to a consulate are the same, no matter your income.

Oh thank God! I mailed my RFE back to them last Thursday, but I didn't use express mail, just certified with return receipt. I signed up with usps.com for email notification but haven't got one yet. I'm just more paranoid than usual because a) my mail carrier, three weeks ago, decided that all of the mail destined for my address should be marked return to sender (called the post office, complained, may have gotten someone fired, oops) and B) my bank doesn't return checks, just teeny weeny photocopies of them.



Does your bank offer online services? That was how I first knew about my NOA1 - I logged onto my bank and saw that the check cleared, then I clicked on the transaction to view a photocopy of the front and back of the check. :star:

S&J, I found that using priority-mail-delivery-confirmation is usually good for these. You can track when it was delivered, and this is much cheaper than getting signature or certification.



In all other circumstances, I would have done that, but because the RFE came with it's own return envelope with barcode, I was thinking that putting the envelope inside an express envelope would have slowed it down, once it got to CSC. I think I think too much... :unsure:
