You also need to find out what she needs, if anything, to enter Mexico. Has she already applied for and received an International passport? Does she need to obtain a visa before entering Mexico?

Others have already contributed about the need to resolve the arrears to get your passport to get anywhere.

However, if you really do want an option for meeting her before you can get your passport, this far-out option just might work....

1. Get her to Canada. I am assuming this is easier than getting her to USA, but I could be wrong.

2. Meet up at a border area that is open on both sides. It has been several years since I was there, but Peace Arch park near Blaine, Washington was like this. You could walk into the park from Blaine on the USA side, and also walk in from the Canadian side. Find a place like that and meet her. Get your picnic basket ready.

The last time I was there, I saw a couple getting married while straddling the USA/Canadian border.

I think there are two ways of thinking about this which are getting intermixed in this discussion, and cause some confusion.

 

One the one hand, you would not be legally married.  It is just a ceremony.  You can make up whatever ceremonies you want, for whatever intentions you want, say a "getting acquainted" ceremony.  Since it's not a legal marriage, why should USCIS care?  This line of thinking says it's no big deal, not visa fraud, and go for it.

 

On the other hand, you really don't want to create problems for your interview.  A "wedding ceremony" will be a huge red flag, and create a lot of problems for you and your fiancee to explain it.

 

My fiancee and I thought about a non-legal marriage ceremony and we cancelled that plan because of this.  It is just not worth making a big stressful difficulty for her interview.  Our celebrations come after she has the visa.

I don't know much about the J1 visa or that "212e law" that would let her stay well past the expiration, so take my advice as that.

When applying through the K1 petition/visa process, the big question they have, obviously, is if you and her intentions are legitimate. Is this a "real" engagement or a sham? Will she not marry you and overstay her visa, entering the country illegally? I would think that is she had already been in the U.S., and overstayed that visa, it would not look very good and she will have some tough questions in her interview. Maybe that "212e law" will help, but, still, I assume it will not look good for her.

On the other hand, if they see that she did return back to Ukraine when her visa expired, then she already passed a test. In their eyes, it will be less likely that she will overstay the K1 visa and be in the U.S. illegally. I think that would put the two of you in a better position than typical K1 applicants that have not been to the U.S. before.

I am sure other people on this forum have more expertise, but those are just my thoughts.
