I am working in Canada so obviously have no US job or housing, and I making very little money with less than 5,000 in savings. I have several options for people who can fill out the financial responsibility forms for my fiancee. Is one process more strict with this than the other?

My fiancee and I are living in Canada, him as a Canadian citizen and me as a US citizen on a temporary work permit. I am trying to figure out whether we should file a K1 or do the IR-1 process with the K3 application. Is the waiting time to enter the US the same on the I-129 whether you are filling it out for K1 or for K3? I want to stay here in Canada while we are waiting for the I-129 to go though. I can prove US domicile with my bank accounts, tax record, bills, etc. Is it possible for me to stay here while we are waiting for the IR-1 to go through? I am trying to decide which process to begin in order to stay here in Canada with my fiance and be able to get into the US the soonest. It looks like the IR-1 allows you to enter the US in the same amount of time due to the addition of the K3, costs a lot less, and will allow my fiancee to work right away. However, I am getting the impression that the IR-1 would require me to be back down in the states. I truly appreciate any advice you can offer, as I have my forms ready and want to send them ASAP once I figure this out.

Paul and I have been travelling together for the last year, and filled out and sent all of our forms while we were "on the road". (Getting FedEx to ship our I129F overnight with no French return address was a nightmare). Being quite optimistic about the 5 month processing time, we decided to "settle down" in the UK to wait for his Interview.

After finding this website and all the awesome resources, we now know it will most likely take another month before we even receive our NOA2.

So after being "homeless" and unemployed for the last year (2.5 for Paul!), we're pretty homesick for Oregon and ready to come back.

Did some research, and we've decided to apply for a B2 Tourist Visa for Paul to come back to the States for the holidays and to get used to his new hometown.

Here's hoping!

Has anyone else visited their SO in America using either a VWP or B2? Any problems, or was it smooth sailing?

I tried posting this before and got no response, but I really would love some help.

I received a rejection because 1) I forgot to sign my I-130 form 2) Part C of the I-130 didn't list the address. I wrote the actual address on the attachment and wrote "See attachment" actual I-130 form. I probably should have signed the form (I'm dumb), but didn't I include the address correctly? What should I be thinking?

I have a sticky question regarding section 30 and 32 of the DS-230 form. My husband is currently working in Istanbul temporarily since January of this year (past 4 months). His primary address is his parent's in Bursa. Since section 32 asks for employment from the PRESENT to ten years ago, we thought we should list his CURRENT job. We attached a paper to explain the situation ( I assumed this might be a red flag for the reviewer of our form). The paper says:

   

I AM CURRENTLY TEMPORARILY LIVING IN ISTANBUL FOR WORK. MY PRIMARY RESIDENCE IS IN BURSA AND LISTED ON THE DS-230 FORM. I HAVE NOT BEEN LIVING IN ISTANBUL FOR MORE THAN 6 MONTHS AT THE TIME THIS DS-230 FORM WAS COMPLETED. IF NEEDED, THIS IS MY TEMPORARY ADDRESS IN ISTANBUL :

(ISTANBUL ADDRESS LISTED HERE)

Thank you, haha I know, Ankara is probably the only city Ahmet doesn't have an aunt or friend we could stay with. We might try to stay a few hours away in another city and just come in for the medical and the interview. I wish we could go to the embassy here in Istanbul, it would be tons easier.

 

I'm hoping Ahmet doesn't need a bunch of immunizations, but around 270 USD is what I am anticipating.

 

Congrats Natalie! We have received our NOA1 mid April and still waiting for NOA2. We're thinking of having the interview in Ankara as well since I didn't want to be away from my wife. 

 

Airbnb is an option, much cheaper then hotels but doesn't he have any friends? Turkish people are great with hospitality, they don't mind to have you guys for a day or two..

Did you check in the Letter what documents you need to submit? where are you going to stay?Does he speak English even though in the consulate they have translator, sometimes the CO wants to talk in English.

 

Good questions! The letter contains a list of instructions and things to bring to the interview. For us, we've already sent them everything listed and paid the application fee, but we will need to bring an updated police report, our medical report results and passport sized photos. We also will probably bring extra proof of relationship (photos from our wedding, air plane tickets etc.). 

 

To complete the Medical exam, which MUST be done in Ankara by an approved doctor, we probably will stay about a week before our interview. Unfortunately we don't have family or close friends in Ankara, so I will be looking at hostels and airbnb. The embassy is very central according to a map of Ankara. My husband speaks English comfortably, but I have read that you can do the interview in Turkish if more comfortable.

Yesterday I recieved by e-mail an official paper stating my husband's interview has been scheduled for Novermber 7th, exactly a month after the NVC telling us we completed all of our pre-processing. I am elated! Our paperwork for the entire CR1 process followed normal quote times (from what I've read in VJ forums and NVC correspondance). I hope this gives hope to other Turkey and beyond members waiting for their interview date.

 

For those who are further along than myself in the process, any timely advice or tips are welcomed :)

My wife got her cr1 visa in December and it expires in may, my wife has a CRBA appointment for our child this month in Manila. She will be going alone and has lots of evidence, but on

the off chance she is requested to have a dna test, everything will be ruined. Im here in the US and if she is requested to have a dna test i will have to pay lots of money to get a dna

test shipped over there and wait for it to be shipped back and the results given to the embassy. Our relationship is legit and the baby is mine but my main worry is, that if they

request one, the results might not get back to the US embassy b4 her visa expires. If it did expire what would happen, would i have to start the I-130 process all over again and wait

another year b4 i see my Wife and daughter? My daughter is 4 months old and i havent got to see her yet. my and my wife met 2 years ago and i flew over there for xmas in 2011, we got

married early january 2012, and i lived with her till early march of 2012. then i left to start work and the Cr1 process, which took almost a year, and im soooo scared its all going to

be ruined because her visa will expire, huhuhuh i dont know what to do! I dont want to start the CR1 process all over again!



I posted a link about someone who went through DNA Testing for her daughter. It is a different case than yours for it was not a CRBA case but she highlighted how she was able to expedite the process. Maybe your worrying way too much about this. You might likely not be required to have DNA Testing. Clearly you have a lot of documentation proving she is your biological daughter. Think positive. Good luck. Posted Image

The NBI Police Clearance is needed during the NVC stage. So yes, she needs to send that to you. The clearance is going to be part of the DS-230 packet.

Why are you getting Philippine passports for your U.S. citizen children? The U.S. requires American citizens to travel to and from the USA with U.S. passports.


I didn't say we were travelling to & from USA using their Philippine passports. We registered my kids births to the Phil Consulate & applied for their passports too. Anything wrong with my kids having dual citizenship(s)? Didn't you see in my above post that we are going to get their US passports soon?

With my children's case, theirs is the other way around. They were born here in the states. When I filled up the Philippine passport applications I followed what was on their US birth certificates, but I was told by the consulate employee that my kids middle name should reflect my maiden name.

Example:

US birth certificate
First name : John
Middle name: Paul
Last name: Smith

Philippine passport
First name: John Paul
Middle name: Flores
Last name: Smith

We will apply for their US passports by following the US birth certificates.

We just filed for Mom-in-Law and I am starting work on the DS-230 paperwork.

As I expect that we will handle all of the paperwork we can from this end, should we be requesting passport style photos from Mom? Yes, passport style photos from your MIL.

If so, should they have the Royal Blue background as required in the Philippines or should we tell her to get white backgrounds? US passport-style photos (white background)

We plan to fill out the form and email it to Mom so she can print it, sign it and snail mail it back to us.

How many copies should she send us? Of the DS-230 as well as how many photos?? Four (4) passport photos. This way you keep the two (2) as back up copies.

Also, my wife takes care of the kids and does not work so how should we go about filling out the I-864 form? The petitioner (your wife) will fill out I-864. The co-sponsor household member ( you the spouse) will fill up I-864A.

Use my info's for income and such?? If you filed taxes jointly, then copies of tax returns or tax transcripts for the last 3 years. Employment letter, paystubs for the last 6 months, proof of citizenship ( e.i BC or US passport)

I called the Philippines embassy in San Francisco and asked them about my questions. :) so it is a physical address and a report of birth is enough in my case. I forgt to ask her if there was a way I can go directly to NSO and report it though. She told me it will take 6 months before it will be available at the NSO. But she told me that they will send me a copy back with a seal on it and I can use it to change my passport name in the Philippine embassy here in Kuwait.


One more question:::
Do you glue the passport photos on the form ? Or you send it to them in a ziplock and they will glue it in the embassy?





@elyhim : yes. you must get your marriage certificate - certified by the county, then after that - your state authenticates it and after the US State department authenticates it. Ony after then you can submit it to the philippine embassy in the US. The Philippine embassy in the U.S. that has jurisdiction of where you got married and they authenticate it once more.
So it goes like this : County certified - Apostille/State Authenticated - US STaTe DEpartment authenticated - Philippine Embassy in the US authenticated - report the marriage at the same embassy.

I am finish with all the authentications! Except the philippine embassy authentication and the report of marriage. I hired a company to get all the authentications for me (State-US State Department-Thai embassy) (i am dual citizen) when you get a copy of marriage certificate after getting married this should already be a certified copy and you send it to top flite (the company) and some passport copies and etcc... It will cost a few hundred to get it done ( I had her do 2 different documents ) but I think it is worth it because we don't have to worry about losing it in the mail or doing it wrong. It is much faster and easier when top flite does it. it is best to give them a call and speak to Zekeu.



Why do you need to have your Marriage Certificate Authenticated? In the Phil Consulate (San Fran) site, there was no mention of having to authenticate your MC prior to filing for Report of Marriage. You only need a certified true copy or original which will be sent back to you.

Yes ^__^;; we just didn't know if we could actually request a Marriage Certificate from the NSO because we got married in the U.S. instead of in the Philippines. We thought the NSO Marriage Certificate was only for marriages solemnized in the Philippines.


Once you've filed for Report of Marriage Contracted Abroad & NSO has received your documents from the Phil.Consulate. Your marriage will be registered in their system.

Hi! I've been trying to find posts about this issue here on VJ but couldn't find a definite answer.

My husband and I submitted our Report of Marriage Contracted Abroad to the Philippine Consulate that has jurisdiction over the state where we got married back in 2010 and they mailed it back to us with the Philippine seal and stamped with the date and record #.

I assume this means that they have registered our marriage to the NSO. Does this mean that we can request a Certificate for Marriage (CEMAR) from the NSO? Or is the Report of Marriage the equivalent of the CEMAR for marriages outside the Philippines?


Yes, you are correct. Posted ImageThe Philippine Consulate will forward that to NSO Philippines. You'll have to wait for a couple of months or so for it to get there & be processed/registered in NSO. You can then request for your NSO Marriage Certificate online or in person. Which ever is convenient for you.

Do you understand that my wife has to travel by buss for 2 hours to get to san carlos city.. then take a ferry to get to the next island.. then take another bus for 4 hours to get to cebu...?? Last time i was in cebu.. i almost got robbed by a taxi driver the first day i arrived..... Would you ever take a risk... losing your loved one... over some stupid cfo certificate??? There are many robbers and rappiest in the philipines... for god sakes.. they dont even have security on the bus rides... you can fall asleep and have your money.. phone .. purse. Even your virginity stolen.. in a blink of an eye.. no joke... Im really having a hard time with this... I camt renew her old passport because she lost it... and in order to replace it they need a cfo cert.

OP, I agree with everyone else. It is not really a big deal to go to Cebu or Manila. You can even have someone ( a relative) accompany her for this trip. I suggest she fly to Cebu or Manila & stay in a pension house or a hotel the day before she attends the CFO seminar. Book her a room in a pension house or a hotel for 1 night. She only needs to bring original documents & photocopies, photos of you , her & her family etc. They apparently are asking some Filipinas to show pictures. lol. Check the CFO link that a member has already provided. Print out the location map. When riding a taxi, to make sure the meter is ON. . The rest of us girls that went through the process are from the province too & we managed to do it alone in getting to Manila of Cebu. Your girl needs to wear big girl pants now.

You can avail of the balikbayan visa if you are travelling with your wife. In the immigration they are going to call out who are balikbayans & you can fall in line in that line. Just show your marriage certificate.

I think you don't need a detailed medical certificate for your caesarean section (operation). In the SLEC site it specifically states there "previously-treated or currently managed clinically significant illness".

From Wikipedia, "A Caesarean is a surgical procedure in which one or more incisions are made through the mother's abdomen and uterus to deliver one or more babies........... CS is only performed when a vaginal delivery would put the baby's or mother's life or health at risk."

Since your CS is not to treat an illness, therefore you don't need a medical certificate for your medical examination in SLEC.

  • Original and photocopy of visa
  • Original and photocopy of Immigrant Data Summary for US-bound emigrants (except for K visa holders);
  • Original and photocopy of Confirmation of Permanent Residence for Canada-bound emigrants;
  • Original and photocopy of Certification of Eligibility for Japan-bound emigrants;
  • Original CFO guidance and counseling certificate;
  • Duly completed emigrant registration form; and
  • Payment of the authorized registration fee.

The requirements below should be what you need to pay attention to, not the requirements for registration.

Requirements for Attendance to Guidance and Counseling Program

  • Two (2) valid identification cards (IDs) with photograph;
  • Duly completed guidance and counseling form;
  • If married, original and photocopy of marriage contract on security paper from the National Statistics Office, or Local Civil Registry Offices; or original and photocopy of marriage contract duly authenticated by the Philippine Embassy/ Consulate (if married abroad)
  • Other documents as may be required by the counselors; and
  • Payment of P400.00 counseling fee.

If She needs the CFO completion certificate to get the passport why on the CFO website under requirements states:

She has been confirmed for the passport appointment at the DFA in a few weeks.

Can someone confirm the steps to get the passport?


She doesn't need a CFO certificate to apply for a CFO guidance counseling seminar. She NEEDS the CFO certificate to APPLY for a passport if her purpose of getting a passport is to MIGRATE abroad. It is the DFA's requirement that those who are going to migrate (as Fiance(e) or Spouse) or work abroad, they are required to attend the CFO seminar. DFA will only require this CFO certificate if your girlfriend will INDICATE in her passport application that the purpose of applying is for IMMIGRATION. They wouldn't know unless she puts it down on the form. She can indicate for TOURIST purpose since the two of you are going on a trip if she doesn't want to do CFO yet. It's really that easy.

As what the other poster posted, she will need to attend the said seminar anyway before she can leave the country to migrate to the USA. Either before her visa interview or after the visa interview. One can attend the seminar even without a visa. They will give her the certificate after the seminar and then once she has the visa she can go back & register to get the CFO sticker affixed to her passport. She must bring that CFO certificate as proof she attended the seminar already.

Which box do most check on the application for reason for the passport? There is one for Immigration which makes the most sense.

It probably really doesn't matter but just want to get everything in order as I understand there is some interview to get the passport.

We just started the K1 in March so its going to be a while. I've already been to the Philippines 3 times in last 6 months to see her. Was thinking for the next visit in July we go to Bali. Its been my dream to go there. I understand people from the Philippines can travel to anywhere in SEA with only a passport; no visa needed. So she needs the passport in the short term for travel. So, short term she should check the box for travel or tourist.

Logic tells me to still check the immigration box and if asked in the passport interview, to explain she might travel to SEA with me before getting the visa. I just want to make sure I'm not raising any red flag with anyone. So wanted input from those who have been through the passport process.

I'm sure I'm over thinking this.

If she indicates that it is for "Immigration", she will be told to attend the CFO seminar & get the certificate. She will then come back to DFA to apply for the passport with the CFO certificate & all of the required documents.
